This chapter examines the transformations in the status and character of Scottish Episcopalianism from 1662 to 1829. Despite being re-established in the Church of Scotland in 1661–2, episcopacy was abolished in 1689. Thereafter Episcopalians were a Nonconformist group, and only the minority of congregations whose clergy were loyal to Queen Anne and her Hanoverian successors enjoyed legal protection. But while the intermittent prosecution of the Jacobite clergy contributed to a steep decline in the number of Scottish Episcopalians, disestablishment allowed the clergy to reassess episcopal authority, and to experiment with liturgical reforms. After transferring their allegiance to the Hanoverians in 1788, the Episcopalians drew closer to the Church of England, formally adopting the Thirty-Nine Articles in 1804. By the end of the period, the Episcopalians saw themselves as an independent, non-established Church, one of the branches of international Anglicanism.

This study discusses legal protection for banks with the status of BPS BPIH in curbing haj bailout financing that has passed the provisions of the Indonesian Ministry of Religion, in Article 12A paragraph (3) of the Regulation of the Minister of Religion Number 24 of 2016 which formulates “In the event that there are still haj bailout funds has not been resolved after the deadline as referred to in paragraph (2) the portion number for Pilgrims is still active ”. This study uses a normative juridical method with a statutory approach and a conceptual approach. The result is legal protection for BPS BPIH in obtaining its right to obtain certainty of repayment of funds for financing the status of the portion of the hajj is still active as regulated in Article 12A paragraph (3) of the Regulation of the Minister of Religion Number 24 of 2016. The formulation of the settlement of haj bailout financing through the fulfillment of formal requirements the formation of legislation by involving the financial services authority in the company, and the material requirements, namely by accommodating the rights of all stakeholders of haj bailout financing.

During the covid-19 pandemic that occurred in Indonesia, which affected the economic sector, there were many layoffs by employers, except in Banturung Village, Bukit Batu District, Palangka Raya City. In Law Number 13 of 2003 concerning Manpower, it is explained about the rights and obligations of a worker in carrying out his work, in which the Act serves to protect and limit the status of the rights and obligations of workers from employers (entrepreneurs) in accordance with human dignity in the scope of work. In the conditions of the Covid-19 pandemic, both employers and workers are disadvantaged, because the weak economy makes people's purchasing power decrease and employers cannot rotate their business capital and take steps to unilaterally terminate employment relations. In Law Number 13 of 2003 concerning Employment, workers who experience termination of employment must be given severance pay.

The paper analyzes the status of bodies and officials of the prosecutor’s office as subjects of protection and subjects of violation of the constitutional right of citizens of Russia to petition as bodies exercising public power, whereas the very norm-principle of the basic Russian law on the right of citizens to petition is considered both as a constitutional right and as a constitutional safeguard. The author identifies the main practical problems, legal gaps and conflicts of law when citizens implement their constitutional right to petition and their reasons. The author proposes options for their elimination at the law-making and law-enforcement levels. It is noted that article 5.59 of the Code of the Russian Federation on Administrative Offences from 2011 providing administrative liability for violation of established procedure of consideration of citizens’ petitions, despite being a very effective instrument for the legal protection of the right under consideration, needs to be adjusted because its discretionary part contains only general language and does not reveal the objective side of this administrative offence. At the same time, prosecutor’s offices have long developed a certain practice concerning the application of Art. 5.59 of the Administrative Code of the Russian Federation as a means of public and legal protection of the violated right of citizens to petition. However, what should be done if the right of citizens to petition is violated by the prosecutors themselves with their special status as subjects of the offense, whereas it is the exclusive competence of prosecutors by operation of law to initiate cases under Art. 5.59 of the Administrative Code of the Russian Federation? The paper is devoted to the search for the answer to this question.

The article deals with sociolinguistic analysis of modern official female onomasticon of Ukraine. Its dynamics reflects processes, which are taking place in language system, and changes in society, social demographic and ethnic pattern, cultural markers and values, even the extent of legal regulation of social relations. Sociologists are interested in personal names as a means of social categorization and differentiation of individuals. Legists see them as a tool for one’s legalization and as an object of legal protection. Anthropologists study them as special units of communication and interaction between generations. For linguists they are a specific typexplore them linguists – ists of means of lexical nomination. Linguistically onomasticon is a valuable source of information on the current state of language norms, level of linguistic culture of the population, and the status correlation between languages in society. According to the date of the Ministry of Justice of Ukraine, the repertoire of newborn girls’ names in 2015–2019 exceeded half a thousand units. It’s due to the magnitude of globalization processes in naming, restoration of national naming traditions, rising social freedom in choosing names, and, sometimes, the decay of sense of responsibility in naming and insufficient language culture. About third part of female names appears as phonetic, orthographic and morphological variants. Ukraine is a multinational state and representatives of other nationalities and national minorities maintain their own naming traditions. Ukrainian spelling of these names in documents often is inconsequent. Often variants arise due to the ambiguity of transliteration, Ukrainian-Russian language interference and violation of Ukrainian spelling standard. Much less it is a result of alive alternation in the Ukrainian language. Rows of variants of the same official female name consist from two to five or six units. Among them there are normative and anomalous variants. In first case main and optional variants can be distinguished. Optional variants are not conventional in language practice but they do not violate the essential features of national language system (over time, some of them may become more popular than the main variant). Linguistically such variants are the same unit, the natural manifestation of potentialities of language system. But legally, person’s name can’t be spelled differently in her documents.

Abstract               Blocking of a book of certified land begins with a legal relationship between two or more parties involving the certificate as the object of the dispute. Losses experienced by one party in the process of buying and selling led to the application of blocking the book of land certificate to the office. The significance of this writing is to know and analyze the status of the Deed of Sale and Purchase Agreement in the process of blocking the land book by the buyer in the land office and the form of legal protection provided by the land office to the injured party due to buyer blocking based on the Deed of Sale and Purchase Agreement. The result of this research is the position of the sale and purchase binding agreement in the process of blocking the land book conducted by the buyer in the land office only as evidence of actual delivery and juridical delivery between the seller and buyer on the object of sale and purchase, not as an administrative requirement blocking at the land office. The Land Affairs Office provides legal protection by implementing the provisions of Article 125 and Article 126 of the Regulation of the Minister of Agrarian Affairs / Head of the National Land Agency Number 3 of 1997 by limiting the party who wishes to file a blocking request to the land office is a party with a strong legal basis to file the request for blocking in an effort defend that right so that it will not harm the other party. AbstrakPemblokiran buku tanah sertipikat diawali oleh suatu hubungan hukum antara dua pihak atau lebih yang melibatkan sertipikat sebagai obyek sengketa.Kerugian yang dialami oleh salah satu pihak dalam proses jual beli memunculkan adanya permohonan pemblokiran buku tanah sertipikat ke kantor. Arti penting dari penulisan ini adalah untuk mengetahui dan menganalisis kedudukan Akta Perjanjian Pengikatan Jual Beli dalam proses pemblokiran buku tanah yang dilakukan pembeli pada kantor pertanahan dan  bentuk perlindungan hukum yang diberikan kantor pertanahan kepada pihak yang dirugikan karena pemblokiran oleh pembeli berdasarkan Akta Perjanjian Pengikatan Jual Beli. Hasil dari penelitian ini adalah kedudukan akta perjanjian pengikatan jual beli dalam proses pemblokiran buku tanah yang dilakukan oleh pihak pembeli pada kantor pertanahan hanya sebagai alat bukti telah terjadinya penyerahan secara nyata dan penyerahan yuridis antara penjual dan pembeli atas objek jual beli, bukan sebagai persyaratan administratif permohonan pemblokiran pada kantor pertanahan. Kantor pertanahan memberikan perlindungan hukum dengan melaksanakan ketentuan Pasal 125 dan Pasal 126 Peraturan Menteri Agraria/Kepala Badan Pertanahan Nasional Nomor 3 Tahun 1997 dengan membatasi pihak yang ingin mengajukan permohonan blokir ke kantor pertanahan adalah pihak yang memiliki dasar hukum yang kuat untuk mengajukan permohonan blokir dalam upaya mempertahankan haknya tersebut sehingga tidak akan merugikan pihak lain.

The formation of the 1974 Marriage Law is based on Islamic Law, which became a problem when the Constitutional Court gave a decision on the judicial review of the Marriage Law with a decision that was considered by the public that the decision was against Islamic law. The research problem in this article is, How is the Politics of Law in the Reform of Legislation in the Post-Constitutional Court Ruling on Marriage related to the status of children outside of marriage? Does the Constitutional Court Decision No 46 / PUU-VII / 2010 contradict Islamic law?The research approach used in this research is normative juridical. The results of the study indicate that children who are born must receive legal protection. If this is not the case, then the children who are born outside of marriage will suffer losses. The relationship between the child and the father does not only occur because of a legal marriage, but can also be based on evidence of a blood relationship between the child and the boy as the father. This is because birth is a legal result of a legal relationship in which there are reciprocal rights and obligations between the child, mother and father. This decision refers, because there is a relationship that is carried out without any legal conditions for marriage, both religiously and in a state, so that it does not cause harm which implies a child who has not done anything wrong. In conclusion, the Constitutional Court granted the renewal of the norm in article 43 of the Marriage Law No. 1 of 1974, which is to provide constitutional rights for children born out of wedlock whether born from a legally valid marriage or not. The decision of the Constitutional Court related to the addition of article 43 paragraph (1) of this marriage law is still in the spirit of Islam as the struggle of Muslims to be able to apply their religious values in this law is not only legally religiously or nationally. Abstrak Pembentukan Undang-Undang (UU) Perkawinan Tahun 1974 berdasarkan Hukum Islam, menjadi permasalahan saat Mahkamah Konstitusi (MK) memutuskan judicial review atas UU perkawinan, bagi masyarakat bertentangan dengan hukum Islam. Permasalahan penelitian ini,  Bagaimana Politik Hukum dalam Pembaharuan Peraturan Perundang-Undangan dalam UU Perkawinan Pasca Putusan MK terkait dengan status anak diluar nikah? Apakah Putusan MK No 46/PUU-VII/2010 bertentangan dengan hukum Islam? Pendekatan penelitian ini yuridis normatif. Hasil penelitian menguraikan, anak yang lahir harus mendapat perlindungan hukum. Jika tidak, yang dirugikan adalah anak yang dilahirkan diluar perkawinan. hubungan anak dengan bapak tidak semata-mata terjadi karena adanya sebuah perkawinan yang sah, tapi berdasar pembuktian adanya hubungan darah antara anak dan laki-laki sebagai bapak. Hal ini karena kelahiran adalah akibat hukum dari hubungan hukum yang terdapat hak dan kewajiban secara timbal balik. Putusan ini mengacu, sebab adanya hubungan yang dilakukan tanpa adanya syarat pernikahan yang sah, baik secara agamadan negara, sehingga tidak menimbulkan kerugian yang berimplikasi pada anak yang tidak melakukan kesalahan. Pembaharuan norma dalam pasal 43 UU  Perkawinan No. 1 Tahun 1974, memberikan hak konstitusional  anak yang dilahirkan di luar nikah baik yang lahir dari pernikahan yang sah secara agama atau tidak. Putusan MK terkait penambahan pasal 43 ayat (1) UU perkawinan masih bernafaskan Islam sesuai perjuangan ummat Islam untuk dapat menjalankan nilai-nilai agamanya dalam UU ini hannya tidak sah secara agama  dan Negara.

<em>This article describes and examines whether the tort victim can profit from the proceeds of the tortfeasor’s liability insurance. This article aims to reflect on which approach, either in common or civil law, provides more access for the tort victim to profits from the proceeds of insolvent tortfeasor’s liability insurance policy. The method used in this research is comparative research. The result of this research showed that the status of insurance proceeds becomes debatable because the tort victim (as the claimant) will have no better rights than any other unsecured creditors during insolvency proceedings. This is regardless of the fact that the tortfeasor already got a fund, albeit indirectly through the insurer, to compensate the tort victim’s losses. In relation to this issue, the United Kingdom has adopted the Third Parties (Rights against Insurers) Act 2010 which gives right for tort victim to directly claim for compensation against tortfeasor’s liability insurer in the event of tortfeasor’s insolvency. Meanwhile, the Indonesian legal system provides no clear legal protection to the tort victim. Thus, in the event of insolvency, the tort victim cannot obtain compensation from the insurer, but only from tortfeasor’s bankruptcy estate as part of creditors’ debts. Furthermore, as an unsecured creditor, the tort victim will obtain the debtor’s bankruptcy estate after all secured creditors have received their payment.</em>

ABSTRAKAnak yang telah mumayiz diberikan kebebasan memilih tinggal bersama ibu atau ayahnya. Kesempatan untuk memilih harus dinyatakan secara eksplisit dalam putusan untuk menghindari konflik di kemudian hari antara kedua orang tuanya. Berbeda dalam Putusan Nomor 175/PDT.G/2011/MS-BNA yang tidak langsung menetapkan anak yang telah mumayiz diasuh oleh ibu atau ayahnya. Hal ini dikhawatirkan akan menimbulkan persoalan hukum di kemudian hari demi memperebutkan anak tersebut. Permasalahannya adalah bagaimana aspek kepastian hukum terhadap pemeliharaan anak mumayiz dalam Putusan Nomor 175/PDT.G/2011/MS-BNA, dan bagaimana perlindungan hukum bagi anak mumayiz yang belum menentukan pilihannya? Penelitian ini termasuk penelitian empiris dan datanya diperoleh melalui wawancara hakim dan putusan Mahkamah Syar’iyah Banda Aceh. Hasil penelitian menunjukkan bahwa Putusan Nomor 175/PDT.G/2011/MS-BNA tidak mencerminkan kepastian hukum bagi anak yang telah mumayiz. Hal ini dikarenakan anak yang berumur 14 dan 18 tahun tidak jelas berada di bawah pengasuhan ibu atau ayahnya. Perlindungan hukum bagi anak mumayiz yang belum menentukan sikap/pilihan menjadi kewajiban bersama kedua orang tua untuk mengasuh dan memeliharanya. Jika anak sudah menentukan pilihan dan memilih ibu sebagai pengasuhnya, maka ia wajib memelihara dan mengasuhnya hingga dewasa dan ayah berkewajiban memberikan nafkah kepadanya. Sebaliknya, jika ayah menjadi pilihannya, kewajiban mengasuh, merawat, dan menafkahi menjadi kewajibannya.Kata kunci: kepastian hukum, pengasuhan, perceraian, anak mumayiz. ABSTRACTA Minor who has been mumayiz is given freedom to choose to live either with the mother or father. The decision should be explicitly stated in court decision to avoid future conflicts between the parents. In contrast, Court Decision Number 175/PDT.G/2011/MS-BNA did not in a straight line determine the status of a minor who has been mumayiz to be raised by either the mother or father. This could lead to legal dispute of fighting over the minor in the future. The question is how the legal certainty in the custody of minors with mumayyiz status in Court Decision Number 175/PDT.G/2011/MS-BNA and how the law provide protection for them who have not made their choice yet? This study is done by empirical research and the data collected through interviews of judges and the ruling of Syar’iyah Court of Banda Aceh. The results show that the Court Decision Number 175/ PDT.G/2011/MS-BNA does not reflect legal certainty for the minors with the status of mumayiz. This is because the law does not set off that minors aged of 14 and 18 are in care of their mother or father. While the law has set for minors who have not mumayiz because of the existence of parenting to the mother has been confirmed in the verdict. Legal protection for undecided custody of mumayiz minors will be obliged to their both parents to nurture and raise. If the child has made a choice and chooses the mother as the caregiver, then she is obliged to care and nurture the child to adulthood, and the father is obliged to provide a livelihood for the child. On the other hand, if the father becomes the child’s choice, the obligation to care, nurture, and provide a livelihood becomes his duty.Keywords: legal certainty, custody, divorce, mumayiz minors.

Marginalization of women in marriage is an issue that always invites debate among Islamic law thinkers, given the ever-changing social conditions of society so that the laws and regulations governing marital problems underwent the first amendment in 2019. This paper focuses on how the position of women in unregistered marriages and child marriages in Islamic law perspective. With a normative approach and legal sociology, this paper confirms a conclusion that the position of women in unregistered marriages and child marriages is very vulnerable to obtaining legal certainty and justice. Even though it is said that child marriage in under age, the original law is permissible according to Islamic law, but it does not mean that it is absolutely permissible for all women in all circumstances. Because in some women there are several conditions that indicate that it is better for her not to marry at an early age. Likewise, unregistered marriages are legally valid according to Islamic law because they have fulfilled the requirements and pillars of marriage, but have not received recognition from the state which results in legal uncertainty for the status of marriage and children born from the marriage. Therefore, Indonesia as a state of law, regulates matters relating to this matter. Namely by requiring the registring of every marriage held and amending the articles of legislation governing the provisions of the age of marriage in order to ensure legal protection and benefit for the parties bound in a marriage bond, especially for wives and children born from marriages. Abstrak Marginalisasi perempuan dalam perkawinan merupakan isu yang selalu mengundang perdebatan di kalangan pemikir hukum Islam, mengingat kondisi sosial masyarakat yang selalu berubah sehingga peraturan perundang-undangan yang mengatur masalah perkawinan mengalami amandemen pertama pada tahun 2019.  Tulisan ini fokus pada bagaimana kedudukan perempuan dalam nikah sirri dan nikah anak di bawah usia dalam perspektif hukum Islam. Dengan pendekatan normativitas dan sosiologi hukum tulisan ini menegaskan suatu kesimpulan bahwa kedudukan perempuan dalam perkawinan sirri dan perkawinan anak di bawah usia sangatlah rentan untuk memperoleh kepastian dan keadilan hukum. Sekalipun dikatakan bahwa perkawinan anak di bawah usia, hukum asalnya diperbolehkan menurut syariat Islam, tetapi tidak berarti ia di bolehkan secara mutlak bagi semua perempuan dalam semua keadaan. Sebab pada sebagian perempuan terdapat beberapa kondisi yang menunjukkan bahwa lebih baik ia tidak menikah pada usia dini. Begitupun dengan nikah sirri yang hukumnya sah menurut syariat Islam karena telah memenuhi syarat-syarat dan rukun nikah, akan tetapi tidak memperoleh pengakuan dari negara yang mengakibatkan ketidakpastian hukum bagi status perkawinan dan anak yang lahir dari perkawinan tersebut. Oleh karenanya Indonesia sebagai negara hukum, mengatur hal-hal yang berkaitan dengan hal ini. Yaitu dengan mengharuskan pencatatan terhadap setiap perkawinan yang diselenggarakan serta mengamandemen pasal-pasal peraturan perundang-undangan yang mengatur tentang ketentuan umur perkawinan guna menjamin perlindungan hukum dan kemaslahatan bagi pihak-pihak yang terikat dalam suatu ikatan perkawinan, khususnya bagi istri dan anak yang lahir dari perkawinan tersebut.
