This study aimed to analyze the application of the registration of communal land rights of indigenous and tribal peoples in the Pakraman Bungbungan Traditional Village, Jembrana Regency, as well as to explore issues that hampered registration of communal land rights and efforts made by the government to overcome these obstacles. The study method used an empirical legal study with a sociological juridical approach. From the study results, it was known that the registration of communal land rights in the Desa Adat Pakraman Bungbungan, Jembrana Regency, Bali Province was implemented through the Government’s Strategic Program, namely the Complete Systematic Land Registration 2019. There were several obstacles experienced, one of them being the community’s ignorance of the communal land registration process. The effort made by officials of the Jembrana District Land Office was to disseminate information to indigenous peoples regarding the way to register communal land.

Abstract: Environment and Forestry Ministry established the reserve incense forest of the Pan-dumaan-Sipituhuta Customary Law Community as a customary forest. But in reality, it has not been guaranteed legal certainty regarding the existence and recognition of the rights of the Pan-dumaan-Sipituhuta Customary Law Community. The objective of this research is to know the le-gal status of Indigenous Peoples forest in Pandumaan-Sipituhuta Customary Law at this time, strategy of the land registration of communal right settlement, and constraint and effort done in the land registration of communal right settlement of Pandumaan-Sipituhuta Customary Law Community. This research uses qualitative research method with empirical juridical research form. Based on the results of the study showed that the legal status of the Indigenous Forests of Pandumaan-Sipituhuta Customary Law Society is currently reserved as customary forest of Pan-dumaan-Sipituhuta Customary Law Community. Strategy for resolving communal rights land registration in the incense forest of the Pandumaan-Sipituhuta Customary Law Community through four stages. First, recognition of the existence of the Pandumaan-Sipituhuta Customary Law Community. Secondly, the establishment of customary forests of the Pandumaan-Sipituhuta Customary Law Community by Environment and Forestry Ministry. Third, the Settlement of Land Control in Forest Areas is carried out in accordance with Presidential Regulation Number 88 of 2017 by issuing customary forests of the Pandumaan-Sipituhuta Customary Law Community from forest areas. Fourth, registration of communal land rights of Pandumaan-Sipituhuta Custom-ary Law Community.Keywords: strategy, communal rights, customary forestsIntisari: Kementerian Lingkungan Hidup dan Kehutanan (KLHK) menetapkan pencadangan hutan kemenyan Masyarakat Hukum Adat Pandumaan-Sipituhuta sebagai hutan adat. Tetapi kenyataannya, keadaan tersebut hingga saat ini dinilai belum menjamin kepastian hukum akan keberadaan dan pengakuan hak Masyarakat Hukum Adat Pandumaan-Sipituhuta. Tujuan dari penelitian ini untuk menjelaskan bagaimana strategi penyelesaian pendaftaran tanah hak komunal hutan kemenyan Masyarakat Hukum Adat Pandumaan-Sipituhuta. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan yuridis empiris. Berdasarkan hasil penelitian menunjukan bahwa status hukum hutan kemenyan Masyarakat Hukum Adat Pandumaan-Sipituhuta saat ini dicadangkan sebagai hutan adat. Strategi penyelesaian pendaftaran tanah hak komunal hutan kemenyan Masyarakat Hukum Adat Pandumaan-Sipituhuta melalui empat tahapan. Pertama, pengakuan keberadaan Masyarakat Hukum Adat Pandumaan-Sipituhuta. Kedua, penetapan hutan adat Masyarakat Hukum Adat Pandumaan-Sipituhuta oleh KLHK. Ketiga, dilakukan Penyelesaian Penguasaan Tanah dalam Kawasan Hutan sesuai dengan Peraturan Presiden Nomor 88 Tahun 2017dengan cara mengeluarkan hutan adat Masyarakat Hukum Adat Pandumaan-Sipituhuta dari kawasan hutan. <p><em><span class="fontstyle0"><strong>Abstract</strong><br /></span></em></p><p><em><span class="fontstyle1">Nationalization of a Dutch-owned plantation company, NV Deli Maatschappij, was an attempt by the government to improve national economic situation. However, during the process, communal land which was concessioned to the plantation, was also nationalized and not given compensation by the government which resulted the indigenous people of Deli Sultanate losing their customary land. The former plantation land was converted to Cultivation Rights and handed over to the State Plantation Company This problem led to a prolonged conflict over ownership of the former estate. The purpose of this study is to determine the validity of the nationalization process carried out by Indonesian government on the existence of indigenous peoples’ customary land rights and obtain  settlement of customary land rights of indigenous peoples as the impact on nationalization. Tanah bekas perkebunan diubah menjadi Hak Guna Usaha dan diserahkan kepada Perusahaan Perkebunan Negara. Hal ini menimbulkan<br />konflik berkepanjangan tentang kepemilikan tanah bekas perkebunan tersebut. The government has indeed provided legal protection and certainty to indigenous peoples regarding their ulayat lands, through a Ministerial Regulation. However, it needs to be studied more deeply about the concept of communal rights to land and Pakraman village as the subject of communal rights holders on land. Communal rights to land are conceptualized as models of land rights that have just been raised in the national land law system. The consequence is that indigenous and tribal peoples as communal rights holders are authorized to use and benefit from their communal land. Pakraman village qualifies as a subject of communal rights to land because Pakraman village in Bali is classified into the community of the community, has a system of customary government referred to as the traditional prajuru led by a customary village leader. Then Pakraman village has a legal area called the Palemahan Pakraman village. As an instrument that regulates the life and social interaction of the community, awig-awig is the customary law of the community in a Pakraman village in Bali.

The purpose of Special Autonomy for Papua is to resolve the source of the problem in Papua, especially concerning the rights of indigenous peoples. Normatively, the background of local autonomy for Papua is affirmed in Act No. 21 of 2001 on Papua Special Autonomy. The results shows that the recognition and protection of the land rights of indigenous peoples have been set clearly in the national legal system, such as Agrarian Law, Forest Law, as well as in Mineral and Coal Mining Law. However, recognition and protection of indigenous peoples’ rights to land in various legal products is still ambivalent. The essence of protection of indigenous peoples’ rights to land is also clearly regulated in Act No. 21 of 2001 and Perdasus No. 23 of 2008 has put customary law community on ownership of communal land is not the object of development, especially in the field of investment. The customary right and indigenous land which is the property and become an authority on indigenous peoples must be recognized by the government and regional and national communities about its presence. Therefore, the government should strive to protect the customary right through regulation of the Ministry of Agrarian and Land Agency and other laws related to the issue of customary rights, customary lands, indigenous peoples and their authority.

Article 41 paragraph (2) of Law No. 2 of 2012 on Land Procurement for Development in the Public Interest states that, when granting Compensation of Parties Entitled to receive Mandatory Compensation, a. exercising the release of rights; and b. submit evidence of ownership or ownership of Land Procurement Objects to Agencies that require land through land institutions. In the court's ruling stated that the boundaries of the land should be mentioned and how much extent was waived and the rest how much, and the procedure of disengagement of the right there was preparation, planning, implementation and release, and the release of the land rights was always followed by compensation, because this is an unlawful act. The results of this study show that, the release of land rights by the government in the land registration process in the court's ruling states that if 6 (six) landowners relinquish the right, it must be 6 (six) people who relinquish their rights if only 2 (two) are invalid, then a new land is said to be state land after the release of his rights. Any release of land rights must have a reason there can't be no reason land is being released to the state. The procedure for the release of that right is there is preparation, planning, implementation and release, and the release of the land rights is always followed by compensation.

Abstract: In order to give the assurance of legal certainty, certainty of rights and legal protection to holders and owners of land rights, the land registration shall be carried out. However, there is still a land dispute which now become a homework for The Government. This is because the certificate which should be a strong evidentiary can not guaranteed the legal certainty for the owner, so the person who right the land can blocking the certificate of land rights at Land Office. The issuance of Regulation Minister of Agrarian Affairs and Spatial / Head of National Land Office Number 13 Year of 2017 concerning the Procedures of Block and Sita which expected to create uniformity, standardization in recording process and abolition of registration blocked, it turns out not all the rules can be implemented at The Land Office of Sleman and Bantul Regency.The result of this research shows that blocking certificate process at Sleman Land Office and Bantul Land Office have a policy that the applicant is required to pay the blocking recording fee after the blocking received. Makes a potential loss to the (PNBP) which should be owned by Land Office for faced the problem of KKPweb application which have not been able to accomodate the time period of blocking. Keywords : blocking certificate, blocking, registration blocked Intisari: Dalam rangka memberikan jaminan kepastian hukum dan kepastian hak serta perlindungan hukum kepada pemegang dan pemilik hak atas tanah, maka dilaksanakan pendaftaran tanah. Namun demikian, masih saja terjadi sengketa pertanahan yang saat ini menjadi pekerjaan rumah bagi Pemerintah. Hal ini disebabkan karena, sertipikat sebagai alat pembuktian yang kuat ternyata belum menjamin kepastian hukum pemiliknya sehingga pihak yang merasa berhak atas tanah tersebut dapat melakukan blokir sertipikat hak atas tanah di Kantor Pertanahan. Dikeluarkannya Permen ATR/Kepala Nomor 13 Tahun 2017 tentang Tata Cara Blokir dan Sita yang diharapkan bertujuan untuk mewujudkan keseragaman, standarisasi dalam pelaksanaan pencatatan dan penghapusan catatan blokir ternyata tidak semua peraturan tersebut dapat dilaksanakan di Kantor Pertanahan Kabupaten Sleman dan Bantul. Hasil penelitian menunjukan bahwa pelaksanaan pencatatan blokir di kantor pertanahan Kabupaten Sleman dan Kabupaten Bantul terdapat kebijakan yaitu pemohon diwajibkan membayar biaya pencatatan blokir setelah blokirnya diterima membuat potensial loss terhadap (PNBP) yang seharusnya didapat kantor pertanahan untuk kendala yang dihadapi yaitu Aplikasi KKPweb yang belum dapat mengakomodir jangka waktu blokir. Land is a form of gift given by God, but human has given brain to think the challenges of live like the land problems, so that the government tries to regulate it properly. The problems in this thesis are: 1) How to regulate ownership of agricultural land rights that exceeds the maximum limit based on Act No. 56 (Prp) of 1960 concerning the Determination of Agricultural Land Areas? 2) How is the action taken by the Land Office towards ownership of agricultural land rights that exceeds the maximum limit? The method used is juridical empirical, with descriptive analytical specifications. The method used in this research is an empirical juridical approach. The results of this study are: (1) The regulation of ownership of agricultural land rights that exceeds the maximum limit is based on Act No. 56 (Prp) of 1960, namely that the provisions regarding land restrictions state that the application for ownership rights as referred to in Article 4 paragraph 1 of Act No. 56 (Prp) 1960 was limited to a maximum land area of 2000 m2. 2) The steps of the Land Office in implementing Act No. 56 (Prp) of 1960, namely the need for a concept of supervision and control over control of land rights, given the various problems that often arise such as in land registration activities.

Hurricane Irma caused significant destruction to the Caribbean during the 2017 Atlantic Hurricane season. In its aftermath, many of these Small Island Developing States (SIDS) are left with the dilemma of seeking ways to rebuild in some cases entire nation states. Using the case study of Antigua and Barbuda, where Barbuda was the first Caribbean island to receive a direct hit from Hurricane Irma, the paper begins to explore the ways in which the global system of exploitation of SIDS exacerbates internal historical conflicts which is a manifestation of climate injustices. Specifically, the Barbudans’ relative privilege in having inherited communal land rights have become, for the government, the barrier standing in the way of the only alternative funding sources for reconstruction, foreign tourism investment. Using the theoretical underpinnings of climate justice, we argue that the causers of climate change, who are generally the inheritors of the historic colonization, exploitation and impoverishment of these states, will effectively benefit from the intensity of Hurricane Irma, given that they will eventually get access to Barbudan land if the communal land rights are revoked.

Further and deeper research into the validity of the Retroactive Principle is required in order to provide assertiveness about the arrangement of Retroactive Principles in the field of agreement law in the Indonesian legal system, especially the Building Rights Agreement in Agrarian Law and the existence of obscure legal norms in the case of the legal Notary / PPAT to the granting right of building use for a period of validity is reviewed according to the provisions of Article 28 of Regulation of Head of National Land Agency Number 2 Year 2013 concerning the Delegation of Authority of Land Rights and Land Registration Activity and by using case approach of PT. Pan Pacific Nirwana Resort. This research is a normative legal research that is derived from the existence of obscurity of legal principle and legal norm contained in the provisions of Law Number 5 Year 1960 on Basic Agrarian Law Basic (UUPA) in the provisions of Article 30 and Article 28 Regulation of Head of National Land Agency No. 2 of 2013 on the Delegation of Authority of Land Rights and Land Registration Activities. The conclusion of this research in Agrarian Law there is legal uncertainty in the concept of law building rights agreement with a period of time that is still running and the future is approved by a new regulation by the government which caused the previous agreement to occur normatively contradictory whether using retroactive or non-retroactive principle and the validity of deed Notary / PPAT in the granting of right to building to limited liability company which is still valid time is reviewed according to UUPA, Article 28 Regulation of Head of National Land Agency Number 2 Year 2013 regarding Delegation of Authority of Land Rights and Land Registration Activity and Article 1320 Privat Law and by using approach case PT. Pan Pacific Nirwana Resort is not valid. Penelitian lebih lanjut dan mendalam terhadap keberlakuan Asas Retroaktif diperlukan dalam rangka memberikan ketegasan  tentang pengaturan Asas Retroaktif [1] di bidang hukum perjanjian dalam sistem hukum Indonesia khususnya perjanjian Hak Guna Bangunan dalam Hukum Agraria serta masih adanya kekaburan norma hukum dalam hal keabsahan akte Notaris/PPAT terhadap Perseroan Terbatas dalam  pemberian Hak Guna Bangunan yang jangka waktunya masih berlaku dikaji menurut ketentuan Pasal 28 Peraturan Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah serta dengan menggunakan pendekatan kasus PT. Pan Pasific Nirwana Resort. Penelitian ini merupakan penelitian hukum normatif yakni beranjak dari adanya kekaburan asas hukum dan norma hukum yang terdapat di dalam ketentuan Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria (UUPA) dalam ketentuan Pasal 30 dan Pasal 28 Peraturan Kepala Badan Pertanahan Nasional No. 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah. Kesimpulan dari penelitian ini dalam Hukum Agraria terdapat ketidakpastian hukum dalam konsep hukum perjanjian Hak Guna Bangunan dengan jangka waktu yang masih berjalan dan ke depannya di sahkan suatu peraturan baru oleh pemerintah yang menyebabkan perjanjian sebelumnya terjadi pertentangan secara normatif apakah menggunakan asas retroaktif atau non retroaktif dan keabsahan Akta Notaris/PPAT dalam Pemberian Hak Guna Bangunan terhadap Perseroan Terbatas yang jangka waktunya masih berlaku dikaji menurut UUPA, Pasal 28 Peraturan Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah jo Pasal 1320 KUH Perdata serta dengan menggunakan pendekatan kasus PT. Pan Pasific Nirwana Resort adalah tidak sah.

As an implementation of welfare society, the government issued Law Number 5 of 1960 Article 19 paragraph (2) c, which provide the legal certainty of land rights for all Indonesians carried out through land registration. The land registration system adopted by Indonesia is negative land cadastre with positive tendency. The implementation of land registration provide the basis of state duty to produce land registration evidence, namely certificate, which is valid as a strong proof of rights. This certificate guarantees the correctness of physical data besides juridical data as long as it is not proven otherwise. Method: This legal research used Normative juridical method, with qualitative juridical data analysis. Results of the study: Negative land cadastre with positive tendency adopted by Indonesia currently does not guarantee legal certainty of land ownership and the community justice itself. This is indicated by the fact that there is still a phenomenon of land disputes, among the result of the issuance of overlapping. By using a legal cadastre-based domain approach, through an approach of extracting historical values of land and integrating the process of dialogue within the issuing of certificate; obtaining legal certainty and the community justice can be achieved. Conclusion: Negative land cadastre with positive tendency is still unable to manifest legal certainty of land ownership and community justice so it is appropriate that an adage states “the highest legal certainty, is the highest injustice”. Strengthening land registration system through the domain approach is an alternative option to manifest legal certainty and community justice.
