A Conservative Critique of Blacksburg

This article presents a conservative rejoinder to the Blacksburg perspective inviting a more discursive elaboration on the overlaps between key conservative thinkers, such as those from Michael Oakeshott, and portions of the Blacksburg view, specifically from the works of John Rohr and Charles T. Goodsell. We posit a conservative perspective that would contest three points in the Refounding texts. The article concludes by elaborating on the generative role that a discussion between the Refounders and key conservatives plays in positing new avenues for administrative theory and addressing challenges to the discretionary power of civil servants in a constitutional democracy.

Dicey believed that discretionary power offended the Rule of Law as it would inevitably lead to arbitrary decisions. His critics pointed out that in the modern state discretion is necessary to carry out a variety of welfare and regulatory tasks. The Rule of Law contains four central features which cohere and overlap: legality, certainty, equality and access to justice and rights. These are not only formal values but also substantive. The Rule of Law is a principle of institutional morality inherent in any constitutional democracy. In a country without a written constitution it constrains the way power is exercised. It is enforced and elaborated through judicial review but also serves as a critical focus for public debate. Although the Rule of Law is not the only requirement of a constitutional democracy, it is of great practical significance in promoting fair decisions, restraining the abuse of power, encouraging investment, and in furthering empowerment and respect for equal human dignity.

The governance of public sector organizations has been challenged by the growing adoption and use of Artificial Intelligence (AI) systems and algorithms. Algorithmic transparency, conceptualized here using the dimensions of accessibility and explainability, fosters the appraisal of algorithms’ footprint in decisions of public agencies, and should include impacts on civil servants’ work. However, although discretion will not disappear, AI innovations might have a negative impact on how public employees support their decisions. This article is intended to answer the following research questions: RQ1. To what extent algorithms affect discretionary power of civil servants to make decisions?RQ2. How algorithmic transparency can impact discretionary power of civil servants? To do so, we analyze SALER, a case based on a set of algorithms focused on the prevention of irregularities in the Valencian regional administration (GVA), Spain, using a qualitative methodology supported on semi-structured interviews and documentary analysis. Among the results of the study, our empirical work suggests the existence of a series of factors that might be linked to the positive impacts of algorithms on the work and discretionary power of civil servants. Also, we identify different pathways for achieving algorithmic transparency, such as the involvement of civil servants in active development, or auditing processes being recognized by law, among others.

The study aims to analyze about the low graduation and certification exam training participants of the procurement of goods / services of the government and its contributing factors, and formulate a strategy of education and training and skills certification exams procurement of goods / services of the government. Collecting data using the method of study documentation, interviews, and questionnaires. Is the official source of information on the structural and functional Regional Employment Board, as well as the participants of the training and skills certification exams procurement of goods / services of the government in Magelang regency government environment. Analysis using 4 quadrant SWOT analysis, to determine the issue or strategic factors in improving the quality of education and training and skills certification exams procurement of government goods / services within the Government of Magelang regency. The results show organizer position is in quadrant I, which is supporting the growth strategy, with 3 alternative formulation strategies that improve the quality of education and training and skills certification exams procurement of government goods / services, and conducts certification examination of the procurement of government goods / services with computer assisted test system (CAT). Based on the research recommendations formulated advice to the organizing committee, namely: of prospective participants of the training and skills certification exams procurement of goods / services the government should consider the motivation of civil servants, is examinees who have attended training in the same period of the year, the need for simulation procurement of goods / services significantly, an additional allocation of training time, giving sanction to civil servants who have not passed the exam, the provision of adequate classroom space with the number of participants of each class are proportional, as well as explore the evaluation of education and training and skills certification exams procurement of goods / services for Government of participants.

This research is conducted in order to assess the effect of competency, motivation, and communication on employee’s performance (case studies at Dinas Pekerjaan Umum dan Penataan Ruang West Bandung Regency) partially and simultaneously. There are many factors that affect the employee’s performance, but this research is only limited to the factors of competency, motivation, and communication. The researcher used primary and secondary data. The research approach used is quantitative approach which the samples are 55 civil servants which is assessed by 5 Heads of Fields and 2 Heads Sub-Division. Before analyzing, all research validity and reliability instruments are examined. After the data are valid and reliable then analyzed by using classical assumption test, partial test (t test), and simultaneous test (F test) helping by IBM SPSS version 23 software. The result of analysis showed that competency, motivation, and communication variables are affected positively significantly and partially to the employee’s performance. Competency, motivation, and communication variables simultaneously affected positively and significantly about 54,3% and the rest is about 45,7% affected by other variable that is not observed in this research.

Education and Training is a form of institutional intervention so that employees have competency standards so that they are able to carry out their duties properly and appropriately. This study discusses the improvement of teacher competency in the implementation of scientific publications through Training in the Workplace (DDTK) Classroom Action Research (PTK). DDTK aims to improve the technical competence of civil servants and non-civil servants of the ministry of religion according to their duties and positions and develop insight into employee duties related to new regulations / policies / provisions, new technologies, or new knowledge relevant to their main tasks and functions. The main objective of Classroom Action Research (CAR) is the improvement and improvement of learning services. The population and sample of this study were participants of the Madrasah teacher training in the Workplace (DDTK) in Bangka, Belitung, and East Belitung Regencies in the 2016 and 2017. The study used multiple regression using Adjusted Square. Calculations for this multiple regression using SPSS statistical version 16 software. From the results of the research, it was found that the average of DDTK Bangka District Classroom Action Research (PTK) 2016 and 2017 were 51.41, and the average DDTK Class Action Research substance (PTK) Belitung Regency in 2016 and 2017 amounted to 50.39, with a difference in mean scores of 1.02. The average understanding of madrasah teachers in Bangka Regency 2016 and 2017 PTK writing was 118.20, and the average madrasah teacher understanding in Belitung Regency PTK writing in 2016 and 2017 was 118.88, with a mean difference of 0.68. The regression coefficient of the Education and Training Center (DDTK) variable (X2) has a positive sign (0.074), which means that the Education and Training Center (DDTK) variable has a positive influence on teacher understanding. The hypothesis which states that there is an effect of the Workplace Education Training (DDTK) substance on Classroom Action Research (CAR) on the understanding of madrasah teachers in writing PTK is statistically proven. Keywords: Training at Workplace, Classroom Action Research, Teacher's Understanding

A new constitutional democracy was established in Nigeria on 29 May 1999. This Fourth Republic was founded upon the Constitution of the Federal Republic of Nigeria 1999 (as amended) which unshackled the judiciary from the bondage of military decrees. This also brought excitement to the citizenry which finds expression in the belief that the judiciary, their last bastion of succour, is now poised to intervene in the inevitable tussle between might and the exercise of new democratic tenets. These tenets encompass the ideals of economic justice, political justice and social justice. 1 1 C. C. As developing programs is the core in fostering knowledge on ethnic work for cadres and civil servants under Decision No. 402/QD-TTg dated 14/3/2016 of the Prime Minister, it is urgent to build training program on ethnic minority affairs for 04 target groups in the political system from central to local by 2020 with a vision to 2030. The article highlighted basic issues of practical basis to design training program of ethnic minority affairs in the past years; suggested solutions to build the training programs in integration and globalization period.

Developing a ethnic knowledge training program for cadres, civil servants and public employees according to 04 target groups (Prime Minister, 2018) in the political system from the central to local levels to meet the requirements of ethnic minority affairs up to 2030 is an urgent task. Because the program is “the core” to create a breakthrough in training ethnic knowledge, improving the capacity of the contingent of cadres, civil servants and public employees in formulating ethnic policies and organizing the implementation of Party and State’s policies in the current period. The article analyzes the results of theoretical and practical research on the development of ethnic knowledge training program and provides the results of developing a program that meets the requirements of Vietnam’s ethnic minority affairs from now to 2030.
