Recognition and protection towards customary law communities in Kampar Regency are inevitable, remembering that the existence of these communities far before the establishment of this nation. A very progressive response was issued by the Regent of Kampar by Forming Registration Team for The Establishment of Customary Law Communities, Customary Territory, and Customary Forests in Kampar Regency. The Registration Team came from local government organizations, national land agencies, academicians, ministries element, non-governmental organization, and customary community institution shows collaboration that involves state actors. This collaboration successfully initiates the acknowledgment toward customary law communities and customary law with the release of Regent Decree in some areas under the Kampar Regency. This study uses a qualitative method with the type of phenomenological research. This collaborative governance is initiated by NGOs that focus on the environment and sustainable development. dominance is still found in the implementation of duties, the unequal power / authority of all parties, conflicts of interest, political will from regional heads and communication and coordination issues are still major obstacles.

In the national development the role of land for the fulfillment of various purposes will increase, either as a place to live or for business activities. In relation to that will also increase the need for support in the form of guarantee of legal certainty in the field of land. The result of the research is the conception of the state of Indonesia is a state law, which contains the meaning in the administration of government and the state based on the law, the protection of the law is a universal concept of the rule of law. The legal certainty on land rights as intended by the UUPA encompasses three things, namely the certainty of the object of land rights, certainty on the subject of land rights and certainty about the status of landrights. Legal conception of land title certificate is a proof that issued by authorized legal institution, containing juridical data and physical data which isused as evidence of ownership of land rights in order to provide assurance of legal certainty and certainty of rights to a plot of land owned or possessed by a person or legal entity. With the certificate of rights, it is expected that the juridical can guarantee the legal certainty and the right by the state for the holder of the right to the land. This country's guarantee is granted to the owner or the holder of the certificate may be granted because the land is already registered in the state land administration system.

Abstract: The construction of Bendung Slinga in Purbalingga Regency begins with land acquisition carried out in 2009 and 2010, but the land acquisition process has not been completed in the land rights certificate, especially the object that comes from the village cash lands of Banjaran. The purpose of this research is to explain the implementation of land acquisition for Development of Bendung Slinga in Banjaran Village, Bojongsari District, Purbalingga Regency and explain the constraints faced and the solution. This research uses qualitative method with descriptive approach. The results show that the implementation of land acquisition for the construction of Bendung Slinga until the payment of compensation has been implemented in accordance with the prevailing regulations, namely Perpres 65/2006 and Perkaban 3/2007. Problems that occur is not complete the condition of the release of cash land Banjaran village which became the object of land acquisition. Terms of release that can not be fulfilled are village regulations, permission of the bupati, and permission of the governor. In addition, replacement land for disbursed village cash lands has not been fully controlled by the Banjaran Village Government and has not yet registered its land rights on behalf of the Banjaran Village Government. Intisari: Pembangunan Bendung Slinga di Kabupaten Purbalingga diawali dengan pengadaan tanah yang dilaksanakan pada tahun 2009 dan 2010, Namun proses pengadaan tanahnya belum selesai pada tahap sertipikasi hak atas tanah, terutama objek yang berasal dari Tanah Kas Desa (TKD) Banjaran. Tujuan dari penelitian ini adalah untuk menjelaskan pelaksanaan pengadaan tanah untuk pembangunan Bendung Slinga di Desa Banjaran, Kecamatan Bojongsari, Kabupaten Purbalingga dan menjelaskan kendala yang dihadapi dan solusinya. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif. Hasil penelitian menunjukkan bahwa pelaksanaan pengadaan tanah untuk pembangunan Bendung Slinga sampai dengan pembayaran ganti rugi telah dilaksanakan sesuai dengan peraturan yang berlaku, yaitu Perpres 65/2006 dan Perkaban 3/2007. Permasalahan yang terjadi adalah belum lengkapnya syarat pelepasan TKD Banjaran yang menjadi obyek pengadaan tanah. Syarat pelepasan yang belum dapat dipenuhi yaitu peraturan desa, izin bupati, dan izin gubernur. Selain itu, tanah pengganti untuk tanah kas desa yang dilepaskan belum sepenuhnya dikuasai oleh Pemerintah Desa Banjaran dan belum didaftarkan hak atas tanahnya atas nama Pemerintah Desa Banjaran. Abstract: Environment and Forestry Ministry established the reserve incense forest of the Pan-dumaan-Sipituhuta Customary Law Community as a customary forest. But in reality, it has not been guaranteed legal certainty regarding the existence and recognition of the rights of the Pan-dumaan-Sipituhuta Customary Law Community. The objective of this research is to know the le-gal status of Indigenous Peoples forest in Pandumaan-Sipituhuta Customary Law at this time, strategy of the land registration of communal right settlement, and constraint and effort done in the land registration of communal right settlement of Pandumaan-Sipituhuta Customary Law Community. This research uses qualitative research method with empirical juridical research form. Based on the results of the study showed that the legal status of the Indigenous Forests of Pandumaan-Sipituhuta Customary Law Society is currently reserved as customary forest of Pan-dumaan-Sipituhuta Customary Law Community. Strategy for resolving communal rights land registration in the incense forest of the Pandumaan-Sipituhuta Customary Law Community through four stages. First, recognition of the existence of the Pandumaan-Sipituhuta Customary Law Community. Secondly, the establishment of customary forests of the Pandumaan-Sipituhuta Customary Law Community by Environment and Forestry Ministry. Third, the Settlement of Land Control in Forest Areas is carried out in accordance with Presidential Regulation Number 88 of 2017 by issuing customary forests of the Pandumaan-Sipituhuta Customary Law Community from forest areas. Fourth, registration of communal land rights of Pandumaan-Sipituhuta Custom-ary Law Community.Keywords: strategy, communal rights, customary forestsIntisari: Kementerian Lingkungan Hidup dan Kehutanan (KLHK) menetapkan pencadangan hutan kemenyan Masyarakat Hukum Adat Pandumaan-Sipituhuta sebagai hutan adat. Tetapi kenyataannya, keadaan tersebut hingga saat ini dinilai belum menjamin kepastian hukum akan keberadaan dan pengakuan hak Masyarakat Hukum Adat Pandumaan-Sipituhuta. Tujuan dari penelitian ini untuk menjelaskan bagaimana strategi penyelesaian pendaftaran tanah hak komunal hutan kemenyan Masyarakat Hukum Adat Pandumaan-Sipituhuta. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan yuridis empiris. Berdasarkan hasil penelitian menunjukan bahwa status hukum hutan kemenyan Masyarakat Hukum Adat Pandumaan-Sipituhuta saat ini dicadangkan sebagai hutan adat. Strategi penyelesaian pendaftaran tanah hak komunal hutan kemenyan Masyarakat Hukum Adat Pandumaan-Sipituhuta melalui empat tahapan. Pertama, pengakuan keberadaan Masyarakat Hukum Adat Pandumaan-Sipituhuta. Kedua, penetapan hutan adat Masyarakat Hukum Adat Pandumaan-Sipituhuta oleh KLHK. In the geographical areas forming the focus of this contribution, the traditional communal areas in former Bantustan and homeland areas in South Africa, communal ownership flows from the application of customary law, linked to the constitutional right to culture. Living customary law, embedded in communities, entails a dynamic system of land rights which are negotiated in line with particular needs. Recent policy and legislative developments, however, seem to bolster rights of traditional authorities, thereby impacting on land rights and effectively negating spontaneous negotiation. Conceptual clarification in this contribution embodies the complexity linked to communal property, specifically land, in light of the aftermath of apartheid, the commencement of an all-encompassing land reform programme and the operation of a dual legal system comprising customary law and Western-style legal paradigms. The challenges and opportunities for law reform are explored in this context of inter-connectedness of customary law and communal property.

This paper is going to discuss the sorts of land rights recognized by laws and the implementation of such rights and recopceptualisation  related to the land reform program. Library and field researches are conducted to obtain the data. Library research is conducted by exploring the relevant laws and literatures while field research is conducted by interviewing relevant informants. The research shows that there are about 13 rights of the land that can be found in the regulations. Most of the rights on land is based on customary law which has communal concept. However, amongst such rights in the implementation still faces unjust in dividing its benefit, there is a tendency to increase the gap in owning the land and to disobey the need of housing that more complex in the limited number of it; hence the reconceptualisation  is required for the rights.  Keywords: Recopceptualisation; Land Rights; Law ReformABSTRAKTulisan  ini dimaksudkan untuk menjelaskan mengenai macam-macam hak atas tanah yang dikenal dalam ketentuan perundang-undangan,  pelaksanaan berbagai macam hak atas tanah tersebut dan rekonseptualisasi hak-hak atas tanah dikaitkan dengan restrukturisasi penguasaan tanah. Untuk mendapatkan data bagi kepentingan penulisan ini dilakukan penelitian kepustakaan dan penelitian lapangan. Penelitian kepustakaan dilakukan dengan cara menelaah ketentuan perundang-undangan dan  literatur yang relevan, sedangkan penelitian lapangan dilakukan dengan cara mewawancarai para nara sumber yang terkait. Hasil penelitian menunjukkan bahwa paling tidak terdapat 13 (tiga belas) macam hak atas tanah yang terdapat pengaturannya dalam ketentuan perundang-undangan. Sebagian besar hak-hak atas tanah tersebut bersumberkan pada hukum adat yang berkonsepsi kumunalistik. Namun diantara hak-hak atas tanah tersebut dalam pelaksanaannya ada yang masih mengandung unsur pemerasan, cenderung semakin meningkatkan  ketimpangan dalam penguasaan tanah dan cenderung tidak dapat mengakomodir kebutuhan tanah yang semakin komplek dalam keterbatasan ketersediaannya, karena itu diperlukan rekonseptualisasi hak-hak atas tanah.Kata kunci:  Rekonseptualisasi; Hak Atas Tanah; Pembaharuan Hukum

The Province of Aceh has a robust legal basis and umbrella in implementing an education system based on Islamic values following the mandate of Law No. 11 of 2006 and is described in the provincial and district qanuns of North Aceh. Implementing the special autonomy policy in education gives the Aceh Provincial government the flexibility to develop creative and innovative Islamic-based programs following the characteristics of Aceh's privileges. This study aims to analyze the formulation of Islamic values-based curriculum education policies in primary education and the collaborative actors involved in forming Islamic values-based educational curriculum policies. The research was used the descriptive qualitative method. The informants were determined by purposive sampling. The study found no synergy of cross-actor in collaborative governance in the formulation of Islamic values-based Aceh education curriculum policies. Thus, the implementation of education programs based on Islamic values was interpreted and meant differently among agencies. In addition, the National Curriculum strongly dominated the implementation of Aceh education in primary education, while local policies on Islamic values were few. Therefore, the policies of providing education do not reflect the specificity of Aceh's privileges. Besides that, the Islamic-based education policy program was not explained in a more detailed derivative policy.

<p><em>Policy of worthy children regency (KLA) is the government effort in order to fulfill and protect children rights by involving stakeholders: government, private, non-governmental organization (LSM) and society. Magelang regency has received several awards related to KLA at the Pratama level (2012), and Madya (2015, 2016, 2017, 2018). This is a little contradictory to the fact that there are still problems related to children’s rights such as malnutrition, children without birth certificates, and child labor at age 10-18 years old. The purpose of this study is to analyze implementation of KLA in Magelang regency using the Van Metter and Van Horn model with qualitative method. Number of informants as many as 10 people. The result of study show there are obstacles in implementing KLA policy: lack of human and financial resources, weak communication between stakeholders, negative influence of thick social conditions, and lack of socialization. Recommendation to stakeholders inlcude: strengthening human and financial resources, increase the intensity of socialization and communication, and noting the social and economic conditiouns of community.  </em></p>

Indonesia has written law in the form of positive law and law that lives in recognized societies and then becomes customary law, but recognition of customary law applies only to groups that recognize its existence, of course this is contrary to positive law that applies universally. Here the author tries to examine how the role of customary law in the formation of positive law and what its effects. The method used in this paper is a qualitative method and the approach uses library research. As a rule of law aimed at creating harmony and balance in society, the existence of customary law in a rule of law is absolutely necessary, because the rule of law as a feature of the rule of law is not a final word, but as a way to create justice in society.

After  Decision of the Constitutional Court Number 98 / PUU-X / 2012, NGO include third parties with an interest in submitting pre-trial proceedings by terminating investigations or terminating proceedings, but related to Post- Decision of Constitutional Court Number 21 / PUU-XII / 2014, it can be seen that there is an extension of pre-trial proceedings, one of which is the suspect's determination. It actually raises concerns about pre-trial object posed by NGO, whether or not it requires the determination of a suspect, it given that it is not written if it looks at grammatically. Based on background above, this research analyzes about first, can non-governmental organizations submit pre-trial applications for the purpose of determining a suspect? Secondly, what is the concern of juries’ respect to the position of Non-Governmental Organization that submitted a pre-trial application for the purpose of determining the suspect? This research is a normative legal research with an approach to laws, a philosophical approach and a case approach. Based on this research, it has been identified that First, NGO should first submit pre-trial applications for the purpose of assessing a suspect. Whereas, since Article 77(a), which is incidentally the subject-matter of pre-trial proceedings for NGO, has been extended, it should be interpreted that NGO also send pre-trial applications for the purpose of determining the suspect. Secondly, in some justices' reflections based on Constitutional Court's Decision Number: 98 / PUU-X / 2012 on May 21, 2013 jo. The justice considered, in Constitutional Court Decision Number 21/PUU-XII/2014, that the complainant as an NGO has a legal role in bringing a preliminary ruling against the object of suspect’s determination.
