This research aims to clarify the practice of sale and purchase agreement of pregnant livestock in Market livestock Nganjuk Regency based on the Islamic law perspective. The central issue of this research concerns the exsistence of an additional payment after delivery.  This research used the normative legal research method, with a statutory approach and supported by an analytical qualitative research approach. This study found that the practice of sale is unlawful regarding to Islamic law because of uncertainty in the consented price and forbidden object in syariah namely livestock in the womb. However, this transaction has not accomodated yet in Indonesian laws eventhough there is possibility of dispute among parties. Therefore, this research recommends that the statutes in the field of Islamic commercial law enables to cover the common transaction in society and not limited for Islamic financial institution in order to give protection due to shari’ah.

Penelitian ini bertujuan mendiskripsikan dan memahami pelaksanaan pitungan Jawa dalam aktivitas permulaan waktu tanam pada petani di Kelurahan Temas, Kecamatan Batu, Kota Batu. Peneliti menggunakan pendekatan kualitatif dengan metode etnografi. Peneliti tinggal di lokasi penelitian selama pelaksanaan penelitian dengan mengamati, melihat, ikut serta, dan berdiskusi dengan warga lokasi penelitian, khususnya para informan. Informan dalam penelitian berjumlah 7 orang terdiri dari penduduk setempat yang memiliki primbon Jawa, mengetahui dan memahami serta mengaplikasikan pitungan Jawa, bersedia berdiskusi secara terbuka dengan peneliti. Analisis data dilakukan dengan tahapan pengumpulan, penyajian, reduksi atau kondensasi, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa persepsi pitungan Jawa dalam upaya menentukan awal bercocok tanam bervariasi. Menurut petani, pitungan Jawa adalah kearifan lokal yang perlu dilestarikan. Mereka percaya pada nasihat orang tua mengenai hal-hal buruk yang telah terbukti di masa lalu apabila tidak mengikuti perkiraan dalam primbon. Petani beranggapan bahwa penerapan pitungan Jawa adalah salah satu bentuk ikhtiar kepada Allah SWT. Meskipun demikian petani tetap menganut ajaran agama dan menghindari tindakan yang bertentangan dengan syariat Islam. Bentuk implementasi pitungan Jawa di Kelurahan Temas tidak persis sama dengan ketentuan yang tertulis dalam primbon, seperti halnya tidak lagi menyediakan sesajen yang ditempatkan dalam takir. Syarat utama petani yang akan melakukan pitungan Jawa yakni haruslah mengingat hari meninggal orang tua dan tanggal 1 Suro. Apabila hasil pitungan Jawa jatuh pada hari tersebut, petani dilarang memulai penanaman. Harapannya adalah untuk menghindari rintangan buruk. Acuan yang digunakan oleh petani adalah oyot, wit, godhong, uwoh yang disesuaikan dengan jenis tanaman yang akan ditanam.        This study aims to describe and understand the implementation of Javanese calculations in the activity of starting planting time for farmers in Temas Village, Batu District, Batu City. Researchers used a qualitative research approach that was classified as an ethnographic research method. Researchers stay at the research location during the implementation of the research by observing, seeing, participating in, and discussing with residents of the research location, especially informants. There are 7 informants in the study consisting of local residents who have Javanese Primbon, know and understand and apply Javanese calculations, willing to have open discussions with researchers. Data analysis was carried out by collecting, presenting, reducing/condensing, and drawing conclusions. The results showed that the perception of the Javanese count in the effort to determine the start of planting varied. According to farmers, Javanese pitung is local wisdom that needs to be preserved. They trust their parents' advice about bad things that have been proven in the past if they don't follow the predictions in the Primbon. Farmers think that the application of Javanese calculations is a form of endeavor to Allah SWT. Even so, farmers still adhere to religious teachings and avoid actions that are contrary to Islamic law. The form of implementation of the Javanese calculation in Kelurahan Temas is not exactly the same as the provisions written in the Primbon, such as no longer providing offerings that are placed in takir. The main requirement for farmers to do Javanese calculations is to remember the day their parents died and the 1st of Suro. If the results of the Javanese calculations fall on those days, the farmer is prohibited from starting planting. The hope is to avoid bad obstacles. The references used by farmers are oyot, wit, godhong, uwoh which are adjusted to the type of plant to be planted.

The practice of polygamy in Indonesia until now has drawn criticism from some feminists who did not agree. But on the one hand, both Islamic law and positive law permit various conditions. In this case, the Religious Court (PA) becomes the last fence which becomes the determining point for a man to be able to polygamy. For this reason, researchers conducted a study of PA decisions on polygamy, namely Jombang PA Decision No. No. 0899 / Pdt.G / 2018 / PA.Jbg . The focus of the problem is (1) the value of gender justice in the decision and (2) reasoning rechtvinding(legal discovery) judge. The method used in this study is a normative-qualitative legal research method with content analysis techniques from Charles Purse. The results showed that the practice of polygamy licensing in the Religious Courts had actually gone through processes that reflected gender justice. This is reflected in the obligation of the Religious Court to summon the longest wife of the applicant for polygamy to be asked for willingness and information. The results of subsequent studies show that PA Jombang judges used hermeneutic techniques in making legal discovery efforts. Because, they not only focus on aspects of legality, but also consider the contextualization.

This article is a study of the commercialization practice of secret marriage in Pekoren Village, Rembang Subdistrict, Pasuruan Regency, East Java Province. Secret marriage is carried out by the community using a broker service. In carrying out its duties, the broker asks for payment in the form of dowry money for operational costs and paying for the services of the Kyai who marry off. This case was analyzed using the eyes of Islamic law and juridical law. While the method used is a descriptive qualitative research method by collecting data through reading or reviewing the expressions and behaviors observed from the speakers in the field. From the field it is described, that the commercialization of secret marriage in Pekoren Village is a fixation of the price of dowry as an operational cost that uses the services of kyai and brokers to find the type of women wanted by interested person. In Islamic law, secret marriage is a legal marriage with the fulfillment of requirements and pillars of marriage. Brokers in this case can be categorized as buying and selling because of doing business, but it is still not suggested in Islam. In Positive Law, unregistered marriage is not valid because one element is not fulfilled, namely marriage recording. In line with these conclusions, the holders of the marriage registration policy must emphasize the regulation of marriage registration. For religious leaders, should not facilitate the  secret marriage ceremonies which are patterned as pleasure.

Menurut Pasal 36 ayat (1) Undang-Undang Nomor 1 tahun 1974, mengenai harta bersama, suami atau isteri dapat bertindak atas persetujuan kedua belah pihak. Adanya ketentuan Pasal tersebut di atas, menunjukkan bahwa jika seorang suami atau isteri, bermaksud melakukan perbuatan hukum yang objeknya terkait dengan harta bersama (misalnya menjual, menghibahkan dan lain-lain), baik itu berupa barang bergerak atau barang tidak bergerak, maka perbuatan hukum tersebut harus didasarkan pada persetujuan kedua belah pihak (suami dan isteri). Untuk mengetahui dan menjelaskan akibat hukum dari peralihan harta bersama melalui hibah tanpa izin dari salah satu pihak. Metode Penelitian yang digunakan adalah penelitian hukum yuridis normatif dan Ketiadaan persetujuan baik suami atau isteri memberi akibat hukum bahwa peralihan harta bersama tersebut menjadi batal demi hukum.As for article 36 paragraph (1) mentions that anything regarded to the shared-property should be with the consent of both parties. It is in line with Article 92 about Compilation of Islamic Law which mentions that either husband or wife without any consent of the other partner is not allowed to sell or transfer the ownerships of the shared-property. Provisionsof the article indicate that if the husband or wife intends to carry out a legal act whose object is related to a common asset (for example selling, granting, etc). whether it is movable or immovable property, the legal action must be based on agreement of both parties (husband and wife). To figure out and explain the legal consequences of share assets transfer throght a grant without permission from one of the parties. Research method used in this is normative juridical legal research. To find out and explain the comparison of provisions on the transfer of property with husband and wife based on Law Number 1 Year 1974 and Compilation of Islamic Law Absence of approval from both husband and wife gives legal consequences that transfer of shared property becomes null and void by law.

Penukaran harta wakaf adalah penukaran harta wakaf dari bentuk semula ke bentuk yang lainnya hukum islam pada dasarnya perubahan status wakaf tidak diperbolehkan melakukan penukaran sebagaimana mazhab Maliki dan Syafi’i sangat menekankan pada keabadian harta benda wakaf walaupun sudah rusak atau tidak menghasilkan sesuatu. Pada Pasal 40 Undang-undang Nomor 41 Tahun 2004 tentang Wakaf dijelaskan harta benda wakaf yang sudah diwakafkan dilarang ditukar. Tujuan penelitian untuk mengetahui status hukum penukaran harta wakaf menurut hukum Islam dan Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf dan mengetahui mekanisme penukaran harta wakaf menurut hukum Islam dan Undang-undang Nomor 41 Tahun 2004 tentang Wakaf. Metode penelitian yang digunakan adalah jenis penelitian hukum normatif (yuridis normatif) dengan mengunakan data primer, data sekunder dan tersier. Hasil penelitian bahwa ada berbeda pendapat ulama dan madzhab tentang penukaran harta wakaf menurut hukum islam ada yang berpendapat melarang ibdal (penukaran) tanah wakaf sekalipun tanah tersebut tidak mendatangkan hasil sama sekali sebagian ulama lainnya memperbolehkan menukar tanah wakaf yang tidak atau kurang bermanfaat dengan tanah lain yang lebih baik namun dengan syarat-syarat tertentu. Dalam perundang-undangan tentang wakaf secara mutlak membolehkan penukaran karena yang menjadi sorotan bukan bentuk akan tetapi yang terpenting dari wakaf adalah fungsi dan tujuannya. Mekanisme penukaran menurut hukum islam harus melalui hakim yang shaleh yang mempunyai ilmu dan amal. Undang-undang nomor 41 Tahun 2004 tentang Wakaf dalam pasal 51 menyebutkan bahwa mekanisme penukaran dilakukan oleh nadzir dengan mengajukan permohonan tukar ganti kepada menteri melalui kantor urusan agama dengan menjelaskan alasan perubahan status dan hasilnya harus dilaporkan oleh nadzir ke kantor pertanahan dana atau lembaga terkait untuk pendaftaran lebih lanjut.The exchange of wakaf property is the exchange of wakaf property from its original form to another form of Islamic law basically the change of waqf status is not allowed to exchange as Maliki and Shafi'i school emphasize on the immortality of waqf property even if it is damaged or does not produce something. In Article 40 of Law Number 41 Year 2004 regarding Waqf, the wakaf property that has been proclaimed is prohibited to be exchanged. The purpose of this research is to know the legal status of the exchange of wakaf property according to Islamic law and Law Number 41 Year 2004 about Wakaf and know the mechanism of exchange of wakaf property according to Islamic law and Law Number 41 Year 2004 about Waqf. The research method used is the type of normative legal research (normative juridical) by using primary data, secondary and tertiary data. The result of the research that there are different opinions of ulama and madhhab about the exchange of wakaf property according to Islamic law there are those who argue forbidding ibdal (exchange) of wakaf land even though the land does not produce the result at all some other scholars allow swap land donation which is not or less useful with other land better but with certain conditions. In the legislation on waqf it is absolutely permissible to exchange because the spotlight is not the form but the most important of the waqf is its function and purpose. The mechanism of exchange according to Islamic law must be through a pious judge who has knowledge and charity. Law No. 41 of 2004 on Waqf in article 51 states that the exchange mechanism is done by nadzir by applying for exchange to the minister through the religious affairs office by explaining the reason for the change of status and the result must be reported by nadzir to the land office of the fund or the relevant institution for registration Furthermore.

Bank sebagai lembaga keuangan, eksistensinya sangat tergantung dari kepercayaan masyarakat yang menjadi nasabahnya. Masyarakat telah memercayai bank sebagai institusi yang menyimpan dana nasabah, mengelola dan menyalurkan kembali kepada masyarakat dalam bentuk pinjaman atau kredit. Oleh karena itu, untuk menjaga kepercayaan nasabah tersebut, bank harus mematuhi ketentuan mengenai rahasia bank. Permasalahan dalam penelitian ini adalah mengetahui dalam kondisi bagaimana rahasia bank dapat diakses, pihak-pihak mana yang wajib menjaga kerahasiaan bank, adakah keterkaitan kerahasiaan bank dengan pajak, dan perlukah kerahasiaan bank yang terkait pajak dihilangkan. Penelitian ini menggunakan metode penelitian deskriptif kualitatif. Hasil penelitian mengungkapkan bahwa terdapat beberapa kondisi dimana rahasia bank boleh dibuka, tetapi tidak semua informasi dan data keuangan nasabah boleh dibuka di hadapan publik kecuali setelah adanya persetujuan dari Otoritas Pajak dan setelah mendapat laporan dari lembaga jasa keuangan di bawah pengawasan Otoritas Jasa Keuangan. Pembukaan rahasia bank diperbolehkan apabila berhubungan dengan kepentingan negara, seperti untuk kepentingan peningkatan kepatuhan masyarakat terhadap pembayaran pajak dan peningkatan penerimaan negara di sektor pajak.Banks as financial institutions, their existence is very dependent on the people’s trust who become their customers. The community has trusted banks as institutions that store customer funds, manage and channel back to the community in the form of loans or credits. Therefore, to maintain the customer's trust, the bank must obey bank secrets provisions. This research uses descriptive qualitative research method in the form of normative legal research and laws and regulations studies related to bank secrecy, derived from literature such as constitutional court decision, books, journals, articles, magazines, and websites. The results reveal that there are several conditions under which bank secrets may be opened, but not all financial information and data of the client may be disclosed in public unless after approval by the Tax Authority after receiving a report from a financial services institution under the supervision of the Financial Services Authority. The unveiling of bank secrecy is permitted when it comes to the interests of the state, such as for the purpose of increasing public compliance of tax payments and increasing state revenues in the tax sector.

This study aims to analyze the problem of legal protection for children in the perspective of human rights. The type of this research is socio-juridical or including descriptive research with a non-doctrinal approach, which views law as a socio-empirical symptom observed in experience. The research method used is descriptive research with the type of incorporation of normative legal research with sociological legal research related to the implementation of legal protection for children in the perspective of human rights. The results of the study show that the results of this study are the legal protection of children in the perspective of human rights in essence is an effort made by parents, government and society to fulfill and guarantee all children's rights that have been guaranteed in the convention of children's rights and laws Number 35 of 2014 concerning Child Protection. Legal protection for children in the perspective of human rights is less implemented because the government has not implemented its obligations in fulfilling children's rights so that there are still legal violations of children. The recommendation of this research is to implement legal protection for children in the perspective of human rights, parents should be fully responsible for the behavior of children and the government establishes policies that are in line with the wishes of the community, so that the common perception between parents, government and society is realized in fulfilling the rights child.

Through education given, learners is expected to be able toimprove independently, use and review knowledge, internalize and personalize the character values and be graciousso these can be implemented in their everyday behavior.This study aims to describe the planning of the main character values implementation in the IPS learning conducted by IPS teachers in SMP Negeri 3 Kelua, describe the executing of the main character values implementation in the IPS learning conducted by IPS teachers in SMP Negeri 3 Kelua, describe the assessment of the main character values implementationin the IPS learning conducted by IPS teachers in SMP Negeri 3 Kelua.This research method uses observation method, interview, and documentation bya qualitative research approach. The research is held in SMP Negeri 3 Kelua. The data analysis is by data reduction, display data and Verification.The results of this study and discussion illustrate, This research suggests that  the results of research can be used as additional repertoire of the application of character values about the analysis of character values implementation in IPS learning. Melalui pendidikan diharapkan peserta didik mampu secara mandiri meningkatkan dan menggunakan pengetahuannya, mengkaji dan menginternalisasi serta mempersonalisasi nilai-nilai karakter dan akhlak mulia sehingga terwujud dalam perilaku sehari-hari. Penelitian ini bertujuan untuk mendeskripsikan perencanaan, pelaksanaan,  penilaian implementasi nilai karakter utama dalam pembelajaran IPS yang dilakukan oleh guru IPS di SMP Negeri 3 Kelua. Metode penelitian ini menggunakan metode observasi, wawancara, dan dokumentasi dengan pendekatan penelitian kualitatif. Dilaksanakan di SMP Negeri 3 Kelua. Analisis data dengan reduksi data, data display dan verifikasi. Hasil penelitian dan pembahasan ini, menggambarkan bahwa: Perencanaan implementasi pendidikan nilai karakter dalam pembelajaran IPS di SMPN 3 Kelua dengan menyiapkan Silabus dan RPP terlebih dahulu, Pelaksanaan implementasi pendidikan nilai karakter dalam pembelajaran IPS di SMPN 3 Kelua dengan cara tugas kelompok dengan presentase dan diskusi, Penilaian implementasi pendidikan nilai karakter dalam pembelajaran IPS di SMPN 3 Kelua dengan menyiapkan lebih dahulu lembaran penilaian untuk peserta didik. Penelitian ini menyarankan hasil penelitian bisa dijadikan sebagai tambahan khasanah penerapan nilai karakter tentang analisis implementasi nilai karakter dalam pembelajaran IPS. Bagi guru bisa meningkatkan kreatifitasnya merancang dan merevisi rencana proses pembelajaran dengan penerapan nilai karakter sesuai kondisi sekolah dan materi pelajaran. Yang menjadikan peserta didik mampu mandiri, meningkatkan dan menggunakan pengetahuannya, mengkaji dan menginternalisasi serta mempersonalisasi nilai-nilai karakter dan akhlak mulia terwujud dalam perilaku sehari-hari.Kata Kunci: Analisis, Implementasi, Nilai Karakter, IPS

This study aims to see the community participation in the satellite area in the construction and maintenance of Drainage in the Village Marindal II District Patumbak Deli Serdang. The research method used to answer the problem in this research is the method of qualitative research approach. Data obtained through in-depth interviews, literature study and documentation. Informant research comes from the elements of sub-district government and community. The results of the research show that the participation, involvement and utilization of drainage facilities are running well.

Teknologi informasi dapat membuat apa saja menjadi lebih mudah dan efisien. Sebagai contohnya adalah pada perusahaan-perusahaan yang ada saat ini menggunakan sistem informasi pada alat elektroniknya untuk mengefektifkan produk dan hasil karyanya. Pada kajian ini, sistem informasi event organizer pada wahana entertaiment bertugas mengolah data seperti penginputan data pelanggan, data petugas, data peralatan, data paket, data pesanan, pencarian data dan laporan-laporan yang dibutuhkan. Tujuan penelitian ini adalah untuk merancang sebuah sistem informasi event organizer pada Wahana Entertainment. Metode penelitian yang digunakan adalah penelitian kualitatif dan pendekatan grounded research. Hasil dari penelitian ini berupa sistem informasi yang dapat membantu Wahana Entertainment dalam menerapkan sistem yang yang lebih baik, dapat mempermudah pekerjaan, meningkatkan kelancaran proses pengelolaan event organizer. Information technology can make anything easier and more efficient. For example, companies that exist today use information systems on their electronic devices to streamline their products and work. In this study, the event organizer information system in the entertainment vehicle is tasked with processing data such as inputting customer data, staff data, equipment data, package data, order data, data search and required reports. The purpose of this study was to design an event organizer information system at Wahana Entertainment. The research method used is qualitative research and grounded research approach. The results of this study are in the form of an information system that can help Wahana Entertainment implement a better system, make work easier, and improve the smoothness of the event organizer management process.
