This study aims to provide information about procedure of dispute settlement of sharia economy in the Religious Courts. This research uses qualitative method with juridical approach. The dispute procedure of sharia economic in religious court runs in accordance with the mandate of the Law contained in article 49 to article 53 Act no. 7 years 1989, Law No. 3 year 2006, Law No. 50 of 2009 about Religious Courts. Sharia economic dispute is basically due to three things, namely because one of the parties to break the promise (wanprestasi), due to unlawful acts against the agreements agreed upon and because of coercive circumstances. Settlement of disputes is held with the aim of enforcing the law which contains the value of legal justice, the value of legal certainty, and the value of legal benefit. The settlement of the sharia economic dispute in the Religious Courts is very new, so the Supreme Court up to now still conducts education and training of sharia economic certification for all Religious Court judges.Penelitian ini  bertujuan   untuk memberikan informasi mengenai prosedur penyelesaian sengketa ekonomi syariah di Pengadilan Agama. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis Prosedur penyelesaian sengketa ekonomi syariah di pengadilan agama berjalan sesuai dengan amanat Undang-Undang yang tertera dalam pasal 49 sampai pasal 53 Undang-Undang No. 7 tahun 1989 jo. Undang-Undang No. 3 tahun 2006 jo.Undang-Undang No.50 tahun 2009 tentang Peradilan Agama.Sengketa ekonomi syariah pada dasarnya disebabkan karena tiga hal, yaitu karena salah satu pihak melakukan ingkar janji (wanprestasi), karena perbuatan melawan hukum terhadap perjanjian yang disepakati dan karena keadaan memaksa. Penyelesaian sengketa diadakan dengan tujuan untuk menegakan hukum yang di dalamnya mengandung nilai keadilan hukum, nilai kepastian hukum, dan nilai kemanfaatan hukum.Penyelesaian sengketa ekonomi syariah di Pengadilan Agama merupakan hal yang sangat baru, sehingga Mahkamah Agung sampai saat ini masih melaksanakan pendidikan dan latihan sertifikasi ekonomi syariah bagi seluruh hakim Pengadilan Agama.

An effort to improve the quality of justice with a gender perspective on July 11, 2017 the Supreme Court of the Republic of Indonesia has issued PERMA Number 3 of 2017 concerning Guidelines for Judging Women Against the Law. In line with this study, researchers assume specifically the implementation of Perma Number 3 of 2017 is related to women dealing with law in divorce cases related to the protection of women's rights (ex-wife) along with children's rights due to divorce based on justice. the implementation of PERMA No. 3 of 2017 in the field of litigation duties in the Religious Courts. In the end, judges in trying women's cases dealing with the law must reveal factors based on principles: Appreciation for human dignity, Non-discrimination, Gender Equality, Equality before the law, Justice, Utilization, for the sake of legal certainty.

The article analyzes the provisions of the arbitration procedural legislation and the practice of its application on a different pre-trial dispute settlement procedure established by the contract. A different pre-trial procedure is considered as an alternative to the general claim procedure for resolving disputes. The characteristic features of a different pre-trial order have been revealed. The authors summarized the practice of arbitration courts, highlighting other demanded pre-trial dispute settlement procedures. In particular, examples of atypical other methods of dispute settlement are provided. Separately, the issue of the admissibility of the cancellation of the general claim procedure for the settlement of disputes by the agreement was considered. An independent subject of the authors’ analysis was mediation as a pre-trial dispute settlement procedure. The work also focuses on the impact of a different pre-trial dispute settlement procedure on the course of the limitation period. The article discusses the provisions of the Resolution of the Plenum of the Supreme Court of the Russian Federation of 22 June 2021 No. 18 “On Some Issues of Pre-Trial Settlement of Disputes Considered in Civil and Arbitration Proceedings”. Some of the recommendations of the Plenum of the Supreme Court of the Russian Federation received critical assessment. The authors note the existing contradictions in the legislation and possible ways to overcome them, formulate individual conclusions as a result of studying the materials of the practice of arbitration courts.

Kompilasi Hukum Islam does not regulate interfaith inheritance distinctly. It only requires the testator and the heirs have the same religion. At court, judges of religious courts employ obligatory bequest (waṣiat wājibah) to divide inheritance to non-Muslim heirs, based on jurisprudence of the Supreme Court Number 368 K/AG/1995. As the result, different faith still become hindrance for Muslim and non-Muslim to inherit each other due to law enforcement without considering the legal reasoning (ratio legis) of the law. In this case, it is important to investigate the legal reason (ratio legis) of the hadith that prohibits the interfaith inheritance as this article tries to do. To do the investigation, the author employs Islamic legal theories (uṣūl fikih) and hermeneutics approach. As the result, the author comes to the conclusion that the ratio legis of the hadith that prohibits the interfaith inheritance is due to hostility and crime element and not due to different faith. The State of Indonesia is a State of Law. But, in fact the ideals of the idea of the State of Law that was built by developing the legal tool itself as a system that is functional and just to achieve community welfare and social justice has not been optimally done. This is reflected in the new Environmental Permit issued by Central Java Governor Ganjar Pranowo (No. 660.1 / 6 of 2017 on Environmental Permit for Mining and Construction Activities of PT Semen Indonesia Plant) is considered to have injured the ideals of the law itself. The new Environmental Permit is contradictory to the content of the Review Judgment issued by the Supreme Court (Supreme Court Verdict Decision Number 99 PK / Tun 2016), because in the ruling it ordered that the Governor Replace the old Environmental Permit, which was issued in 2012 and did not issue New Environmental Permit. The verdict contains the basis of judges' consideration in deciding cases that have reflected fairness and legal certainty. The result of the research on the validity of the Environmental Permit Decree on the Review Judgment issued by the Supreme Court concluded that the decree should be invalid because it is not in line with the decision of the court which has permanent legal force.

Undang-Undang Parpol mengatur bahwa perselisihan Parpol diselesaikan secara internal oleh Mahkamah Partai atau sebutan lain daripada itu dan secara eksternal oleh Pengadilan Negeri dan Mahkamah Agung. Substansi perselisihan yang final dan mengikat di Mahkamah Partai adalah perselisihan kepengurusan, selebihnya dapat diajukan upaya hukum ke Pengadilan Negeri dan Mahkamah Agung. Di dalam praktek, pengaturan tersebut telah menjauhkan dari rasa keadilan, kepastian hukum dan kemanfaatan, oleh karenanya sebaiknya direvisi yang mana perselisihan PAW, pelanggaran terhadap hak anggota partai politik, penyalahgunaan wewenang,  pertanggungjawaban keuangan, dan atau keberatan terhadap keputusan partai politik (termasuk keputusan untuk tidak memutuskan terhadap sesuatu hal) final dan mengikat dengan Putusan MPP. Sedangkan perselisihan kepengurusan dapat diajukan upaya hukum ke Mahkamah Konstitusi. Political parties act stipulates that a political party dispute resolved internally by the Mahkamah Partai or other designation of that and externally resolved by the District Court and the Supreme Court. The dispute substance in Mahkamah Partai which is final and binding is about organization dispute, the other can be settled in District Court and the Supreme Court. In practice, that arrangement makes the decision apart from the sense of justice, legal certainty and utility. Therefore, these rules should be revised so that the regulation of PAW, violations of the rights of members of political parties, abuse of authority, financial liability, or an objection to the decision of political parties (including the decision not to decide on something) is final and binding through Mahkamah Partai decision. While the organization disputes can be submitted to the Constitutional Court for legal action.

This paper aims to find the basis for the philosophical rationality of applying sharia principles in resolving sharia economic disputes in religious courts as well as the prerequisites required by religious court judges to apply sharia principles in resolving sharia economic disputes. The type of research used is normative legal research to find philosophical rationality and the institutionalization of sharia principles in resolving sharia economic disputes. The approach used is a conceptual approach. Secondary data were collected through literature study. The research results obtained first, the philosophical rationality of the application of sharia principles in sharia economic dispute resolution in line with the first and third principles of Pancasila. Second, the institutionalization of sharia principles becomes effective if there are prerequisites that must be met, firstly enough information for judges to understand sharia principles, secondly the obstacles that come from the judges themselves who are still oriented towards the flow of legism / positivism will have an effect on providing legal basis and third the speed of instilling the institutionalization of sharia principles can be done through education and training organized by the Supreme Court for Religious Court judges.

The purpose of this study is to know that the Certain Working Agreement on Oral Time is not allowed in the legislation, the Supreme Court judges consideration in deciding the case Number 501 K / Pdt.Sus-PHI / 2016 and the conformity of the decision with the law applicable in Indonesia. This study uses normative juridical method, which is analytical descriptive, with data collection method in the form of library study and supported by interview with judges. The results of the research show that First, the judge's decision is unfair to both parties litigation because the defendant is not punished to pay the wage of suspension (wage process) with emphasis on the consideration of unwritten PKWT so that by law become PKWTT. Second The process wage demands which are not accepted by the judge are contrary to the laws and regulations on employment and on the settlement of industrial relations disputes because the law requires that workers and employers continue to perform their obligations until the establishment of an Industrial Dispute Settlement Institution, including the obligation of employers to pay the wage of a suspension (wages process). So the Supreme Court Decision Number 501 K / Pdt.Sus-PHI / 2016 is less in accordance with the prevailing laws and regulations in Indonesia. Keywords: Oral Employment Agreement, Termination Dispute, Employment

The new authorities of religious courts, particularly in Economics Sharia field still collide with other rules. This writing intends to identify the rules conflict  that exist. Based on the analysis, can be identified the rule conflict  relating to the authority of the judge occurs on the peace effort. Rules of conflict regarding peace with instrument PerMA No.1 year 2008 can be accessed by using the principle of lex superior derogat legi law priori, whereas with regard to the authority prosecuting Sharia Board of arbitration verdict temporarily can use the verdict of the Supreme Court of Cassation Number 56/PK/AG/2011, however this is still not final because we are not wedded to the binding force principle of precedent. The next rule of conflict is related with judgement authority to the bankruptcy matter. AbstractThe title of this research is “Elektonic State Administration Dispute Settlement Arrangements” provides an explanation of the legal issues discussed by the author about 1) Comparison of procedural law ini State Administrative Courts which is carried out coventionally and electronically; and 2) Constraints to the application of Electronic Court in the State Administrative Court. Rapid technological advances make it easy for humans in all area, one of which is in the law. Legal breakthroughs carried out by the Supreme Court can be seen in the existence of Electronic Court. The State Administrative Court, which is an institution under the Supreme Court, implements electronic court. Peradilan Tata Usaha Negara yang merupakan lembaga yang berada di bawah Mahkamah Agung menerapkan peradilan elektronik.
