The Criminal Code Bill which has been approved by the House of Representatives and the Government, but has been delayed on its legalization, contains provisions to eliminate imprisonment for elderly over 75 years. Protection of the elderly is a human right because it belongs to vulnerable groups, such as children. For children in conflict with the law, restorative justice has been applied with diversion, where a solution is sought by involving the offenders, victims and the community. This article is written with normative juridical research method that examines the elimination of imprisonment for elderly criminal offenders in criminal law reform; with a question on achievability of restorative justice, which is expected to enrich criminal law extensive knowledge. This issue is important because the Criminal Code has not yet regulated the protection of elderly criminal offenders. Based on the results of the study, the judge was given an alternative sentence to impose a criminal fine to the elderly as a substitute for imprisonment, with due regard to the objectives and guidelines for punishment, as well as under strict conditions. Thus, restorative justice for elderly criminal offenders can't be achieved. The application of restorative justice should be carried out with regard to the rights of victims to obtain compensation. Therefore, there is a need for readiness of laws and regulations, law enforcement officers, and the community. The community needs to be given an understanding that, children and the elderly are vulnerable groups, and their rights are guaranteed by the 1945 Constitution. With age as their major factor, elderly are exposed to social, economic and health limitations. AbstrakRUU KUHP yang telah disetujui oleh DPR dan Pemerintah, namun ditunda pengesahannya memuat ketentuan untuk sedapat mungkin tidak menjatuhkan pidana penjara bagi lansia di atas usia 75 tahun. Pelindungan terhadap lansia merupakan hak asasi manusia karena termasuk dalam kelompok rentan, seperti halnya anak. Terhadap anak yang berhadapan dengan hukum telah diterapkan keadilan restoratif dengan diversi, dimana diupayakan penyelesaian dengan melibatkan pelaku, korban, dan masyarakat. Penulisan artikel dengan metode penelitian yuridis normatif ini mengkaji peniadaan pidana penjara bagi pelaku lansia dalam pembaruan hukum pidana, dapatkah keadilan restoratif tercapai?, yang diharapkan dapat menambah khasanah ilmu pengetahuan hukum pidana. Hal ini penting, mengingat KUHP belum mengatur pelindungan terhadap pelaku tindak pidana lansia. Berdasarkan hasil kajian, hakim diberikan alternatif pemidanaan untuk menjatuhkan pidana denda bagi lansia sebagai pengganti pidana penjara, dengan memperhatikan tujuan dan pedoman pemidanaan, serta syarat-syarat yang ketat. Dengan demikian, keadilan restoratif bagi pelaku lansia, tidak dapat tercapai. Penerapan keadilan restoratif hendaknya dilakukan dengan memperhatikan hak korban untuk memperoleh ganti rugi. Oleh karena itu, perlu kesiapan peraturan perundang-undangan, aparat penegak hukum, dan masyarakat. Terhadap masyarakat perlu diberikan pemahaman bahwa, anak dan lansia merupakan kelompok rentan, yang haknya dijamin oleh UUD 1945. Seorang lansia karena faktor usianya menghadapi keterbatasan sosial, ekonomi, dan kesehatan.

<p><em>Reform of the National Criminal Law is absolutely necessary with political, practical and sociological considerations. The amend of Criminal Code also include adjustments of the punishment aims, which leads to restorative justice. Likewise the sanctions for criminal offense in adat law, the punishment is less than optimal if only imposed the freedom deprivation to the perpetrator's, it is necessary to make efforts in restoring the situation (balance).</em></p><p><em>This type of research is normative research, by analyzing norms and legislation related to the aim of punishment in customary offenses.</em><em> </em><em>The results of the research that is the aim of customary sentencing is not specifically regulated in positive law, but customary criminal law have the power to apply, based: Article 18 B paragraph (2) of The 1945 State Constitution of the Republic of Indonesia, Emergency Law No. 1 of 1951 on Temporary Measure in Organizing the Unity of the powers and procedure of Civil Courts, Law No. 48 of 2009 on Judicial Power, Law No.39 of 1999 on Human Rights, and the Supreme Court Decisions, among others: (1) Decision No. 1644K / Pid / 1988 dated May 15, 1991; (2) Decision No. 984 K / Pid / 1996 dated January 30, 1996. </em></p><p><em>In the positive law, there is a reflection of restorative justice as a concept that developed in modern criminal law in line with the purpose of sentencing the customary offenses. The aim of sentencing as ius constituendum is formulated in Article 55 paragraph (1) of the 2017 Criminal Code Concept which includes resolving conflicts that arise, restoring balance, and bringing sense of peace and secure in the community, which is in line with customary criminal sanctions because of the visible values of customary law; resolve conflicts, restore balance, and bring a sense of peace in society.</em></p><p><strong> </strong></p><p><strong>Keywords</strong>: Analysis, Purpose of Sentencing, Criminal Law Reform, Customary Criminal Act</p>

The sources of Indonesian criminal law are numerous. The backbone of substantive criminal law is the Criminal Code (KUHP), which was first applied in Indonesia during Dutch colonialism in 1918 and endorsed in 1946, after Independence. Today, most of this Code remains intact but for a handful of additions and deletions. Criminal law reform has proceeded largely through enactment of ‘special criminal laws’ governing particular offences. The government has, for many years, recognized that the Code is out-of-date, and replacements have been drafted and debated but none agreed upon. The most recent draft, which this chapter discusses, retains or adds controversial offences, including defamation, prostitution, homosexuality, and blasphemy. Meanwhile, Aceh province has had authority to impose its own criminal laws, based on Islamic law, since 2006. These are, by modern standards, archaic and appear to breach a range of human rights, both domestic and international.

LAPAS or Correctional Institution under the auspices of the Directorate General of Corrections is the final place of the criminal justice system process that fosters and integrates the social of convicts, so that when returning to society they are able to live a normal life. Elderly (according to Law No. 13 of 1998: Elderly) is a person whose age reaches the age of 60 years and above. In its efforts, Correctional Services interpret this understanding by regulating the rights of inmates contained in Law no. 12 of 1995 article 14 paragraph 1.The increasing age and declining body condition of the elderly inmates need special treatment both in health, treatment, and public services. Elderly inmates as much as possible are treated as people usually are, it's just that the place and application are different. This is for the implementation of part of Human Rights (HAM) as a national instrument. This special handling effort involves other stakeholders be it medical or health workers and the government to support the infrastructure needed. The elderly as one of the vulnerable groups become important objects in terms of how decent handlers are so that they feel cared for in their twilight years. Although until now still in the process and stages of refinement of special handling for them. The fact is still not optimal and this study illustrates how well the effort is.

The Model Criminal Code (MCC) was intended to be a Code for all Australian jurisdictions. It represents a high point of faith in the value and possibility of systematising, rationalising and modernising criminal law. The core of the MCC is Chapter 2, the ‘general principles of criminal responsibility’, which outlines the ‘physical’ and ‘fault’ elements of criminal offences, and defines concepts such as recklessness. This paper assesses the MCC as a criminal law reform project and explores questions of how the MCC came into being, and why it took shape in certain ways at a particular point in time. The paper tackles these questions from two different perspectives—‘external’ and ‘internal’ (looking at the MCC from the ‘outside’ and the ‘inside’). I make two main arguments. First, I argue that, driven by a ‘top down’ law reform process, the MCC came into being at a time when changes in crime and criminal justice were occurring, and that it may be understood as an attempt to achieve stability in a time of change. Second, I argue that the significance of the principles of criminal responsibility, which formed the central pivot of the MCC, lies on the conceptual level—in relation to the language through which the criminal law is thought about, organised and reformed.

<p align="justify">The disparity by judges in decisions led to the inability of people facing criminal offenses. Laws are not grounded to small communities, the judicious use of a crime in Indonesia as well as the strength of spider webs in which only able to ensnare minor crimes, but are not able to touch the major crimes that occurred in Indonesia. This study uses normative juridical. The results of this study found that completion ordinary crime patterned petty can be reached with a restorative justice approach, so it can focus on the direct participation of the offender, victim and community.</p>

 ABSTRAKJika melihat kecenderungan proses penerapan pemidanaan di Indonesia, maka dapat kita lihat bahwasanya banyak proses pemidanaan yang diterapkan secara berlebihan. Tentunya hal ini menyebapkan adanya over ciminalization pada penerapan pemidanaan yang tentu saja hal ini menyebapkan adanya ketidak harmonisan dalam penerapan hukum pidana yang mana meniadakan rasa kemanusiaan yang berujung pada banyak gejala dehumanisasi yang terjadi. Pada penelitian ini mengunakan jenis jenis penelitian hukum normative dengan mengunakan pendekatan Pendekatan Perundang-Undangan (Statue Approach), Pendekatan konseptual (Conseptual Approach), dan pendekatan kasus (case Approach). Penelitian ini bertjuan untuk mengetahui Bagaimana  penerapan hukum pidana yang ada di Indonesia saat ini dan Bagaimana Prospektif hukum pidana dan pemidanaan yang ada di Indonesia?.  Hasil penelitian ini menunjukkan Bahwa penerapan hukum pemidanaan di Indonesia saat ini, masih meninggalkan beberapa catatan penting antara lain; banyak Terjadinya Over Criminalization dan banyaknya terjadi Dekonstruksi Pidana dan Pemidanaan di Indonesia dimana dekonstruksi itu antara lain; Pertama, Terjadinya Over Kapasitas Lapas dan Rutan, kedua, Pengaturan Hukuman Mati yang Sangat Massif; ketiga, Kebijakan Hukum Yang Over Pada Penghinaan Di Media Sosial; keempat, Dalam Penyidikan Kriminal Penyidik Mencari Bukti Dengan Kejahatan (penyiksaaan); kelima, Inkonsistensi Hak  Atas Perkara Cuma-Cuma (prodeo). Bahwa Prospektif Pembaharuan Hukum Pidana dan Pemidanaan Yang Ada di Indonesia harus didasarkan pada beberapa hal, antara lain: Pedekatan Restorative Justice dalam Penerapan Pemidanaan; Pendekatan Ultimum remedium dalam penerapan pemidanaan; Reformasi Kelembagaan Lembaga Penegak Hukum; dan Revisi Kitab Undang-Undang Hukum Pidana (KUHP) dan Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Kata Kunci: Dehumanisasi, Over Criminalization, Restorative Justice, Ultimum remediumABSTRACTIf we look at the trend of the process of implementing criminal punishment in Indonesia, we can see that many criminal proceedings are over-applied. Of course this implies over ciminalization in the application of punishment, which of course imposes a disharmony in the application of criminal law which negates the sense of humanity which leads to many symptoms of dehumanization that occur. In this study using the type of normative legal research using the approach of legislation approach (Statue Approach), conceptual approach (Conseptual Approach), and case approach (case approach). This research aims to find out how the application of criminal law in Indonesia today and How is the prospect of criminal law and punishment in Indonesia ?. The results of this study indicate that the current application of the criminal law in Indonesia still leaves some important notes, among others; there is a lot of Over Criminalization and many cases of Criminal Deconstruction and Criminalization in Indonesia where deconstruction is among others; First, the occurrence of over-capacity of prisons and detention centers, second, the regulation of extremely mass death sentences; third, the Legal Policy Over Over Insulting on Social Media; fourth, In Criminal Investigations Investigators Seek Evidence With Crime (torture); fifth, the Inconsistency of the Right to Free Cases (prodeo). This study aims to evaluate the provisions related to social service crime in the draft criminal law (R-KUHP) in the act of national criminal law reform. The study uses a normative juridical with a statue approach. The urgency of social service as the main criminal sanction against minor offenses can be justified through a combined criminal theory. Social service appropriate in the case of minor criminal offenses because this criminal has the advantage, i.e., the criminal sanction is punitive and still maintaining that the perpetrator can reintegrate into the community. The provisions of social service in the R-KUHP are quite complete and comprehensive. But several things can be noted, i.e., the need for adjustments to several clauses in the R-KUHP related to the provisions of social service and assessment to test the defendant’s readiness to work in the community needs to be more oriented towards community safety.

Various violations on human right happening in Indonesia today have never been completely solved. Victims of human right violations (direct or indirect victims) find it difficult to access justice through the existing criminal law today. Difficulties in proving the violations committed by the actors make it harder for the justice to be in the victim’s side. For any reasons, the violations of human rights should be brought into the court. It is surely not easy to do so as the retributive justice applied so far has not been able to solve the existing problems and to give fairness to the victims. Restorative justice is therefore considered as a potential way out for a justice to take place for the crime actors, victims and society in general. In various types of criminal actions such as domestic violence, law –violatingchildren and traffic crime, the restorative justice has been successfully applied and it is now under evaluation in human right related cases. This is done in order to find out the effectiveness of this restorative justice in solving those cases. This writing aims to find out opportunities for the restorative justice implementation in solving human right violations in Indonesia. Restorative Justice adalah merupakan suatu bentuk model pendekatan baru dalam penyelesaian perkara pidana. Model pendekatan restorative justice ini sebenarnya telah digunakan dibeberapa negara dengan fokus pendekatannya kepada pelaku, korban dan masyarakat dalam proses penyelesaian kasus hukum yang terjadi diantara mereka. Walaupun model pendekatan ini masih banyak diperdebatkan dalam tataran teori oleh para ahli, namun dalam kenyataannya tetap tumbuh dan eksis serta mempengaruhi kebijakan dan praktek hukum di banyak negara. Permasalahan dalam penelitian ini yaitu bagaimana mekanisme penerapan pendekatan restorative justice dalam penyelesaian kasus hukum di Indonesia dan bagaimana konsep restorative justice dapat menjadi bagian dari pembaharuan hukum pidana di masa yang akan datang. Dengan menggunakan metode penelitian deskriptif analitis dan bersifat kualitatif, dapat disimpulkan bahwa Indonesia dengan angka kejahatan yang relatif tinggi, patut pula untuk dipertimbangkan model restorative justice ini menjadi bagian dari pendekatan dalam penyelesaian kasus-kasus hukum yang terjadi selama ini. Dalam perkembangannya prinsip restorative justice sudah diintrodusir melalui sejumlah ketentuan dalam RUU KUHP dan diversi terhadap anak, terutama untuk memberikan keseimbangan perhatian diantara stakeholders hukum pidana (pelaku, korban, masyarakat dan negara). Tentunya, model pendekatan ini diharapkan dapat menjadi bagian dari pembaharuan hukum pidana Indonesia di masa yang akan datang guna mencapai keadilan, kepastian dan kemanfaatan sebagai tujuan dari hukum itu sendiri.<p>Restorative justice is a new approach model to solve criminal matters. Restorative justice model is an approach that has actually been used in several countries with focus its approach to offenders, victims and the community in the process of settlement of legal cases that have happened among them. Even though the model has still been widely debated in the level of theory, but in fact, it still grows and exists, also influences policy and practice of the law in many countries. Based on the reasons, the focus of this study, namely: How is a mechanism of a restorative justice approach in solving legal cases in Indonesia? How is the concept of restorative justice that can be a part of the reform of criminal law in the future? The research applies descriptive analysis study and uses qualitative method. The result of the study shows that Indonesia as a law state with criminal figures relatively high ought also to be considered that the model of restorative justice may become an approach for solving legal cases. Restorative justice principles in development have already been introduced through a number of provisions in the Criminal Code Bill and diversion of children, especially to provide a balance among stakeholders in criminal law (perpetrators, victims, community and nation). Of course, this model is expected to be a part of the Indonesian criminal law reform in the future to bring justice, certainty and expediency as the purpose of the law itself.</p>

The basic idea underlying the reform of  the Criminal Code Bill has an impact on reforming the pillars of criminal law. The purpose of this research is to find out the new direction of criminal law policy regarding criminal acts, criminal responsibility and punishment. The research method uses normative legal research. The results of the research study in the discussion section are the reform of the pillars of criminal law, namely criminal acts, criminal liability, and punishment oriented to the basic idea of ??the value of balance. The reform of the pillars of criminal acts is aimed at broadening the meaning of the legality principle which provides space for living law as a source of law and also creates juridical terminology regarding criminal acts. The pillar of criminal responsibility accommodates the principle of no crime without error. The pillar of punishment is that the purpose of punishment is no longer synonymous with retaliation, but there are efforts to improve the behavior of the perpetrators of crime. The changes in the three pillars are influenced by the basic idea of ??balancing the values ??of Pancasila, namely the values ??of Divinity, Humanity, and Society. Recommendations in strengthening the direction of criminal law reform are needed in formulating criminal provisions outside the Draft Criminal Code that must be in accordance with the basic idea of ??balance which is the ideal of criminal law reform law. Ide dasar yang melandasi pembaruan RUU KUHP berdampak pada pembaruan pilar hukum pidana. Tujuan penelitian untuk mengetahui arah baru kebijakan politik hukum pidana mengenai tindak pidana, pertanggungjawaban pidana dan pemidanaan. Metode penelitian menggunakan penelitian hukum normatif. Hasil kajian penelitian dalam bagian pembahasan ialah pembaruan pilar hukum pidana yakni tindak pidana, pertanggungjawaban pidana, dan pemidanaan berorientasi pada ide dasar nilai keseimbangan. Pembaruan pilar tindak pidana tertuju pada perluasan makna asas legalitas yang memberikan ruang pada hukum yang hidup sebagai sumber hukum dan melahirkan pula terminologi yuridis mengenai tindak pidana. Pilar pertangungjawaban pidana mengakomodasi asas tiada pidana tanpa kesalahan. Pilar pemidanaan bahwa tujuan pemidanaan tidak lagi identik pembalasan akan tetapi ada upaya memperbaiki perilaku dari pelaku kejahatan. Perubahan ketiga pilar tersebut dipengaruhi oleh ide dasar keseimbangan nilai Pancasila yaitu nilai Ketuhanan, Kemanusiaan, dan Kemasyarakatan. Rekomendasi dalam memperkuat arah pembaruan hukum pidana diperlukan dalam merumuskan ketentuan pidana di luar RUU KUHP harus sesuai dengan ide dasar keseimbangan yang menjadi cita hukum pembaruan hukum pidana
