The process of formation of different directions of objective scientific analysis of problems of the theory of state and law is investigated; the analysis of the transformation processes of Christian- law traditions in the legal system is carried out. Attention is drawn to the fact that the issue of preserving an identical national law culture and law traditionalism in the general context of globalization and European integration processes remains open; in the process of formation and development of the legal system. The author argues the point of view, the Christian-law traditions as an activity of social and interpersonal interaction through religious cognition and worldview is reflected on the level of social and individual consciousness. Guidelines are formed on the basis of ideas, beliefs, and ideas about Christian-law traditions. The ideals of Christian-law traditions are in the minds of both the postulates and the patterns of material and spiritual content. It is noted that the appeal to the Christian-law traditions is important in creating a community and in seeking to give society independence and autonomy In modern society, Christian-law traditions are used as a form of preservation and transmission to the next generations of spiritual culture, an important element of education of the people. In addition, Christian-law traditions as a kind of cultural and law traditions form the historical basis of the modern existence of the people, fix the sources of its existence. The ideological content of Christian-law traditions are spiritual and law values, stable standards of worldview and behavior, norms of morality, stereotypes of thinking, political, law and philosophical ideas, aesthetic ideas. It is argued that Christian-law traditions, together with axiological perceptions, beliefs and knowledge of acceptable order and structure of society, are passed down from generation to generation in the form of law experience on the basis of law mentality and within the law culture form law traditions. In addition, Christian-law traditions are part of the system of values of law, are the basis of law values, law ideas and ideas that have found their normative fixation, official recognition, institutionalization in positive law and are transmitted from one state to another in the form of laws, rules, legal attributes, legal monuments, etc. within the relevant legal system. Jewish law is an independent legal system embracing most of the subjects to be found in any system of positive law. The hopes and efforts of many people notwithstanding, Israeli law is not identical to Jewish law, nor does it constitute one of its branches. The generally accepted view is that Jewish law is not influenced, nor affected in any way, by the acts of the Israeli legislature or judiciary. There is, however, little doubt that to a certain extent, Israeli law is influenced by Jewish law. It is therefore a legitimate exercise to discuss the nature of the relationship between the two systems from the point of view of Israeli law. We may also comment upon the amount of satisfaction or disappointment which may legitimately be felt, on the one hand, by those in favour of reinforcing the relationship between the two systems and making it stronger and more active and, on the other, by those opposed to such a relationship. It should also be observed that the interrelationship between Israeli and Jewish law is not only to be perceived from the standpoint of pure law. Any discussion of this question involves issues of a political, religious and social nature; a study focussing on the bare legal facts alone would provide a necessarily distorted picture.

The author argues that the Christian legal traditions are a unique religious and social value, because they embody the fundamental principles of civilized organization of religious relations in society, their regulatory requirements. Christian legal traditions generalize national law at the level of the legal space, reflect the unity of the legal system, which fixes the legal individuality and identity of the country, which affects the formation of the national idea. The author notes that in modern society, Christian legal traditions, Christian legal traditions appear as a legal category, a phenomenon of legal culture, an element of the legal system and a component of the succession of law, which captures generalized legal experience, legal memory, legal knowledge and legal ideas. passed down from generation to generation as acceptable ways of organizing society, models of formation of the legal system, order in law, hierarchy of values in law, etc. The point of view that Christian-legal traditions can be characterized from the standpoint of traditionalism and modernism is substantiated. Socio-historical heritage is a liability of past traditions and a basis for the formation of new traditions. In general, modern society is characterized by the action of real Christian legal traditions, which combines authentic and non-authentic Christian legal traditions and socio-historical heritage in ensuring the heredity of social development with its previous stages. Authenticity is determined by the preconditions for the formation of Christian legal traditions in society, arising from the laws of the stages of its development. Inauthentic Christian legal traditions are created artificially and act as declared social norms that have not yet confirmed their value nature in the course of social practice. They are most often observed in societies undergoing transformational periods of their existence, during which there is a need for new methods of regulating social relations and means of community unification. Such Christian legal traditions can be used to fill gaps in the mechanism of social and normative regulation of social relations by connecting the past with new conditions and needs. In addition, Christian-legal traditions occupy an important place in the socio-normative organization of modern society, and during the historical process of development of society the content of Christian-legal traditions was influenced by ideological, cultural and socio-economic deformations of society. Christian-legal traditions as religious-normative principles ensure the realization of Christian-legal ideals and values in religious relations, their indisputable status in public life. Penelitian ini bertujuan untuk mengetahui penerapan lembaga suluk dalam membentuk nilai-nilai karakter masyarakat di Rokan Hulu, Provinsi Riau. Penelitian ini menggunakan tipe kualitatif dengan pendekatan etnografi yaitu pemahaman sudut pandang penduduk pribumi, hubungannya dengan kehidupan, untuk mendapatkan pandangan dunia suluk dengan sampel mursyid (guru utama), wakil mursyid dan pengikut dari suluk. Metode pengumpulan data yang digunakan adalah observasi, wawancara dan dokumentasi di lokasi kegiatan suluk. Hasil penelitian menunjukkan bahwa penerapan lembaga suluk dalam membentuk nilai-nilai karakter masyarakat di Rokan Hulu sangat baik dilihat pada perubahan sikap dan perilaku masyarakat dilihat dari aspek nilai-nilai karakter kejujuran, nilai-nilai karakter Toleransi, keyakinan nilai karakter , nilai dan nilai karakter kerja keras. tanggung jawab karakter. The application of Suluk institutions in shaping the character values of the community  AbstractThe research aims to find out the application of suluk institutions in shaping the character values of the community in Rokan Hulu, Riau Province. This study uses a qualitative type with an ethnographic approach that is understanding the point of view of the indigenous population, its relationship to life, to get a view of the world of suluk with a sample of murshid (master teacher), vice murshid and followers of suluk. Data collection methods used are observation, interviews and documentation at the location of suluk activities. The results showed that the application of the suluk institution in shaping the values of community characters in Rokan Hulu was very good seen in changes in the attitudes and behavior of the people seen from the aspects of honesty character values, Tolerance character values, confidence character values, hard work character values and values. character responsibility.

Abstract.Culture of gender in education sector and its implications on sexism in educational institution is a research that the University of Seville has studied and has leaded in the last years. In this paper, we show the first step of an investigation, leaded by Ana Guil Bozal, financed by Instituto de la Mujer (Prevenir la violencia contra las mujeres, evitando el sexismo en las instituciones educativas, 2013-2015) where we study the relation between the culture of gender and different ways of discrimination based on gender matters, specially violence. From the Doing Gender Theory (West & Zimmerman, 1987) point of view applied to an educational sector, there are different aspects that we could identify and that affect institutions from a gender perspective. The Doing Gender model identifies three levels: socio-cultural, relation and personal. In this first step of the project, we analyze the relational and personal level. Also, we added in our analysis the resources level, not included in the Doing Gender Theory, and where we study the human and economic resources available to work in gender area in educational organizations. There are relations between the people involved in education, mainly as follows: students, teachers and management team; then, their own system of values, attitudes and behavior; human resources with specifically training in gender matters and the economic resources. Violence against women can be face with education which must include a gender perspective. All the aspect involved in the daily education practices have reflected on the position of women in society.Keywords: Culture of Gender, Doing Gender, Gender ViolenceResumen.La Universidad de Sevilla ha estudiado y liderado diferentes líneas de investigación sobre la relación existente entre el sexismo y algunos aspectos presentes en las instituciones educativas. En este trabajo se presentan los resultados de la primera fase de un proyecto, financiado por el Instituto de la Mujer (Prevenir la violencia contra las mujeres, evitando el sexismo en las instituciones educativas, 2013-2015) en el que -de cara a la prevención- estudiamos la relación entre la Cultura de Género y las diferentes formas de discriminación por razón del género, especialmente la violencia. Como marco teórico para nuestro estudio hemos utilizado el modelo Doing Gender (West & Zimmerman, 1987), que mantiene que el género se manifiesta en tres planos: Socio-cultural, Relacional y Personal. En una primera fase del proyecto, analizamos los niveles relacional y personal. También incluimos un plano, al que llamamos plano de recursos, no contemplado en el modelo original y en el que indagamos sobre los medios humanos y económicos disponibles para el trabajo en el área de género en las instituciones educativas. En este documento se presentan los resultados iniciales de esta primera fase que servirán de base para la construcción de un modelo que permita evaluar la cultura de género de las instituciones educativas y así fomentar la prevención de las diferentes formas de discriminación por razón del género, entre ellas la violencia.Palabras clave: Cultura de Género, Doing Gender, Violencia de Género

Kebutuhan akan pembangunan fisik semakin meningkat seiring dengan bertambahnya jumlah penduduk. Problematika penyediaan tanah untuk pembangunan terjadi karena adanya pergeseran makna dan nilai tanah, sebagai akibat dari berkembangnya ideologi ekonomi kapitalis. Rakyat cenderung tidak mau melepaskan tanahnya kepada pemerintah untuk tujuan pembangunan dengan dalih bahwa besaran nilai ganti kerugian yang ditetapkan atas tanah terlalu rendah dan tidak adil. Oleh karena itu, perlu dilakukan revisi kebijakan dalam aspek pertanahan yang mengarahkan pada mekanisme pengelolaan aset tanah negara terintegrasi yang dapat mengakomodasi keinginan semua pihak, sehingga dapat menjamin terciptanya keadilan sosial (al-‘Adalah al-Ijtima’iyyah). Penerapan konsep bank tanah sebagai sarana pengelolaan aset tanah negara dapat menjadi solusi dalam mengatasi krisis tanah untuk pembangunan yang terjadi saat ini. Konsep bank tanah yang memperoleh tanah melalui mekanisme jual beli, tukar menukar, hibah maupun lelang akan memenuhi rasa keadilan yang diidam-idamkan oleh rakyat. Sebelum menerapkan konsep bank tanah melalui suatu instrumen hukum, maka konsep tersebut harus terlebih dahulu disesuaikan dengan hukum positif nasional, khususnya dalam sistem hukum agraria. Hal ini perlu dilakukan untuk menghindari terjadinya disharmonisasi antar peraturan perundang-undangan dalam sistem hukum agraria yang saling berhubungan antara satu dan yang lainnya. Artikel ini bertujuan untuk menganalisis landasan hukum mengenai konsep bank tanah sebagai pengelola aset tanah negara yang dapat mewujudkan keadilan sosial (al-‘Adalah al-Ijtima’iyyah) bagi seluruh rakyat Indonesia.(The need for physical development is increasing as the increase in population. Any problems in clearing land for development are caused by shifts in land meaning and value, as a consequence of the development of the capitalist economic ideology. The people tend not to relinquish their land to the government for development purposes under the pretext that the amount of compensation paid for land is too low and unfair. Therefore, it is necessary to revise the policy in the land aspect that leads to the integrated state land asset management mechanism that can accommodate the wishes of all parties, so as to ensure the creation of social justice (al-'Adalah al-Ijtima'iyyah). Implementation of the concept of a land bank as a means of managing state land assets can be a solution in overcoming the land crisis for development that occurs today. The concept of a land bank acquiring land through buying and selling mechanisms, exchange, grants, and auctions will satisfy the sense of justice coveted by the people. Before applying the concept of the land bank through a legal instrument, the concept must be adjusted to national positive law, especially in the legal system of agrarian. This needs to be done to avoid the occurrence of dis-harmonization between laws and regulations in the agrarian legal system that is interconnected between one and the other. Žiniasklaidos temų darbotvarkės kūrimas formuoja visuomenės temų darbotvarkę. Medijos teikiamos informacijos kokybė lemia visuomenėje naudojamo diskurso lygį, o pastarasis turi įtakos bendrųjų politinių, ekonominių ar socialinių klausimų sprendimui. Siūlomas naujas teorinis bendrojo konteksto nagrinėjimo aspektas – informacinis nutylėjimas. Informaciniai nutylėjimai – tai svarbios informacijos nepasakymas, kuris veikia bendrąjį kontekstą. Empirinis tyrimas nėra atliekamas, nes siekiama į reiškinį pažvelgti komunikacijos teorijos aspektu. Kitas aspektas, kad informacinių nutylėjimų empirinis nagrinėjimas vestų prie konkrečios istorijos pateikimo analizės. Būtų prarastas holistinis teorinis požiūris į informacinį nutylėjimą, kai, pateikiant informaciją ir sąmoningai ar atsitiktinai dalį svarbių žinių, duomenų ar faktų paliekant paraštėse, kuriamas nevisavertis visuomenės informuotumas. They not only inform, educate and provide entertainment, but also provide to the people the general context. Creating the news, the media shape the public agenda. The information provided by the media determine the quality of society’s discourse level and affect the political, economic, and social issues. The article theoretically proposes a new aspect of the examination, which is the information veiling. Informative veiling is an important information suppressing, which affects understanding of the context of general events. The information veiling can be intentional or accidental, but the effect will be the suppressing of important knowledge, data or facts and their unbalanced awareness. The purpose of the article is to examine analytically and theoretically the phenomenon of information veiling, linking it with propaganda and the context formation in general. In the deliberate or accidental information veiling, the result appears to be similar. Such information creates a weakly informed audience which is not using the valuable information for making the most effective decisions. If the public space is dominated by a large percentage of information veiling news, in society evolve myths, false assessments, and incorrect conclusions. In order to reduce the influence of information veiling, the audience should be careful as to the source of information and its expected effect. Examination of the media interest in the material reduces its propagandistic effect, and a more critical approach to the media coverage could reduce the information influence on the audience. On the other hand, we have to admit that it is a more idealistic approach rather than the reality.

Hegemony is defined as a condition under which a group establishes its supremacy not only by physical force but also through a consensual submission of the people who are dominated. This study aims to describe how “Sameness” is represented as a form of hegemony to create utopian society in The Giver and to describe the kinds of hegemony found in the novel. The methodology used in this study was descriptive-qualitative. By using sociological approach, this study analyzed the novel from the point of view of hegemony, a theory developed by Antonio Gramsci. There were two objects of the study, namely material object which was The Giver novel and formal object taken from the analysis of the novel using theory of hegemony. The results of this study show that system of “Sameness” is represented as a form of hegemony to create utopian society, seen from the episode of climate control which is created to avoid unpredictable weather, episode of family unit to control the populations of the community by regulating some procedures and rituals, episode of assignments by observing each of the citizens’ interest through volunteer hours and recreation time, episode of precision of language and attitude to keep good communication and behavior; episode of no individual choices, episode of artificial sense which limit the vision, audio, and feeling after the removal of memory, and episode of punishments for rule breakers. There are three kinds of hegemony found in the novel based on the level of domination and resistance, namely Integral hegemony which is seen from the full obedience of the citizens towards the authority of the Committee of Elders, Decadent hegemony which is depicted by the citizens’ disrespect and boredom towards the rules, and Minimal hegemony which happens due to the the resistance from the Receiver of Memory against the Committee of Elders despite the transformismo.   Keywords: Sameness; Hegemony; Utopian society

Introduction. The article discusses the state of preservation of universal and unique components in the structure of the traditional ceremonial culture of the Yakuts (who call themselves the Sakha), which is relevant in the modern society operating in the context of progressing processes of urbanization and globalization. The purpose of the research is to study the ceremonial traditions of the Sakha from the point of view of the principle of human congruity of culture and to structure this stratum of ethnic culture in accordance with the three substances of the spirit, soul and somatics of man. Materials and Methods. The work was carried out on the basis of cultural methodology using the methods of included observation, comparative analysis and generalization of the results of applied research and the author’s field materials. Results. The author has established and structured the elements of an integral novenary system of universals of the ceremonial culture of the Yakuts (Sakha). It has been revealed that these elements of traditional culture are generally preserved and function in a modern ethno-society to different extents of activity. It has been corroborated that, depending on the internal and external factors of cultural genesis, these components can be activated or pushed into the shadows, alienated from the people at different historical times; but something once created in a culture never disappears but remains in the cultural memory of the people. It has been proved that the latter happened to the ceremonial traditions of the Sakha, when in the post-Soviet time it became possible to openly perform both festive and daily rites and naturally follow the traditions of the ancestors when a person feels the need to do so. Discussion and Conclusion. Rites are historically shaped by ethnic communities for the purpose of naturally congruent existence and prosperous life in a given cultural landscape, as well as necessary components of the inner culture of the individual. The work is of practical significance for the structural and functional analysis as well as diachronic-synchronous study of the modern existence of the ceremonial culture of any ethnic group.

Indonesia implements civil law system. There are three sub legal systems which are implemented until today. They are: positive/national law system, Islamic law system, and Adat law system. The majority of Indonesians are Islamic believers. The people claim that they are a religious nation. However, the implementation of the inheritance law in accordance with the Islamic law and the Adat law is sometimes different. One of the ethnic groups which has different regulation in heritance is Minangkabau. Minangkabau inheritance adat law has been a controversy. It is because while they claim that all Minangkabau people are Islam, they implement an inheritance law that is said as violating the Islamic inheritance law. In Islam, inheritance is passed down to children, both daughter(s) and son(s)  with the composition son(s) inherits two parts compared to daugther(s). Many people  mislead that the Minangkabau inheritance law passes down the inheritance to daughter(s) only. This paper discusses: 1) how are inheritance matter regulated in each of the aforementioned sub legal system? 2) how is inheritance matter regulated in Minangkabau ethnic group?
