This study aims to identify the factors preventing the state from responding in a manner that will avoid future conflict in post-civil war Sri Lanka. After the government ended the separatist struggle of the Liberation Tigers of Tamil Eelam (LTTE) by bringing the civil war to an end in May 2009, the protracted and destructive 30-year war presented an opportunity for both state and society to learn many useful lessons from the long war. These lessons could have enabled the government to reconstitute the state as an inclusive institution, one in which minorities could also participate to ensure just and equitable development for all Sri Lankans. This study uses a qualitative research approach that involves analysis of critical categories. Findings of this study offer some crucial insights about Sri Lanka’s ethnic politics, particularly, the various factors have influenced the state to avoid inclusive policies. The key factor is the dilemma of post-independent political culture or traditions amongst ruling elites resulted in the avoidance of inclusive policies. This study also reveals some other factors that contestations between different social forces within society, within the state, and between the state and society still prevail in Sri Lanka, hampering the institution of inclusive policies. Further, the paper highlights the failure of India and the International Community to pressurize the state of Sri Lanka to introduce inclusive mechanisms due to international power balance (China factor).

Many observers view the defeat of the Liberation Tigers of Tamil Eelam (LTTE) in May 2009 as a significant turning point in the protracted ethnic conflict that was troubling Sri Lanka. The armed struggle and the consequences of war have encouraged the state and society to address the group rights of ethnic minorities and move forward towards state reconstitution. The Tamil minority and international community expect that the Government of Sri Lanka (GOSL) must introduce inclusive policies as a solution to the ethnic conflict. They believe the state should take measures to avoid another major contestation through the lessons learned from the civil war. The study is a qualitative analysis based on text analysis. In this backdrop, this paper examines the attempts made for the inclusion of minorities into the state system in post-civil war Sri Lanka, which would contribute to finding a resolution to the ethnic conflict. The study reveals that numerous attempts were made at various periods to introduce inclusive policies to achieve state reconstitution, but those initiatives failed to deliver sustainable peace. The study also explores problems pertaining to contemporary policy attempts.

Universities are expected to provide employable and quality graduates. The government of Sri Lanka provides education facilities to the nations and the total expenditure incurred from the General Treasury. However, a lack of financial resources is one of main constraints being faced by the State universities. These situations negatively affect the performance of the students. Even though, the financial and other constraints remain, universities would not reduce the expected service delivery. Thus, this paper argues that universities could perform in innovative ways in managing their educational programmes that would lead to improve the quality and the relevance of the output of the universities leading to more effective and efficient administration. Thus, this study examines the utility of innovation theory in university administration in Sri Lanka. The study attempts to answer two main research questions: Is innovation possible in the university Administration? And what are the main factors affecting on innovation in the university administration? Qualitative research approach with a purposive sample of 20 administrators from four universities from the Western Province was selected by using reputed snowballing technique. Descriptive analysis was undertaken. The study confirmed that innovation is possible and already happening within the university administration. Innovation in university administration means introducing and implementing systems of management by using new ideas to improve the efficiency and the effectiveness of the degree programs. The study presents several innovative practices initiated by the university administration which have created potential benefits to the degree programs. The administrators’ motivation to achieve is the significant determinant of the managerial innovation and supportive environment which is mainly the supports of the academic staff and the external environment are other significant determinants of managerial innovation in the administration of the selected universities in Sri Lanka.KeywordsManagerial Innovation, Public Sector, University Administration

This study aims to analyze the strong state of Sri Lanka that emerged after the civil war during the regime of Mahinda Rajapaksa. The Liberation Tigers of Tamil Eelam (LTTE) was the leading Tamil militant social force, which was waging war against the government to form a separate state in the northern and eastern regions of Sri Lanka. The government ended both the separatist struggle of the LTTE and the civil war in May 2009 by winning a major military victory. This study is a qualitative analysis based on text analysis and field interviews, supplemented with limited observations. The study reveals that the state introduced enhanced security measures to avoid possible LTTE regrouping and re-commencement of violence in the country. The state also attempted to fragment minority parties to weaken the state reconstitution process through penetration and regulation of the social order.

Abstract This research focuses on the issue of state-minority contestations involving transforming and reconstituting each other in post-independent Sri Lanka. This study uses a qualitative research method that involves critical categories of analysis. Migdal’s theory of state-in-society was applied because it provides an effective conceptual framework to analyse and explain the data. The results indicate that the unitary state structure and discriminatory policies contributed to the formation of a minority militant social force (the Liberation Tigers of Tamil Eelam – The LTTE) which fought with the state to form a separate state. The several factors that backed to the defeat of the LTTE in 2009 by the military of the state. This defeat has appreciably weakened the Tamil minority. This study also reveals that contestations between different social forces within society, within the state, and between the state and society in Sri Lanka still prevail, hampering the promulgation of inclusive policies. This study concludes that inclusive policies are imperative to end state minority contestations in Sri Lanka.

The evolution of the Islamic Republic of Iran and the dynamics of the relationship between the Iranian state and society can be explored by examining the postrevolutionary regime's policies toward intellectuals, particularly as expressed in its regulation of cinema and book publication. This relationship—at least in the period from the early 1980s to the early 1990s—was complex and nuanced. Factionalism within the regime provided an opportunity for intellectuals to engage the state in a process of negotiation and protest, cooperation and defiance, in pushing the boundaries of permitted self-expression. The degree of their success depended in part on which faction controlled the government and its regulatory agencies during particular phases in the evolution of the postrevolutionary regime.

“Whenever a large organized group believes it has the right to resist the sovereign power and considers itself capable of resorting to arms, war between the two parties should take place in the same manner as between nations…” This statement by de Vattel in the 19th century seemed destined to take its place as a part of positive law, constituting part of what was known as recognition of belligerency, tantamount to the recognition by the established government of an equal status for insurgents and regular belligerents. When a civil war became extensive enough, the State attacked would understand that it was wisest to acknowledge the existence of a state of war with part of the population. This would, at the same time, allow the conflict to be seen in a truer light. The unilateral action of the legal government in recognizing belligerency would be the condition for granting belligerent rights to the parties. It would constitute a demonstration of humanity on the part of the government of the State attacked and would also provide that government with prospects for effective pursuit of the war. By admitting that it was forced to resort to war, it would at least have its hands free to make war seriously.

The concept of citizenship is one of the pillars upon which the modern civil state was built. The concept of citizenship can be considered as the basic guarantee for both the government and individuals to clarify the relationship between them, since under this right individuals can acquire and apply their rights freely and also based on this right the state can regulate how society members perform the duties imposed on them, which will contributes to the development of the state and society .The term citizenship has been used in a wider perspective, itimplies the nationality of the State where the citizen obtains his civil, political, economic, social, cultural and religious rights and is free to exercise these rights in accordance with the Constitution of the State and the laws governing thereof and without prejudice to the interest. In return, he has an obligation to perform duties vis-à-vis the state so that the state can give him his rights that have been agreed and contracted.This paper seeks to explore firstly, the modern connotation of citizenship where it is based on the idea of rights and duties. Thus the modern ideal of citizenship is based on the relationship between the individual and the state. The Islamic civilization was spanned over fourteen centuries and there were certain laws and regulations governing the relationship between the citizens and the state, this research will try to discover the main differences between the classical concept of citizenship and the modern one, also this research will show us the results of this change in this concept . The research concludes that the new concept of citizenship is correct one and the one that can fit to our contemporary life and the past concept was appropriate for their time but the changes in the world force us to apply and to rethink again about this concept.

The history and development of land tenure in Iran have been affected by many factors, including climatic conditions, scarcity of water, lack of security, widespread tribalism, and legal and administrative confusion. In addition to limitations in resources, political instability in the premodern period molded systems of land tenure in Iran. Changes of dynasty were frequent and usually followed by the confiscation and redistribution of land. The Qajar dynasty (1788–1925), which came to power after a long period of anarchy and civil war, continued that general pattern. There were three classes of land ownership in Iran in this period: waqfs (religious endowments), arbābī (land owned by large landlords), and khāliṣah (state-owned lands). This last category was composed of lands confiscated by the government as punishment for rebellion or failure to pay taxes. As land was often the only form of wealth landlords had, the threat of government confiscation was an instrument of control as well as a source of revenue for the state. The khāliṣah were usually rented out on long-term leases or were granted as ṭuyul, that is in lieu of services rendered or salaries deferred. The khāliṣah were also in some instances farmed directly by the government. These lands were cultivated by peasants under conditions similar to those of the arbābī lands. They were scattered throughout the country and were also subject to various local and regional variations in agricultural taxes.

Abstract We build a model for predicting civil wars where the government bargains with a rebel group using concessions and repression. The equilibrium is either a state of perpetual peace where there are concessions but no repression or a state of repressive equilibrium that can lead to civil wars. At the lowest levels of political competition, a move towards open electoral participation decreases the ability of the state to use repression to limit challengers, increasing the likelihood of war. At higher levels, an increase in competition decreases the probability of war by increasing concessions to the rebel group. Increasing concessions makes war less likely because it decreases the spoils of war and provides one explanation for the non-monotonicity found between probability of civil war and democracy. We test the prediction of this non-linearity using the technique in [Hansen (2000). “Sample Splitting and Threshold Estimation.” Econometrica 68:575–603] and find evidence consistent with the model.

After the 30-year long civil war was over, the Government of Sri Lanka commenced an accelerated programme to develop the Northern Province. If not carefully planned, such a programme will result in the loss of biodiversity and the consequent loss of services that ecosystems provide humans. Therefore, documenting the biodiversity found within coastal, nearshore and offshore islands of the Northern Province was identified as a need that would help both planners and conservation biologists alike. This report presents the results of a rapid biodiversity assessment of a 949 km stretch from Mannar to the Kokkilai Lagoon, including 22 coastal islands, five coastal stretches and four lagoons, extending across four districts (Jaffna, Mannar, Kilinochchi and Mullaittivu), 20 Divisional Secretariats Divisions and 264 Grama Niladhari Divisions. For terrestrial ecosystems, assessments were carried out during November 2015 and March 2016, and for marine surveys in the coastal waters of Palk Bay and Palk Strait, during November 2015 and March 2016.
