ABSTRAKPermohonan sita jaminan adalah untuk menjamin pelaksanaan suatu putusan di kemudian hari, atas barang-barang milik tergugat, baik yang bergerak maupun yang tidak bergerak, selama proses perkara berlangsung terlebih dahulu disita, atau dengan kata lain bahwa terhadap barang-barang yang sudah disita tidak dapat dialihkan, diperjual belikan atau dipindah tangankan kepada orang lain. Tujuan penelitian ini adalah untuk mengetahui Upaya pengadilan dalam melaksanakan Sita Jaminan Terhadap Barang Milik Tergugat Sebagai Jaminan dalam Suatu Perkara Perdata (Studi Kasus di Pengadilan Negeri Kelas I A Bengkulu) dan Faktor-faktor penghambat mengenai eksekusi sita jaminan Terhadap Barang Milik Tergugat Sebagai Jaminan dalam Suatu Perkara Perdata (Studi Kasus di Pengadilan Negeri Kelas I A Bengkulu. Jenis penelitian yang digunakan oleh penulis adalah penelitian empiris yang bersifat deskriptif. Penelitian hukum bersifat deskriptif merupakan penelitian yang bertujuan menggambarkan tentang sifat-sifat individu, keadaan, gejala atau kelompok tertentu atau untuk menentukan penyebaran suatu gejala dengan gejala lain dalam masyarakat. Pelaksanaan sita jaminan di diatur dalam pasal 197 HIR, penyitaan jaminan putusan di Pengadilan Negeri Kelas I A penyitaan jaminan untuk membayar sejumlah uang. Pelaksanaan dan putusannya jasa akan menjadi sita eksekusi dan nanti akan di lelang, jadi tidak ada kendala jika yang disita itu bukan milik tergugat tetapi milik orang lain nanti ada perlawanan dari pihak yang mempunyai tersebut terhadap perlawanan ke pengadilan dengan gugat perlawanan terhadap sita jaminan. Hambatan dalam pelaksanaan sita jaminan diharuskan surat-surat yang tercantum pada barang atas nama tergugat. Barang atau obyek sengketa menjadi agunan dalam hak tanggungan. Barang atau obyek sengketamerupakan harta warisan yang belum terbagi.Kata kunci: sita jaminan; tergugat; perkara perdataABSTRACTThe request for confiscation of collateral is to guarantee the implementation of a decision in the future, on the property of the defendant, both movable and immovable, as long as the proceedings take place first confiscated, or in other words that the confiscated items cannot transferred, traded or transferred to others. The purpose of this study was to determine the efforts of the court in carrying out the seizure of the Defendant's property as collateral in a civil case (case study at the Bengkulu IA Class Court) and inhibiting factors regarding the execution of collateral seizure against the Defendant's property as a guarantee in a case Civil Code (Case Study in Bengkulu IA Class District. The type of research used by the author is descriptive empirical research. Descriptive legal research is a research that aims to describe the characteristics of individuals, circumstances, symptoms or certain groups or to determine the spread of a symptoms with other symptoms in the community.The implementation of seizure guarantees is regulated in Article 197 of the HIR, confiscation of guarantee decisions in the Class IA District Court confiscation of guarantees to pay a sum of money.The execution and decision of services will be seized execution and later will be auctioned, if there is no problem if the confiscated person does not belong to the defendant but someone else's property will have resistance from the party who has it against the resistance to the court by suing the resistance against the seizure of the guarantee. Obstacles in the implementation of collateral seizure are required for the documents listed on the goods on behalf of the defendant. Goods or objects of dispute become collateral in mortgage rights. This gift is regulated in article 1882 of the Civil Code which states, among other things, that the gift must be made with a notary deed, especially for immovable property, while for movable property it can be granted just like that, a gift made outside of it is canceled. Likewise, a grant cannot be renewed, even if it is made with a notary deed, which means that updates on the grant or by making changes or additions from the time the grant was originally made are not allowed. Regarding the reasons for the cancellation of the grant, the cancellation of this grant is regulated by Article 1666 of the Civil Code, which states that a grant cannot be withdrawn or canceled because of it. The problems that will be investigated are: How do you prove the validity of a grant deed in the Case Study of Decision No. 142 / PDT / 2015 / PT.Mdn ?, Why can't a grant be withdrawn but can be canceled? decide the case No. 142 / PDT / 2015 / PT-MDN ?. This study uses a normative legal approach. Normative legal research in this research is carried out on the procedure for settlement of grant disputes through courts. The type of data used in this legal research is secondary data. Secondary data sources in this legal research were obtained from: Primary legal materials, among others: Civil Code, Law No. 48/2009 concerning Judicial Power, Decision No.142 / PDT / 2015 / PTMDN. In proving the validity of a Grant Deed, it must have physical, formal and material evidentiary strength, and the process of making a Grant Deed meets the elements stipulated by Article 1868 of the Civil Code. Basically, a grant is irrevocable but can be canceled based on exceptions that have been determined based on statutory regulations. The Legal Considerations of the Medan High Court Judge against the Simalungun District Court Decision No.55 / Pdt.G / 2014 / PN-Sim regarding the settlement of grant disputes in this case were declared incorrect and wrong because the appellate's memory of appeal is very reasonable based on law and can prove that the object of the dispute is the right of the appellant whose truth cannot be denied by the party being appealed against in the counter memorandum of appeal.

Budi Pego was charged with violating Article 107a of Law Number 27 of 1999 concerning Amendment to the Criminal Law Code relating to crimes against State security, because of. Because of these accusations, Budi Pego was charged with a 10-month prison sentence in the Banyuwangi District Court. The problem faced is how criminal liability on the perpetrators of the spread of the teachings of communism in terms of Article 107A of the Criminal Code (case study of decision No. 559 / Pid.B / 2017 / PN.Byw)? The research method used is normative legal research. The results showed that criminal liability on the perpetrators of the spread of the teachings of communism in terms of Article 107A of the Criminal Code in Decision No. 559 / Pid.B / 2017 / PN.Byw. it is inappropriate if this criminal liability model is applied to criminal liability to individuals. Considering that individual accountability still requires actions and mistakes as a basic element of accountability. That is, without any deeds and mistakes, there is no criminal liability. Regarding the Budi Pego case, the policy of criminalizing the ideology of Communism/Marxism-Leninism was decriminalized. If this cannot be done, then the legislators need to revise Law No. 27 of 1999 with the concept of eliminating articles containing formal offenses and replacing them with the formulation of material offenses and in the formulation of the weight of sanctions.

Undang-Undang No 6 Tahun 2014 tentang Desa dan Peraturan Pemerintah nomor 43 tahun 2014 tentang Peraturan Pelaksanaan Undang-Undang nomor 6 Tahun 2014 tentang Desa, dimana kerjasama antar Desa dilaksanakan oleh Badan Kerjasama Antar Desa (BKAD) yang dibentuk melalui peraturan bersama antar kepala Desa melalui kesepakatan Musyawarah Antar Desa. BKAD bertanggung jawab untuk mengimplementasikan kerja sama Desa berdasarkan Peraturan Menteri Dalam Negeri nomor 38 tahun 2007 Tentang Kerjasama Desa dan di dalam Undang-Undang Desa dan BKAD tidak mengatur secara tegas tentang Perjanjian dikarenakan setiap melakukan kerjasama pihak BKAD harus membuat perjanjian untuk memikat antara pihak BKAD dengan kelompok masyarakat gampong di Pidie sebagaimana perjanjian diatur dalam Pasal 1313 Kitab Undang-Undang Hukum Perdata menyebutkan: “Suatu perjanjian adalah suatu perbuatan dengan mana satu orang atau lebih mengikatkan dirinya terhadap satu orang atau lebih. Tujuan penelitian untuk mengetahui implementasi perjanjian dana bergulir antara Badan Kerjasama Antar Desa (BKAD) dengan kelompok masyarakat dan untuk mengetahui hambatan yang ditemukan dalam implementasi perjanjian dana bergulir antara Badan Kerjasama Antar Desa (BKAD) kepada kelompok masyarakat. Metode penelitian yang digunakan adalah jenis penelitian hukum empiris (yuridis empiris) dengan mengunakan data primer, data sekunder dan tersier. Hasil penelitian bahwa pelaksanaan perjanjian dana bergulir sudah berjalan sesuai dengan mekanisme yang dituangkan dalam Standart Operasional Prosedur ( SOP) perguliran pola syari’ah dan menggunakan sistem murabahah yaitu akad jual beli barang dengan menyatakan harga perolehan dan keuntungan (margin) yang disepakati oleh penjual dan pembeli, hambatan yang terjadi disebabkan oleh gagalnya usaha, lambat lakunya produk usaha, tidak tepat dalam penggunaan dana untuk modal usaha, tidak jujurnya anggota dalam pengembalian utang jual beli.The Act Number 6, 2014 regarding Village. and Government Regulation number . 43, 2014 on the Implementation of Act number . 6, 2014 on Villages where inter-village cooperation is carried out by the Inter-Village Cooperation Agency (BKAD) established through a joint regulation between village heads through an Inter-Village Deliberative Assembly. AbstractMediation as an alternative to dispute resolution has been integrated in court. Further provisions for mediation as a process that must be carried out are further regulated in the Supreme Court Regulation No. 1 of 2016 concerning mediation procedures in court. This means that cases filed in court including cases of divorce on the grounds of domestic violence are obliged to undergo mediation. This research is a normative legal research that focuses on solving legal problems by providing a basis for theoretical argumentation and adequate concepts. Sources of data in this study came from primary, secondary and tertiary legal materials. The findings of the study indicate that in cases of divorce on the grounds of domestic violence, they still take the path of mediation. This is stated in the Supreme Court Regulation No. 1 of 2016 which requires mediation in civil cases, even in the Supreme Court Regulation states that in the resolution of a civil case a judge does not take mediation, it is considered to have violated the law. Divorce cases on the grounds of domestic violence cannot be categorized as a criminal act, if the filing process is a civil process (divorce), it is different when the wife makes a complaint (complaint offense) and/or an ordinary offense which results in a violation of the Abolition of Domestic Violence. However, divorce cases are considered civil and processed according to other civil cases and on the grounds of domestic violence they still go through mediation. Keywords: Mediation; Divorce; Violence; Household.

This article aims to analyze how the crime of child kidnapping is covered in the Indonesian Criminal Code and the type of sanctions that can be imposed on the perpetrator of the crime of child kidnapping. It is a legal research that uses statutory, conceptual, and case approaches in discussing the legal protection of child kidnapping victims. In order to illustrate how the law that protects the victim of child kidnapping is applied by the court, it presents a case study at the Gianyar District Court that investigated a criminal offense of child kidnapping in 2018. The results reveal that the Indonesian Criminal Code classifies child kidnapping as a crime that is punishable as stipulated in Article 330 of the Code. In a more specific context, Law of the Republic of Indonesia Number 35 of 2014 concerning Amendments to Law Number 22 of 2003 concerning Child Protection includes child kidnapping as a case that needs to be given special protection  A case study regarding the imposing of sanctions on the perpetrator of child kidnapping can be seen in a criminal case before the District Court of Gianyar in 2018. In the judgment, the panel of judges imposing a sentence against the defendant in the form of imprisonment of 8 (eight) years in prison and a fine of Rp. 60,000,000 (sixty million rupiah) subsidiary 6 (six) months in prison;

Abstract This article first discusses the question of how empirical research can contribute to the ongoing discussions concerning the future of the church. Among others, German research on church membership is used as a case study for gaining insights into the interplay between theoretical assumptions, empirical research and designing strategies for church development. The need for comparisons over time, for longitudinal studies and the identification of long-term predictors is discussed. Against this background, recent research on confirmation work in Germany and Europe is taken up as an example. The article draws on data from a European study on confirmation work with a longitudinal research approach. The results show that confirmation work, as one of the major educational programs of the Protestant Church, can influence adolescents’ views of Christian faith and the church. Predictors for future commitment to the church in terms of believing, belonging and volunteerism are not only dependent on religious socialization in childhood but also on experiences and activities during confirmation time in adolescence.

This study tried to parse the possibility of contempt of court application is a breakthrough to build for effectiveness of real execution of civil cases. The discussion in this study rests on two problem objects, namely; 1) What are the obstacles in the real execution of civil case decisions; and 2) How can a solution be proposed to encourage the effectiveness of the real execution of civil cases. This paper is used to normative legal research so that it rests on the statute approach. The results of this research to indicate that in addition to normative problems in execution arrangements, in practice it is often found that problems occur due to physical resistance from the losing party in the trial. Because of this reason, it is important to apply contempt of court as a legal formulation to create an effective and efficient execution system.Keyword: Contempt of court, Real Execution, Civil CaseAbstrakKajian ini mencoba mengurai kemungkinan Penghinaan terhadap Pengadilan yang merupakan terobosan untuk membangun efektivitas eksekusi nyata dalam perkara perdata. Pembahasan dalam penelitian ini bertumpu pada dua objek masalah, yaitu; 1) Apa saja kendala dalam pelaksanaan putusan perkara perdata; dan 2) Bagaimana solusi yang dapat diajukan untuk mendorong efektivitas pelaksanaan perkara perdata yang sebenarnya. Tulisan ini digunakan untuk penelitian hukum normatif sehingga bertumpu pada pendekatan undang-undang. Hasil penelitian ini menunjukkan bahwa selain masalah normatif dalam pengaturan eksekusi, dalam praktiknya sering ditemukan masalah yang terjadi karena adanya perlawanan fisik dari pihak yang kalah dalam persidangan. Oleh karena itu, penting untuk menerapkan Penghinaan terhadap Pengadilan sebagai rumusan hukum untuk menciptakan sistem eksekusi yang efektif dan efisien. Kata kunci; Penghinaan terhadap Pengadilan, Eksekusi Nyata, Perkara Perdata
