This study discusses legal protection for banks with the status of BPS BPIH in curbing haj bailout financing that has passed the provisions of the Indonesian Ministry of Religion, in Article 12A paragraph (3) of the Regulation of the Minister of Religion Number 24 of 2016 which formulates “In the event that there are still haj bailout funds has not been resolved after the deadline as referred to in paragraph (2) the portion number for Pilgrims is still active ”. This study uses a normative juridical method with a statutory approach and a conceptual approach. The result is legal protection for BPS BPIH in obtaining its right to obtain certainty of repayment of funds for financing the status of the portion of the hajj is still active as regulated in Article 12A paragraph (3) of the Regulation of the Minister of Religion Number 24 of 2016. The formulation of the settlement of haj bailout financing through the fulfillment of formal requirements the formation of legislation by involving the financial services authority in the company, and the material requirements, namely by accommodating the rights of all stakeholders of haj bailout financing.

In the era of digital economic development, the community continues to innovate in terms of providing lending and borrowing services. One form of development of Financial Technology (fintech) is the distribution of funds through the Peer to Peer (P2P) Lending system. Where this system has more or less the same role as banks, namely as an organizer; from parties who have funds (investors) to those who need funds (debtors) whose methods are carried out online. The distribution of funds through the P2P Lending system has developed rapidly in Indonesia. In carrying out its business, the loan and loan service provider uses an electronic system that is a series of electronic devices and procedures that function to disseminate information in the field of financial services. The electronic system can also be referred to as Artificial Intelligence (AI). By using AI, loan and loan service providers can find out all the debtor's personal data, where in the end the debtor becomes disadvantaged because his personal rights are violated. On the other hand there are no legal provisions in Indonesia that can protect debtors in this regard. So that in this study later will discuss about the extent of legal arrangements related to the protection of debtors in the P2P Lending system using AI. This research uses the statute approach method; namely the approach through legislation and conceptual approach, namely the legal approach through the concepts and opinions of legal experts.

Deposit type most often used by Islamic Bank in collecting funds from the public is revshare system (mudharabah) where the customer is acting as an investor and profit from business carried on by the bank. But in practice mudharabah can also loss caused by managers (Banks) in running the business. The problem in this research is how the legal protection of depositors with mudharabah in Islamic banks. With normative juridical research method and approach to literature. Results of the study stated that the legal protection of depositors in Islamic banking are protected by rules that are already fairly well from the Financial Services Authority and the Institute of deposit insurance, even the rules better than  protection applied to customers of conventional banks. LPS in Regulation 2 of 2010 Article 44 stated that the interest rate is considered reasonable set LPS does not apply in determining the status of the deposit guarantee to deposits based on Islamic principles because Islamic Bank using revshare principle in operation.

The implementation of a will for the object of inheritance in the form of shares in a limited company of domestic investment aimed at foreign nationals as recipients of a will until now has not been regulated in the Laws and Regulations in force in Indonesia. The author in this study wants to examine and analyze further about the validity of a will addressed to foreign nationals and legal protection for foreign nationals who obtain an inheritance in the form of shares from a will. The research method used is normative legal research, namely legal research carried out by examining library materials or secondary legal materials while the problem approach is carried out using a law approach and conceptual approach. The results of the study indicate that making a will is not limited to the citizenship of a person, either an Indonesian citizen or a foreign national. A will addressed to a foreign national must be made in the form of an open will (open bar testament) made before a Notary who is domiciled in the country where the object of inheritance is located. Legal protection for the transfer of shares due to inheritance to foreign citizens is to change the status of the company into a foreign investment limited liability company in accordance with the provisions in Indonesia.

Today there are still many problems with the existence and traditional rights of indigenous and tribal peoples. These problems tend to place the indigenous and tribal peoples in a weak and marginalized position. Not without reason, it is due to the unequal perception of all related parties, in positioning customary land and indigenious peoples in the context of national and state life based on Pancasila and the Constitution. The issue that will be discussed in this paper is about how to realize progressive legal protection of the existence of indigenous and tribal peoples to realize their welfare. This paper will use the conceptual approach method, namely the Pancasila concept as a source of ideas in providing legal protection to indigenous and tribal peoples. Furthermore, it also uses a conceptual approach from thought of progressive law. The existence of the status quo in providing legal protection to indigenous and tribal peoples which tends to be static, conditional and legalistic which has been done so far. Legal protection is more concerned with how the criteria regarding indigenous and tribal peoples will be recognized. The state should have dared to make policy and legal breakthroughs to provide legal protection based on guidance and empowerment. These policy and legal breakthroughs can refer to thougt of progressive law, which positions the law for humans with the aim of providing justice, welfare and happiness for indigenous and tribal peoples based on Pancasila and the Constitution.

The rise of fraud cases and investment offers that are suspected to be illegal have resulted in losses for consumers and the public, so in this case legal protection is needed to minimize illegal investment cases. The purpose of this research is to analyze the role of the financial services authority in anticipating illegal investment activities carried out by investors and a legal protection for consumers by the financial services authorities against illegal investment activities carried out by investors. This research is a normative juridical research with a statutory approach and a conceptual approach. The technique of collecting legal materials used is the recording technique. The legal materials used are primary and secondary legal materials. After the data is collected then the data is analyzed systematically. The results of the research reveal that in the context of legal protection, the Financial Services Authority is given the authority by the State to take steps to prevent consumer and public losses. Efforts are made based on Article 28 of Law No. 21 of 2011 concerning the Financial Services Authority by conducting outreach and education to the public regarding the characteristics of fundraising activities and managing illegal investments and asking the Financial Services Institutions to stop their activities if these activities have the potential to harm the community. The handling carried out by the Financial Services Authority cannot be separated from the support of the public who have submitted reports or complaints.

In providing services to the community there are two important things, namely the making of authentic deeds including the PPJB deed relating to the trade of state land, and providing legal counseling to the public. Legal consouling by Notary must be did for and for legal actions did by notaries at the request of their clients. In the case of taking legal action for his client, the notary may also not side with his client, Notary must be neutral, because the task of the notary is to prevent the occurrence of problems. This normative juridical research uses a statute approach and conceptual approach. This research is limited to the discussion forms of legal protection the object buyers of State land through the Deed Agreement of Trade Binding (PPJB) which is not given legal counseling by Notaries, and Notary responsibilities in connection with the PPJB Deed with the object of state land before a Notary are not preceded by legal counseling of parties in relation to land status. The results from this study explain that in the PPJB deed there is a legal relationship between the legal subject and objects which creates the rights and obligations that also need to get legal protection. Forms of legal protection against buyers of State land object through the Deed Agreement of Trade Binding (PPJB) made by a  Notary that trade object is state land and cannot be traded with the status of property rights is by Submit a claim for cancellation of the deed and Submit a claim for compensation to both the seller and the Notary. The notary is responsible in connection with the Deed Agreement of Trade Binding (PPJB) with the object of state land made before a Notary whose services are not preceded by legal counseling because there is a legal relationship between the Notary with the respondent, but not contractual relations.

<p><em>Financial technology is the implementation of the use of technology to improve banking and financial services. The emergence of Fintech-based companies, especially those offering lending and borrowing services or Peer To Peer Lending (P2PL) is currently getting the attention of the public and regulators. P2PL-based fintech services are one of the solutions for limited access to financial services in the country and realizing financial inclusion through synergies with financial institutions and technology companies. With the development of fintech peer to peer lending, illegal fintech problems arise which are detrimental to society, so it is necessary to study the legal protection of the regulations that govern it, and how to resolve disputes against it This research is normative by examining legal issues regarding legal protection for consumers and fintech peer to peer lending services and dispute resolution in the fintech business. The research method used includes a statue approach and a conceptual approach.</em></p><p><strong><em>Keywords : </em></strong><em>Legal Protection, Financial Technology Peer to Peer Lending.</em></p><p> </p><p><em>Financial technology </em>merupakan implementasi dari pemanfaatan teknologi untuk peningkatan layanan jasa perbankan dan keuangan. Kemunculan perusahaan-perusahaan berbasis <em>Fintech </em>terutama yang menawarkan layanan pinjam meminjam uang atau <em>Peer To Peer Lending </em>(P2PL) saat ini semakin mendapatkan perhatian publik dan regulator. Layanan <em>fintech </em>berbasis <em>P2PL </em>menjadi salah satu solusi terbatasnya akses layanan keuangan di tanah air dan mewujudkan iklusi keuangan melalui sinerginya dengan istitusi-institusi keuangan dan perusahaan-perusahaan teknologi. Semakin berkembangnya <em>fintech peer to peer lending </em>timbul permasalahan <em>fintech </em>illegal yang banyak merugikan masyarakat, maka itu perlu dilakukan kajian perlindungan hukum terhadap regulasi yang mengaturnya, serta bagaimana penyelesaian sengketa terhadapnya. Penelitian ini bersifat normatif dengan mengkaji isu hukum tentang perlindungan hukum terhadap konsumen dan layanan <em>fintech peer to peer lending</em> dan penyelesaian sengketa pada bisnis <em>fintech.</em> Metode penelitian yang digunakan meliputi pendekatan undang-undang <em>(statue approach)</em> dan pendekatan konseptual <em>(conceptual approach). </em></p><strong>Kata Kunci : </strong>Perlindungan hukum, <em>financial technology peer to peer lending.</em>

The readiness of the community in the era of information technology has opened up opportunities in online businesses such as equity crowdfunding, equity crowdfunding as an alternative capital is increasingly in demand, especially by novice businesses. The Financial Services Authority issues regulations regarding the Equity Crowdfunding transaction model by issuing the Financial Services Authority Regulation Number 37 / POJK.04 / 2018. This provides questions for the regulation of Equity Crowdfunding in Indonesian Capital Market Law. The writer in this study would like to examine and analyze the Equity Crowdfunding activities and legal protection for investors, because legal protection is a form of legal certainty. The research method used is a normative juridical types, the problem approach uses the legislation approach and the conceptual approach. The results show that equity crowd funding is a form of new innovation in funding sources. The service mechanism has many similarities with public offering activities in the capital market, only the implementation is simpler. Equity Crowdfunding legal protection for investors who have been registered in the provisions of Chapter 54 paragraph (2) POJK Number 37 / POJK.04 / 2018, providing the latest information is only placed on the organizer's website or website.

In many societies, marriage customs, who married her partner of different nationality for example a man citizen of Indonesia who married women foreign nationals or otherwise. It is caused due to the influence of globalization today. Of course, the marriage will having problems in the determination of citizenship status if they have children, especially if they settled in Indonesia. This research intended to find answers about the determination of the status of citizenship of children born of mixed marriages and the legal protection of children of mixed marriages that result. This research uses research methods through a conceptual approach to normative. The author uses primary law binding and also secondary legal material as a reference. The results of this research is the child of a mixed marriage deserve the status of dual citizenship is limited and is also entitled to preventive legal protection to guarantee the certainty of the law as a citizen of Indonesia. Dalam melangsungkan perkawinan, banyak masyarakat yang menikah dengan pasangannya yang berbeda kewarganegaraan misalnya seorang pria warga negara Indonesia yang menikah dengan wanita warga negara asing ataupun sebaliknya. Itu disebabkan karena pengaruh globalisasi saat ini. Tentu saja perkawinan tersebut akan menimbulkan masalah dalam penentuan status kewarganegaraan apabila pasangan tersebut memiliki anak, terutama apabila pasangan tersebut menetap di Indonesia. Penelitian ini dimaksudkan untuk menemukan jawaban tentang penentuan status kewarganegaraan anak yang lahir dari perkawinan campuran tersebut dan perlindungan hukum terhadap anak hasil perkawinan campuran terserbut. Penelitian ini menggunakan metode penelitian normatif melalui pendekatan konseptual. Penulis menggunakan bahan hukum primer yang bersifat mengikat dan juga bahan hukum sekunder sebagai referensi. Hasil penelitian ini adalah anak hasil perkawinan campuran berhak mendapatkan status kewarganegaraan ganda terbatas dan juga berhak mendapatkan perlindungan hukum preventif untuk menjamin kepastian hukumnya sebagai warga negara Indonesia.

This study aims to analyze the relevance of the �health emergency� status to the existing legal theory and condition as well as to identify the validity of the Circular Letter of the Rector of State Universities. To this end, this study applied the statute and conceptual approach. The study was conducted by inventorying primary and secondary legal materials to obtain a proper and critical review of the legal issues under study. The results showed that the determination of the �health emergency� status by the government was inappropriate due to the uncertainty of the regulations issued by the government to determine the current condition. Thus, the status of the COVID-19 pandemic is a �legal emergency� status. Further, the Rector�s policy through the Circular Letter is valid judicially, sociologically, and philosophically. The determination of the �legal emergency� status can be done by issuing a Perppu without a �state of emergency� from the President. Finally, it is suggested to firstly get an approval from the Ministry of Education and Culture regarding the issuance of the Rector�s Circular Letter. Besides, further study is needed as this study was conducted during the COVID-19 pandemic.�Keabsahan Surat Edaran Rektor Perguruan Tinggi dalam Pandemi Covid-19Tujuan dari penelitian ini adalah untuk menganalisa relevansi status �darurat kesehatan� dengan teori hukum dan kondisi yang ada dan keabsahan atas Surat Edaran Rektor Perguruan Tinggi Negeri. Metode yang digunakan dalam penelitian ini adalah statute approach dan conseptual approach. Penelitian dilakukan dengan menginventarisasi bahan hukum primer dan sekunder, guna mendapatkan kajian yang seyogianya dan telaah kritis terkait isu hukum. Hasil penelitian menyatakan penetapan status darurat kesehatan oleh pemerintah kurang tepat, dikarenakan tidak menentu-nya peraturan yang dikeluarkan oleh pemerintah untuk menetapkan kondisi saat ini. Sehingga, status pandemi COVID-19 merupakan status darurat hukum. Kebijakan rektor melalui Surat Edaran adalah absah secara aspek yuridis, sosiologis, dan filosofis. Penetapan darurat hukum cukup dilakukan dengan menerbitkan Perppu tanpa pernyataan darurat dari Presiden. Saran peneliti adalah di perlukan persetujuan pada Kementerian Pendidikan dan Kebudayaan terkait terbitnya Surat Edaran Rektor, dan dibutuhkan penelitian lebih lanjut dikarenakan penelitian ini dilakukan pada masa COVID-19 yang bersifat temporal.�
