Abstrak: Dengan diberlakukannya otonomi daerah di Indonesia, maka urusan pembangunan pun tidak lagi dijalankan satu arah dari Pemerintah Pusat. Keberadaan dari otonomi daerah ini memberikan kendali kepada Pemerintah Daerah untuk mengatur daerahnya masing-masing. Namun, pelaksanaan dari otonomi daerah yang terkesan terburu-buru menimbulkan beberapa kendala dalam pelaksanaannya. Kendala yang dihadapi meliputi ketidakmerataan sumber daya manusia, berkembangnya kesenjangan antar daerah, dan sulitnya menyinkronkan pembangunan daerah dan pusat. Sehingga, untuk mengurangi permasalahan yang muncul tersebut, maka perlu dilakukan seleksi atau rekrutmen ketat terhadap sumber daya manusianya dan dilakukan pendampingan secara seksama terhadap proses pembangunan di daerah. Abstract: With the enactment of the regional autonomy in Indonesia, some of the development affairs are no longer implemented one-way from the Central Government. The existence of regional autonomy has given some controls towards the Regional Government to manage their region. However, the implementation of regional autonomy that seems to be rushed has resulted in the emergence of problems during its execution. The issues that emerged are the discrepancy of human resources between regions, regional inequality, and the difficulty in synchronizing the development between the area and central. To reduce the number of problems that arose because of that, there should be a strict recruitment process for human resources and implementation of a careful accompaniment for the development process in the region.

East Kalimantan is a province full of paradoxes. This region has considerable economic potential measured in terms of its abundant endowments of natural resources, including oil, natural gas, gold, coal and forestry. Yet, East Kalimantan still lacks infrastructure, has poor human resources and high levels of unemployment, factors that condemn much of the population to a life of poverty and hardship. The new system of regional autonomy, which has been implemented since 2001, was expected to give more benefit to the regions, as regional governments have held relatively more power and fiscal capacity. Law 22/1999, which has been revised twice, has provided more authority to regional governments to manage their respective regions. The introduction of fiscal decentralisation through Law 25/1999, further revised in Law 33/2004, has favoured regions rich in natural resources such as East Kalimantan. As it has abundant natural resources, this region has received greatly increased funds from the central government due to the implementation of sharing revenue formula generated from the exploitation of natural resources. These supposed to give more opportunities for the rich regions such East Kalimantan to accelerate regional development and bring their people to greater prosperity. Nevertheless, East Kalimantan has realized neither the objectives of regional autonomy nor the community aspirations for a more prosperous society. This paper aims to examine the extent to which regional autonomy laws have impacted people's welfare in East Kalimantan.

Fiscal decentralization is one the major component of the decentralization implementation of regional autonomy. As the new beginning in regional development and the people in managing the resources or all of the potential to the prosperity and the progress of region. Financial aspect is one of the basic criteria to find out the real capability regional government in managing their autonomy system (household system) the capability of regional government in managing their financial can be seen in APBD which describes the capability of local government in financing the activities of development task and equity in each region. The purpose of this research is to determine the financial capability of Tidore in regional autonomy especially in 2013-2017 judging by ratio of independency, decentralization fiscal degree, growth ratio. This research used observation, interview and documentation to collect the data. The data was analyzed using qualitative and quantitative data with described analysis. The result showed that the independence ratio of Tidore has been able to improve its financial capability. The degree of decentralization is still highly dependent on the central government, although it has been increasing year by year. Growth rate fluctuated this indicates the local government of Tidore is not too concerned with regional development and community welfare.Keywords: regional autonomy, ratio of independency, The degree of decentralization ratio, Growth ratio.

This article aims to explain the 2018-2019 state defense action plan in Presidential Instruction No. 7 of 2018 which mandates all ministries, non-ministerial government agencies, and local governments to take action to defend the country through three stages, namely the stages of socialization, internalization, and movement action. The dilution of the state defense action plan at the central government level has been very active, however, at the level of the reverent regional government it has not yet been felt, especially with the existence of regional autonomy where the central government is not necessarily able to "control" the regional government, so that all this needs attention parties, to see the perspective of the regional government in implementing the state defense action plan.

Indonesia is the Unitary State. It is understood that within a unitary state, the central government operates a high state sovereignty. In order not to be arbitrary, the activities of the central government are supervised and limited by the constitution. The government which is divided from the Central Government to the Regional Government included Regional Autonomy therein, as well as the authority of the Regional Government, is on duty to manage the Regional Property. In carrying out its authority as an administrator of local property, there are still many abuses or omissions committed by the local government in operating its authority in managing regional property, such as the negligence of the Regional Assets, the misuse of authority in the revocation of rights already granted by the regional government on the right to use of local property, using local property for personal interest. In the management of regional property required planning, implementation, and supervision by the local government in accordance with applicable laws and regulations in the constitution. The existence of the Regional Representative Council (DPD) which is regulated in Article 22D of the 1945 Constitution of the Republic of Indonesia (UUDNRI of 1945) with the authority of the DPD as regulated in Law Number 2 of 2018 concerning the Second Amendment to Law Number 17 of 2014 Regarding the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council and the Regional People's Representative Council (MD3), in particular Article 249 Paragraph (1) letter e. Article 22D of the 1945 Constitution places the position of the DPD as an institution that has the authority to submit a Bill relating to regional autonomy, central and regional relations, the formation and expansion of regions and the merger of regions, management of natural resources and other economic resources as well as related also by placing the DPD position to monitor and evaluate the Draft District / City Regional Regulations and Regency / City Regional Regulations according to Law Number 2 of 2018 concerning the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council, and the Regional People's Representative Council (DPR) ( MD3). This authority will cause problems especially those regulated in Law Number 2 of 2018 concerning MD3, because the Regency / City Regional People's Representative Council and the Governor as representatives of the central government do the same thing as is done by the DPD as regulated in Law Number 23 2014 concerning Regional Government, particularly in the provisions of Article 149 Paragraph (1) and Article 153 Paragraph (1). While the form of coordination that will be carried out by the DPD and the Regional Government has yet to exist, in addition to the DPD's position as a high state institution will cause problems when coordinating with the Regency / City DPRD as an element of the regional government.Keywords: The telescope, Position, DPD, State Administration, Republic of Indonesia

Dinas Komunikasi, Informasi, dan Persandian Yogyakarta is a combination of 3 assignments used to be handled by 4 different divisions : (1) Telematics and Information Technology, (2) Promotion, Publication, and Public Relation, (3) Coding, and (4) Sectorial Statistics. The merging of those 4 divisions weren’t followed by addition of resources. All human resources, equipment, and technical rules used are those already available at the time. Based on Yogyakarta’s Mayor’s Rules number 79 year 2016 about Organization Structure, Position, Duties, Function, and Working Procedures of Dinas Komunikasi, Informasi, dan Persandian Yogyakarta, the duty of Dinas Komunikasi, Informasi, dan Persandian is to carry out regional government matters based on the principle of regional autonomy in communication, information, coding, and statistics area. Dinas Komunikasi, Informasi, dan Persandian Yogyakarta must have some strategies in order to carry out its duties and functions, especially to support the acceleration of implementation of smart city for Yogyakarta City Government. Some matters that need to be prepared in order to support the program are (1) Human Resources who are competent in information technology (e-skills) and implementation of electronic based services concepts, (2) Infrastructures of communication and information technology which include infrastructures for network & data centre, information system, and data integration & integrated application development.

Abstrak Otonomi daerah adalah suatu bentuk demokrasi yang diberikan oleh Pemerintah Pusat kepada Pemerintah Daerah untuk mengelola rumah tangga mereka sendiri dengan berpegang pada hukum dan peraturan yang berlaku. Implementasi otonomi daerah merupakan titik fokus penting dalam rangka meningkatkan kesejahteraan rakyat. Pengembangan suatu daerah dapat disesuaikan oleh pemerintah daerah dengan potensi dan kekhasan masing-masing daerah. Ini adalah kesempatan yang sangat baik bagi pemerintah daerah untuk membuktikan kemampuannya menjalankan wewenang yang merupakan hak daerah. Otonomi daerah adalah salah satu agenda utama reformasi yang bertujuan mengurangi kesenjangan ekonomi-politik antara pemerintah pusat dan daerah. Era reformasi menjadi titik awal pergeseran paradigma terpusat yang diadopsi oleh Orde Baru ke era desentralisasi. Desentralisasi dalam konteks Indonesia diyakini sebagai cara untuk membangun pemerintahan yang efektif, mengembangkan pemerintahan yang demokratis, menghormati keanekaragaman lokal, menghormati dan mengembangkan potensi masyarakat lokal, dan mempertahankan integrasi nasional. Masyarakat menaruh harapan yang besar pada otonomi daerah untuk membawa perubahan dalam sistem negara. Sayangnya desentralisasi telah menyebabkan banyak korupsi di wilayah ini. Inilah yang terjadi pada 2018 lalu. Tahun 2018 tampaknya menjadi tahun yang gelap bagi upaya pencegahan dan pemberantasan korupsi, terutama di daerah. Pada 2018 Komisi Pemberantasan Korupsi (KPK) telah menjerat puluhan kepala daerah dalam sejumlah kasus dugaan korupsi mulai dari gubernur, bupati, walikota, hingga pejabat daerah. Hingga akhir 2018, KPK masih menjerat kepala daerah yang tersandung kasus korupsi yaitu Bupati Jepara Ahmad Marzuqi dan Bupati Cianjur Irvan Rivano Muchtar sebagai tersangka. Daftar panjang kepala daerah yang dijerat oleh KPK selama 2018 menunjukkan bahwa penanganan kejahatan korupsi di Indonesia masih membutuhkan perhatian serius dari banyak pihak. Demikian juga, Indeks Pencapaian Korupsi Indonesia masih jauh dari ideal, yaitu 3,7, seperti yang dikatakan oleh juru bicara KPK Febri Diansyah. Ini menunjukkan bahwa korupsi yang dilakukan oleh sejumlah kepala daerah merupakan salah satu bentuk kegagalan otonomi daerah. Dengan kata lain ada banyak pekerjaan rumah yang harus dilakukan terkait dengan implementasi otonomi daerah. Karena kasus-kasus yang ditangani oleh Komisi Pemberantasan Korupsi menunjukkan bahwa korupsi masih terjadi dan merupakan gejala di banyak lembaga. Kata Kunci: Otonomi Daerah, Korupsi, Kepala Daerah         Abstract Regional autonomy is a form of democracy given by the Central Government to the Regional Government to manage their own household by sticking to the applicable laws and regulations. The implementation of regional autonomy is an important focal point in order to improve people's welfare. The development of an area can be adjusted by the regional government with the potential and distinctiveness of each region. This is a very good opportunity for the local government to prove its ability to exercise the authority that is the right of the region. Regional autonomy is one of the main agendas of reform aimed at reducing the economic-political gap between the central and regional governments. The era of reform became the starting point of shifting the centralized paradigm adopted by the New Order to the era of decentralization. Decentralization in the Indonesian context is believed to be a way to build effective governance, develop democratic governance, respect local diversity, respect and develop the potential of local communities, and maintain national integration. The community places considerable expectations on regional autonomy in order to bring about changes in the state system. Unfortunately decentralization has caused a lot of corruption in the region. This is what happened in 2018 ago. The year 2018 seems to be a dark year for efforts to prevent and eradicate corruption, especially in the regions. In 2018 the Corruption Eradication Commission (KPK) has ensnared dozens of regional heads in a number of cases of alleged corruption ranging from governors, regents, mayors, to regional officials. Until the end of 2018, the KPK still ensnared the regional heads who tripped over corruption cases namely Jepara Regent Ahmad Marzuqi and Cianjur Regent Irvan Rivano Muchtar as suspects. The long list of regional heads snared by the KPK during 2018 shows that the handling of corruption crimes in Indonesia still needs serious attention from many parties. Likewise, the Indonesian Corruption Achievement Index is still far from ideal, namely 3.7, as said by KPK spokesman Febri Diansyah. This indicates that corruption committed by a number of regional heads is one form of failure in regional autonomy. In other words there is a lot of homework that must be done related to the implementation of regional autonomy. Because the cases handled by the Corruption Eradication Commission indicate that corruption still occurs and is a symptom in many institutions. This study aims to determine the problems of regional autonomy after the enactment of Law No. 23/2014 which describes the paradox of the application of regional autonomy in Indonesia. The method used in this research is a statutory approach. The results of this study indicate that the main characteristic of implementing the principle of regional autonomy is the authority of local governments to manage their household affairs without intervention from the central government. The authority is in the form of independence and freedom possessed by the regional government. The implication of this shift in regional autonomy law politics is the loss of regional independence and freedom to manage their household affairs, in other words, the Regional Government Law currently makes regional heads government (Governors, Regents, Mayors) only as an extension of the central government, without the authority to take Policy.

The Regional government which carried out based on the principle of autonomy as wide as possible implies that the regions are given the authority to regulate and manage all their own affairs. So, this study tried to conduct a study of normative law to further examine the nature of the implementation of regional autonomy, and the second tried to analyze the role of regional regulations in order to support the implementation of regional autonomy through library research using the statute approach and conceptual approach. The results of the study indicated that one of the important ideals and rationalities for implementing regional autonomy was to make the policy process closer to the society, not only in the central government. For this reason, authority needs to be given so that local governments can take their own initiative to make decisions regarding the interests of the local community through laws at the local government level. Thus, the contents of the Regional Regulations are to accommodate the interests of the people in the regions in order to achieve happiness and prosperity that is distributed equally to the people in the area.Pemerintah daerah dilaksanakan berdasarkan prinsip otonomi yaitu memberi dan melaksanakan rumah tangga itu sendiri. Untuk alasan ini, penelitian ini adalah studi hukum normatif untuk memeriksa lebih lanjut tentang pelaksanaan otonomi daerah dan pendekatan lain yang dapat dianalisis dengan menggunakan pendekatan perpustakaan menggunakan pendekatan Statuta dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa salah satu cita-cita dan rasionalitas penting pelaksanaan otonomi daerah adalah membuat proses lebih dekat dengan masyarakat, tidak hanya di pemerintah pusat. Untuk alasan ini, perlu mengisi ruang sehingga pemerintah dapat mengambil inisiatif sendiri untuk membuat keputusan tentang lingkungan masyarakat melalui peraturan di tingkat pemerintah daerah. Ini adalah konten materi dari Peraturan Daerah pada dasarnya untuk mengakomodasi manfaat masyarakat di daerah dalam rangka mencapai kebahagiaan dan kemakmuran yang didistribusikan secara merata kepada orang-orang di daerah tersebut.(The regional government is carried out based on the principle of autonomy is giving and carrying out the household itself. As the leader of the implementation of governmental affairs which become the authority of regional government, based on the mandate of Law Number 23 Year 2014 on Regional Government, the Head of regional government is obliged to prepare Regional Government Administration Report (RGAR) which by the central government will be used as material for evaluation and guidance to implement the administration of regional government. Batang Regency is the only Regency which for the last respective three years (2016, 2017 and 2018) has been in the 5th rank (the lowest five) in Central Java. The results of this evaluation are used as material for the Ministry of Finance in determining the Regional Incentive Fund and for the Ministry of Home Affairs in approving additional income for state civil apparatus. However, Batang Regency has not yet optimized its reporting system and Evaluation of Regional Government Administration Performance. Due to this unoptimal evaluation results on the implementation of regional Government, organizational capacity and the evaluation of the Governmental Division at Batang Regency regional Secretariat as the division who conducted the report preparation activities became the focus of this research. Qualitative descriptive method was used to describe all the symptoms / conditions which exist during the research. Moreover, the analysis was carried out through data reduction, display data and conclusion drawing / verification. Based on the results of this research, it can be concluded that the Organizational Capacity of the Government division of the Regional Secretariat of Batang Regency which involves some resources (human resources, infrastructure, technology and financial resources) and management (leadership, program and process management as well as cooperation and relationships among organizations) needs to be improved, such as conducting job analysis, increasing the quantity and quality of human resources, making more detail activities planning and budgeting as well as defending them during budget discussions, making Terms of Reference and improving effective communication skills.
