On the fifth anniversary of Amoris Laetitia, this article focuses on the importance of family relationships in our globalized world. The family allows everyone to feel equal while remaining different. In tune with Romano Guardini, Pope Francis uses the dialectic of polar opposition to describe the unity in diversity typical of authentic family life (part 1). He notes, however, that the technocratic paradigm, homogeneous and one-dimensional, cancels out this dynamic, thus opening the way to globalized indifference and the throwaway culture (part 2). Therefore, the Pope invites us to rebuild family relationships and preserve polar opposition at our four fundamental levels: spiritual, personal, social and natural (part 3).

Resumo: O que se entende por “fundamentação bíblica” de um documento eclesiástico,no caso, da Exortação Apostólica “sobre a alegria do amor na família”?Obviamente, é a verificação da maneira como o autor do texto recorreu à Bíbliapara justificar suas afirmações. Em outras palavras, qual a hermenêutica dascitações bíblicas apresentadas pelo papa Francisco? Nesse sentido, meu trabalhonão se reduzirá à mera identificação dos textos bíblicos em cada um dos novecapítulos. Além de identificá-los, procurarei contextualizá-los e, quando for o caso,avaliá-los do ponto de vista da exegese, contribuindo assim, espero, para umamelhor apreciação do documento. O desenvolvimento do trabalho percorrerásimplesmente a sequência dos nove capítulos, em cada um deles examinandoas citações bíblicas explícitas, sem esquecer de aludir às citações implícitas.Palavras-chave: Argumentação bíblica. Família.Abstract: What does one mean by “biblical foundation” of an ecclesiasticaldocument, namely, of the Apostolic Exhortation “about joy of love in the family”?Obviously, it is the examination of the way how the author of the text resortedto the Bible in order to justify his assertions. In other words, which was the hermeneuticsof the biblical quotations presented by pope Francis? In this way, thepaper won’t be reduced to the mere identification of the biblical texts in each oneof the nine chapters. Besides identifying them, the author will try to show theircontext and, when necessary, will evaluate them from an exegetical point of view,so contributing to a better appreciation of the document. The paper will simply gothrough the sequence of the chapters, in each one examining the explicit biblicalquotations, without forgetting to allude to the implicit quotations.Key-words: Biblical argumentation. The paper analyses the protection granted under Article 8 of the European Convention of Human Rights for different immigration cases. The way the European Court of Human Rights determines compliance with Article 8 for settled migrants differs from the way the Court determines compliance for foreign nationals seeking entry or requesting to regularize their irregular migration status. The paper argues that the European Court of Human Rights application of different principles when determining a States’ positive and negative obligations is contradicting its own case law. It also argues that the absence of justification grounds for the refusal of foreign nationals who are seeking entry lacks legitimacy. By treating all immigration cases under Article 8(2) the paper suggests that the differentiation between cases should be based on how a refusal of entry or an expulsion would impact on the family life. The paper also suggests that more consideration should be given towards the insiders interests when balancing the individual rights against the state's interests. These changes would lead to a more consistent and fair case law and generate a more convergent practice by the states which will increase the precedent value of the Court's judgements.

The article deals with pastoral care for family according to Amoris Laetitia. The author’s concern is to discuss the pastoral steps for the families in the face of crisis situations: What kind of pastoral steps can be organized to assist families in crisis situations? This article is based on the study of ecclesial document Amoris Laetitia, a post-synodal apostolic exhortation by Pope Francis addressing the pastoral care of families. First of all, the article describes the basic thoughts of this document, especially those related to the reality and ideals of family life. Then, it shows some practical pastoral thoughts for assisting families in special situations. The results can be a significant contribution for the Church in terms of its important duties and responsibilities in assisting the families today, but also for family pastoral activists. This description concludes that the crisis situation faced by families is not a fact to be constantly regretted, but an opportunity for the Church to show God's mercy to those who are struggling in difficult situations.

This chapter examines the interpretation of ‘family life’ under Article 8 and the way that this has evolved throughout the Court’s history. It contrasts the approach of the Court to ‘family life’ between children and mothers, with ‘family life’ between fathers and children, noting the focus of the Court on function over form. It then turns to the establishment of parenthood, both in terms of maternity and paternity, as well as the right of the child to establish information concerning their origins. Finally, the chapter examines the changing face of the family, considering new family forms, including same-sex couples and transgender parents, as well as new methods of reproduction, such as artificial reproductive techniques and surrogacy.

SummaryThis paper reports a pilot study of thirteen children with epilepsy and their families; the parents' efforts to obtain help for the child and the effect of the child's disability on the family relationships are described. About half of the parents did not consult the family doctor immediately after the first appearance of signs of epilepsy (patient delay). About a quarter of the family doctors delayed referral of the patient with epilepsy to the specialist (doctor's delay). Another 3 years passed, on average, before the patient reached a special centre or clinic for epilepsy (specialist delay); in three-quarters of all cases the first step to get there was taken by the parents and not by the specialist and chance plays an important role in determining how the entry into this third echelon is achieved. Reasons for the search for more specialized help were: dissatisfaction with the results of the treatment and the kind of rapport with the second echelon specialist. The out-patient clinic for epilepsy is generally favourably commented on because the expert medical advice is combined with the availability of a social worker, thus offering support with social problems also. As regards the influence of the illness on the family, there is evidence that family life is disrupted to a greater or less extent. The parents experience psychological stress and are generally apprehensive lest something will happen to their child. In a number of cases the relationships between siblings are rather disturbed. The parents, especially mothers, tend to (over-)protect the child with epilepsy. The child with epilepsy has a relatively isolated position in his social environment; he has few informal or formal social contacts with his peer group. The condition epilepsy contributes to a diminution of expectations for the future and curtailment of scholastic behaviour.

The article presents a theological analysis of Pope Francis’ statements on the sanctity of life with reference to familiological issues. The aim of the research undertaken is to show the value of human life resulting from the relationship between the elements that create the created reality and with God. According to Francis, holiness is closeness to God and the ‘divine space’ in which all creation exists and functions. The sanctity of »life« is shown by the Pope in the following aspects: 1) theological – as an expression of the integration of creation with God, 2) social – as the principle of existence and relations, and 3) defensive – as an imperative to defend the life of every human being. The family is presented by the Pope as a sanctuary of life, a place of sanctifying love and a school of holiness. The conclusions resulting from the theological analysis of papal statements indicate the need for a ‘familiological turn’ encompassing the space of culture and civilization of the contemporary world. Such a turn is necessary for the good of the man for whom the family is the first social circle. The sanctity of life in the familiological area is the principle that defines the sacredness of the family and the determinant of intra-family relationships that develop love.

The article addresses the spirituality of marriage according to Saint Augustine and has three parts. In the first part, the context of the Roman family institution, in which the Christian vision of the family was born and matured, is presented. Secondly, the presentation of the Christian family in the time of Saint Augustine is made, highlighting the three heterodox currents of that time in relation to marriage, as well as the position of the Bishop of Hippo regarding the body. Subsequently, a presentation of the most significant texts of De Bono coniugali is made. Thirdly, some pastoral observations are presented, starting from the penitential practice of Saint Augustine in relation to the wounded families, to later make a comparison with the contents expressed by Pope Francis in the Apostolic Exhortation Amoris laetitia on the same topic.

This chapter focuses on Afghani motherhood that highlights the powerful role that mothers play within Jewish cultures while conforming to idealized notions of the Jewish mother within the family circle. It points out how the mother's praiseworthiness surfaces with husbands and sons glorifying her for serving as a protective force. It also cites that Ottoman mothers played active roles in the legal structure of family life, involving themselves in the betrothals and divorces of their sons and daughters. The chapter captures the ennobling manner in which Afghani mothers turn the everyday chore of bread-making into a protective cultural force. It illustrates family relationships that are conducted through bread and known among the Afghani Jews as nan.

From a historical point of view, it can be argued that the cultivated arrangement of the relationship between man and woman, the support of the institution of marriage, and therefore families, have always been one of the important requirements of individual cultures and religions. There is also a close connection between the state of society (and the dominant requirements in it) and the form of personal and family life. In the Western cultural space with the decisive ecclesiastical discourse, the view of marriage and the family was not spared from one-sidedness and problematic practice. The current magisterium of the Catholic Church remains critical of some contemporary trends and phenomena, including the questioning of the very institution of marriage and the family. At the same time, it remains open to new challenges in this field.The article aims to critically reflect on some issues related to the current situation of marriage and the family, especially the individual and social ethical context of married and family life in contemporary Western culture.Using a reflection of the findings of selected authors, especially of sociologists (Lipovetsky, Beck), the article demonstrates the reality of problematic „points“ of the present time (marked by magisterial texts by Pope Francis) and their connection to married and family life. It thus verifies the thesis that the preconditions for marriage and the family are currently weakened in the Western area. This state of affairs include even the institutions that want to invoke the necessary personal and social responses to the problematic situation. Although the study does not capture the full range of issues and problems currently associated with marriage and the family, it does demonstrate that marital and family relationships in contemporary Western culture are conditioned by a number of factors. Those cannot be fully influenced by the individuals directly affected. The study points to the crucial role of politics, including its responsibility and to the exclusive role of the Church. The Church can, in many respects, increase respect for the institutions and bring a concrete help to the people.The result of the study is an emphasis on the fact that, in the current situation, it is not easy for individuals or families to maintain their own integrative values. It is not easy to withstand the pressures from the outside, to not succumb to the vision of success offered by the majority society. It is also problematic that the focus of politics is not predominantly on the family but, above all, on the immediate interests of the individual. Politics is irresponsibly undercutting itself in order to get into favor of individuals.The conclusion of the study confirms the validity of the magisterial belief that the prosperity of the family is crucial for the future of the world and the Church. Marriage and the family are natural communities that correspond to a person‘s anthropological setting. They allow him or her to find his or her own identity. They are a guarantee of the humanization of the person and society, a protection against deformations of the individualistic or collectivist type.
