As the gateway to the criminal justice system, law enforcement that carried out by polri always influenced by social change factors. In accordance with the development of law today, polri required to be able to resolve criminal acts by prioritizing restorative justice approach. However it hasn’t been regulated in statutory. The research purposes to describe and analyze the settlement of criminal acts with restorative justice approach in investigation level at the present and the future. The research used normative legal research, using a statute approach, historical approach and comparative approach, using primary and secondary legal materials that collected by a systematic method and then analyzed by descriptive and interpretation techniques. The research show that polri has carried out several policies to answer the community expectations and demands in accordance with the development of law today by issuing several letters and regulations, namely Surat Kapolri No. Pol. B/3022/XII/2009/Sde Ops, ST Kabareskrim No. ST/110/V/2011, STR Kabareskrim No. STR/583/VIII/2012, Perkap 15/2013, Perkap 3/2015, SE Kapolri No. SE/7/VII/2018 and SE Kapolri No. SE/8/VII/2018. In perspective of “ius constituendum,” it is needed criminal law policy to regulate the settlement of criminal acts with restorative justice approach in investigation level, by carrying out a renewal of material criminal law, including the understanding of criminal acts, objectives and guidelins for criminal actions and also renewal of formal criminal law including updating KUHAP, Perkap 14/2012 and Perkap 3/2015. Sebagai pintu gerbang sistem peradilan pidana, penegakan hukum yang dilakukan polri selalu dipengaruhi oleh faktor perubahan sosial. Dalam perkembangan hukum dewasa ini, polri dituntut mampu menyelesaikan tindak pidana dengan mengedepankan pendekatan restorative justice. Akan tetapi hal itu belum diatur dalam peraturan perundang-undangan. Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis pendekatan restorative justice dalam penyelesaian tindak pidana di tingkat penyidikan pada saat ini dan pada masa yang akan datang. Metode penelitian yang digunakan adalah jenis penelitian hukum normatif, menggunakan pendekatan perundang-undangan, pendekatan kasus, pendekatan historis, pendekatan perbandingan dan pendekatan konsep, dengan menggunakan bahan-bahan hukum primer dan bahan-bahan hukum sekunder yang dikumpulkan dengan metode sistematis yang selanjutnya dianalisis dengan teknik deskriptif dan interpretasi. Hasil penelitian menunjukkan bahwa polri telah melakukan beberapa kebijakan untuk menjawab harapan dan tuntutan masyarakat sesuai dengan perkembangan hukum dewasa ini dengan menerbitkan beberapa surat dan peraturan, yaitu Surat Kapolri No. Pol. B/3022/XII/2009/Sde Ops, ST Kabareskrim No. ST/110/V/2011, STR Kabareskrim No. STR/583/VIII/2012, Perkap 15/2013, Perkap 3/2015, SE Kapolri No. SE/7/VII/2018 dan SE Kapolri No. SE/8/VII/2018. Dalam perspektif ius constituendum diperlukan kebijakan hukum pidana untuk mengatur penerapan konsep restorative justice dalam penyelesaian tindak pidana di tingkat penyidikan, dengan melakukan pembaharuan hukum pidana materiil, mencakup pengertian tindak pidana, tujuan dan pedoman pemidanaan, serta melakukan pembaharuan hukum pidana formil, mencakup pembaharuan KUHAP, Perkap 14/2012 dan Perkap 3/2015.

This research was conducted to analyze and find out how criminal law policy is in the effort to apply criminal sanctions against children facing the law in terms of Law No. 11 of 2012 concerning the Criminal Justice System for Children and whether the concept of Diversity can be applied in the process of law enforcement against children involved in Narcotics Crimes. This research is a normative study, to analyze the legal material related to the problem under study, the author uses the Interpretation, Subjective and Objective Interpretation instruments, after that the authors process these legal materials by deductive thinking. The results obtained from the study that the drafting of Law Number 11 of 2012 is a replacement to Law Number 3 of 1997 concerning juvenile justice conducted with the aim of establishing a judiciary that truly guarantees the best protection of the interests of children facing the law as nation's next generation. The concept of Restorative Justice is one of the important things in Law Number 11 of 2012 where restoring the situation as it used to be the main goal and also no less important is the form of criminal sanctions that can be imposed on Children where criminal sanctions that are harsh and miserable are used as ultimum Remedium is not as a premium remedium especially as a maximum remedium. The concept of diversion that should be applied in Indonesia in the future, should be a combination of the concept of diversion that is applied in Australia, namely Police Diversion which is combined with the process of handling cases with the diversion prevailing in Indonesia today.

AbstractCriminal justice system as a tool of law enforcemen didn�t work optimally, in fact criminal justice system in Indonesia be acquainted whith principle of function difference impact on law enforcemennt performance so it will be difficult to achieve its function, as a crime prevention effort. This research purpose to set system concept and ideal approaches the organization of a unified criminal justice system so as to achieve an optimal performance of the criminal justice system (CJS) in criminal law enforcement, by approachng the system and re-structural, substantial and cultural reorientation of the criminal justice system.the main object of research is againt criminal law enforcement policy, the approach used is a normative juridical and sosiological approach complemented by a historical aproach/contextual and global/comparative, by prioritizing secondary data whit qualitative analysis. The result of the research show the sub system in the criminal justice system (such as investigation, prosecution, adjudicate and execution) funcionally and institutionally has not yet shown the existence of an integrated criminal justice system when viewed partially, the components of the support component seem to separate from one another, and tend to be centric institutions. Understanding of the integrated criminal justice system is inseparable from an understanding that includes substantial meaning, but also a philosophical aspect about the meaning justice and be nefit integrated. Therefore the legal culture is an integral part. ����Keyword: implementation of the criminal justice system, functional differentiation, integrated approach.Abstrak Sistem peradilan pidana sebagai sistem penegakan hukum dengan menggunakan hukum pidana, tidak berjalan secara optimal bahkan sistem peradilan pidana di indonesia dikenal asas �differensiasi fiungsional� berdampak pada kinerja penegakkan hukum sehingga akan sulit untuk mencapai fungsinya, sebagai upaya penanggulangan kejahatan. Penelitian ini bertujuan untuk menemukan konsep sistem dan pendekatan yang ideal penyelenggaraan sistem peradilan pidana yang integral sehingga terwujud suatu kinerja Sistem peradilan pidana (SPP) yang optimal dalam penegakan hukum pidana, dengan melakukan pendekatan sistem dan reorientasi struktural, substansial dan kultural terhadap sistem peradilan pidana. Objek utama penelitian ialah terhadap kebijakan penegakan hukum pidana, pendekatan yang digunakan adalah pendekatan analisis yuridis normatif dan sosiologis dilengkapi dengan pendekatan historis/kontekstual dan global/komparatif, dengan mengutamakan data sekunder dengan analisis kualitatif. Hasil penelitian menunjukkan sub-sistem dalam sistem peradilan pidana (sub-sistem penyidikan, penuntutan, mengadili dan pelakasana pidana) secara fungsional dan kelembagaan belum menujukkan adanya perihal sistem peradilan pidana terpadu (SPPT) apabila dilihat secara parsial, komponen-komponen pendukung terkesan terpisah antara satu dengan yang lainnya, serta cenderung bersifat �instansi sentris�. Pemahaman mengenai sistem perdilan pidana terpadu tidak terlepas dari pemahaman yang mencakup makna substansial, tapi juga menyentuh aspek filosofis mengenai makna keadilan dan kemanfaatan secara terintegrasi. This article discusses how the law arrangements in the juvenile justice in the process of resolving the case, How restorative justice restrictions in law enforcement in Indonesia and How the application of Restorative justice law in the process of settlement of criminal case in Criminal Law in Indonesia. This type of research is normative juridical that describes reviewing and explaining and analyzing normative provisions associated with restorative justice applicable in Indonesia. From the above discussion that restorative justice in the settlement of criminal acts committed by children is very concerned in rebuilding relations after the occurrence of criminal acts, rather than exacerbate the rift between the perpetrators, victims and the community which is the character of the current modern criminal justice system. The restorative criminal justice process holds the view that realizing justice is not only a matter of government and criminality, but more than that it must provide justice in totality that can not ignore the interests and rights of victims and society. Implementation of the principle of restorative justice and the process of diversion as an effort to solve crimes committed by children in formal juridical has been set clearly and firmly in Law Number 11 Year 2012 about kids of justice.

This thesis addressed the issue of election criminal law enforcement in the era of simultaneous general election in 2019. Based on data released by The General Election Supervisory Agency (Bawaslu) there were 2,724 reports and findings of alleged violations of election crimes, which continued with the investigation of 582 cases, closed at the investigation stage there were 132 cases, then closed at prosecuting 41 cases, and ajudicated by the court in 319 cases. Meanwhile, based on the Indonesian Legal Roundtable (ILR) data from the whole cases in electoral crime, 170 cases or 53% were sentenced to conditional or probation. The method of this research is used normative legal research methods (normative juridical). Data research compiled based on suited laws and regulations through statutory approach, case approach, historical approach, comparative approach, and conceptual approach. Furthermore, normatively the data is analyzed based on applicable regulations as positive legal norms by interpreting and constructing statements contained in documents and applicable laws. The results of this study are to reveal and analyze the law enforcement applied in handling election crimes that occurred in simultaneous general elections in 2019. Analyzing the formulation of criminal law in tackling more effective general election crimes for the future through the formulation definite regulations, fair, not multi-interpreted and attend to all parties in equal rights of each individual before the law in order to establish a general election which honest and fair as well as legitimate

Restorative justice or more precisely keadilan restoratif in the Indonesian context is based on the principle of building joint participation between perpetrators, victims, and community groups in resolving a criminal act. The problem has been that in the formulation of the laws and government regulations diversion (diversi) is carried out if a criminal act is committed by a child who is punishable by imprisonment under seven years other than that if criminal acts that were committed by a child is not a repetition of criminal acts (recidive). A research using a normative legal research method found that through legal findings or rechtsvinding (penemuan hukum), judges can formulate criminal law policies through their decisions based on mens rea. Tt is a must for judges to settle criminal cases with a child of 12-years-old age perpetrator and/or the delinguent actor is a recidive via diversion. The provisions of Indonesian criminal procedure law dicates that judges are also obliged to seek diversion towards the settlement of all criminal cases whose actions were committed by children, both those with a criminal penalty over seven years and/or recidive or those who does not included in the two categories.

 In terms of enforcement the law. Second, legal instruments in the framework of criminal law enforcement abuse of narcotics against minors using a legal basis Law Number 11 of 2012 concerning the Criminal Justice System for Children. In the the provisions of the SPPA Law, in order to prosecute children who are involved with the law, then a diversion effort is carried out, namely a restorative effort or recovery state solve the problem together, in this research is focous about How are repressive legal measures against child narcotics users in under age?. As previously explained, in act Number 11 In 2012 concerning the Juvenile Criminal Justice System, there is a restorative principle (Restorative justice), which is aimed at restoring the original state, meaning efforts to restore the attitudes and mentality of children who have committed acts the crime of narcotics abuse to be as before or as a cure for the criminal act he has committed. Of course, the provisions of the Narcotics Law are not sidelined even though his repressive legal remedies are based on the provisions of law SPPA.

ABSTRAKPrinsip keadilan restoratif dalam peraturan perundang-undangan hukum pidana yang berlaku di Indonesia hanya diatur dalam Undang-Undang Sistem Peradilan Pidana Anak (SPPA) yang diaplikasikan dalam bentuk diversi, namun diversi tersebut hanya ditujukan bagi pelaku tindak pidana anak bukan untuk pelaku dewasa, peraturan perundang-perundangan pidana Indonesia belum mengatur prinsip keadilan restoratif bagi pelaku dewasa. Dalam praktik penegakan hukum, penerapan prinsip keadilan restoratif bagi pelaku dewasa sebagian telah dilaksanakan melalui diskresi, namun secara teoritis dan pratik pelaksanaan diskresi masih bermasalah karena belum memenuhi tiga nilai dasar hukum yaitu keadilan, kepastian dan kemanfaatan, dan diskresi juga bisa menimbulkan permasalahan ketidakadilan, karena adanya perbedaan perlakuan dalam proses penegakan hukum, sehingga asas “equality before the law” tidak dilaksanakan. Tujuan penelitian adalah untuk mengetahui bagaimana pelaksanaan prinsip keadilan restoratif dalam peraturan perundang-undangan pidana yang berlaku di Indonesia dan bagaimana penerapan diversi bagi pelaku dewasa dalam rangka mewujudkan keadilan restoratif. Jenis penelitian yaitu penelitian hukum normatif atau penelitian hukum kepustakaan, untuk mencari dan menemukan data yang dibutuhkan untuk menjawab permasalahan. Hasil penelitian diketahui bahwa peraturan perundang-undangan hukum pidana Indonesia belum mengatur tentang prinsip keadilan restoratif bagi pelaku dewasa, prinsip keadilan restoratif diterapkan baru sebatas untuk pelaku anak yang diaplikasikan dalam bentuk diversi. Secara teoritis, historis, normatif dan praktik prosedural, diversi juga dapat diterapkan untuk menyelesaikan perkara tindak pidana yang dilakukan oleh orang dewasa, namun perlu adanya perubahan dan penyesuaian terutama dalam hal tujuan pelaksanaan, kwalifikasi jenis tindak pidana dan mekanisme atau prosedur pelaksanaannya.Kata kunci: kebijakan hukum pidana; anak; dewasa; diversi; keadilan restoratif.AbstractThe principle of restorative justice in criminal law regulations in force in Indonesia is only regulated in the Law on the Criminal Justice System for Children (SPPA) which is applied in the form of diversion, however the diversion is only intended for child offenders not for adult offenders, Indonesian criminal laws and regulations do not regulate the principle of restorative justice for adult offenders. In law enforcement practices, the application of the principle of restorative justice for adult offenders has been partially implemented through discretion, but theoretically and practically the implementation of discretion is still problematic because it does not meet the three basic legal values, namely justice, certainty and benefit, and discretion can also cause problems of injustice, due to differences in treatment in the law enforcement process, so the principle of "equality before the law" is not implemented. The research goal is to find out how the implementation of the principles of restorative justice in criminal legislation in Indonesia, and how the application of diversion for adult offenders in order to realize restorative justice. This type of research is normative research or library research, to search and find the data needed to answer the problem. The results of the study note that Indonesian criminal law regulations do not regulate the principles of restorative justice for adult offenders, the principle of restorative justice is applied only to the child offenders which is applied in the form of diversion. Theoretically, historically, normatively and procedural practice, diversion can also be applied to resolve cases by adult offenders, but there needs to be changes and adjustments especially in terms of implementation objectives, qualification of the type of crime and the mechanism or procedure for its implementation.Keywords: criminal law policy; children; adults; diversion; restorative justice.

The settlement of criminal offenses with mild motives can be carried out by reasoning penal mediation called the restorative justice approach, which focuses on the direct participation of perpetrators, victims and the community. The research that use in this study is sociological legal research (social legal research). The concept of restorative justice through reasoning penal mediation in the settlement of a mildly criminal case for the indigenous people of village kuala gasib in koto gasib siak, was carried out with the intermediary of the headman. Headman as customary village heads and as government administrators have an important role in creating peace efforts in resolving disputes that occur in the community, one of which is through the settlement of criminal cases by reasoning penal mediation with the concept of restorative justice. The constraints of the concept of restorative justice through reasoning penal mediation in the settlement of mildly criminal cases for the indigenous people of village kuala gasib in koto gasib siak are: a) The absence of a special law mediation of regulation, b) Lack of facilities and infrastructure in mediating, c) Lack of mediator skills for village head to reconcile the parties to the dispute, d) There are differences of opinion among law enforcement officials about the concept of restorative justice through penal mediation

Progressive law puts forward the sociology of law rather than legal certainty which is the focus of legal positivism. In Indonesia, this law was coined by Satjipto Rahardjo. This study aims to determine the formulation of progressive law in future criminal law, and to determine the actualization of the concept of progressive law in regulating corruption in Indonesia. The research method used is a normative legal research method with statute and conceptual approaches. The technique of collecting legal materials in this study is a descriptive method that aims to obtain the meaning of reality related to the problems to be discussed and solved in this study. The results show that in the current Criminal Code Bill, progressive law has been regulated, to be precise in Article 2 paragraph (1) and (2). Progressive law is also regulated in Law no. 48 of 2009 concerning Judicial Power. Then, the actualization of progressive law in regulating corruption in Indonesia is a judge with the powers that take into account the sociological context of society in making decisions. Judges, prosecutors and lawyers can certainly discuss together in eradicating corruption. Efforts are also being made to reconstruct and redefine the power of law enforcement. This arrangement can also encourage the KPK to be more progressive in eradicating corruption, as well as building law enforcers who have morality so that they can become role models and increase public participation, for example by forming NGOs in preventing or fighting corruption in various agencies.

<p class="1judul"><em><span>The Role of the Police in the Application of Restorative Justice to Perpetrators of Criminal Offenses Conducted by Children and Adults</span></em></p><p class="1judul"> </p><h1><span lang="EN-US">The rise of cases of brawl between high school students and even not only between high school students, but also has hit up to campuses, this often happens in big cities such as Jakarta, Surabaya, and Medan. This study aims to determine the role of the Police in implementing Restorative Justice against perpetrators of criminal acts of beating carried out by children and adults that occurred in the District of Namo Rambe District of Deli Serdang. The research method is done by using descriptive qualitative method that is normative. Based on the data obtained in the results of this study, the authors draw conclusions as follows: The criminal justice system must always promote the importance of law and justice. But there is a false view that the measure of the success of law enforcement is only marked by the success of bringing a suspect to court and then being sentenced. The measure of success of law enforcement by law enforcement officers should be characterized by the achievement of values of justice in the community. The police as a state tool that plays a role in enforcing the law is expected to be able to respond to this by implementing a Restorative Justice mechanism.<strong></strong></span></h1>
