The article analyzes the latest versions of federal laws that made changes to the mediation procedure — allowed judges to resign to perform the procedure of professional mediation; provided an opportunity to notarize a mediation agreement, giving force to an enforcement document; the procedure of «judicial reconciliation» appeared. It is proved that mediation in its essence is not the «activity» of professional intermediaries, mediators, but a «procedure», namely, a structured process that is an alternative dispute resolution technology. The legal principles of the mediation process are disclosed: voluntariness, confidentiality, neutrality, passionlessness and independence of the mediator, independent decision-making by the parties, equality of the parties.

The investment concept, reflecting the investor's investment purpose and willingness, is a value that embodies the investor's investment personality characteristics, prompts investors to carry out investment analysis, judgment, decision-making, and guides investor behaviors. Due to different maturity of the capital market in China and Western countries, there are many differences in the regulatory level, cultural and behavioral patterns of the supervision and management departments of the capital market between Chinese and Western investment philosophy. This article analyzes the differences in investment ideas between Chinese and Western investors from the culture perspective. This thesis studies on the basis of four cultural differences: "The Golden Mean" and "Interest Maximization"; the face-culture and individualism; rule of man and rule of law; and gambler psychology and adventure spirit. Based on these four aspects of cultural differences, four different investment concepts of Chinese and Western investors are analyzed: long-term investments and short-term speculation; "Herd Effect" and independent decision; grapevines and public information; and leveraged trading and allocation of funds. This thesis adopts several cases to analyze the differences between Chinese and Western investors in financial products such as stocks, gold, and futures, and in investment behavior such as the long-term investment, short-term speculation, leveraged trading, and investment portfolios. With cultural differences between China and the West probed into, the differences between Chinese and Western investors' investment concepts are justified. It is hoped that this effort will help investors deepen the understanding of the capital markets in China and the West, enable Chinese investors to learn the Western mature investment concepts, and facilitate the regulators to manage the capital market effectively.

This article aims to assess the problems and prospects of the development and formation of music and art education given the impact of the pandemic COVID-19. Methodology. The research formed a model for the creative development of pupils and students of music and art education based on the Organization for Economic Co-operation and Development Skills for Jobs database. Results. Creativity is shaped by the hands-on activities of students, their music, and art education. Basic creativity skills are best formed through interdisciplinary collaboration toward STEM-education. Research shows that math skills, science, and engineering have a positive effect on students' creativity in hands-on product creation during art courses. Technical skills are important, but they stimulate creativity when students independently decide to use them in a specific, student-defined task. The novelty effect of technology is temporary in creativity stimulation, whereas the student's independent decision to use specific technical skills accordingly to a self-defined problem and task stimulates creativity in the long run. COVID-19 pandemic has exacerbated long-standing challenges and barriers for arts and music education as well as ways to solve those challenges.

In the era of open banking, the phenomenon of bank switching will intensify. The aim of the current study is to answer the following question: is switching, or not switching banks, a result of conscious and independent decision-making? The results from primary data demonstrate that the switching group clients are more conscious than non-switching group clients. They are more likely to compare offers from different banks, visit blogs about finances, demonstrate independence in making financial decisions, and use more service providers which improves their knowledge concerning the offers. The analysis of perceptual maps shows that the switching group is differentiated by various switching costs.

The present study was undertaken to study the decision making pattern of  farm Women in different farm and non-farm activities with following objectives i) to study the selected personal and socio personal and socio-economic characteristic of rural women and ii) to analyze the decision making pattern of rural women in different farm and non farm activities The study was conducted in Six Districts of Assam. A purposive cum simple random sampling technique was adopted for selecting the respective samples for the study. Altogether 1200 farm women were selected for the present study. Data was collected personally by interview method. The findings reveals  that farm women belonged to low socio-economic status, less than fifty per cent of farm women took independent decision in maintenance of house (35.25%), followed by buying food items for family consumption (34.17%) and  crop harvesting and transporting (33.75%). majority (78.75%) of farm women took joint decision in purchase of household items, purchase of implements (73.66%) followed by selling of  crops and where to sell (72.42%), buying of clothes for family members (67.25%).

In the developed world one of the pillars of ethical conduct in surgical practise is informed surgical consent. In low income developing countries only a few researchers have explored the practise of surgical consent pre-operatively. During the informed consent process, the patient has a right to make an autonomous and independent decision about his/her surgical treatment after having been provided the necessary information by the surgeon caring for the patient. Patient autonomy and independent decision-making is recommended by the World Medical Association (WMA) Declaration of Lisbon. Family and cultural background, education, religion and socioeconomic status may all influence informed consent in surgical practise. In East Africa, few studies have reviewed consent practises among surgeons to document best surgical practise and identify areas that need improvement in the East African setting. This review reports the author’s personal experience of the practise of surgical consent among surgeons in Uganda and reviews the specific challenges faced in East Africa. In Uganda, the administration and documentation of informed consent is still inadequate. Better medical ethics education and proper communication skills training in medical schools needs to be addressed. Refresher courses on medical ethics and communication skills may also be necessary for fully trained surgeons.

Abstract LGBTQ adults disproportionately experience dementia and are more likely to rely on informal social support to meet care needs in the community compared to cisgender, heterosexual peers. Culturally responsive interventions will accommodate the unique strengths and independence of this population and support self-determination as they navigate reduced capacity for self-care, increased need for support, and changes to autonomous, independent decision-making. Motivational Interviewing (MI) is a culturally responsive approach to treatment, amenable to integration with other evidence-based practices (EBP), and is especially relevant for the LGBTQ community for its compatibility with self-determination theory. This paper describes the unique contributions of MI that resulted in culturally relevant adaptations to a leading EBP for dementia and culminated in an efficacious intervention (Aging with Pride: IDEA) that is compatible with self-determination theory, designed for individuals and care providers in the LGBTQ community affected by dementia, and adapted for online delivery during the COVID pandemic.

The article analyzes the specific features of motivation of sport activity as a certain type of labor activity and studies the peculiarities of psychological factors that influence the type of motivation, the level of its manifestation and the duration of its preservation. The basic features of the judoist athlete's personality motivation, in particular the motivation for success and fear of failure, communicative and organizational inclinations, locus of control, internalizing, directivity, indicators of terminal and instrumental values are considered. Experimental work allowed to reveal connection of various forms of behavior and personality parameters with externality-internality. Conformal and compliant behavior is more peculiar to judoists with an externalistic locus. Internals, in contrast to externals, are less likely to submit to pressure from others, to resist when they feel manipulated, and they react more strongly than externals to the loss of personal freedom. Athletes from internalizing loci of control perform better at the independent level than they do under supervision or videotaping. The opposite is true for externals. Internals and externals differ in the way they interpret various social situations, particularly in the way they receive information and in their causal explanation mechanisms. Internals are more active in seeking information and are usually more aware of the situation than externals. Internals attribute more responsibility to the individuals involved in the same situation. Internals are more likely to avoid situational explanations of behavior than externals. According to the results of the study, the motives that determine attitudes toward actual circumstances are of the greatest interest. Almost all athletes are dissatisfied with the level of material provision, solution of domestic issues. Among the measures to increase the level of sports motivation the majority names the proper use of means of material and moral encouragement, improving the organization of work, the possibility of discussion and independent decision-making on their use.

The article is intended as a step forward from considering only the noble objectives and positive effects associated with the authorities’ bank recovery and resolution powers, for revealing also the inherent effects of these powers on the possibility of banks fighting back against the powers’ unlawful application. Specifically, while the Bank Recovery and Resolution Directive (BRRD) sets out the general rule that, under its regime, a bank should have the right to appeal against authorities’ actions, some of the measures established under the BRRD have a natural effect of greatly diminishing bank managers’ motivation to appeal or even completely eliminate any independent decision-making capabilities. This includes choices of whether to file an appeal. This article shows that the properties or outcomes connected with some recovery and resolution measures specified in the BRRD reduce banks’ right of appeal to a fiction and may leave possibilities for uncontrolled unlawful application of powers by the supervisory and resolution authorities.

The article considers the use of innovative methods in English lessons on the example of personality-oriented method. The tasks of modernization of education cannot be solved without the optimal introduction of modern educational technologies in all its spheres. The use of innovative methods gives impetus to the development of new forms and content of traditional activities of students, which leads to their implementation at a higher level. Work with the use of such methods should be organized in such a way that from the very beginning it becomes a powerful psychological and pedagogical means of forming a motivational plan for students, a means of supporting and further developing their interest in the subject. It is emphasized that properly organized work of students with the use of innovations can promote in particular the growth of their cognitive and communicative interest, which in turn will enhance and expand opportunities for independent work of students to master a foreign language, both in class and after school. It is emphasized that the use of innovative forms of learning in contrast to traditional methods gives the student a major role in the acquisition of knowledge, in which the teacher is an active assistant, organizes, directs and stimulates learning activities. In his work, the teacher must not only solve educational problems, but also create conditions for students to independently creatively search, encourage them to research, develop skills of orientation in a huge information space and independent decision-making. And as a necessary condition in solving the tasks is the introduction of innovative technologies in the educational process. The constantly evolving system of information support in combination with technical support ensures the quality of the educational process. Innovative methods have become an integral part of the process of teaching and learning English. They help students to acquire the necessary skills for free use of English in a short time, namely: listening, reading, writing and communication skills. Given the importance of innovative methods, it should be noted that the central place in the teaching process is the personality of the teacher, who selects, evaluates and implements new methods. Thus, innovative methods help the teacher to solve a large number of organizational issues, to make the lesson more interesting, but innovation cannot completely replace the teacher. An analysis of other innovative trends in the teaching of English may be a prospect for further research. Key words: educational process, innovation, method, knowledge, project.
