ABSTRACT In the Law No. 5 of 2014 concerning the State Civil Apparatus has emerged a new terminology named Te Government Contract Workers. Te presence of the Government Contract Workers followed by a reason but as part of the Bureaucratic Reform to improve the professionalism of the state apparatus, one of which is done by structuring the management system in terms of procurement and the appointment of the State Civil Apparatus.But, the law protection provided by the Government for the Government Contract Workers is perceived not enough. Terefore, the form of law protection that should be given are rights received by the Government Contract Workers related with welafare, appointment of the Government Contract Workers to be the Government Permanent Workers, Issue Te Government Regulations about Te Government Contract Workers Management. Adanya PPPK bukan tanpa alasan namun sebagai bagian dari reformasi birokrasi untuk meningkatkan profesionalisme aparatur negara yang salah satunya dilakukan dengan penataan sistem manajemen dalam hal pengadaan dan pengangkatan Aparatur Sipil Negara. Tetapi, perlindungan hukum yang diberikan Pemerintah untuk PPPK saat ini masih dirasa belum cukup. Oleh karena itu bentuk perlindungan hukum yang seharusnya diberikan yaitu mengenai hak yang diterima PPPK yang terkait dengan kesejahteraan, pengangkatan PPPK menjadi PNS, menerbitkan Peraturan Pemerintah tentang manajemen PPPK. Kata Kunci: Perlindungan Hukum, Pegawai Pemerintah dengan Perjanjian Kerja, Reformasi Birokrasi.

Abstract. The purpose of this article is to outline the main concepts of improving efficiency in the system of the state apparatus of the Republic of Kazakhstan by improving Human Resources management system in these organizations. Based on the data from international and local statistical resources, performance of state bodies in Kazakhstan is not currently sufficiently effective despite the involvement of high professionals in this sector working even more than eight hours a day. Multiple studies of organizations in the developed countries show that happy employees are more productive and creative. In this regard, the author of this article measured the level of happiness in the government agencies, which occupy the first and last positions in the System of annual assessment of the performance of state bodies of the Republic of Kazakhstan in order to determine whether there is a correlative dependence between the level of employee’s happiness and effectiveness of the employer. Based on the analysis of the data obtained, recommendation are provided in the article to improve human resources management system, specifically, via measuring level of employee satisfaction and forming positive working culture in the state bodies.

The purpose of this research is to see the open selection mechanism in the government of Bantul district. Because the success of bureaucratic reform is a part of human resources within the government bureaucracy. Therefore it is necessary to have human resource management to realize a state of civil apparatus with integrity, professionalism and competence. In this study, researchers used qualitative approach methods. Where in the technique is done in-depth interviews to get information and gather other supporting documents on this research. Human resource management could be done by structuring employees through an open selection mechanism. The Government of Bantul District has conducted an open selection in structuring employees who are in their government. Because the open selection is considered a solution in the screening of the state civil apparatus. Moreover, the Bantul Government in the open selection process uses several stages including administration selection, competency tests, interviews, and paper presentations. With the existence of several stages carried out in the open selection process by the Bantul Government, it is expected to capture and create a state civil apparatus who are professional and competent in running of bureaucracy in the government. So the existence of the state civil apparatus competent then will be influenced in its performance.

Universities that apply the concept of Public Service Agency (BLU - PK PTN ) in performing functions as an organ which is engaged in the service infrastructure support through goods or services . As an institution under the auspices of the government and the state budget receives PTN PK - BLU implement mechanisms to acquire goods or services in accordance with the law. However, the procurement process in obtaining goods or services sometimes poses problems that arise as a consequence of the passage of the procurement of goods or services involving the organs in it as PA / KPA , KDP , ULP , and Committee / Receiver Procurement Officer. Rector of the KPA in PK - BLU PTN has the authority to control the organs that carry out the process of procurement of goods / services in the environment . Errors in the procurement process of goods / services performed by the CO and the ULP / Procurement Officer causing state losses due to these errors, either due to negligence or unlawful acts. As the KPA in the process of procurement of goods / services Rector can control the organs in accordance with the authority given. The consequences are acceptable if the authorities ultimately the procurement of goods / services did not heed the warning Rector officials related procurement process of goods / services will receive sanctions. During that period in the field of education was held a radical change in the direction of intensive Romanization. In period of rigid occupation regime in the province, the government of Romania laid its hopes on the University. AbstractFor many communists working in the Soviet state apparatus during the 1920s, the state's continued employment of so-called “bourgeois specialists” (spetsy) was an ideological affront and an obstacle to proletarian advancement. In their eyes, until the spetsy were removed and workers staffed the institutions of the state, the revolution would be neither secure nor its promises fulfilled. Based on archival research, this article traces rank-and-file communists' attempts to remove one such specialist, N. A. Dobrosmyslov, from his position in the Tax Department (Gosnalog) of the People's Commissariat of Finances (Narkomfin). Dobrosmyslov had been a long-time official in the tsarist tax bureaucracy and had also worked for the Provisional Government in 1917. Communist opposition to him took the form of a denunciation campaign that focused on his alleged anti-Sovietism, his professional competence, his arrogant manner, his high salary, and his attempt to obtain a large pension from the government. The documents related to the case reveal the atmosphere of suspicion and often open hostility that surrounded the spetsy. They provide evidence of the contrasting evaluations of the spetsy made by leading communist administrators and by the lower-level communists who worked closely with them. They also show how important the issue of material compensation was for this latter group. Finally, the case provides an example of how biography could be interpreted and manipulated to serve particular ends, especially in the context of political and personal denunciation.

Hitzarmen horrek, hain zuzen ere, espazio horietako ibai-arrantza, itsaski-bilketa eta akuikultura arautzen ditu, bai eta horietan egindako arau-hausteen ikuskapena eta zehapena ere, eta konstituzioa onartu eta ia berrogei urtera, ez du zuzenketarik izan araudi berrira egokitzeko. Esto es, a la competencia exclusiva de la Comunidad Autónoma Vasca en esas materias y en esas aguas. Para corregir esta anomalía se propone que los órganos competentes de la Comunidad Autónoma Vasca soliciten al Gobierno del Estado la enmienda del Convenio en el marco de los procedimientos instaurados por los arts. 49, 50 y 51 de la Ley 25/2014, de 27 de noviembre, de Tratados y otros acuerdos internacionales; procedimientos que contemplan la participación autonómica. ABSTRACT: The article deals with the unconstitutionality, as far as Spain is concerned, of the Spanish-French Convention of July 14, 1959, concerning fishing in the Bidasoa and Higuer Bay; treaty ruling river fishing, shellfish and aquaculture in these waters as well as inspection and punishment of violations of it. Nevertheless, nearly forty years after the current block of constitutionality it has not been adapted to it; this is the exclusive competence of the Basque Autonomous Community in these areas and in those waters. To correct this anomaly the request by the competent bodies of the Basque Autonomous Community for the amendment of the Convention to the Government of the State in the framework of the procedures set up buy articles 49, 50 and 51 of the Law 27/2014, of 27 November, of treaties and other international agreements; procedures including regional participation, is proposed.

The role of taxes is very important in the state finances. Taxes become necessary in financing the expenditures of the state, especially the routine state expenditures. However, not infrequently there are taxpayer actions that cause in State losses. The condition is realized by the government so that the government issued Law Number 11 Year 2016 on Tax Amnesty. However, with the issuance of the Tax Forgiveness Law, it has resulted in various views in the community because for some obedient taxpayers, it is assumed that taxpayers are granted the convenience of their mistakes. So that does not reflect justice as one of the objectives of the law. Based on the issue, the authors will conduct further research on the legality of tax debt relief in the framework of tax forgiveness and the urgency of determining the tax forgiveness rule. This study is qualified as a normative juridical legal research with a type of legal research doctrinal using a statutory approach, and a conceptual approach. From this research, it is expected that the writer can analyze related to the legality of tax debt relief in the framework of tax forgiveness and the urgency of determining tax forgiveness rule.

Abstract: The role of marriage registration (recording) is important particularly in maintaining and protecting the rights of individuals to prove the marriage implementation. Registration of marriage, therefore, is governed by various related rules or regulation. Unfortunately, the registration of marriage is only as a normative one. Meanwhile, most Muslims do not obey the law of marriages arranged by the state because the law is ambiguous, having multi interpretations and difficult to implement. In fact, there are many negative effects emerging from marriage under the hands such as not getting the marriage certificate, and husband, wife and their children not being able to perform civil legal action against the genetic father who has left them. Therefore, marriage under the hand must be prevented with preventive, curative and anticipative measures. In order to produce a law that can respond to the changing demands of time, place, conditions and welfare of the spouses, the maqa>s}id al - shari>ah approach (the purpose of the law) is eligible to apply . Therefore, the government should change the law of registration of marriages that are not relevant to the state of society so that society will feel suitable with the legal registration of the marriage.

Legislation is one of the legal products issued by the state government component. In this case, the laws and regulations include the Constitution of the Republic of Indonesia year 1945, the Decree of the People's Consultative Assembly, The Law / Regulation of the Government In lieu of Laws, Government Regulations, Presidential Regulations, and Local Regulations. As for its application, the rules have levels in the arrangement, where there are sections that explain macro and its derivatives that are narrowing down to the implementing regulations. The levels of the rules must be complete because each of them has its own function.  Meanwhile, in this journal, there will be a discussion on the phenomenon of legal vacancies in the case study of Government Regulation of the Republic of Indonesia Number 51 of 2020 related to the Period of Extending Passports to 10 Years, where in the issuance of government regulations have not been included implementing regulations that will regulate how the implementation of government regulations in the field.

The Government through the Minister of State-Owned Enterprises (SOEs) in his position as a Shareholder in SOEs (Indonesian: Badan Usaha Milik Negara (BUMN) enacts the Minister of SOE Regulation Number: PER-15 / MBU / 2012 Regarding Amendments to the Regulation of the State Minister of State-Owned Enterprises Number PER-05 / MBU / 2008 Regarding Guidelines General Implementation of Procurement of Goods and Services of State-Owned Enterprises in SOE Subsidiaries. Which actions have raised the pros and cons of the capacity of the Minister of SOEs as BUMN shareholders in SOE subsidiaries. The legal status of BUMN subsidiaries in the BUMN holding scheme remains a separate legal entity that has their respective organs and responsibilities as regulated in the Law of PT. When the SOE Minister acts on behalf of the State, he is the shareholder of SOE as contained in Article 1 paragraph (1) of the BUMN Law. As a shareholder, the Minister of SOEs can only establish policies towards SOEs. Whereas in SOE Subsidiaries, the shareholders are SOEs as legal subjects. So that the provisions of Article 1 number (2) SOE Ministerial Regulation Number 3 of 2012 whereby the Minister of BUMN cannot act as a shareholder. The enactment of BUMN Permen 15/2012 to SOE Subsidiaries by SOEs Minister in his capacity as BUMN shareholder is an ultra vires action.
