The opening chapter explores a philosophic question that reflexively sheds light on the orientation of the book as a whole: how can we write the history of the present? Against the backdrop of the more specific question of how to understand the present state of philosophy, it turns to the late work of Michel Foucault and his unique account of the ontology of actuality or of contemporary reality (ontologie de l’actualité). It carefully reconstitutes his concern with providing a historico-philosophical justification of his own project, which he situates in a trajectory that begins with the emergence of the ontology of actuality in the later Kant. It assesses the contemporary relevancy of his critique of historical periodization and his redefinition of modernity in terms of a critical attitude. Given the apparent contradiction between his rejection of periodic history and his identification of a new era of historical thought, the chapter goes on to suggest that an alternative logic of history—founded on the three dimensions of time, space and social practice—would allow us to completely reformulate the way in which we think the present.

Discourse analysis has been a study that attracts many intelectuals of various disciplines to discuss about, generating the emergence of theories of their own perspectives. Many criticisms for the theories also show that intelectuals are more interested in this field leading to make discourse analysis as a multidisciplinary study. Based on this ground, Norman Fairclough seeks to reconstruct discourse theory as a criticism to the existing theories, which tends to be side-emphasis and partial on the basis of their own discipline. Combining three traditions, i.e. linguistic, interpretative, and sociological traditions, he offers a discourse model integrating three dimensions: text, discourse practice, and social practice. Each dimension has its area, process, and analysis model, in which all of them dialectically connect to one another. In addition, Fairclough also formulates another important concept, namely intertextuality, which affirms the interrelation of various texts and discourses to a text. This concept will also create ideological effect of structuration and restructuration of the prevalent discourse order. When power and ideology embed in a discourse, intertextuality will function as a mechanism for maintaining and changing the domination relation.

Formalism persists everywhere despite 100 years of critical legal theory. The reasons for that are sociological and political and include the persistence of the separation of powers idea as a central concept for the theory of law. In Brazil, this phenomenon manifests itself acutely for two supplementary reasons: (1) the lack of a real differentiation between academic research and professional lawyering and (2) the influence of neo-liberal economic thought. The persistence of formalism is a serious problem for Brazilian development since it naturalizes the existing institutions and their related power positions, creating an obstacle to any project of development that proposes something new. It blocks the development of a critical and reflexive knowledge on institutions, shortening institutional imagination to projects that could transform Brazilian reality. The main objective of this article is to develop a critique of formalism useful both as a general method to criticize formalism and as a tool to criticize its Brazilian manifestation. It will be argued here that the critique of formalism fails when it is only theoretical. An efficient critique must also grasp the ideas and the social relations responsible to reproduce formalism as a conceptual idea that informs social practices. To do that, this article will first propose a characterization of Brazilian formalism that does not fit in the Formalism X Instrumentalism dichotomy and is more adequate to grasp how law rationality works in countries from the Continental Law tradition. Afterwards, it will identify the power positions and the respective ideologies responsible to reproduce formalism in Brazil, giving criticism a sociological basis. Finally, it will show that only a positive view of what law should be will able to overcome formalism, both as a philosophical idea and as a social practice. In its final part, a sketch of such a view will be presented.
