Methodological foundations of legal education reform in Ukraine: Scientific paradigm and modern context

The study investigates the current state and defines the methodological foundations for improving the practical training of lawyers in the context of reforming legal education by establishing the features of legal regulation of legal education and its role in the state system, identifying the main problems of modern legal education, as well as analysing foreign experience in practical training of specialists in the field of law. The study uses general scientific and special legal methods of scientific cognition, including comparative legal, philosophical and functional methods, dialectical and formal legal methods of cognition, method of analysis and synthesis. The paper established that the professional training of future specialists in the field of law is currently described by a disparity between the theoretical knowledge and practical skills of law graduates, which complicates their adaptation to practical work. The authors of this study proved that the reform of the legal training system through increasing its practical orientation, determining the state needs of legal personnel of various educational levels, internationalisation of higher education, introduction of new specialisations in accordance with the needs of various spheres of legal practice, should become the basis for the development of legal education in Ukraine. Attention was focused on the need to optimise the system of training legal personnel mainly through the introduction of new teaching methods, the approval of new educational standards, considering the corresponding progressive foreign experience in this field, provided that the accumulated experience, traditions, and principles of Ukrainian higher legal education are preserved, thereby ensuring the development of future specialists with stable practical skills of law enforcement activities. It was found that in the context of the reform of legal education, it is important to establish such requirements for the educational process that would ensure that students master not only a minimum amount of knowledge, but also practical skills because practical training of students is a mandatory component of the educational and professional programme for obtaining an educational degree. In particular, it is necessary to reorient the content and orientation of educational works of applicants for legal education, which should be focused not only on repeating or reproducing theoretical material, but also on solving specially developed practical situations. The issue of increasing the duration of internships and effective cooperation between educational institutions and employers is also important. Improving the effectiveness of training specialists in the field of law through a proportional ratio of theoretical and practical content of the educational process in legal specialities is aimed at modernising the higher legal education model in Ukraine

The authors set a goal to analyze the problems of contemporary legal education in Russia in the presented research. The necessity of legal education in interdisciplinary and cross-sector interaction with other humanities are identified, and only when these connections are established, it is possible to get into inter-scientific relations. The most extreme issues of the activities of law faculties in various types of educational institutions - in departmental and multidisciplinary institutions were considered, using the example of the influence of various approaches to training future employees of the judiciary. The influence of the educational institution affiliation on the educational process and the issues of deployment the teaching staff are considered, the differences in teaching practical skills in these types of educational institutions are also demonstrated. The authors identified two types of problems - internal and external. Internal - the problems of the educational institutions themselves, external - the problems of implementing the educational policy of the state. Unfortunately, the authors state the unwillingness of the teachers themselves to change because of the rapidly modifying social relations. The absence of a critical attitude, first of all to oneself, causes a false illusion of normality and acceptability. Resulting from the analysis of the entity of the problems, the necessity of initiating changes from the educational institutions and teachers is understood, and not from the state.

The article is devoted to the analysis of modern approaches to the organization of the educational process, which would contribute to the formation of a category of lawyers with the necessary knowledge and are capable of preparing and implementing reforms in the political and legal system of their state. It is determined that modern legal education poses its own requirements to the applicant, namely to be a comprehensively developed, independent, self-sufficient person, guided in life by his own knowledge and beliefs, in this regard, the issue of professional training of a modern lawyer, which could withstand modern challenges, becomes especially relevant. It is noted that the training of the future lawyer should be aimed at forming a versatile specialist (lawyer), ready to fulfill a complex set of modern practical tasks for the legal protection of the rights, freedoms and legitimate interests of a person and citizen. On this basis, the training of future lawyers should take into account modern approaches to the educational process. The most important of them are analyzed on the example of the National University of Life and Environmental Sciences of Ukraine (hereinafter - NULES of Ukraine). First, the quality of specialists’ training substantially depends on quality of teaching subject matters which is defined by providing applicants with the corresponding training material (modern qualitative textbooks, manuals, study guides, didactic materials, etc.). And most importantly - the use of computer technology, electronic educational resources, with the help of which the interaction of the sphere of higher education with other spheres of life of society is ensured. Of course, modern ICTs increase the efficiency of the educational process, open the possibility of introducing completely new methods of teaching and learning. However, the implications of the growing importance of ICT in general, and the Internet in particular, should also be taken into account. The use of modern ICTs has become an integral part of the educational process of NULES of Ukraine during the Covid-19 pandemic. Secondly, taking into account modern trends in the field of education, the training of future lawyers should not ignore one of the most important indicators of the quality of higher legal education - the use of a foreign language in the educational process, in particular English. In particular, the NULES of Ukraine provides teaching in English of certain legal disciplines for applicants for higher education of the first (bachelor's) level. Thirdly, the training of a lawyer should be not only theoretical, but also practical. Practical training of a lawyer involves work during practical classes, internships in enterprises, institutions and organizations, self-training by independently performing certain tasks. However, it is worth highlighting another form of practical component of the training of future lawyers - these are legal clinics. To date, such a form of specialists’ practical training in the field of law has been effectively introduced into the educational process of higher educational institutions of Ukraine of the III-IV levels of accreditation. NULES of Ukraine is no exception. The Legal Clinic «Protection and Justice» operates on the basis of the Department of International Law and Comparative Law. It is proved that the quality of specialists’ training in the field of law depends on many factors (the use of modern ICT in the educational process, electronic educational resources, the possibilities of foreign languages in teaching legal disciplines, etc.). However, to a large extent, the quality of training depends on the practical component of the educational process, and therefore special attention should be paid to this component. Different approaches to the interpretation of the essence of innovative pedagogical technologies have been highlighted in the article, as well as their influence on the activation of cognitive activity of students as future specialists. It has been analysed that methods of intensification of educational activities are aimed at forming positive motives for learning, stimulate cognitive activity and at the same time contribute to the enrichment of educational information. The implementing of innovative pedagogical technologies in the educational process will increase students' interest in learning, teach them to work independently, be communicative and mobile, adapt to the requirements of modern society. It has been considered that innovative pedagogical technologies are the purposeful, systematic and consistent implementation of innovative methods, techniques, tools that encompass a holistic educational process from determining its purpose to expected results. This is due to the fact that the training system of a future specialist must comply with modern trends in the development of society, its needs. Innovative learning is a learning and educational activity focused on dynamic changes in the world around us, based on the development of various forms of thinking, creative abilities, and high social and adaptive abilities of an individual. In the professional and practical training of future teachers, technologies are being introduced to form their professional competence, among which are: personality-oriented education and training, group educational technology, information technology, project training, problem-based learning theory, interactive technology, creative personality formation technology , game technology theory, specialized training, integrated technologies and others. Technologies contribute to the assimilation of knowledge and skills, the activation and development of mental actions, the system of effective practical sphere, the strengthening of emotionality, the development of a creative nature; independence in decision making; the desire to acquire skills in a relatively short period.

The correct organization of the study process serves as a basis for the development of theoretical knowledge and practical skills in students. The present paper explores the specificity of the study process organization in the militarized educational institution with hierarchy, discipline and one way communication. Therefore, the study process and pedagogical work is diverted into a second place, thereby reducing their effectiveness. The aim of the research is to perform a study of the professional training system of border guards to detect the factors that influence the training system and to determine the possibilities to improve and increase the organization and efficiency of the study process in the State Border Guard College. In order to explore the possibilities to increase the organization and efficiency of the study process, questionnaires for the teachers were created and factors that influence the professional training system of border guards were detected. The author brought forward the conclusion that increasing the organization and efficiency of the study process in militarized educational institution is not possible without correct and planned organization of the study process, giving priority to the study process, reducing the involvement of the students in internal service duties, and applying "subject-subject" communication in the implementation of professional and general education courses.

This article is aimed at studying issues related to the reform of legal education in Ukraine, taking into account the legal regulation of this area of state activity. Since 2004, since the adoption of the national program of adaptation of Ukrainian legislation to the legislation of the European Union, a process has begun to bring the provisions of national legislation into European standards in order for Ukraine to meet the third Copenhagen and Madrid criteria for membership in the European Union. One of the areas of implementation of this Program is legal reform in Ukraine, which affects the formation of common approaches to creating a regulatory framework for training qualified professionals and creating appropriate conditions for the institutional, scientific and educational process of adaptation of Ukrainian legislation. In addition, the ways of implementing the National Strategy for the Development of Education in Ukraine until 2021 and the National Doctrine of Education Development need special attention. Many domestic scholars have paid attention to the issue of legal education reform in different years. However, this area is becoming increasingly important due to the development of society as a whole and the growing demand for the legal profession, which is reflected in quantitative indicators. Thus, according to the Ministry of Education and Science of Ukraine, in 2021, in the ranking of specialties by the number of applications, the specialty «Law» takes second place. In 2021, 68,124 applications were submitted for this specialty. As a result of the study, the problematic issues related to bringing the regulatory framework to a single model, which must meet both European standards and the Constitution of Ukraine, were identified. Given the demand for legal education, both in Ukraine and abroad, its regulation should be paid attention in the first place.

The article analyzes the development and functioning of the system of education, training, retraining and advanced training of civil servants. The relevance of the research topic has been proved - qualified civil servants successfully implement the functions of the state; the efficiency of public services depends on the level of training and qualifications of civil servants. The quality of training for a civil servant directly depends on the level of education in the country. The system of training, retraining and advanced training of civil servants should be considered as a single, integral subsystem in the public administration system. The research of scientists should be used in the development of projects for reforming the vocational training system of civil servants. At the same time, when analyzing modern literary sources, it was revealed that the problems of a practical nature that exist in the civil service, that is, the needs of civil servants in the modern conditions of their work, have been insufficiently studied, and foreign experience of professional training of personnel for the civil service remains little studied. An analysis of regulations and a survey of civil servants allows us to draw conclusions about the shortcomings of the existing system of training civil servants. In particular, the system of training, retraining and advanced training of civil servants should be aimed at achieving the main goal - providing government bodies with the necessary number of highly professional and highly knowledgeable, trained civil servants who have modern scientific knowledge, practical skills and abilities and are capable of effective implementation of the goals and functions of a legal modern state in its practical activities. The authors noted that it is extremely necessary to study the foreign experience of training civil service specialists and implement it in Ukraine. It is necessary to establish a relationship between the needs of civil servants and the curricula and plans of educational institutions, retraining and professional development courses; to increase the level of dissemination of new forms and methods of professional development of civil servants, including remote ones; improve the qualifications of teachers and educators by increasing funding from the state, international cooperation and internships; to start constant sociological monitoring of the needs of civil servants; establish the correspondence of basic education to the position held.

AbstractThe paper discusses the use of information technologies in professional training of future security specialists in the United States, Great Britain, Poland and Israel. The probable use of computer-based techniques being available within the integrated Web-sites have been systematized. It has been suggested that the presented scheme may be of great significance for organization of security specialists’ professional training in Ukrainian higher education institutions as it promotes searching for an individual paradigm in processing various data and adjusting to modern challenges of an information soceity. The process of expanding learning techniques through information technologies has been emphasized; four directions of US Education Reform have been outlined; the distinctive features of theory and methodology of using information technologies in the United States have been highlighted. The learning models in Israel have been described; the aim of future specialists’ training in Poland has been formulated. The methodological and practical components offuture security specialists’ training of have been analyzed. It has been indicated that nowadays Great Britain has the most detailed education standards in Europe. It has been pointed out that studying experience of other countries contributes to determining a strategy for using information technologies in education. It has been concluded that methodical and practical training of future security specialists for using information technologies should be related to practical skills. It has been found out that motivation play an important role in developing future security specialists’ practical skills. It has been proved that pedagogical professionalism promotes achievements of science and technology. Prospects for further researches are seen in studying the peculiarities of professional training of future security specialists in leading European countries.

The article highlights theoretical aspects of the socio-pedagogical direction of pedagogical practice of future primary school teachers.The tasks of pedagogical practice as a mandatory component of professional training of future specialists are outlined. The necessity of involvement employers in cooperation with higher education institutions to ensure a high level of continuous practical training, creating conditions for professional development and self-realization of future teachers are substantiated. Great emphasis is placed on the need for creative use of theoretical knowledge and practical skills working with students, modern teaching technologies, students’ educational and social development, as well as systematic professional self-improvement and self-development. It was proved that in the process of teacher training system pedagogical practice performs a number of important functions: educational, developmental, diagnostic and corrective, communicative, organizational (management), prognostic, preventive, etc. The approximate content of this student practice in general educational institutions is given taking into account such directions, as: work with deviant and gifted pupils, inclusive education, sociocultural animation, etc. The results of an empirical study on the readiness of graduates of pedagogical specialties for the practical use of social and educational technologies in school are presented. The difficulties most often faced by respondents in working with students were identified, including: work with different categories of parents, individual counseling of students, resolution of pedagogical conflicts, implementation of diagnostic activities and socio-pedagogical communication, etc. The author proved that combination of theoretical and practical teacher training, integration of teaching with research and experimental work would contribute to the practical orientation of the educational process at the university, active search and implementation of non-traditional forms and methods of teaching, in particular in socio-pedagogical aspects. The article partially uses the materials of the author's dissertation “Theoretical and methodological principles of professional training of future primary school teachers for socio-pedagogical activities” (2015) for the degree of Doctor of Pedagogical Sciences.

Based on the analysis of the scientific literature, the peculiarities of the formation of professional competence of future employees of the National Police of Ukraine and its components are determined. The specifics of service activity of patrol policemen are considered. It is stated that the level of professional competence of police officers is low, and sometimes insufficient. A set of requirements for the professional competence and professionalism of law enforcement officers has been formulated. Areas of professional training that need improvement are outlined. The practical aspects of formation of professional competence of patrol police officers are covered. Practical tools aimed at improving the efficiency of the patrol training process as a professional have been developed. The author's method of forming professionally competent patrol police officers is substantiated, its efficiency is tested. The essence of this technique is to introduce into the educational process of simulated situational tasks, which aim to form professional skills and abilities. The pedagogical experiment involved students of the course of primary professional training of police recruits in 2019 (n = 61), who studied at the center of primary professional training «Police Academy» of the National Academy of Internal Affairs (Kyiv). An experimental (n = 31) and control (n = 30) groups were formed. The experimental group included students who studied the author's method, the control group - students who studied the traditional method of teaching. The effectiveness of the author's methodology was evaluated by cognitive and operational criteria. Cognitive criterion was determined by indicators: 1) knowledge of the legislative unit; 2) knowledge of professional and practical direction. The operational criterion was characterized by the following indicators: 1) the formation of professional and practical skills; 2) the effectiveness of scripting. The results of the pedagogical experiment testified to the effectiveness of the author's method in comparison with the traditional one. The use of the proposed innovations contributed to a significant improvement of the cognitive criterion «Knowledge of professional and practical direction» (p <0.05) and indicators of the operational criterion «Formation of professional and practical skills» (p <0.05) and «Effectiveness of scenarios» ( p <0.001). It was stated that the experimental group had a larger number of people with a high and sufficient level of professional competence in the selected indicators. Prospects for further research are to substantiate the means and methods of forming the professional competence of police officers during training in the training system.

The study of the problem of the value sphere of the student's personality in a higher educational institution based on the basic conceptual foundations of Ukrainian psychology scholars in the study of general and professional disciplines of professional training with the aim of becoming personal and professional value orientations for each student, in particular, increasing interest in knowledge in the process of educational-professional activities, with the purpose of development of creative thinking, acquisition of professional-personal competences, practical skills that will facilitate the increasing - future specialists teaching professional direction priority, spiritual and moral values, which is one of the main objectives of the institution of higher education in today's society. Using of scientific and scientific-methodical publications, methods of psychological and pedagogical researches and methodical materials and practical experience of experts of age and pedagogical psychology and department of Psychology of education of the faculty of Correctional and Social Pedagogy and Psychology of the Kamyanets-Podolsky National University named after Ivan Ogienko have been used. The article substantiates the importance of the problem of improving the quality of the professional training of future specialists in the pedagogical industry with the use of active teaching methods, specific pedagogical situations in the study of professional disciplines, in particular, practical training aimed at the formation of a personality of a specialist who would be competitive on the domestic and European labor markets. The article substantiates the importance of the problem of quality improvement. To improve the organization of the educational process, acquiring practical skills close to the educational process, forming professional and personal competences for a future specialist in the pedagogical direction, it is advisable to pay attention to the problem of practical training through the introduction into higher education of the higher education an educational institution of active teaching methods, which is one of the main ways for acquiring the practical skills and skills necessary for the formation of a person professional specialist, competitive on the domestic and European labor market with the purpose of the possibility to search for solved pedagogical tasks, increase of professional knowledge, acceptance of original and creative decisions in the conditions of future pedagogical activity.
