The aim of the following article is to discuss the issues of the power of the prosecutor to reveal information pertaining to ongoing preparatory proceedings in the light of the new regulations determined by Article 12 of the Act of January 28, 2016, the Law on the Prosecutor’s Office. The aforementioned regulation constitutes an important exception to the general rule of confidentiality of preparatory proceedings, which heavily informs the scope of the analysis. Moreover, the author discusses the relationship between Article 12 of the Law on the Prosecutor’s Office and earlier regulations regarding the revealing of information regarding preparatory proceedings included in the following acts: press law, law on access to public information, personal data protection act, supplemented with relevant regulations of the Criminal Code and Code of Criminal Procedure. In addition, the author discusses the consequences of the analyzed regulation for the interest of the criminal justice system, the interest of the public, as well as the interest of the parties in the proceedings, which has allowed her to assess the justification for that regulation and the necessity of implementing it in Polish legal system.

Abstract In the review below the author presents a general overview of the selected contemporary legal issues related to the present growth of the aviation industry and the development of aviation technologies. The review is focused on the questions at the intersection of aviation law and personal data protection law. Massive processing of passenger data (Passenger Name Record, PNR) in IT systems is a daily activity for the contemporary aviation industry. Simultaneously, since the mid- 1990s we can observe the rapid growth of personal data protection law as a very new branch of the law. The importance of this new branch of the law for the aviation industry is however still questionable and unclear. This article includes the summary of the author’s own research conducted between 2011 and 2017, in particular his audits in LOT Polish Airlines (June 2011-April 2013) and Lublin Airport (July - September 2013) and the author’s analyses of public information shared by International Civil Aviation Organization (ICAO), International Air Transport Association (IATA), Association of European Airlines (AEA), Civil Aviation Authority (ULC) and (GIODO). The purpose of the author’s research was to determine the applicability of the implementation of technical and organizational measures established by personal data protection law in aviation industry entities.

The article deals with the most important problems of protection of human rights in the field of personal data connected with information collection through the visual tracking. The possible risks of using CCTV (closed-circuit television) cameras and the consequences of their improper use are considered. In addition, the authors assessed the relationship between the public security interests and the need to protect the privacy of the individual citizen. This study is related to the widespread digitalization of society and the expansion of application scope regards the face recognition technology.

The main purpose of this study is to determine which conflict of law rules constitute the basis for the search for the law applicable to private-law compensation claims provided for in Article 82 of the GDPR, and whether it is possible to apply the Rome II Regulation on the law applicable to non-contractual obligations in this regard. The authors first set out the main features of the claim, with particular emphasis on those areas where discrepancies may arise at the level of national law. They then qualify the claim as a tortious one, which leads them to pose a question about the applicability of the Rome II Regulation in this case. Special attention is given to the relationship between privacy and personal data protection. The authors argue that these two spheres have become gradually separated from each other and finally, under GDPR, claims for damages for a breach of personal data protection being independent of claims for an infringement of personal rights. Consequently, they assume that the law applicable to a claim under Article 82 of the GDPR should be indicated on the basis of the Rome II Regulation, despite the doubts arising from the exclusion provided for in Article 1.2.g Rome II. If approach is accepted, it will have significant consequences for the harmonisation of the application of the GDPR in the EU Member States, and for achieving the harmonisation of decisions at the level of national law.

The problem of modern technologies rapid development is shown and characterized, which makes the issues of Internet users personal data protection very urgent. The current state of personal data protection in accordance with the requirements of Ukrainian legislation and the General Data Protection Regulation (GDPR) is analyzed. It is also determined which data belong to personal data and why they are subject to protection. According to Ukrainian Laws "On Access to Public Information", "On Personal Data Protection " and "About information protection in information and telecommunication systems" it was found the methods of personal data protection, peculiarities of processing information, storage, and transfer. Personal data is a kind of restricted access information so should be processed only in systems that have a comprehensive information security system possessing a certificate of conformity. Ukraine was one of the first countries, which introduce an electronic passport, so we considered the "DIIA" application. This application contains a huge database of personal data, that is why we investigate it and many interesting facts about the development are presented. The Code of Ukraine on Administrative Offenses and the Criminal Code of Ukraine for violation of requirements and non-compliance with the law on personal data protection in Ukraine are analyzed, penalties are also described. The requirements for personal data protection according to the European standard GDPR, namely, the procedure of pseudonymization, annihilation, encryption, etc. are given. A set of technical solutions and cybersecurity tools for implementing compliance with the GDPR standards is considered. In addition to technical solutions, important issues are security organization measures, these include staff training, adding privacy policies, proper organization of processes, providing access to personal data only to authorized employees. The penalty for violating the GDPR requirements has been clarified. Every country in the world is trying to ensure the protection of the personal data of its citizens at the legislative level by creating laws, regulations, and orders. It is emphasized, an important factor is to raise the awareness of citizens, who often ignore the problems associated with the protection of their personal data, including due to a lack of understanding of legal standards and requirements in this area. Atlikdama visuomenės informavimo funkciją žiniasklaida užtikrina, kad piliečiai reikiamu atveju –pavyzdžiui, balsuodami – priims tinkamus sprendimus, o valdžios institucijos ir politikai taip pat galvos apie savo veiksmus, siekdami išvengti kritikos, visuomenės neigiamos nuostatos arba siekdami didesnio populiarumo ir pakliūti į valdžios institucijas. By informing the audience, the media ensure that citizens in cases like voting will make right decisions, and the authorities and politicians will be careful about their own actions in order to avoid criticism or negative attitudes of society or to become more popular and to get into government structures. On the other hand, by doing so as everybody else and just being part of the whole, governments and politicians are not interesting for the media. As a result, these two groups must always think how to attract attention to themselves in the endless stream of information.The purpose of this article is to show the existence of politicians’ desire to construct the media agenda (to be the source of news) while adopting the Law on Minors’ Protection against Detrimental Effects of Public Information. The article also discusses the relationship between politicians and the media, the interdependence between politicians and the media. The author also shows how politicians try to atract the media by adopting laws and how the length and frequency of politicians’ speeches during the reading of a particular law can attract the attention of the media and thus of the public.

Este artigo se origina de uma pesquisa que problematiza as políticas públicas direcionadas à juventude que comete atos infracionais, especialmente as adolescentes mulheres. Norteadas pelo pensamento de Michel Foucault, discutimos e analisamos o modo como o discurso sobre a população jovem em conflito com a lei é operacionalizado para legitimar intervenções no meio socioeducativo. Partimos da arqueogenealogia foucaultiana para pensar o presente nas relações de poder-saber, refletindo acerca dos discursos sobre os direitos das jovens que cumprem medidas socioeducativas, pois as políticas da socioeducação têm sido pensada, prioritariamente, para os jovens do sexo masculino, invisibilizando as condições específicas que implicam a entrada das adolescentes no sistema de justiça. A operacionalização das políticas públicas para a juventude em conflito com a lei, no presente, indica a execução de medidas que, subsidiadas por discursos produzidos na relação entre instituições de saúde e justiça, violam os direitos garantidos em lei. This article is the result of a research that problematizes the public policies directed to the youth that commits offensive conducts, especially the adolescent women. Guided by Michel Foucault's thought, we discuss and analyze how the discourse on the young population in conflict with the law is operationalized to legitimize interventions in the socio-educational environment. We started from the Foucauldian archaeogenealogy to think about the present in power-knowledge relations, reflecting on the discourses on the rights of young women who serve socio-educational measures, because the policies of socio-education have been designed for young men, invisibilizing the specific conditions that imply the entry of girls into the Brazilian justice system. The operationalization of public policies for youth in conflict with the law, in the present, indicates the implementation of measures that, subsidized by speeches produced in the relationship between health institutions and justice, violate the rights guaranteed by law. Este artículo se origina en una investigación que problematiza las políticas públicas dirigidas a jóvenes que cometen infracciones, especialmente a las adolescentes. Guiadas por el pensamiento de Michel Foucault, discutimos y analizamos cómo se operacionaliza el discurso sobre la población joven en conflicto con la ley para legitimar las intervenciones en el entorno socioeducativo. Partimos de la arqueogenealogía de Foucault para recapacitar sobre el presente en las relaciones de poder-conocimiento, reflexionando acerca de los discursos sobre los derechos de los y las jóvenes que cumplen con las medidas socioeducativas, ya que las políticas de educación social se han diseñado principalmente para hombres jóvenes, haciendo invisibles las condiciones que implican la entrada de los adolescentes a la justicia. La operacionalización de las políticas públicas para jóvenes en conflicto con la ley, en la actualidad, indica la implementación de medidas que, subsidiadas por discursos producidos en la relación entre instituciones de salud y justicia, violan los derechos garantizados por la ley.

The most important part in a Book of Criminal Law (Penal Code) is a prison, because the prison contains rules about the size and implementation of the criminal. The position of life imprisonment in the national criminal justice system is still considered relevant as a means of crime prevention, it can be seen from the number of offenses punishable with life imprisonment. However, life imprisonment is considered contrary to the penal system. This study aims to investigate the implementation of life imprisonment, weaknesses, and the solution in the future. The approach used in the study is a non-doctrinal legal research with socio-legal research types (Juridical Sociological).The results of research studies show that life imprisonment is contrary to prison system, and life imprisonment become an obstacle to fostering convicts back into society. Bill Criminal Code of September 2019 can be used as a solution to life imprisonment change in the future. Presented advice, in order to be disseminated to the application of the criminal purpose of the Criminal Code of Prison adopted in the future, so that the public and experts no longer make the criminal as a form of retaliation.Keywords: Reconstruction; Crime; Prison; Life Imprisonment; System; Corrections.

The case of Oguche v. Iliyasu & Ors. raises several interesting issues in the law of the Northern States of Nigeria, in particular the definitions of “native” and “non-native” and the powers of the Commissioner under the Land Tenure Law, the relationship between title to land and the rules governing trespass to land, the protection afforded by the Public Officers (Protection) Law and the award of exemplary damages for oppressive acts by public officers. The facts of the case will be given first, followed by a summary of the judgment and comment on the issues raised.

Introduction. The article is devoted to the use of digital technologies in the field of public administration using the example of state and municipal information systems. Currently, two types of such systems can be distinguished in the Russian Federation: 1) allowing direct enforcement activities; 2) used to capture certain information. Theoretical analysis. Information systems of the first type acquire the properties of an object of complex legal relations, in which suppliers and consumers of information, government bodies, as well as other persons become participants. This entails the fact that in the implementation of public administration, the source of regulation of public relations to a certain extent becomes the program code of these information systems. Accordingly, any failures and errors in the public information system become facts of legal importance. Empirical analysis. The main risks of using information systems of the second type in public administration relate to the illegal access (or use) of information stored in their databases. The consolidation of databases containing different types of information is a serious threat. In this regard, the creation of the Unified Federal Information Register containing information about the population of the Russian Federation, provided for by the Federal Law No. 168-FZ of 08.06.2020, may lead to a large number of socially negative consequences and comes into obvious conflict with the legislation on personal data. Results. State and municipal information systems themselves can improve public administration, including reducing corruption in the country. At the same time, their reduced discretion in management decisions is not always appropriate. Accordingly, their implementation should be preceded by the analysis of the characteristics of a specific area of management, as well as the proposed use of digital technologies.

<p>Pregnancy is a very happy situation for every partner who has been legitimate. In connection with this we still often encounter couples who do not value pregnancy so take the decision to do inhumane actions, one of which is abortion. Abortion is a form of criminality that is still very difficult to be handled by the public or the government, this is because there are still gaps for the perpetrators to carry out these actions and the deterrent effect is still lacking for abortion. This study aims to determine the legal arrangements and accountability for abortionists. This study uses normative juridical research methods, to address abortion problems that occur without looking at it from one perspective, but comprehensively. The results showed that the legal arrangements for the crime of abortion have been regulated in the law adjustment for abortion has been regulated ib article 194 law number 36 year 2009, about a midwife who help those who committed abortion is included in criminal code article 349</p>
