Islamic law gives a high appreciation for the human equality. It happens because all humans come from one source, Allah S.W.T. Respecting of human rights is regulated in fiqih, holy Qur’an, and hadist. From the Islamic law perspective, the differentiate of human level is on their devotion. Working as a migrant worker is allowed in Islamic Law. State gives regulation for the Indonesian migrant in a constitution No 18, 2017 year. The constitution is provide to give all society to have work both of domestic and overseas with a certain period, of course they get salary. Working is a citizen’s right. The purpose of migrant is to get bigger result. Other factor which triggers the Indonesian citizen of Indonesia to change the fate is the difficulty of getting work. There are many kinds of work in this country. Various job opportunities that exist in this country but most of them have been occupied by Indonesian society. Consequently, it is being minimum opportunity for the next generation. Indonesian mindset of working abroad to be a migrant worker is a necessity. The real fact is when women work, and then they have to perform two roles, as a wife or a mother as well as a worker.  This article will discuss about the female position as a migrant viewed from the religion point of view, especially in term of Islamic law related to Indonesian female migrant workers.

<p><em>In this study, researchers examined the role of the Village Care for Migrant Workers (Desbumi) program in mentoring female migrant workers in Darek Village, Praya Barat Daya District, Central Lombok Regency. This research is field research with data collection steps, namely interviews, documentation and observation. Therefore, this research aims o find out female migrant worker assistance patterns through the Desbumi program in Darek Village, Praya Barat Daya District, Central Lombok Regency. The results and discussion in this study are that the Desbumi program has three roles. First. Information center provides information to migrant workers about safe and legal migration (safety migrations). Second is the mobility data center, which assists prospective migrant workers in arranging migration filings at the village office. Third, the center for case advocacy, namely the role in providing protection and assistance to migrant workers who experience problems abroad.</em> <em>Meanwhile, the pattern of assisting female migrant workers in the Desbumi program approach is namely. First, pre-work mentoring, namely conducting socialization to the community by bringing migration flyers that have been given by Migrant Care and from the BNP2TKI office in Central Lombok Regency. It then provides an opportunity for people to ask questions about safe migration. Second, after work assistance, the Desbumi program can carry out consolidation and integration with Migrant Care, PPK and BNP2TKI if they encounter problems with migrant workers abroad. Furthermore, they confirm through social media with the Desbumi program in Darek Village, Praya Barat Daya District, Central Lombok Regency. Third, post-work mentoring, where former migrant workers are empowered in the village with various empowerment approaches. These approaches included making crackers, chips, sewing training and soft skills activities supported by the village government, Migrant Care, the Mataram City Panca Karsa Association (PPK), and BNP2TKI Central Lombok Regency </em></p><p> </p><p>Dalam penelitian ini, peneliti mengkaji peran dari program Desa Peduli Buruh Migran (Desbumi) dalam pendampingan buruh migrant perempuan di Desa Darek Kecamatan Praya Barat Daya Kabupaten Lombok Tengah. Penelitian ini merupakan penelitian lapangan dengan langkah pengumpulan data yakni wawancara, dokumentasi dan observasi. Oleh karenaitu, tujuan dalam penelitian ini yakni untuk mengetahui bagaimana pola pendampingan buruh migrant perempuan melalui program Desbumi di Desa Darek Kecamatan Praya Barat Daya Kabupaten Lombok Tengah. Hasil dan pembahasan dalam penelitian ini yakni, bahwasannya program Desbumi memiliki tiga peran seperti. Pertama. Pusat Informasi yakni untuk memberikan informasi pada buruh migrant tentang bermigrasi yang aman yang legal. Kedua, pusat data mobilitas yakni untuk membantu calon buruh migrant mengurus pemberkasan migrasi di kantor desa. Sedangkan pola pendampingan buruh migrant perempuan dalam pendekatan program Desbumi yakni. Pertama, pendampingan sebelum bekerja yakni melakukan sosialisasi ke masyarakat dengan membawa pamphlet migrasi yang sudah diberikan oleh pihak Migrant Care serta dari kantor BNP2TKI Kabupaten Lombok Tengah. Kemudian memberikan kesempatan bagi masyarakat untuk bertanya tentang migrasi yang aman. Kedua, pendampingan setelah bekerja yakni program Desbumi dapat melakukan dengan konsolidasi dan integrasi dengan Migran Care, PPK dan BNP2TKI jika menerima problematika buruh migran di luar negeri, dan melakukan konfirmasi melalui media social dengan adanya program Desbumi di Desa Darek Kecamatan Praya Barat Daya Kabupaten Lombok Tengah. Throughout history, migration has been considered an indispensable part of human life. It has occurred due to various reasons, among which searching for new job opportunities has always been a chief one. This happens when workers observe lack of vacancies in their homeland, while there are chances for them in other regions and countries. It impels local workers to move to leave in search of better conditions in their careers, along with having the desire for a better life. However, divergent factors such as demographic change, socio-economic and political crises, and huge wage gaps between developed and developing countries play undeniable roles. Half of these migrants who move across borders for employment are women. Most of these women migrate from Asia especially India, Pakistan and Nepal to developed countries in the world to achieve new opportunities and a better life. The aim of this study is to identify the distribution of international female migrant workers around the world by applying compilation methodology approach, utilizing library documentation method and secondary analysis of qualitative data. The findings indicate that there is a strong connection between gender gap at work and the destination of female migrant workers. Nowadays, Northern, Southern and Western Europe and North America have the least gender gap between women and men at work. These regions are also the main destination of female international migrants. This research also predicts that in the future the destination of these women will be East Asia which is experiencing remarkable gender equality at work.

The purpose: to study the rule of law as a principle in the judiciary in such aspects as to clarify the origins of the idea of the rule of law, the relationship between the concepts of the rule of law and the judiciary, analysis of relevant doctrine in Ukraine. Methods: dialectical, hermeneutic, prognostic, comparative-legal, formal-logical, method of modeling, decomposition, complex analysis, intersectoral method of legal research, logical methods that were used as tools to achieve this goal. Results: Applying the principle of the rule of law, the judge must remember it as a global goal of justice - the rule of law in society. The resolution of every dispute and any legal conflict must be aimed at adhering to this principle. Scientific novelty: From a practical point of view, the rule of law determines the place of the judiciary in the system of public power, which should attest not only to the real separation of powers but also to the judiciary's ability to limit the discretion of the legislature and the executive. This is possible only if the court (and justice procedures) are independent of other branches of government. This approach to the relationship between the separation of powers (traditionally - an element of the concept of the rule of law) brings together the concept of the rule of law and the idea of the rule of law in modern conditions. The principle of the rule of law in the modern state is studied. Emphasis is placed on the scope of the rule of law, which includes: legality, which provides for a transparent, accountable and democratic process for the implementation of legal provisions; legal certainty; prohibition of arbitrariness; access to justice; respect for human rights; prohibition of discrimination; equality before the law. Conceptually, the rule of law is to limit the arbitrariness of public authority over society and the individual. Different ways of establishing the system of the rule of law (the court through the application of human rights directly forms the system of the constitution - the English tradition; it is created by the people through the exercise of constituent power - the European continental tradition) are not fundamental. From a practical point of view, the rule of law determines the place of the courts in the system of public power, which must attest not only to the real separation of powers but also to the judiciary's ability to limit the discretion of the legislature and executive. This is possible only if the court (and justice procedures) are independent of other branches of government. This approach to the relationship between the separation of powers (traditionally an element of the rule of law) brings together the concepts of the rule of law and the rule of law. The article is devoted to a comprehensive study of the theoretical foundations of judicial law enforcement in Ukraine as a special process of practical achievement of the rule of law in the daily activities of courts, carried out after the constitutional reform of justice in 2016-2017. The acute theoretical and applied need to find ways and means to ensure the unity of law enforcement after this reform, which allowed to form a new scientific approach to solving problems of judicial law enforcement. The problem is solved with the help of intersectoral methodology and integration in law, given the expansion of the functions of the judiciary, in particular, in terms of increasing the law-making role of courts (the theory of "soft" separation of state power). The article proves that the current state of transit legislation in Ukraine leads to the fact that the courts of first instance (sometimes - the appellate court as courts of first instance) take on challenges - to consider the case, guided by the rule of law, taking into account not only the balance of public and private interests, but often the existence of gaps in laws or applying poor quality legislation. The result of judicial enforcement in such cases is the completion of a rule of law, which in fact can be considered a judicial rule and become the basis for the emergence of a new law, the maintenance of which during the review of the court decision gives it a precedent, and thus lower courts promote judicial supremacy.

Jihad in Islam is not a war that is termed a "religious war” (al-harb al-muqaddasah) - as perceived by Westerners all along. However, Jihad is: any action accompanied by sincerity, every useful perseverance, and every firmness of faith in the soul, so that we are able to fight against the various challenges in this life, which continue to evolve all the time in our souls, and in our environment. Therefore Jihad is a fountain that never diminishes for every Muslim to drink and to serve as a source of strength and energy so it creates a perfect readiness in assuming a responsibility to submit to the will of Allah SWT based on awareness and belief. Indeed jihad is a form of preparedness for Muslims as a form of self-defense of the enemies of Islam for the establishment of Islamic law in Islamic social life in the Islamic State. The history has spoke since Islamic countries have never been peacefull, human rights abuses and wars as historical evidence shows. That the enemies of Islam in this hemisphere are very intelligent to turn facts with various ways and means owned. Yet the real terrorists are very clear, as clear as the sun in broad daylight.

Being a migrant worker is an alternative choice for many Karawang people to get out of the economic hardship. The decision of many women to be a migrant worker indicates the reposition of their role from reproduction to production. However, this creates internal problems, as well as deeply affects their domestic functions and roles, in their families. This research aimed to describe the reposition of women’s role in migrant workers’ families related to their decision to work abroad. Case study was the method used to provide a complete and in-depth view on the subject under study. The subject was multi-sources with ten key informants of female migrant workers from Tempuran District in Karawang Regency. Data were collected through in-depth interview, observation, and library study. The result shows that the reposition of female migrant workers’ role in Karawang is from domestic sphere (as housewives) to public sphere (as breadwinner). It occurs because of family economic pressure, which eventually resolved by working abroad. Although it has a positive impact on the fulfillment of family economic needs, it has a negative impact on psychological and social aspects of abandoned husbands and children.

AbstractIn this article, I depart from the factual difficulties of undocumented migrants to access a state’s protection mechanisms for avowedly universal human rights. I relate this aporia to two competing conceptions of territorial jurisdictions. Drawing on the Convention on the Rights of the Child and the Migrant Workers Convention, I separate the sphere of the political community (the polis) and that of the house-hold (the oikos) in developing a political theory of undocumented migration. It rests two central tenets: one is a tributary transaction between sending state and host state, in the course of which the undocumented migrant worker is offered without conditions attaching, yet with the hope of remittances flowing in return. This offering relates to the oikos, which makes available a limited degree of protection under labour law. The second is a contractual form of submission by the undocumented migrant worker, which is structurally analogous to the master-slave relationship developed in Hobbes’ defense of war slavery. This is related to the polis, which denies all meaningful political activity to the undocumented migrant (as reflected in the denied right to found labour unions). Finally, drawing on Werner Hamacher’s work, I analyse how human rights are intrinsically related to a position of privacy, which escalates into a form of isolation under the structures producing undocumented migrants.

Purpose of the study: This research aims to describe legal issue related to the protection to Indonesian migrant workers who work abroad and to analyze the existence of migrant workers in Indonesia, viewed from human rights which must get legal protection in constitution and regulation of legal norm and implementation in the applicable legislation. Methodology: This research used the normative research methodology supported by empirical data from the document of institutional study. Main Findings: Research about the protection of human rights in Indonesian Migrant Worker sector is a certainty. It is guaranteed in the international documents (Declaration of Human Rights in the United Nations, Convention of United Nations on Ecosoc and ILO Convention) and national documents (1945 Constitution and Law of Indonesian Migrant Worker Protection). However, in the perspective of its implementation, it has complexity. The protection to Indonesian migrant workers involves many parties, central and regional rules, and culture. This research focuses on the context of Indonesian Migrant Worker protection in a country where they work from the perspective of human rights. This research has novelty since it captures and analyzes issue of Indonesian Migrant Worker in rules and empirical terms based on the database. Applications of this study: this study can be useful for Immigration is one of the instruments to support unity of family with different nationality background. Novelty/Originality of this study: The new in this study that may find the ideal concept of the treasury of jurisprudence, particularly for foreign citizens who legally get married with Indonesian citizens and ex-Indonesian citizens and children born from legitimate mixed marriage with double citizenship.

One of cases in islamic law today is same-sex marriage. The case sparked a controversy in muslim society. On theone hand, the case can be seen as an integral part of a person’s rights to meet the biological needs, but on the otherhand is seen as a violation of religious norms and moral principles. Those who have a sexual orientation towardsthe same gender (homosexual), which was also approved this orientation, continue to get same-sex marriagelegalization because a sense of love towards the same sex due to biological and psychological factors is viewed aspart of human rights. This paper attempts to examine same-sex marriage from the point of view of Islamic studies.[Salah satu kasus dalam hukum Islam saat ini adalah perkawinan sesama jenis. Kasus ini memicukontroversi. Di satu sisi, kasus tersebut dapat dipandang sebagai bagian tidak terpisahkan dari hakhakasasi seseorang untuk memenuhi kebutuhan biologisnya, tetapi di sisi lain dipandang sebagaipelanggaran norma keagamaan dan moral yang prinsip. Mereka yang memiliki orientasi seksualterhadap gender yang sama (homoseksual), juga yang menyetujui orientasi ini, terus berupaya untukmendapatkan pelegalan perkawinan sejenis karena rasa suka terhadap sesama jenis yang disebabkanfaktor biologis dan psikologis dipandang sebagai bagian dari hak-hak asasi manusia (HAM).
