Protection for people or social groups that do not have a home or who have it lost because of wars, internal or external displacement, violence and insecurity, require special attention from States. To address this approach, the criterion or standard established in the Inter-American System of Human Rights with respect to the protection of this right through the connection of rights will then be analyzed. The judgments could set out the standard of protection that from national governments must be afforded to people who lose their homes in these contexts and, on the other hand, the role of the State in complying with these claims, in order to conjecture the autonomous declaration of the right to housing in the judicial headquarters of the region of the Americas.

Artigo trata na construção de reflexões e proposições sobre a relação da educação, direitos humanos e formação de professores para atuarem na educação básica. Aborda a relação entre o poder político e a sociedade a partir da análise do Estado como instância promotora de direitos e pelos mecanismos que o mesmo se apodera para forjá-los na educação. Analisa o papel das reformas curriculares em conformidade às políticas dominantes. Discute a formação de professores e sua relação com a pobreza, com as desigualdades sociais e direitos humanos. Os fundamentos que norteiam as análises são do campo de conhecimento educacional e pedagógico. Para elucidações contextuais apropria-se de referencial sócio histórico, das políticas educacionais e políticas curriculares. Permite o diálogo com o objeto da formação e atuação de professores na área dos direitos humanos. Artigo se organiza metodologicamente em cinco tópicos a saber: Introdução, O Estado e a promoção de direitos, Currículo enquanto princípio político, Formação de professores para os direitos humanos e Considerações. Conclui ponderando a importância do papel do Estado na promoção dos direitos humanos a partir de políticas públicas comprometidas com a educação e com a formação de professores para o trabalho com os vulneráveis, as desigualdades sociais e os direitos humanos. Também chama a atenção da educação para os direitos humanos nos diferentes níveis e modalidades de ensino, expansiva à comunidade escolar.Palavras-chave: Educação. Direitos humanos. Currículo.EDUCATION, HUMAN RIGHTS AND TEACHER TRAINING: reflections and propositions.AbstractArticle deals in the construction of reflections and propositions on the relationship of education, human rights and teacher training to work in basic education. It addresses the relationship between political power and society based on the analysis of the State as a promoter of rights and the mechanisms it takes to forge them in education. It analyses the role of curricular reforms in line with dominant policies. It discusses teacher education and its relation to poverty, social inequalities and human rights. The foundations that guide the analyses are the field of educational and pedagogical knowledge. For contextual elucidations it appropriates the socio-historical reference, educational policies and curricular policies. It allows dialogue with the subject of the training and action of teachers in the area of human rights. Article is organized methodologically in five topics: Introduction, The State and the promotion of rights, Curriculum as a political principle, Training of teachers for human rights and Considerations. He concludes by considering the importance of the role of the State in the promotion of human rights from public policies committed to education and teacher training for working with the vulnerable, social inequalities and human rights. AbstractThis paper presents a comparative analysis of two reports by the UN Rapporteur on Extreme Poverty and Human Rights, one for Spain and one for the UK. In both countries, austerity policies were introduced following the banking crisis of 2008. The UN Rapporteur reports highlight the damage that was done by welfare retrenchment. In particular, the reports document the impact of austerity on the most vulnerable individuals and communities. The paper uses Somers' (2008) conceptual model of citizenship as the basis for a comparative analysis of two reports. Somers' (2008) model of citizenship is a triadic one which sees the state, market and civil society as competing elements. Each one can serve to regulate and limit the influence or excesses of the other two. Somers argues that neoliberalism has seen the dominance of the market at the expense of the role of the state and the institutions of civil society. Austerity policies saw the market dominating. Having examined the context of the two reports and their conclusions, the paper discussed the implications for individual social workers’ practice and the role of social work as a profession in tackling poverty and marginalisation.

The article describes the impact of the Mass Media on the formation of the worldview of the young. This impact may be positive or negative. On the one hand, the media educate young people and enhance their participation in public life. On the other hand, they may mislead or promote false values, and manipulate the young generation’s consciousness. What helps people not to get involved into the tried-and-true crowd manipulation scheme in the media landscape is critical thinking, whose lack results in inability to choose the right guidelines in the flow of false information provided by various Media. The authors emphasize the role of the state, which, regarding the needs of the society, should enculturate the young generation, as well as exercise tight control over communication in the global web and publications in the Internet Media and social networks. One of the directions of the state’s policy is expanding the geography of information and communication technologies, and the other is ensuring information security of the young in general and adolescents in particular. To provide this, the state develops organizational and legal mechanisms aimed at protecting children from harmful information in the web, and requirements for the content, its expert evidence and government control. The article demonstrates the results of a study carried out by the authors to assess the current youth Media and their influence on criminality. The key criterion for selecting participants of the focus group was young age, since the young are the most active and the least protected players in the media landscape. The sampling was made by random choice in order to ensure equal opportunities for participation in the study.

This chapter discusses how the ‘stickler-enjoining’ account of equity has important limits. While many distinctive doctrines of equity can be understood to limit stickler behaviour, equity in fact often turns a blind eye to, and sometimes even enables, stickler behaviour. One can sort cases in which equity restrains sticklers from those in which it is indifferent to stickler behaviour if one attends to the role of the state in private litigation. Sometimes the state’s responsibilities require it to protect plaintiffs against sticklers. Other times, it requires it to protect the stickler, as a means, for example, of keeping as open as possible each person’s sphere of choices. Ultimately, the self-regarding account of equity sheds light on the question of the relationship between equity and justice: from the distinct perspective of the judgment, sometimes equitable justice is better than legal justice and sometimes legal justice is better than equitable justice.

Information technologies (IT) and the new (virtual) space of dominion that they create can alter the order of the powers of the democratic states. This article will discuss the idea that the digital state is becoming a Virtual state with less power of control over its territory, because the historic power of the state is being restricted by the rise of governance beyond the state. The process of globalization, as well as the larger use of digital technologies, challenges the Westphalian nation-state, changing the state’s boundaries so that new forces and new actors acquire even larger space of dominion. We will explain that the information society challenges, but does not eliminate, the effectiveness of the state. The Web, with its open spaces, extends the state’s boundaries, creating new spaces of virtual dominion and changing governments structures: Actually, digital technologies affect functions of direction, control and organization of governments, and democracy quality, opening new areas of dominion for governments. Even if some of the functions of the states, like those related to economics, are diffuse under the new globalized and virtalized world, the states still preserve most of their political and military power. And more, the regulatory role of the state is considered pivotal: In the future, national governments need to define a new code of regulation of the Internet to defend citizens’ rights in the virtual space.

What these four quite different books broadly share is a focus on the role of the state in Myanmar society. Current scholarship describes the authoritarian state in Myanmar, which has been controlled by the army since 1962, as either dominantly present or neglectfully absent. Censorship and the repression of autonomous spaces in society, on the one hand, and the failure of the state to enforce efficient health and environmental policies, on the other, are keywords in these works that illustrate the double-faced appearance of the state's existence and role in society.

This paper analyses and critically discusses the role of regions in implementing renewable energy (RE) policies, examining the relationship between state policy and RE deployment. Using evidence from four case study regions, Apulia and Tuscany in Italy and Wales and Scotland in the UK, the paper teases out some differences in terms of regional competencies to implement RE policies across the two countries. The national governments in both Italy and the UK have constructed regulatory and governance relationships to orchestrate and reorder economic, social and ecological challenges and devolve responsibilities at the sub-national level. This has offered an opportunity for the peculiarities of regional setups to be taken into account and regions have contributed towards the promotion of green and sustainable path development via the route of promoting RE deployment. The paper argues that the downscaling and distribution of responsibility in the cases investigated reflect the capacity and willingness of nation states to respond to and mediate the strategic goals and outcomes formulated at national and international levels. Nevertheless, while the regions investigated display differences in their incentives, capacities and capabilities to increase RE deployment, their ability to act is very much influenced by nation states, stressing the important role of the state in mediating the form and direction of RE deployment.

Summary Studies of the diffusion of new workplace technologies and management practice often fail to account for differences in state labour regulation. This article examines the role of the state in seeking to regulate the introduction of an American system of computerized work monitoring in the Australian grocery warehouse industry. While the establishment of a government inquiry into the technology offered the potential for significant constraints upon management control, over time the state’s role shifted to a more accommodating stance that endorsed management’s right to use the new technology. The reasons underlying the state’s ultimate support for the technology are explored, as are the broader implications for national variations in the global diffusion of new workplace technologies.

ABSTRACTThe Reformation then became a momentum for improving the issues of upholding human rights in Indonesia, where human rights matters formally entered into the division of power. On the one hand, for the first time, a ministry was formed specifically to deal with human rights matters. While outside the executive body, Law No. 39 of 1999 strengthens the position of the National Commission of Human Rights which has actually been established since 1993. This phenomenon then raises a problem statement, on how bureaucratization of human rights after Reformation is manifested through the establishment of the National Human Rights Commission and the Ministry of Human Rights. It was found that each institution gained legitimacy from political dynamics in a more democratic public space. Between the state ministries for human rights and the National Commission of Human Rights, the principle of check and balances was carried out in their role as an organ of the Indonesian bureaucracy. On the one hand, the state minister for human rights is an extension of the executive's hand in managing human rights matters. As a counterweight, the National Human Rights Commission carries out the role of the state auxiliary bodies to monitor the government’s human rights work.Keywords:    Politic of Law, Bureaucratization, Human Rigths, Ministry of Law and Human Rights Affairs, National Commission of Human Rights. ABSTRAKPeristiwa Reformasi menjadi momentum perbaikan urusan penegakan HAM di Indonesia, di mana urusan HAM secara formal masuk ke dalam pembagian kekuasaan negara. Di satu sisi, untuk pertama kalinya dibentuk satu kementerian yang secara khusus menangani urusan HAM. Sementara di luar lembaga eksekutif, Undang-Undang Nomor 39 Tahun 1999 menguatkan kedudukan Komisi Nasional Hak Asasi Manusia yang sejatinya telah terbentuk sejak tahun 1993. Fenomena ini kemudian menimbulkan satu rumusan permasalahan, yaitu bagaimana birokratisasi urusan HAM pasca reformasi termanifestasi melalui pembentukan Komnas HAM dan kementerian urusan HAM. Ditemukan bahwa masing-masing lembaga memperoleh legitimasi dari dinamika politik di ruang publik yang lebih demokratis. Antara kementerian negara urusan HAM dan Komnas HAM kemudian menjalankan prinsip check and balances dalam menjalankan perannya sebagai organ birokrasi Indonesia. Di satu sisi, kementerian negara urusan HAM merupakan perpanjangan tangan eksekutif untuk mengurus urusan HAM. Sebagai penyeimbang, Komnas HAM menjalankan peran sebagai state auxiliary bodies guna mengawasi kinerja HAM pemerintah.Kata Kunci: Politik Hukum, Birokratisasi, Hak Asasi Manusia, Kementerian Urusan HAM, Komnas HAM.
