Principle of freedom of doing business (entrepreneurship) and its implementation into the system of innovative law of Ukraine

Problem setting. Despite the ramifications of national legislation on entrepreneurship and real activity on a significant scale of small and medium-sized businesses, as well as a significant amount of research in this area, there are problems that reduce the effectiveness of business results and encourage improvement as a regulatory framework. and mechanisms of the national model of entrepreneurship. The ways to implement the principle of freedom of entrepreneurial activity in the system of innovation law remain unclear. The purpose of the article is to identify problems that reduce the efficiency of entrepreneurial activity and search for options to improve the existing regulatory framework in the field of innovation, as well as ways to implement in the national model of economic experience of advanced countries. Analysis of recent researches and publications. A comparative analysis of the results of research by scientists from Georgia (T. Anasashvili, D. Bridze, B. Bolkhvadze, I. Margalitadze), Belarus (E. Voronko, V. Panashchenko), Kazakhstan (S. Moroz) with the conclusions and suggestions of Ukrainian scientists: A. Brevnova, P. Bubenko, D. Zadykhailo and others is carried out. Article’s main body. In the context of the global economic crisis, the most effective ways out of it are two main directions. The first, global, is due to the unification of states into economic unions and the development of common mechanisms for economic development. And the second, local, is based on a detailed study of international best practices and its implementation in national models of innovative development. A systematic analysis of the national regulatory framework with the legislation on entrepreneurship of other countries gives grounds for concluding that it is formed on similar conceptual principles, in particular with regard to consolidating the principle of “freedom of enterprise”. The Doing Business survey periodically determines the ranking of countries in the world regarding freedom of enterprise. The assessment is based on the arithmetic mean of ten control indicators: the process of business registration, the mechanism of connection to energy supply, the process of property registration, credit system, existing tax mechanisms, the degree of investor protection and more. In connection with the unsatisfactory state of development of the economy of Ukraine, attention is focused on ensuring the activities of small business on these criteria in countries that are consistently ranked in international ranking research. In particular, Georgia, China, New Zealand, Singapore and others. Conclusions. The plans of the Ukrainian authorities to further harmonize the legislation in the field of small business with European standards, to carry out in-depth tax reform and to carry out manifestations of illegal pressure on business deserve support. In order to accelerate the process of improving the legal framework for entrepreneurship and effective mechanisms for innovation, the conclusions of international experts should be used more widely. The recommendations of international rating agencies on the need to adopt a realistic strategy for the development of small and medium-sized businesses (entrepreneurship), improve the regulatory framework in the field of lending to small and medium enterprises and improve their access to existing forms of financing, development of entrepreneurship and real action should be implemented. the principle of freedom of its conduct in the field of innovation.

The essence of international business, its active development and expansion, that influence the integration of economic systems and intensification of business relations between countries, are considered. The attention is paid to the international market of the European Union, first of all to Polish-Ukrainian cooperation due to the modern development of international business. The importance of the development of trade and business between Ukraine and Poland is determined, taking into account close relations in the field of economy, politics, culture and historical connections. The legal framework between Ukraine and Poland is substantiated, which ensures the proper development of bilateral cooperation at the level of strategic partnership and emphasizes the presence of an active dialogue between countries. The main agreements between Ukraine and the European Union, which influence the economic cooperation between Ukraine and Poland, are considered, taking into account Polish membership in the EU. The implementation of special projects by the European Union to support the development of Polish-Ukrainian cooperation is determined. The increase of the intensity of economic exchange between Ukraine and Poland, the active development of trade and investment in various spheres of business and the growth of economic indicators are determined. The peculiarities of the development of the small business sector and its influence on the stabilization of socio-economic processes between European countries are substantiated, emphasizing Poland's experience in development of the small business as a driving force on the way to economic integration. The main aspects and characteristics of international business between Poland and Ukraine are determined and the main differences in doing business in these countries are revealed, emphasizing the perspectives of development.

The article presents the results of the implementation of the National Project “Small and Medium Business and Support for Individual Entrepreneurial Initiatives” and federal projects included in it: “Improving the conditions for doing business”; “Expanding the access of small and medium-sized businesses to financial resources, including concessional financing”; “Acceleration of small and medium-sized businesses”; “Creation of a support system for farmers and the development of rural cooperation”; “Popularisation of Entrepreneurship”. We critically analysed the national project as a whole and assessed the newest situation of small and medium-sized businesses. Further, we carried out the analysis of the achievement of the leading indicators of the national project. Also, we considered the financing and the results of the achievement of indicators in the context of federal projects that are part of the national project for 2018-2020.We assessed the risks of non-fulfilment of the goals and objectives set in the projects. The article also examines the effectiveness and evaluates the effectiveness of state support measures for small and medium-sized businesses affected by the spread of coronavirus infection in 2020. Besides, we analysed the main changes in the regulatory legal framework within the framework of implementing the national project. The analysis of the updated structure and activities of the national project “Small and Medium Enterprises and Support for Individual Entrepreneurial Initiatives” has been carried out.

Support and stimulation of the development of small business in our country today is of the most urgent importance in comparison with other periods of economic development in Russia. It is for this purpose that the Presidium of the Council under the President of the Russian Federation for Strategic Development and National Projects in 2018 approved the national project «Small and Medium Enterprises and Support for Individual Entrepreneurial Initiatives», the implementation period of which is from October 2018 to 2024 inclusive. In 2019, the national project was launched in a number of regions of our country. The main purpose of writing a scientific article was the desire of the authors to make a number of practical recommendations to the Moscow Chamber of Commerce and Industry of the Russian Federation in providing assistance and assistance to young entrepreneurs, as well as to the population showing economic initiative. In this scientific article, its authors consider the objective possibilities for the development of small business on the territory of Moscow, about the role and contribution to this process of the Chamber of Commerce and Industry of the Russian Federation and its territorial associations. In particular, having analyzed the activities of the Moscow Chamber of Commerce and Industry, as well as the Headquarters for the protection of the rights and legitimate interests of subjects of investment and entrepreneurial activity in Moscow, the authors offer their vision of the process of developing small business in the capital and give a number of practical recommendations that have already found real implementation in the work of the RF Chamber of Commerce and Industry.

Nowadays a number of legal, economic and organizational problems related to the implementation of the role of the state in the effective regulation of business development in Ukraine have become relevant. The development of entrepreneurial activity is one of the main prerequisites for the formation and realization of the export potential of the state, its material enrichment and growth of living standards. In modern conditions there is a need for a detailed study of business activity in Ukraine. Using statistical data of the site ukrstat.gov.ua, the economic indicators of small industrial enterprises within the period of 2010-2019 have been analyzed in the article. They are the volume of goods manufactured by enterprises; the volume of goods sold by enterprises; financial results prior to taxation of enterprises; net profit of enterprises. During 2012-2019, the volume of goods sold increased, which has a positive trend and may indicate the development of small industrial enterprises. During 2010-2019 the volume of sold products also has a positive upward trend, due to the excess of the volume of sold products over those produced in 2019. This indicates an excess of demand over supply. Net profit for the entire period of 2010-2019, except for 2018, 2019 has a negative trend, as shown by its negative values, namely the losses of small businesses. The state of entrepreneurial activity in Ukraine is currently unsatisfactory. It is evidenced by the slow growth rate of the number of small enterprises, imperfect market infrastructure and competition, lack of working capital, lack of investment resources, etc. Further development of small business, increasing its competitiveness in both domestic and foreign markets, largely depends on a balanced and sound state policy. Today it is vital to include the development of small business in Ukraine in the overall strategy of economic growth and structural reconstruction of the national economy. To improve and stabilize business activities in Ukraine, the following measures are offered: to apply a flexible system of preferential taxation for medium and small businesses, depending not on the number of those working in them, but on the annual volume (sales) of products, services, works; to constantly reduce the tax burden on small and medium enterprises; to facilitate access of small and medium enterprises to financial resources; to change the microcredit system in the field of small business in Ukraine. The financial and loan system in Ukraine currently offers different conditions and rates for small business loans, which has a particularly negative impact on the work of entrepreneurs in the period of the economic crisis.

The development of entrepreneurial activity is one of the main conditions for solving society’s current economic and social problems. The primary requirement for this development is the growth of effective financial and economic activities of business structures. Today, unfortunately, the business environment, especially competition, occurs only in the field of activity of small and medium enterprises, and competition at the level of large enterprises and their associations is distorted due to destructive processes occurring at the industry level. Today it is an urgent task to identify the characteristics of business structures depending on their size. The article studies and classifies business structures depending on their potential of doing business.

The aim of this article is to evaluate the business activity of small and medium enterprises in the Statutory City of Karviná in the Czech Republic. With regard to the objective of the work, a questionnaire survey focused on small and medium-sized enterprises in Karvina was carried out. Secondary data are obtained from the Czech Statistical Office. Within Karvina, the number of registered entities is approximately half the number of registered entities every year, except for cooperatives. Enterprises of natural persons doing business under the Trade Licensing Act have a considerable advantage over legal entities. The main motivating factors for entrepreneurship are the influence of “self-fulfillment” when entrepreneurs engage in entrepreneurial activity to achieve their inner satisfaction. The second main motive is the possibility to organize your time and take responsibility for yourself. From the perspective of barriers to starting a business, the most important factor is the bureaucracy and redundant administration.

In the article a detailed analysis of the small and medium entrepreneurship in the world economy is conducted. The objective reasons for the growth of the small and medium enterprises in the postindustrial society and the influence it realizes on the improvement of the competitiveness of the advanced economies are shown. On the basis of the vast statistical material is proved, that, as a rule, in the countries of the high socio-economic development the small entrepreneurship is effectively stimulated by the public structures. In the article the role of some methods of financial support for small and medium enterprises by the example of the certain countries is studied in details. Special attention is paid to the financial support of the small enterprises in New Zealand since it is the country that has been ranked first for a number of years in the “Doing Business” rating. Special attention in the article is paid to the US experience, because just this country for the researchers as well as for the practitioners is a role model in the field of the small entrepreneurship support. Special place is given to the analysis of the SBA (Small Business Administration) activity – organization, playing a key role in the functioning of small business in USA. In the article on the basis of the information presented the conclusions are made what methods of the small business stimulation could be realized in the Russian society.

This article uncovers relevant sources and methodologies to gather knowledge about micro, small and medium enterprises (MSME) in Brazil. To achieve its purpose, the text presents sources and methodologies. This type of study is relatively neglected concerning MSMEs. Until this moment, not much data has been reported about these companies’ categories, and even less in advanced research. Among the most significant data and methodology of addressing MSMEs in the country, the text highlights the surveys conducted by the Brazilian Institute of Geography and Statistics (IBGE), the Brazilian Micro and Small Business Support Service (SEBRAE), and the international annual research Global Entrepreneurship Monitor (GEM) a study on the entrepreneurial activity, which Brazil is part for more than 20 years. The Brazilian institutions, as well as consulting for those companies, collect key data that posteriorly become research sources. Also, when explaining how institutions chose and treated the data, they own specific methodologies regarding those businesses in Brazil. The paper also points out the importance of constant law monitoring, adjustment, and technology incentives. This article's contribution is to present a research methodology on MSME in Brazil with relevant data.

Entrepreneurship plays an important role in the modern global economy; the share of products of small and medium enterprises in the gross product and exports not only of the developed but also of developing countries is growing. Innovation processes cover all sectors of the economy, and more and more people are involved in entrepreneurial activity, which contributes to the penetration of entrepreneurial thinking and business values in all areas of the socioeconomic life of society. The Institute of Entrepreneurship plays an increasingly prominent role in the institutional environment of socio-economic systems. This actualizes the problem of studying the relationship of the institution of entrepreneurship with the institutions of law, culture, management. This requires a methodology that allows you to explore the impact on the institute of entrepreneurship not only economic, but also non-economic factors. The methodology of the “old” institutionalism possesses such a tool, it is structural modeling (pattern modeling), which allows to explore the diversity of interrelationships of the institution of entrepreneurship with other components of the institutional and economic environment. The article explored the features of the development of the institution of entrepreneurship in Russia, established the relationship between the institution of entrepreneurship, values, motives and incentives for entrepreneurial activity, built a structural model of the institution of entrepreneurship based on the methodology of the old institutionalism (pattern modeling). The structural model of the institution of entrepreneurship reveals the relationship between the institution of entrepreneurship, the values of entrepreneurial activity, its motives and incentives; as well as the relationship between the institution of entrepreneurship with the institutions of governance, cultural and religious institutions, legal institutions and society.

The presented study examines the experience of forming a regulatory framework for the integration of the Eurasian Economic Union (EAEU) member states through the example of standardization as one of the key tools of quality economics.Aim. The study analyzes the major solutions of the EAEU authorities and member countries aimed at increasing the role of standardization in the economic integration of the Union over five years of its existence.Tasks. The authors identify efficient methods for developing standardization for the integration of the EAEU states as well as the most problematic aspects in this field that need to be taken into account in the qualitative strengthening of the Union’s economy.Methods. This study uses general scientific methods of cognition to examine the activities of the EAEU authorities and member states aimed at creating a system for the economic integration of the Union during a period of its transition from separate national markets towards a single (common) market.Results. Over five years of operation in the field of stadardization, the Eurasian Economic Union has created the necessary organizational and legal framework to ensure the successful development of integration processes. The national legislation on standardization has been modernized with allowance for the harmonization of these laws. In the next five-six years, the development of international standards for 40 technical regulations is expected to be completed, which would create a regulatory framework for unhindered interaction between all participants of the single (common) EAEU market. Conclusions. The analysis of activities in the field of standardization reveals a sufficiently thought-out and coordinated policy of the EAEU states in creating the necessary conditions for overcoming legal and administrative barriers in the movement of goods and services within the common economic space of the EAEU.
