scholarly journals Adapting to mediation online: the Irish experience

This article contrasts the use of online mediation in Ireland from February 2019, prior to the Covid-19 pandemic in March 2020, and from then until March 2021. It considers the context for online mediation in Ireland, the challenges to the mediation process, the experience of online mediation from the perspectives of mediators and participants in mediation. Sharing these experiences informs future decisions as to how technology might best be integrated into mediation practice in the longer term. The experience of 13 mediators indicates that there are challenges due to familiarity with technology for mediators and participants, and challenges to power balancing and confidentiality. In Ireland, although platforms such as Zoom played a major role, use of the telephone in the mediation process also increased. An online mediation competence framework for mediators is proposed.

The institute of mediation is becoming increasingly popular. This is due to several factors, including the possibility to save on attorneys' fees and court costs. Mediation also helps to save a lot of time and find a solution to the conflict that would satisfy both parties as quickly as possible. During the pandemic, the institution of mediation, like many other spheres of public life, moved online. The mediation process itself involves individuals who use online communication or even artificial intelligence, such as chatbots. Thus, in connection with the transition of mediation to the online plane, there is a need for legal support for the use of innovative technologies in the field of mediation. Thus, the article is relevant and timely in terms of quarantine restrictions. The object of research is public relations in the field of online mediation. The authors of the article used general and special research methods. The authors of the article concluded that online mediation is a useful institution, but the implementation of appropriate procedures must take care to protect private information, as there is no full control over the situation outside the camera of a computer, tablet, phone, or other device with access on the Internet.

The purpose of this article is to present a case for the importance of research in informing mediation practice specifically in the context of the management of workplace conflict in Ireland. The position of mediation within the broader dispute-resolution framework is clarified at the outset and the core mediation process is described. The increasing use of mediation in Ireland and the changing institutional context within which it is conducted are discussed. The importance of research is stressed along with crucial methodological challenges. The paucity of workplace mediation research in Ireland is highlighted and the preliminary findings of an on-going research project are presented. The article concludes that more research into workplace mediation in Ireland is needed to inform practice in this area and to improve external perception of the legitimacy of mediation as a dispute resolution process

This research was field qualitative. Purpose is (1) To determine the strategy of judges mediators in settling divorce cases through mediation in the religious Gresik (2) To know the views of people about the existence of mediation as a way to prevent divorce (3) To find out how the effectiveness of the mediation process in handling divorce cases in the religious Gresik. The variables of this research is the role of the judge Mediator Mediation Divorce Case. The study population was numbered 7 people, samples of this study is 4 mediators as informants for only two the informant can be reached. For people who are litigants, 4 as the samples which are in neighborhood religious Courts Gresik. Data collection techniques used were interview and documentation. The results of this study indicate that. (1) strategy judge mediator in case of divorce mediation is to maximize the mediation process by providing advice and consideration if later married couples end up with divorce where previously done caucus or to each party alternately on mediation it self. (2) The view of the public about the existence of the mediation is a good thing because it provides education in the form of advice and teach harmony and the community is also considered that mediation in the religious should stay there. (3) the effectiveness of mediation in the religious Gresik which is not very effective because the number that failed in mediation more than a successful mediation. Arahnya ialah (1) Untuk dapat memahami cara  mediator dalam menangani kasus perceraian melalui proses juru damai (2) Untuk mendapatkan hasil mengenai pandangan masyarakat tentang adanya mediasi yang berperan sebagai juru damai mengenai perceraian (3) Untuk dapat memahami seberapa penting efektifitas proses mediasi dalam menyelesaikan permasalahan yang terjadi. penelitian ini ialah inovasi mediator dalam menentukan keberhasilan mediasi kasus perceraian. Populasi penelitian ini adalah berjumlah 7 orang, yang diteliti ada 4 orang sebagai informan  mediator. Untuk masyarakat yang melakukan mediasi diambil dua pasang. Tehnik yang digunakan yakni tehnik wawancara dan dokumentasi. Hasil penelitian ini menjelaskan bahwa. (1) cara yang dipakai juru damai untuk menangani masalah cerai adalah mempermudah proses mediasi ,mediator berulangkali menyelipkan nasehat -nasehat yang berujung perdamaian, meskipun nantinya tidak dapat rukun kembali, alangkah baiknya berpisah dengan cara baik-baik.(2) Pandangan masyarakat mengenai adanya mediasi ini antusiasnya begitu baik, karena juru damai seperti ini yang dibutuhkan saat ini, lebih bersifat kekeluargaan. (3) efektifitas mediasi belum sempurna disebabkan meningkatnya orang yang ingin cerai dan juru damai yang mempunyai sertifikat sangat kurang. Kata Kunci: Inovasi Mediator, Mediasi, Perceraian

The work aims to analyze the theoretical aspects of the use of information technologies in the mediation process, as well as the aspects of its implementation. The purpose of the investigation is online mediation as a form of resolution of intellectual property disputes. In addition, the topic of study is the social relationships that arise when using information technologies and mediation to resolve civil conflicts in the field of intellectual property. The research methods used in this case are the dialectical method, the generalization method, the comparison method, the analysis method, the synthesis method, the method in administration and the deduction method, the modeling method, and the abstraction method. As a result of the study, conclusions are drawn on the state of online mediation in the real world, the benefits and potential problems of introducing virtual mediation for disputed parties, the need for support for special applications, along with the need for the introduction of online mediation at the state level to a state policy.

The development of online mediation in the Arctic and the Far North of the Krasnoyarsk Territory is necessary because of the increased level of conflict potential in educational institutions and the need to find the most effective methods for resolving conflicts, taking into account the needs of persons with disabilities. This article analyzes the problem of the development of mediation as a tool for resolving conflicts with the participation of children with disabilities, as well as adapting the mediation procedure to a digital format. A content analysis of Russian and foreign practices, demonstrated the insufficient development of inclusive education and the mediation process in our country. Monitoring of school mediation services in the Arctic and northern territories of the Krasnoyarsk Territory confirmed the formalized nature of school mediation services, the lack of training programs for mediators on the basis of higher educational institutions of the Arctic and northern territories, insufficient knowledge of methods of working with ‘special children and an emphasis on preventive measures. An interview was conducted on the organizational system of school mediation services, the identification of conflict-generating factors, ways of resolving conflicts, the readiness of mediation specialists to transition to a digital environment, the adaptation of the mediation procedure to the specific characteristics of children with disabilities and the need to develop a mediation procedure in connection with the natural-climatic factors of these territories. The practical benefit of the study is in promoting the implementation of mediation and online mediation practices in the educational system to resolve conflicts with the participation of children with disabilities, develop a humane attitude towards various categories of the population and establish favorable conditions for learning. The practical use of the research increases due to the scarcity of scientific developments in the field of inclusive education, an alternative and innovative mediation process in the Arctic and Northern territories of the Krasnoyarsk Territory.

Необходимость внедрения онлайн-медиации на Крайнем Севере обусловлена особенностями жизнедеятельности северных территорий, которые накладывают отпечаток на психологическое развитие детей и, как следствие, на эффективность образовательного процесса. Дефицитарность развития альтернативной процедуры разрешения конфликтов в отдаленных районах края приводит к актуализации онлайн-медиации с точки зрения профилактики, предотвращения и разрешения конфликтных ситуаций и освоения специалистами информационно-коммуникативных технологий, подготовки конкурентоспособных специалистов, а также установления благоприятного эмоционально-личностного фона. Проблематика исследования связана со сравнительно недавним внедрением медиативных процедур на территории Крайнего Севера и в то же время с возможностями, которые предоставляет медиация для региона, особенности которого создают наиболее тяжелые психологические условия. Эмоционально-личностное развитие представителей малых народов известно не только позитивными, но и неблагоприятными социально-психологическими последствиями перемен.В научной статье посредством контент-анализа и сравнительного анализа рассматриваются психологические особенности обучающихся на территориях Крайнего Севера, развитие и формы медиативного процесса на территориях Красноярского края и Крайнего Севера, а также возможности онлайн-медиации для отдаленных территорий региона и установление положительного психологического климата. The need to introduce online mediation in the Far North is due to the peculiarities of the life of the northern territories, which affect the psychological development of children and, as a result, the effectiveness of the educational process. The lack of development of alternative conflict resolution procedures in remote areas of the region leads to the actualization of online mediation in terms of prevention, prevention and resolution of conflict situations and the development of information and communication technologies by specialists, the training of competitive specialists, as well as the establishment of a favorable emotional and personal background. The problems of the study are related to the relatively recent introduction of mediation procedures in the Far North and at the same time to the opportunities that mediation provides for the region, the features of which create the most difficult psychological conditions. The emotional and personal development of the representatives of small nations is known not only for the positive, but also for the unfavorable socio-psychological consequences of changes. The article examines the psychological characteristics of students in the Far North, the development and forms of the mediation process in the territories of the Krasnoyarsk Territory and the Far North, as well as the possibilities of online mediation for remote areas of the region and the establishment of a positive psychological climate.

Domestic violence happens when a woman or man regularly hurts his or her spouse physically or verbally such as beats or mentally tortures the other. Meeting face-to-face in the mediation process with the batterer to resolve family disputes may raise the issue of power imbalance, especially when the victim hide the history of violence. This article reviews the challenges of Muslim family disputes in Malaysia resolving the disputes with the history of violence and analyses what online mediation may offer to overcome the said problem. Being a pure legal research, this paper is doctrinal in its approach. The finding of this research is mediation is not an appropriate mechanism to resolve Muslim family disputes with the history of violence because it will cause more injustice to the victim. Thus, this paper concludes by suggesting online mediation as another alternative to resolve the family disputes.
