scholarly journals ON HUMANITARIANISM AND HUMANISM: LINGUISTIC AND STYLISTIC FEATURES OF THE STATEMENTS OF THE LEADERS OF LITERARY GROUPS IN THE EARLY 1930S (based on the responses of Leopold Averbakh, Maxim Gorky, Viktor Shklovsky to the death of Vladimir Mayakovsky)

The suicide of Vladimir Mayakovsky, the prophet of the revolution, its «agitator, bawler ringleader», which occurred in 1930, when the fate of the fi rst fi ve-year plan was being decided, coincided with a turning point in the Soviet Union’s sociopolitical life. This death, as well as the former suicide of Sergei Yesenin, impressed the society dramatically – it rocked the social optimism of the builders of socialism, besmirching the prospects. The responses of Leopold Averbakh, Maxim Gorky and Viktor Shklovsky to the tragic event reveal their assessment of Vladimir Mayakovsky’s work and their attitude to him as a person and a bearer of a certain worldview. These responses are important documents of the time, because they revealed the moral traits of the leaders of the literary life of the country, those who were later called «engineers of human souls». The analysis of statements about Vladimir Mayakovsky’s death, undertaken for the fi rst time in this article, reveals the «style» of the era of socialist reconstruction, in which there are no ways to express sympathy for a person: the poet’s tragedy became an occasion for polemics with class enemies (Leopold Averbakh), for edifying teaching (Maxim Gorky), for playing self-justifi cation (Viktor Shklovsky). The «slogan», «educational» and «game» principles represent the triumphant «humanitarianism» of the public consciousness of the era, understood as a form of «social domination» that provides people with «words» of the position of the arbiters of human destinies. In these relations, there are no concepts characteristic of a patriarchal society that include words and concepts to explain the principle of functioning of the social organism in the categories of «humanity», understood as «moral», «conscientious», «cordial», «sincere», not happening from the mind, but from the action of the «spirit».

In the modern global world, a study on mentality as a main characteristic of the nation which defines the unity of the religious and cultural tradition of the society is conditioned with the need to develop an effective international religious and cultural cooperation. The purpose of the analysis is to determine religious factors in shaping the Ukrainian mentality taking into account its historical background and the challenges of modernity. The study methodology is based on the principles of the non-confessional approach and philosophical pluralism, involving a system of methods, namely: historical, dialectical, comparative methods, synthesis, and generalization. In the conclusions it is emphasized that mentality is one of the forms of the social experience accumulation, the set of historically accepted ideas, viewpoints, stereotypes, forms and behavior which are laid down is the public consciousness by means of education, culture, religion, a language through the years. Every mental formation has its imaginary lines of a friend and foe which were formed by ideologies, beliefs, and religious values. The religious factors in the formation of mentality reflect the role of the Church as the main regulator of the social life. In the social environment of the Ukrainian nation, a temple can be seen as a peculiar archetypical formation, the part of the landmark, symbolic, communicative, and informational religious system which regulates the public consciousness and it is an integral part of the national memory. The mental archetypes of the national identity stem from the phenomenon of the borderlands, and have shaped in the social context the desire for personal freedom, patriotism, social activity; in the spiritual dimension, it is a willing for the inner world to be protected, sacrifice, mercy, non-violence.

This article shows how education, which is the most important form of activity in the social medium, changes the cultural image and awareness of individuals, and shapes and transforms their political attitude toward the surrounding day-to-day realities. A comparison analysis is used to explore a civic education system that forms the national and state identity of a person as a derivative of an “imagined community.” This phenomenon will be regarded here as the result of designing social and political values and their internalization in the public consciousness. This approach makes it possible to optimize the process of education for the public sphere which is destined to form an active citizen, to create a sustainable link between an individual and the social medium and is the most important tool of political communication.

Security as a social category is realised intuitively (subjectively) and is not always subject to unambiguous (objective) assessments. The perception of various formations tasked with ensuring public security and order gives rise to extreme assessments, sparking numerous discussions on how to judge their functioning. The aim of the article is to analyse the basic components which shape the social image of people and property security services in the public consciousness of the inhabitants of Słupsk – a medium-sized city in Poland . This has been researched on the basis of empirical surveys (questionnaires) diagnosing the assessment of the work and activities of security personnel. Referring to the past era often intends to show the social and political system and, accordingly, focus is on the opinion of philosophers, sociologists, political scientists, etc. In this case, often on the sidelines is a person, his feelings, and attitude. This is evident in the attitude to the recent Soviet past of our country. In this regard, along with the coverage of the problem of time fixation in the artistic consciousness, we analyze the spiritual life of the transitional period, the main feature of which is the contradictory assessment of the 70-year history of the USSR. And it is not only about the nihilistic attitude, in the simplified denial of the Soviet experience, but also on ignoring the spiritual quest, the history of the formation of images and meanings inherent in our nation. The past time is not only economics and ideology, it is also artistic culture. Nihilistic atti-tude to the Soviet era is the way to oblivion of a huge cultural layer. It is an axiom which for some reason needs to be proved again and again. The social and cultural approach to the understanding of the past and present time has a greater tolerance in judgments and allows to fill the gaps in the public consciousness, to present spiritual life in diversity and uniqueness. The works of words, screen masters, sociologists conclusions contribute to the understanding of the recent past and the rapidly changing reality of the transition time.

For over a decade the Qantas Spirit of Australia advertising campaign has worked to incite pride and nostalgia in Australian consumers. Its widespread success has led to four renewed television commercials, strategically released to coincide with key (inter)national sporting events, including the 2000 Sydney Olympics and the 2004 Rugby World Cup. All four Spirit commercials feature children singing Peter Allen's I Still Call Australia Home in picturesque global and national landscapes. As a result of the Spirit campaign's widespread success, Peter Allen's song has become almost synonymous with the Qantas brand. The iconic Spirit commercials are exemplary in (re)affirming the public consciousness towards Australian childhood identity. Exploring national issues of freedom, race, youth and adventure, the commercials are situated among diverse social signs that attempt to typify Australian children. Influenced by post-structural theoretical frames, the author analyses the ‘social’ semiotic dimensions of these advertisements. His intention is to contribute to understandings of the discursive constitution of Australian childhoods in advertising. The unique iconic status of the Spirit campaign, he argues, lies in its capacity to be commensurate with, and (re)affirm, Australia's public perceptions of self and community.

This essay focuses on proportionality stricto sensu as a consequential test of balancing. The basic balancing rule establishes a general criterion for deciding between the marginal benefit to the public good and the marginal limit to human rights. Based on the Israeli constitutional jurisprudence, this essay supports the adoption of a principled balancing approach that translates the basic balancing rule into a series of principled balancing tests, taking into account the importance of the rights and the type of restriction. This approach provides better guidance to the balancer (legislator, administrator, judge), restricts wide discretion in balancing, and makes the act of balancing more transparent, more structured, and more foreseeable. The advantages of proportionality stricto sensu with its three levels of abstraction are several. It stresses the need to always look for a justification of a limit on human rights; it structures the mind of the balancer; it is transparent; it creates a proper dialog between the political brunches and the judiciary, and it adds to the objectivity of judicial discretion. Proportionality stricto sensu however has it critics: some claim that it attempts to balance incommensurable items; others that balancing is irrational. The answer to the critics is that it is a common base for comparison, namely the social marginal importance and that the balancing rules—basic, principled, concrete—supply a rational basis for balancing. A democracy must entrust the judiciary—the unelected independent judiciary—to be the final decision-maker—subject to constitutional amendments—about proper ends that cannot be achieved because they are not proportionality stricto sensu.

The article attempts to justify and introduce the scientific term of "political and legal manipulation" that will make it possible to reach a new level of discussion of closely coupled psychological, political and legal means influencing the public consciousness. It is maintained that the term under discussion offers a kind of a methodological stepping stone in the research of the two most important aspects of a far-reaching process of political and legal influence on social processes: a) legal mechanisms, tools, tricks and techniques of carrying out certain political manipulations; b) the impact of political expediency on the law itself, on the processes of lawmaking, implementation and interpretation of law within nations of the world. Political and legal manipulation is viewed as a form of psychological impact on the social relations combining psychological, political and legal means. The article studies in detail the nature, essence and indicators of political and legal manipulation, its main goals and objectives, as well as the selection of tools that lends such a specific character to this kind of manipulation.
