Reviews of Cases of Construction Disputes in Malaysia and its Relation with Standard Form of Construction Contract

In Malaysia itself, the construction industry has well governed the economic trend and providing the pathway towards modernization. Construction industry is a huge process that involves many activities in different phases and participation of various professions. The complexity of this industry has made it closely linked to disputes. There are always possibilities of dispute occurrence even when almost all projects are governed by their respective contracts. This study is initiated to find the relationship of standard forms of contract with construction disputes. The focus of this study will be on the construction disputes litigation cases in Malaysia reported to the Current Law Journal (CLJ) between year 1999-2009. The secondary data for this study is obtained from questionnaire survey distributed throughout Malaysia, which looks into construction dispute cases that were not referred to formal law journals. Research findings identified that all projects are governed by standard forms and even though the parameters causing construction dispute are actually monitored by the standard form itself, disputes are not declining or effectively resolved, and hence, making the standard forms as one of the the major causes of construction disputes.

The practice of efficient and timely payment in construction projects is a major factor that can contribute to the success of a project. Delays in payment to subcontractor(s) by main contractor and client on construction projects in the Malaysian construction industry is considered to be a significant factor of concern. It causes severe cash flow problems to subcontractor(s) and this condition may lead to a devastating impact to the contractual payment chain. Withholding or delaying payment creates financial hardship for the construction companies and its impacts are sometimes so harsh that some companies have to close down their services. The research methodology adopted was the questionnaire survey analysis based on thirty (37) respondents from selected main contractors and sub-contractors in Gombak, Selangor. The data and information were also gathered from interviews analysis. From the research findings, among the factor of late payment from the client is payment withhold by the client. Meanwhile, the factor of late payment from the main contractor is when the term of “pay when paid” is applied. To improve the payment situation, the findings of this study suggest that there must be dedicated enforcing provisions for payment delay in contracts. This is proposed by introducing the standard form of contract clause regarding payment between the main contractor and domestic subcontractor which include levying charges on overdue payments.

SYNOPSISThe relationship between herpes simplex virus type 1 and mental retardation is explored by studying the antibody levels to this virus in a group of 86 severely and profoundly retarded adults. A tendency towards higher antibody levels is found in patients whose retardation is of unknown aetiology. The relationship of these observations to previous research findings and the possible significance of herpes simplex virus in the aetiology of mental retardation are discussed

Objectives. Studying the relationship of autonomy and attachment in relationships with parents with real self-determination in students. Background. The growing world globalization, intercultural contradictions, confrontation within society seriously complicate the path of self-determination of modern youth. At the same time, due to technical progress and digitalization of the communication and education environment, there are significant transformations in the interaction of people in almost all spheres, including in the family. Therefore, the question of studying the most important aspects in the relationship of young people with their parents for real self-determination is especially acute. Study design. The work studied the indicators of real self-determination, attachment to parents and autonomy among students. The presence of a relationship between these parameters was established by calculating the Spearman correlation coefficient. Participants. 60 college students aged 18 to 21. Measurements. Methodology “Scale of adult attachment for close relationships”; autonomy questionnaire (authors O.A. Karabanova and N.N. Poskrebysheva); questionnaire “ORS” (author D.A. Krasilo). Results. An inverse relationship of indicators of real self-determination of students with the level of intimacy and the level of anxiety (scales of attachment to parents) was established. A direct relationship was revealed between the indicators of real self-determination and the level of autonomy. Conclusions. Proximity and anxiety (components of attachment) have a significant inverse relationship with the level of real self-determination in students. There are no significant connections between reliability (a component of attachment) and real self-determination in the sample under study. Emotional autonomy, cognitive autonomy, behavioral autonomy, and value autonomy have significant positive correlations with the level of real self-determination in students.

Cataract is the leading cause of 51% blindness case in the world. Cataract can only be cured trough surgery, but most people with cataract in Indonesia is not in undergoing surgery due to several factors. The increasing number of cataract victim whose not undergoing any treatment to cure them will resulting in increasing number of blindness case, so blindness cause by cataracts can be a public health problem. This research was conducted to determine the relationship of age, attitudes, knowledge and the cost of the action to perform cataract surgery. This research was an observational analytic study with cross sectional design. The samples were cataract patients in Undaan Eye Hospital Surabaya who were randomly selected using a simple random sampling based on medical records of 60 people. Data collection was done by taking secondary data and interviews to patients. Those variables was analyzed with chi square or Fisher’s exact with significancy level at 95%. The result showed that there were correlation between knowledge (p = 0.017), operating costs (p = 0.001) and attitude (0.000) while age was not related (p = 1.000), the actions to perform cataract surgery. The conclusion from this research was the attitude, knowledge and operating costs related to the actions to perform cataract surgery, while age was not related to the actions to perform cataract surgery. It is recommended to give through leaflets or other media in the lobby for improving patient education, counseling to the patient family, the doctor’s advice to convince patient for surgery.Keywords: practice, surgery, cataract, attitudes, costs

Purpose of the study: The objective of the study was to investigate the relationship of the dividend payout on a firm's performance under low growth opportunities from the manufacturing sector of Pakistan. Methodology: A sample of 251 firms out of 378 manufacturing firms listed at the Pakistan Stock Exchange (PSX), have been carefully chosen for the era of ten years from 2006 to 2015. The secondary data was obtained from the firm’s web financials and analysis of financial statements, published by the statistics department of the State Bank of Pakistan. For the persistence of investigation panel data (fixed effect) analyses were employed in this study. Main Findings: The fallouts of the analysis revealed that the dividend payout ratio has an insignificant relationship with the firm's performance in the low growth perspectives of the study. Applications of this study: The findings of the study are helpful for the financial managers of the firms facing low growth opportunities. Furthermore, the investors in capital markets can use the findings of this while investing. The originality of this study: The study focussed on the role of low growth opportunities while studying the nexus of dividend pay-out and the firm’s financial performance which inherits the novelty and originality of the study.

Technological innovation as an engine for development requires a structural apparatus to its consolidation, reinforcing the approach of innovation systems, with emphasis on the role of universities. Therefore, considering that associated with this potential are present several innovative elements, such as the Technological Innovation Centers (NITs), the incubators of technology-based companies (IEBTs) and Technology Parks (ParqTecs), and given the lack of systematization National these instruments, the ultimate goal of this study was to analyze the environment for innovation in Brazilian federal universities, through the mapping of NITs, the IEBTs and ParqTecs associated with these institutions, further outlining the relationship of these instruments with technological variables (technological scholarships and patents). We used a qualitative and quantitative approach, descriptive nature, with collection of secondary data on institutional sites of universities and the adoption of simple linear regression analysis. The results realized all 63 Brazilian federal universities and revealed that the most widespread instrument between universities are the NITs, since its presence in 86% of the analyzed institutions. Have business incubators, idealized to strengthen interaction in innovation systems, are associated with 68% of universities, enabling regional development contexts. In relation to technology parks, it was found that, depending on the expenditure required for its implementation, only 26 universities are integrated into ParqTecs. The contributions of this study are concentrated in addition to the mapping done in highlighting the distinctions between the Brazilian regions in terms of scientific and technological structure and the importance of innovation ecosystems.

This study aims to find out the efficiency of the administration of Palembang City, 2002 – 2016 period in building the area with and components that caused whether or not administrative expenditure of an area was efficient. This study uses data secondary data that is realization data of administrative expenditure, average employe’s expenditure, capital expenditure and local revenue. This data was tested by stochastic frontier analysis (SFA). The results of estimation from the stochastic frontier analysis (SFA) found that the administrative expenditure of the city of Palembang was inefficiency. The average variable of employee expenditure has a negative related and has a significant effect to administration costs in Palembang City. The relationship of variable capital expenditure with the administration costs of the regional government in the city of Palembang has a positive and significant effect. And the Local Revenue variables have a positive and significant effect to administration costs in Palembang City.

The purpose of this research study was to help inform the researcher’s future practice as a teacher on the influence of technology on young learners. The question of inquiry pertained to define how technology has initiated and increased student engagement within their learning, and through this, how technology has specifically influenced the creation of the 21st century learner. By beginning the inquiry through a literature review on the theme of technology and student engagement, the researcher was able to gain an understanding that technology is the motivator for children in developed, and even in undeveloped countries. In order to assess the relationship of technology and student engagement in learning, along with how digital devices influence the creation of 21st century learners, the researcher surveyed a variety of teacher candidates and university students to draw conclusions. From the research findings of the study, the researcher concluded that students were attracted to technology as it is a tool that is convenient in organizing information, and is efficient in making data easier to allocate. Therefore, the skills that technology imparted upon 21st century learners from the findings were allowing students to become self-directed learners, access and, evaluate information through critical thinking and solving data to become more engaged thinkers, and influencing leadership and collaboration skills.

Teachers and researchers have been designing telementoring programs for more than fifteen years, yet there are many possible program designs that have not yet been attempted, and enormous potential yet to fulfill. An attempt is made to map out the “design space” of K-12 telementoring by discussing the major decisions made in designing a telementoring program, and the relationship of these decisions to one another. Where possible, research findings and examples of specific programs are cited in this discussion. By providing a look “under the hood” of telementoring programs, the chapter aims to help teachers become more equal partners in the effort to refine existing programs and develop new ones. Encouragement is offered to researchers to more fully articulate the rationale behind their designs in their writing, and to carry out more research on the efficacy of particular design choices, so that the field can develop cumulative literature on telementoring design.

The main objective of the study is the development of an effective motivational mechanism for employees of construction enterprises. The paper considers particularities of remuneration of participants of construction process in order to define the application of various mechanisms of motivation and incentivisation. The existing methods of development of motivation and incentivisation are analyzed as a tool for increasing the performance of the enterprise. Scientific and methodological recommendations on the establishment and implementation of the mechanisms of motivation and incentivisation as a tool for increasing the performance of enterprises in the construction industry were developed. These recommendations allow identifying the relationship of motivation and incentivisation with the performance of the enterprise. The developed mechanism is based on the relationship between the strategic objective of the enterprise and the key performance indicators of the units or specific employees.
