The article deals with the problems of legal regulation of participation of basic departments in the system of network interaction of educational organizations. Regulatory and legal support of network interaction of educational organizations should be a part of a comprehensive regulatory framework governing the activities of participants in educational relations. The adoption of the law on education and the introduction of the concept of “network interaction” allowed educational organizations of higher education to create departments and other structural units. At the same time, the legislator does not defi ne the concept of “basic departments”. The lack of legislative defi nition of the concept of the basic department, determining its legal status, leads to many problems, which complicates the relationship between the participants of the educational environment in the system of network interaction.

Актуальность статьи обусловлена возрастанием напряженности и конфликтогености образовательной среды в сфере современного высшего образования. Цель статьи заключается в определении факторов, повышающих уровень конфликтогенности в высшем образовании, обусловленных ролями и интересами субъектов образовательной среды и образовательного процесса в высшей школе. Авторами классифицированы группы факторов, выявлены причины их активизации, влияние колебаний психологической напряженности на отношения между субъектами образовательной среды, возможности регулирования их негативного воздействия на процесс обучения. Раскрыта сущность их возникновения, заключающаяся в расхождении интересов и ожиданий субъектов. Показана значимость регулирования факторов конфликтогенности для эффективного, комфортного и бесконфликтного функционирования образовательной среды. Статья предназначена для работников системы образования, руководителей образовательных организаций, преподавателей, исследователей. The relevance of the article is due to the increasing tension and conflict potential of the educational environment in the field of modern higher education. The purpose of the article is to determine the factors that increase the level of conflictogenity in higher education, conditioned by the roles and interests of the subjects of the educational environment and the educational process in higher education. The authors classified groups of factors, identified the reasons for their activation, the influence of fluctuations in psychological tension on the relationship between the subjects of the educational environment, the possibility of regulating their negative impact on the learning process. The essence of their origin is revealed, which consists in the divergence of interests and expectations of subjects. The importance of regulating factors of conflictogenity for the effective, comfortable and conflict-free functioning of the educational environment is shown. The article is intended for employees of the education system, heads of educational organizations, teachers, researchers.

Improving the quality and efficiency of higher education is closely linked to the need for comprehensive security in an educational environment within which the vital processes of forming, developing and becoming a future professional are going on. Psychological violence, as a threat to the psychological security of the educational environment, is a pressing scientific problem that makes the research relevant. The purpose of the article is to analyse the problem of psychological violence as a destructive socio-psychological threat to the security of the educational environment and a complex obstacle in the process of modernisation and improvement of higher education. The objectives of the study were to analyse the basic principles of psychological security of the educational environment; to define the notion “psychological violence” and its signs manifested in the educational environment as well as the forms of its manifestations; to describe possible ways of preventing manifestations of psychological violence in the educational environment. The analysis of the scientific psychological and pedagogical literature made it possible to identify the main system components of the educational environment. It is established that the relationship between pedagogical and psychological conditions alongside influences are the concept of the system of the educational environment, whereas psychological violence is the main socio-psychological destruction of this system. The study emphasises that the consequences of psychological abuse extend to all levels of human functioning and contribute to the process of the deformation of personality; they reduce motivation to act and impede the realisation of person’s abilities, educational and professional skills. The authors have analysed the main types of psychological violence, including those ones which have emerged relatively recently and need further scientific study. The necessity to create a set of measures aimed at preventing psychological violence in the educational environment has been substantiated, the ways of solving this problem at the scientific and legislative levels have been outlined. The main methods of scientific development are as follows: analysis, synthesis, generalisation, as well as the systematic and descriptive methodological approaches.

The purpose of the article is to show the effectiveness of the imperative method of legal regulation of the economy on the example of the Ukrainian SSR. Method. The research methodology is based on the application of a systematic approach, which allowed to consider economic and legal phenomena in their relationship. The following methods of scientific cognition were used in the research: the dialectical method, which made it possible to study the relationship between state and legal phenomena and economic processes; study of the legal status of participants in economic relations of the USSR during the perestroika required the use of a historical method, which made it possible to trace the evolution of the legislation of the USSR on the regulation of economic processes. Using the dogmatic method, the legislation of the studied period is analyzed. The hermeneutic method was used in the interpretation of certain economic concepts from the standpoint of law. Results. In the course of the research the principles of the imperative method of legal regulation for overcoming the deficit are analyzed, namely: laws, orders, directives, prescriptions, instructions. Scientific novelty. On the basis of the analysis of legislative acts of the Ukrainian SSR the problems of economic development of the state are revealed, their reasons and ways of overcoming are analyzed. It was found that the key role was given to administrative methods of economic regulation with an emphasis on the imperative method of legal regulation. The inefficiency of this method is shown, which was expressed in numerous offenses and the development of the "shadow economy". Practical significance. Conclusions and theoretical generalizations can be valuable to avoid negative trends in the economic (deficit, speculation, shadow economy) and legal spheres (absolutization of one method of legal regulation) at the present stage of development of the Ukrainian state.

This study aims to find out the relationship between the use of SNSs and educational adaptation process of Chinese international students (from China) in New Zealand. Based on interview data, this paper addressed how Chinese international students use SNSs (RenRen, Facebook, etc.) to expand and manage their online social networks to help their adaptation to new educational environment. As a case study of Chinese international students in New Zealand and from the narrative of students, we examined the relationship among educational difficulties, life satisfaction, and the use of SNSs. This study would help in further understanding how and why SNSs can be adopted in higher education to support effective overseas learning experiences.

Статья посвящена проблеме психологической безопасности образовательного пространства высшей школы, в частности, – исследованию удовлетворенности образовательной средой студентов гуманитарных специальностей. Актуальность темы обусловлена необходимостью проектирования условий, способствующих сохранению психического и психологического здоровья молодежи. Целью нашего исследования являлся анализ психологического описания характеристик в образовательном пространстве высшей школы, значимых с точки зрения психологической безопасности обучающихся. В данном исследовании изучены взаимосвязи характеристик образовательной среды (позитивные переживания интереса, радости, удовлетворенности, и выраженности негативных эмоций страха, гнева и обиды) с уровнем депрессивности студентов. В статье анализируются результаты студентов высших учебных заведений гуманитарного профиля Республики Татарстан (выборка 7383 студента). В ходе исследования методом анкетирования изучались параметры образовательной среды, влияющие на психологическую безопасность личности – эмоциональное отношение к обучению и удовлетворенность образовательной средой. Данное исследование предназначено для педагогов психологов, преподавателей и заинтересованных лиц в развитии психологически безопасного образовательного пространства высшей школы. Материалы исследования могут быть использованы при организации и проведении мероприятий по психологической профилактике и сопровождению процессов адаптации студентов высших и средних учебных заведений. The article is devoted to the problem of psychological safety of the educational space of higher education, in particular, to the study of satisfaction with the educational environment of students of humanitarian specialties. The relevance of the topic is due to the need to design conditions conducive to the preservation of mental and psychological health of young people. The purpose of our study was to analyze the psychological description of characteristics in the educational space of higher education, which are significant from the point of view of the psychological safety of students. This study investigated the relationship between the characteristics of the educational environment (positive experiences of interest, joy, satisfaction, and the severity of negative emotions of fear, anger and resentment) with the level of students' depression. The article analyzes the results of students of higher educational institutions of the humanitarian profile of the Republic of Tatarstan (sample of 7383 students). In the course of the study, the parameters of the educational environment that affect the psychological safety of an individual - emotional attitude to learning and satisfaction with the educational environment - were studied using the questionnaire method. This study is intended for educational psychologists, teachers and those interested in the development of a psychologically safe educational space for higher education. The research materials can be used in the organization and implementation of measures for psychological prevention and support of the adaptation processes of students of higher and secondary educational institutions.

The paper investigates the issues of a legal status of scientists, researchers and persons involved in conducting scientific research (supporting personnel), analyzes changes under the Federal Law No. 157-FZ of May 25, 2020, “On amendments to the Labour Code of the Russian Federation with regard to the establishment of the limit age for replacement of positions of heads, deputy heads of state and municipal educational organizations of higher education and scientific organizations and heads of their branches,” determines the directions of improvement in legislation associated with insufficient legal regulation of working hours of scientific workers. The author examines the issue of scientific workers’ labor norming and substantiates the necessity of implementing labor standards for scientific workers in order to exclude their overworking. In addition, the paper focuses on problems related to the introduction of researchers’ performance and efficiency indicators that have appeared due to the introduction of an “effective contract” (a performance-based contract of employment).

Autonomy as a fundamental guarantee for the implementation of educational activities accompanied the formation of the first universities, subsequently acquiring regional specificity. The education system in Russia objectively operates by a different structure for the interrelation of the subjects and mechanisms in order for educational organizations to implement their activities compared to the era of the first universities. In the article, the authors identify and propose to consider the key nodes of the legal status of universities: organizational and legal form as a legal shell, proprietary rights in property, methods of financing, tax preferences, and forms of control over activities. The study of these features is important for answering the questions of whether they lead to the emergence of a new model of legal regulation of universities and whether there is a correlation with university autonomy. Both answers, as shown in the article, are negative. The decision should not come only “from above”, although the state recognition of the independence of universities should be expressed in the expansion of their powers in property and financial spheres. Educational organizations themselves must realize the value of autonomy, starting with the formulation of their mission, which is presented formally and not meaningfully in the charters of Russian universities. The mission of the article’s authors is seen in the ability to make independent decisions and be responsible for such decisions. The participation of a public entity in the functioning of universities today seems to be excessive: goal setting, state task, and state control should not suppress the autonomy of educational organizations. The use of various public resources may become a Solomon solution: supervisory and board of trustees, student government, internal financial audit, and others. Finally, the latest and far from the last challenges to the education system (digitalization, pandemic) are shifting the area of responsibility to the universities themselves, which will have to make operational decisions based on their vision of the current situation. For this to occur, educational organizations need to understand the degree of their autonomy.

The article analyzes the legal problems of the integration of science and education, offers an assessment of various organizational forms of integration of science and higher education over the past 30 years. The main provisions, stages of implementation and the results of the implementation of various scientific and educational state programs are studied, statistical data are provided that emphasize the increase in the volume of scientific activities carried out in educational organizations (higher educational institutions). The authors investigate the status of educational organizations as subjects of scientific law, emphasize the imperfection of Russian educational legislation regarding the differentiation of educational institutions of higher education and scientific organizations. The article focuses on the study of the positive and negative consequences of the introduction of a new category of higher educational institutions – flagship universities. After analyzing the problems of legal regulation of flagship universities, the authors come to the conclusion that the logical conclusion of the reform of flagship universities can be the establishment of the status of flagship universities in the legislation on education and a clear separation of flagship and federal universities.

The article examines the legal positions of the constitutional control bodies regarding the legislative regulation of the status of mass media. The authors note that the Constitutional Court of the Russian Federation has made decisions on the issues of financing, ownership and legal regulation of mass media, the relationship between the mass media, society and the state, the content of the constitutional prohibition of censorship and its correlation with restrictions on freedom of mass media, etc. Conclusions are drawn about the conceptual nature of the decisions of the constitutional Court of the Russian Federation aimed at clarifying the constitutional and legal status of mass media and contributing to filling legal gaps in this area
