Quality evaluation for recommendations of the antitrust regulator in the development of the legal system of Ukraine

The formation of a competitive system in a country’s economy is always determined by the possibilities of using tools that stimulate development and form an independent picture for the external environment. In this regard, the study determines the efficiency of antimonopoly regulatory authorities in establishing the criteria and limits of regulation. At the same time, there are cases when antitrust regulation is understood primarily as a form of economic pressure on business entities. The novelty of the study lies in a new consideration of the limits of antitrust regulation. The authors demonstrate that antitrust regulation in its current capacity constitutes a form of limiting the growth of the company and is aimed primarily at reducing the dependence of the market on one stakeholder. The paper identifies the possibilities of additional consideration of the criteria for limiting antitrust regulation in the context of the formation of economic security of a business entity. The paper covers the aspects of determining the limits of state support of economic security of business entities. The practical significance of the study is determined by the need for a more practical harmonization of the legislation of the country with global business standards and a decrease in the level of regulation of the business environment, coupled with its protection from hostile takeovers. Introduction and Objective of the Research. According to the modern economic theory, compliance in the global business and its support occupy a certain, moreover, indefinite place among the heaviest burdens for global business entities. The objective of the article is to cover the issue of smart contractual relationships (SCR) as a way to increase the business activity of global business entities by minimizing compliance risks (CR).Hypothesis of Research Studies. With current technology solutions available today, it is expected that SCR will allow minimizing the burden of global business entities by widespread CR. The most important role among such solutions is played by the latest distributed ledger technologies (DLT). In the medium term, these technologies will reach such a level of development, at which the transition of contractual relationships from ordinary to intelligent ones will not only lead to the decrease in business activity in world markets, but will also contribute to its substantial increase.Objective. To prove that CR substantially overburden global business processes; to substantiate the urgency of the issue of the transition of the global business to SCR, as a way to a possible lack of CR in the global business environment.Research Methods:- theoretical substantiation for proving the significance of CR as factors of the global business environment and the necessity of using DLT in SCR;- statistical analysis for conducting a normative monetary valuation of CR and representing the degree of awareness by global business entities (GBE) of the competitive advantages of SCR over ordinary ones.Results: the significance of compliance risks in the global business is defined; the importance of smart contractual relationships in the way of eliminating compliance risks essential for entrepreneurship is theoretically grounded. The existence of advantages of the activities of global business entities within one or more sectors according to the cluster principle has been proved:- the cluster economy is a set of solely smart contractual relationships with the use of blockchain technologies;- using these technologies, entrepreneurship in the cluster is accompanied by minimal compliance risks.Conclusions. The article outlines the economic essence of SCR using DLT. Accordingly, theoretically, DLT will promote the spread of SCR to the entire global business environment, since business processes that are not accompanied by CR are possible then. Further research will cover the essence of DLT, due to which all the main advantages, as well as all existing deficiencies of the technology and defects for their active introduction in SCR in the world.

Purpose. Under the conditions of strengthening of the destructive effects of the global economic crisis and the growing number of risks of agribusiness, there is a problem in finding the ways to improve accounting and analytical support as the only reliable source of the relevant and accurate information needed for economic security management. The purpose of the article is to substantiate the directions to improve the analytical basis as a component of accounting and analytical support of economic security management of the agricultural enterprises. Methodology / approach. The methodological basis of the research is a dialectical method of cognition of the complex economic phenomena. Consideration of the analytical support of complex management processes took place using a systematic approach, analysis and synthesis. Using an integral approach, a methodology for assessing and analyzing economic security of the agricultural enterprises is developed. This methodology approach includes the parameters of financial, social, resource and environmental security. Results. The analysis of the theoretical and methodological foundations of accounting and analytical support of economic security management showed a variety of the approaches to the choice of the indicators that describe the level of economic security. The situation is complicated by the need to analyze the information that may be relevant for management decisions in conditions of uncertainty. Under these conditions, it is proposed to implement a model of analytical support for economic security management under conditions of uncertainty and growing risks and threats to the business environment of the agricultural enterprises, which should be based on the use of general economic, statistical, integral and econometric approaches. It is determined that in the process of counteracting the risks and threats of the external and internal environment of the agrarian business the use of the integral methods of assessing economic security of the agricultural enterprises becomes crucial. It is substantiated that the most expedient in terms of achieving strategic goals of the enterprise, maintaining its competitive advantages and ensuring sustainable development is the use of integral assessment of economic security, which should be based on a synergistic approach to analysis of 25 indicators of financial, social, resource and environmental components. The approach was tested on the example of 24 agricultural enterprises of Kharkiv region (Ukraine) of crop specialization (2019). The model is also used to analyze the dynamics of the level of economic security under conditions of individual agricultural enterprises of different organizational and legal forms of management (2014–2019).  Originality / scientific novelty. According to the results of the research, a methodological approach to determination of the integral level of economic security of the agricultural enterprises has been improved, based on the impact of the indicators of its individual components, which, at the same time, improves the analytical support of economic security management and strengthens verification, forecasting, preventive, planning and control functions of accounting and analytical support of management mechanisms. Practical value / implications. The practical significance of the proposed approaches consists of the possibility of positioning the enterprises in terms of optimal, satisfactory, shaky and crisis economic security zones, as well as analyzing the dynamics of the integral level of economic security, which takes into consideration the causal relations of the key areas of the agrarian business under conditions of uncertainty.

This article seeks to provide argument that effective performance in modern realia of business and management is impossible without understanding the socio-psychological processes that accompany entrepreneurial endeavours. Further development of market competition in the national economy, its inclusion in the system of global economic relationships, aggravation of internal barriers to successful implementation of economic reforms significantly raise the issue of exploring a psychological aspect of economic security of businesses, and in international ventures, in particular. An emphasis is put that the roots of genesis and evolution of economic psychology refer to radical changes, especially changes occurred in the economic paradigm and attitudes towards ownership for the means of production in the first place, as well as the emergence of new economic actors. Apart from that, pressing globalization trends, changes in political and economic patterns, as well as rapid technological advances in society have greatly affected socio-cultural values of the population. However, even the very speed and extent of global change faced by modern society depends on psychological characteristics inherent in different social groups. Different psychological patterns and perspectives that drive the development of business environment world-wide have created a new background for shaping and launching new economic security strategies for international business entities and ventures. The findings have verified that business economic security directly relates to management's understanding of the needs and the specifics of business structure and their alignment with the personal goals of the leader. Moreover, business operation of economic entities, both in the external and internal environment, encourages them to search for the new pathways and raise awareness of the need for effective interaction between the internal corporate culture and its organizational structure, ensuring and managing economic security and values of international markets. To attain the above objectives, a thorough research on the international business environment is of critical significance. It is argued that deep insights into psychological factors driving drastic change in the politicians’ perceptions of the need to make a shift from a planned socialist paradigm to a market economy, exploring the psychology of transformation of the theoretical concepts from Marxist political economy to Western market theories will facilitate better understanding of the nature of economic security of international ventures.

The article develops concept of strategic management as a system of actions necessary to achieve the goals, often in conditions of limited resources. The terms strategy, economic strategy and strategic management of economic security of regions are considered as a specific strategic action plan aimed at developing the economy of the regions, which, in turn, is manifested in the development of social, cultural and other areas of activity of the regions. The principles of strategic management of economic security of regions are characterized: systemic - strategic management should take into account all components of the region’s economy as a system, be aimed at different areas of economic security of both subjects and objects of economic development of regions, strategic measures should be systemic related economic security management processes; regularities - to take into account the regularities of regional development and to have institutional support; planning and continuity - strategic management should be continuous, the directions of economic security should not contradict and agree with each other, be reflected in regional integrated programs; Interactions - measures should be aimed at ensuring the security of regional development and be accompanied by coordinated actions of all participants in this process, including by bringing information to the subjects of strategic management measures. It is noted that the features of strategic management of economic security at the regional level in relation to the national, they include: - the close proximity of diversified regional producers who are able to respond quickly to changes in effective demand; - availability of local labor funds with a concentration of specific skills; - involvement of regional actors in transnational networks; - development of industrial and social regional infrastructure that contributes to economic security. The determinants of the meso-level are substantiated, according to the territorial aspect the following characteristics of the regions should be attributed: - resource provision and potential opportunities of the regions; - regional features; - development of regional infrastructure; - attractiveness of the region (regional level of employment and unemployment; standard of living in the region; investment attractiveness; availability of natural and other resources; branched transport infrastructure). The main obstacles to effective strategic management of economic security of the regions are revealed: distrust of business entities in the methods of public administration and reform of economic relations, administrative barriers and corruption component of economic activity, etc. However, the introduction and implementation of strategic management of economic security of regions in terms of decentralization of management form a competitive business environment, ensure economic development, stability and stability of the economic system of the region through the interest of all actors of economic security.

The development of the information sphere and the corresponding increase in its volume and cost is accompanied by the introduction of advanced information technologies in all spheres of public life of the state, which leads to an increase in the frequency of attacks and potential losses from information leakage. As a result, the complexity of protection systems and an increase in their cost. In these conditions, the task to efficiently distribute limited financial resources to protect the information of business entities becomes more and more important and largely determines the level of financial and economic security of the enterprise and the state as a whole. Of particular relevance is the development of issues of optimisation of indicators of the information security system in a dynamic confrontation. Such indicators can be the amount of damage caused from the implementation of information threats, which determines the effectiveness of the protection system, the profit from making investments in information protection, their profitability, and the like. It was established that it is necessary to determine the total amount of protection resources, which minimises the total losses from possible information leakage in conditions of instability. The authors believe that the optimal control mechanism is the distribution of resources between objects that contain a different share of information and are distinguished by natural security, dynamic vulnerability, and the probability of an attack with the allocation of a certain amount of resources. The practical significance of the study lies in determining the optimal moment for the introduction of defence resources – after the direction and intensity of attacks and, accordingly, the possible level of losses was clarified.

The article is devoted to the problems of pricing processes in the economic security system. Pricing processes are one of the central and main processes in the economic. At the same time prices as a flexible tools are very powerful management lever of economic. Pricing processes are certain algorithms for generating prices, when various environmental factors are inconsistent and irregular. The article describes some problems of pricing processes in the economy, explores the practice of price manipulation by business entities. The authors analyze some antitrust regulation tools, content and conditions of their application and also define the disadvantages of these tools. The authors consider the situation, when exerting regulatory influence on pricing processes is on free prices market. The purpose of the issue is to reveal the features of the antitrust regulation tools in the management of pricing processes, to determine the basic principles of creating and functioning of a unified system for monitoring pricing processes. General scientific and special methods such as the system analysis method, the retrospective analysis method, and analytical methods of data research were chosen as scientific tools for conducting this study. The empirical materials of the study are presented by open data and analytical reports of the Federal Antimonopoly Service of Russia, decisions and definitions of the Supreme and Arbitration Courts of the Russian Federation, official data of state authorities. The authors make recommendations on how to accept some antitrust regulatory tools. They also determine the additional priority of the state’s economic security strategy in managing pricing processes and develop the objectives of creating a unified system for monitoring pricing processes.

Purpose. Corporate social responsibility (CSR) is an important feature of modern business. It provides a certain level of voluntary response to social problems, compliance with moral requirements of society. Companies have already realized the benefits of a socially proactive position and are increasingly involved in solving social and environmental problems. This raises the issue of CSR evaluation from a cost / benefit standpoint. The aim of the article is to study the existing approaches to assessing the level of CSR and determine the scope of their use. Design/methodology/approach. Abstract and logical method was used for generalization of theoretical and methodological provisions for the assessment of CSR. A systematic approach was used to form a system of ESG-indicators and to develop a system of indicators for assessing the benefits of implementing CSR activities. Economic and statistical methods were used for the assessment of CSR Ukrainian companies. Finding. The article presents the key characteristics of CSR. The focus is on the positive impact of the implementation of CSR practices on the activities of companies. A critical analysis of the approaches of Ukrainian scientists to the assessment of CSR was made, which allows to distinguish the assessment of CSR in general and the effectiveness of CSR activities. The authors identified three methodological approaches to the assessment of CSR. A general description of these approaches is given, their advantages and disadvantages are identified. The authors note that there is no universal form of financial reporting, businesses have a choice of what form it is. The most common are sustainable development reports, which are formulated for GRI standards. More Ukrainian companies publish their social reports, thus declaring their commitment to CSR concepts. It is proved that CSR is gradually transformed into a system of environmental, social and management parameters - ESG. The content of ESG-factors is determined and a system of indicators in the context of ecological, social and management spheres is formed. The system of indicators for assessing the benefits of implementing CSR activities is formed. A special place in the article is given to the international rankings of companies according to their ESG indicators. Based on the data of the catalog of social initiatives of companies, the general state of CSR in Ukraine is analyzed. It is established that the development of CSR in Ukraine is in line with European trends. The modern practice of social responsibility assessment is systematized. Practical implications. The practical significance of the obtained results is to develop the theoretical and methodological basis for the assessment of CSR. The results of the study can be used by entrepreneurs and managers seeking to achieve long-term success in the global business environment. Originality/value. The theoretical basis of CSR evaluation is developed by distinguishing three groups of methodological approaches, including analysis of non-financial reporting, calculation of quantitative and qualitative indicators, as well as index and rating methods. A system of indicators based on the maximum consideration of stakeholders' interests has been developed to assess the benefits of CSR activities.

The article examines the role of the business environment in shaping the economic security of business entities. The key economic interests of the entity and factors of influence that originate from the internal and external environment and which have a significant impact on the commercial business are distinguished. Potential and real threats to the realization of economic interests and the achievement of goals of the business entities are foreseen. Appropriate measures of an effective system of their protection within the competence of economic security have been developed. The author's vision of defining the economic security of business entities is proposed, which is interpreted as a state of protection of economic interests against the destructive effects of the business environment that maintains resistance to internal and external threats, ensures high competitiveness and ability to sustainable development. It is proposed to distinguish certain areas of economic security, which differ in their purpose and have an individual focus, namely financial, personnel, technical and market. It is proved that the formation of components is, first of all, related to the internal environment, since its factors are solely within the competence of the economic entity and is a primary sign of its effective functioning, which will allow sustainably resisting the effects of the external environment. Internal and external threats of economic activity by separate functional components are distinguished. It is taken into account that economic security management provides for their comprehensive systematic monitoring in order to prevent and minimize destructive effects in a timely. Preventive measures have been developed to improve the level of business security, which will allow to successfully operate in the conditions of competition and to ensure the sustainable development of business entities in the future.

The study is devoted to the interaction of the interests of business entities and the interests of subjects of the corporate environment, as well as determining the possibility of targeting accounting and financial activities in the business environment, taking into account the social constraints associated with the COVID-19 pandemic. The purpose of the article is to study the processes of the possibility of targeting accounting and financial interaction of business entities in various conditions of the development of the business environment. The subject of the research is the accounting and financial interaction of business entities both within the country and abroad in the context of the introduction of various social and behavioral restrictions on doing business. The hypothesis of the study – the definition of specific target categories of accounting and financial interaction of the subjects of state subsidies will provide a specific algorithm for determining the feasibility of implementing some business initiatives and reducing others, precisely in the context of the introduction of social and behavioral restrictions associated with the COVID-19 pandemic. Methods used in the study: system analysis, economic and statistical methods, information processing, method of logical generalization of results, expert assessments, etc. Presentation of the main material. The article examines the conditions for targeting accounting and financial interaction of business entities, designed to use the factors of competitiveness that were underutilized in the past period in the business environment. This systematization pursues the goal on the part of the state to introduce a system of economic incentives, changes in macroeconomic parameters (reduction of inflation, emphasis on attracting long-term money to the economy, growth of business activity and private investment, changes in the structure of budget expenditures), and on the part of the state entities themselves – situational assessment their own capabilities and threats, subject to the introduction of social and behavioral restrictions. The practical significance of the results obtained lies in the possibility of using the developed recommendations for an independent analysis of the possibility of introducing a target in the field of accounting and financial interaction of business entities in Ukraine. Conclusions and prospects for further research. Targeting accounting and financial interaction of business entities to ensure contractual stability between partners provides for compliance with the regime of floating, but stable relations (depending on the conditions of socio-behavioral restrictions), the fluctuations of which serve as the main buffer against the impact of external shocks on the economy of Ukraine as a whole. Further research will be aimed at determining the feasibility of target procedures in the tax environment and identifying the prospects for the introduction of target tools for targeted interaction with various audiences for administering tax payments

The financial security state of the country directly depends on the amount of resources available in the financial system. Internal sources of financing of the economic and social needs may deprive the government of the necessity seek opportunities for obtaining external borrowings, which lead the country to the loss of financial autonomy. The financial inclusion of the population and business entities into the process of using financial products and services will stabilize the situation in the financial market by obtaining additional financial resources by its professional participants. At the same time, the lack of control of this process can lead to new threats for financial security at micro and macro levels. In view of this, the purpose of the study is to specify the opportunities and risks of financial inclusion for the financial security of financial intermediaries and the state as a whole. The object of the study was the level of financial inclusion, a set of factors that affect it, and a list of the consequences that its change may have for financial security. As the theoretical basis of the study, the reporting materials of financial market regulators were used, as well as information obtained from the application of such methods of scientific research as the analysis by which the level of financial inclusion in different sectors of the financial market was established, and the expert method implemented through surveys and questionnaires. Its use enabled to get a quantitative assessment of the level of financial inclusion of the population and economic entities. As a result of the study, the possible, positive consequences, risks and challenges of financial inclusion for the financial component of economic security are specified and systematized. The practical significance of the results of the survey is the possibility of developing on their basis the mechanisms for stimulating and controlling the level of financial inclusion by the financial market national regulators.
