The family theme permeates the work of the three titans of literature - Leo Tolstoy, Hervé Bazin and John Galsworthy. As is well known, these are great representatives of different generations and nationalities. The importance of the problem statement is self-evident; it is included in the register of the so-called "eternal plots". The institution of marriage and family, as well as issues of the extinction of love and the identification of the causes of the breakdown of relationships, will draw attention to themselves as long as humanity is alive. The family theme in the work of Leo Tolstoy is so voluminous, and the breadth of conclusions and generalizations in the work is so deep that it is fundamentally impossible to fit it into the framework of one article. Therefore, we limited ourselves to the most striking examples from Tolstoy's "flash fiction". To complete the picture, we pointed to the creative borrowing of a number of Tolstoy's ideas in the family epic sagas of Bazin and Galsworthy.

The article considers Leo Tolstoy's views on marriage in the evolutionary aspect. For young Leo Tolstoy, marriage and family is one of the main values. He understands them as a sphere saving a person from disharmony, despondency, sin, helping to find the meaning of life. The family is interpreted by Leo Tolstoy as the main purpose of person's life. In his early works, he builds a family model. Marriage and family for young Leo Tolstoy are considered to be the main condition for happiness. Love for the spouse is understood as a sense of respect for parents of their children. Over the years, Leo Tolstoy’s views on marriage have changed significantly. This is due to the change in Leo Tolstoy's attitude to the Church and to Church religion (by his definition), the writer's complete denial of private property, the complication of relations with his wife and children. Leo Tolstoy explains his point of view on marriage by following the true Christian teaching. Leo Tolstoy motivates the denial of marriage in the Christian way by the fact that the main purpose of a Christian is to serve God; marriage makes people serve themselves. Leo Tolstoy identifies justification by the church of the marriage with the excuse of "physical love". Leo Tolstoy considers marriage as a veiled form of fornication. However, he denied divorce because he believed that a woman left without a husband or a man without a wife would be exposed to moral decline. The author finds contradictory Leo Tolstoy's assessments of the marriage in the later work.

This chapter provides a case analysis of the Catholic Church’s Synod on the Family, an assembly of bishops convened in Rome in October 2014 and October 2015, to address the changing nature of Catholics’ lived experiences of marriage and family life. The chapter argues that the Synod can be considered a postsecular event owing to its deft negotiation of the mutual relevance of doctrinal ideas and Catholic secular realities. It shows how its extensive pre-Synod empirical surveys of Catholics worldwide, its language-group dialogical structure, and the content and outcomes of its deliberations, by and large, met postsecular expectations, despite impediments posed by clericalism and doctrinal politics. The chapter traces the Synod’s deliberations, and shows how it managed to forge a more inclusive understanding of divorced and remarried Catholics, even as it reaffirmed Church teaching on marriage and also set aside a more inclusive recognition of same-sex relationships.

Abstract After more than four decades since its reunification since 1975, Vietnam has achieved remarkable results in social and economic development. With the rapid speed of recent modernization, society has loosened numerous old values related to the family and promoted individual freedoms. Marriage and family affairs, including divorce, have modernized with liberal characteristics. The paper examines the trends of divorce and reasons for divorce using statistical data from the Vietnam People's Supreme Court and from the government's annual population statistics. The analysis compiled and analysed a database of every divorce case at six urban and rural districts in Can Tho province. The analysis highlights changes in the reasons for divorce in the South in comparison with previous divorce studies in the North of Vietnam, discussed in relation to modernization, individualism and gender equality. The analysis is supported by interview data with thirty male and female divorcees.

The article analyzes individual measures aimed at protecting and strengthening the institutions of marriage and family in the Republic of Belarus, in particular, the establishment of a differentiated rate of state duty charged for divorce in both judicial and administrative procedures, as well as the provision of basic and additional term for divorcing spouses to take reconciliation measures. The article is based both on the norms of international legal acts and their interpretation by the authorized bodies, as well as on the norms of the national legislation of the Republic of Belarus and current statistical data. The article draws a number of conclusions: on the non-uniform application of security terminology in relation to the institutions of marriage and family; on the irrational approach to setting the rates of state fees charged for divorce in an administrative procedure; on unnecessary administrative barriers in the form of a two-month term for registration of a divorce in administrative procedure.

В статье представлен сопоставительный анализ инноваций в семейной сфере осетин, их синтеза с традиционными компонентами семейного быта. Особое внимание уделяется особенностям взаимодействия таких институтов регулирования, как обычное право осетин, церковные установления и законодательство Российской империи. Теоретическую основу работы составили концепции ученых, исследовавших проблемы традиционных брачно-семейных отношений, особенностей трансформации семьи в период пореформенной модернизации. Источниковой базой для статьи послужили ранее не опубликованные архивные материалы: судебные дела по разводам, выплатам калыма, двоеженства; переписка Владикавказской епархии с начальником округа; ежегодные отчеты начальников округов Осетии начальнику Терской области. Новизна предопределена предметным обращением к новациям и их конкретным результатам: противоречиям между традиционным укладом семьи и некоторыми трансформациями, например, изменениями гендерных стереотипов и пр. Объектом исследования является традиционная осетинская семья XIX в. с характерными для той поры обычаями и традициями. Своей целью мы поставили выявление особенностей внедрения новаций, присущих российскому администрированию, в брачно-семейную сферу осетин. Следует уточнить, что научному анализу подвергаются отдельно взятые аспекты традиционных норм и установок патриархальной семьи. Высказывается мнение, что именно в семье воплотились наиболее значимые трансформации гендерных стереотипов, что имело свое отражение и в некоторых аспектах этнического сознания осетин. The article presents a comparative analysis of innovations in Ossetians family sphere and their synthesis with traditional components of family life. Special attention is paid to the peculiarities of interaction between such regulatory institutions as Ossetian customary law, church orders, and the legislation of the Russian Empire. The theoretical basis of the work is based on the concepts of those scientist who researched the problems of traditional marriage and family relations, the peculiarities of family transformation in the period of post-reform modernization. The source base for the article was previously unpublished archival materials: court cases on divorce, bride prices; the Vladikavkaz diocese correspondence with the district chief; annual reports of the district chiefs of Ossetia to the chief of the Terek region. The novelty is predetermined by a substantive appeal to innovations and their concrete results: contradictions between the traditional way of life of the family and certain transformations, for example, changes in gender stereotypes, etc. The object of the research is a traditional Ossetian family of the XIX century with customs and traditions typical for that period. Our goal is to identify the features of introducing innovations applied by Russian administration in the marriage and family sphere of the Ossetians. It should be clarified that only specific aspects of traditional norms and attitudes of the Patriarchal family are subject to scientific analysis. It is suggested that it was in the family where the most significant transformations of gender stereotypes took place, which was also reflected in some aspects of the ethnic consciousness of the Ossetians.

Russian conflict of laws rules that determine the choice of law applicable to marriage and family relations associated with foreign law and order came into force in 1995 and have been in effect for more than 25 years. Despite the fact that this problem has been studied in great detail in the Russian legal doctrine, the relevance of the analysis of conflict of laws rules set forth in the Family Code of the Russian Federation is by no means exhausted due to the large-scale reform of the rules of Private International Law in the Civil Code of the Russian Federation and the current legislative regulation of international family relations in other States. The article concludes that conflict of laws regulation of the international family relations in the Russian Federation adopted more than 25 years ago needs serious modernization. It is reasonable to carry out the corresponding updating in the following directions: maximum specification of the content of conflict of laws rules for the purpose of more differentiated regulation of the family relations; establishment of a complex and detailed system of the connecting factors aimed at correct determination of the law the most closely connected with the relation and decision-making; the expansion of possibility of choice of the applicable law to divorce and property relations; application of the law the most favorable for a child should become a dominating connecting factor.

This chapter describes what might be the last battleground over “traditional” marriage—same-sex marriage, and the social and legal revolution that brought us from an era in which it was never contemplated to one in which, depending on the state, it is either expressly authorized or expressly prohibited. Same-sex marriage has posed—and continues to pose—a challenge to traditional definitions of marriage and family. But, more importantly, the issue implies broader changes in family law—the increasing role of constitutional analysis; limits on the right of government to regulate the family; and the clash between the traditional family form and a new and wider menu of intimate and household arrangements, and all this against the background of the rise of a stronger form of individualism.

Gender role issues permeate nearly all aspects of marital and family life, and understanding the ways that women and men and girls and boys are different and similar will heighten our understanding of marriage and family relationships in general. Although theory and experience seem to insist that gender differences clearly exist, empirical evidence about similarities or differences—with few exceptions—is not so clear. In this article, I argue that these ambiguities can be traced in large part to conceptual and methodological issues, such as construct definitions, measurement techniques, and sampling, as well as inattention to the historical context. Throughout the article, I focus particularly on division of household labor to illustrate how attending more carefully to method, theory, and history can enlarge our understanding of how gender roles are played out in the family. In the last section of the article, I discuss ways in which gender role issues might be thought about and studied beyond the individual and the dyad to the family as a whole.
