One of the most important stages in the construction process is selecting the right contractor considering the smallest price that may raise many doubts. The cheapest option may be uneconomi­cal in view of a failure of technical quality and assessment of building lifetime. The article reviews literature and worldwide used practice to establish the most important factors of contrac­tor’s competitiveness. The paper also determines the main factors of the competitiveness of roofing contractors and evaluates qual­ity as a competitive advantage of the companies having influence on other factors of competitiveness. In conclusion; important proposals for assessing the competitiveness of the contractor and recommendations for future research are provided. Santrauka Vienas svarbiausių statybos proceso etapų – parinkti tinkamą rangovą. Rangovo pasirinkimas pagal mažiausią kai­ną kelia daug abejonių. Pigiausias pasirinkimas gali būti neekonomiškas, atsižvelgiant į nepakankamą pagamintos produkcijos techninę kokybę ir įvertinant statybos objekto gyvavimo trukmę. Norint išsiaiškinti svarbiausius rangovo konkurencingumo veiksnius, buvo atlikta pasaulinės literatūros ir praktikos apžvalga. Straipsnyje nustatyti pagrindiniai įmonių, klojančių prilydo­mąsias stogų medžiagas, konkurencingumo veiksniai. Įvertinta kokybės, kaip įmonės konkurencinio pranašumo, įtaka kitiems jos konkurencingumo veiksniams. Pateikti siūlymai rangovo konkurencingumui vertinti, taip pat būsimų tyrimų pasiūlymai.

How can a supreme audit institution (SAI) use design thinking in auditing? SAIs audit the way taxpayers’ money is collected and spent. Adding design thinking to their activities is not to be taken lightly. SAIs independently check whether public organizations have done the right things in the right way, but the organizations might not be willing to act upon a SAI’s recommendations. Can you imagine the role of design in audits? In this paper we share our experiences of some design approaches in the work of one SAI: the Netherlands Court of Audit (NCA). Design thinking needs to be adapted (Dorst, 2015a) before it can be used by SAIs such as the NCA in order to reflect their independent, autonomous status. To dive deeper into design thinking, Buchanan’s design framework (2015) and different ways of reasoning (Dorst, 2015b) are used to explore how design thinking can be adapted for audits.

There is a gap of knowledge between practitioners about the off-site construction. For this reason, the Manni Group case study presented in this article highlights the positive role of dissemination as business value proposition support in the context of off-site construction industry. The Manni Group involved opinion leaders, professionals, universities and industrial partners in a network of dissemination that, going beyond the concept of advertising, it generated a multiple effect of value creation between the direct and indirect involved stakeholders. Dissemination emerges as a model of action that creates impacts on cultural change. It is scalable and applicable in many areas where actors have the right competences to manage the dissemination. Wherever there is a knowledge gap or friction towards new techniques and methodologies, the model is able to create value for companies and stakeholders involved in the emerging network.

The article outlines the main criteria for determining the temperament of the student for the formation of educational groups in order to optimize the educational process. It describes the way of conducting research to identify the effectiveness of training students with a predominant phlegmatic type of temperament (introverts) and students with a predominant choleric type of temperament (extroverts) in separate academic groups. The article also touches upon the problem of the right to have a mistake as the only way to the educational growth of a person. The main results of the study are pointed out.

Quality management is considered one of the most important obstacles facing the construction industry in Sudan. The application of a quality assessment system contributes to the development of quality in projects as it is possible to measure the quality in projects. This paper aims to introduce one of the quality assessment systems, which is the system followed and applied in the Singapore (CONQUAS). This system assesses quality based on structural, architectural, mechanical and electrical work. The paper also aims to study the factors affecting the application of the quality assessment system in Sudan. The study is carried out in the region of Khartoum. The study is focusing on the construction projects. The study is carried out by questionnaires and other literature review. The respondents are consultants and contractors. The data has been distributed and analyzed by using the Average Index. From the study it was found that CONQUAS standard is assessed the building based on workmanship standards by the assessors from the BCA on site using standard score sheets. The assessment is done throughout the construction process for structural, mechanical and electrical works, and from questionnaire results the main factors affect construction industry in Sudan is lack of standardization in Sudan. The author recommended that more study shall be conducted to identify factors affecting quality in Sudanese construction industry and how to improve the quality.

This chapter studies the operations of the Iranian criminal law and analyzes how the procedural administration of the law animates the shariʻa. Iranian criminal laws provide many avenues for victims to forgo retributive sanctioning. But preserving the right of retribution serves several purposes: maintaining the sovereign's monopoly on legitimate violence, giving victims a sense of power, and halting the cycle of violence. The way Iran achieves this comprises an interesting balancing act between maintaining the monopoly over legitimate violence and granting individual victims the right of retribution, which its leaders believe, through their interpretation of the shariʻa, cannot be appropriated by the sovereign. Since the law categorizes intentional murder as qisas and leaves judges with no discretion in sentencing, the judges may use their considerable influence to pressure the family to forgo retribution. The chapter then considers the role of judges and examines how the laws (substantive and procedural) shape their reasoning and discretion in both sentencing and encouraging forbearance.

Is health a human right? Many would maintain that it is not. On this view health and ill-health are due to natural causes, not to State actions. Others are concerned that health raises too many polycentric problems to be dealt with through justiciable human rights. These contestations have shaped the way in which the right to health is understood. Section II sketches out the health context. Section III considers jurisdictions in which there is no express right to health, but a right has been derived from rights to life, personal integrity, or privacy. Section IV contrasts this approach with jurisdictions with an express right to health. Section V examines the role of the right to equality, while section VI focuses on reproductive health. The final section returns to the challenges of polycentricity and the extent to which a justiciable right can address systemic issues rather than individual rights to medication.

The nature of the enterprise and the way people work is changing rapidly. The enabling power and competitive advantage of new social and participative technologies will benefit those that recognize the way work is changing. Web 2.0, the ‘second phase’ of the Web, is the foundation of a new and improved Enterprise 2.0. Enterprise 2.0 provides, through a web of interconnected applications, services, and devices, the capabilities for enterprise employees and vendors to be more competitive and productive and for enterprise customers to be more engaged and loyal by accessing the right information from the right people at the right time. This paper describes Enterprise 2.0 management challenges and issues identified by Chief Information Officers, which include the unauthorized use of services and technologies, the integration of a myriad of technologies and capabilities, and the potential compliance and security implications. The authors have proposed a conceptual framework that explores the relationships of three Enterprise 2.0 dimensions – technology, its use, and how resulting user-generated content may lead to business value – with management implications affecting IT culture and policies within the enterprise. This paper provides observations and suggestions for future research.

The purpose of this study is to investigate the influence of knowledge sharing (KS) and two specific types of innovation on competitive advantage in Vietnamese firms. Based on using structural equation modeling (SEM) and survey data collected from 225 participants, the findings reveal that KS directly and indirectly affects firm’s competitive advantage through the mediating role of innovation speed and innovation quality. The findings stress the important role of building a positive climate to stimulate employees for sharing knowledge aimed at improving firm’s innovation capability, and sustaining competitive advantage. Future research needs to explore the relationship between three components of knowledge management namely knowledge acquisition, KS, and knowledge application, innovation, and specific aspects of competitive advantage (such as low cost advantage, differentiation advantage, and time advantage) to provide deeper the mechanism of how specifics aspects of knowledge management connected with firm’s certain types of competitive advantage through innovation.

This study investigates conflict management climate as perceived by the owners and contractors significantly affect trust and relationship quality in the Nigerian construction industry. This empirical study also assesses trust as a mediator between conflict management climate and relationship quality. Data gathered from 426 owners and contractors employees in the Nigerian construction industry were used to verify the abovementioned relationships via structural equation modeling. The results show that conflict management climate significantly predicted trust and relationship quality. Trust significantly predicted relationship quality and partially mediates the relationship between conflict management climate and relationship quality. This study contributes to theory within this research by showing trust and relationship quality is significantly affected when owners and contractors are aware of the conflict management climate. The study offers important practical implications for managing conflict management between owners and contractors in the construction industry. Insights into future research directions are also documented.

Changes in the current workplace are creating changes in traditional processes. One such process is the way that the millennial and subsequent generations joining the workplace consume learning. The hospitality industry is an ever-changing service industry in which organizations need to continue to adapt to stay relevant. Trained employees providing excellent guest experiences are a competitive advantage. Some barriers to training include lack of time, lack of resources, and changing learning expectations. The aim of this article was to propose a new learning model that integrates performance workflow and microlearning. Microlearning is an approach that focuses on a single concept, utilizing multisensory and multimodality in a focused short amount of time. It can be easily incorporated to the job workflow. The model, future research, and implications are discussed.
