The Confucian Individual

Confucian individualism is analogous to the Western acclaim for personal individuality. The notion of individualism, which is seen as fundamental and pervasive in Western civilization, is not to be contrasted with collectivism, which is perceived in Eastern societies as the underlying social structure. The Chinese, on account of Confucius, conceive of individuals and family as subordinated to the importance of society or the state. Confucius was mindful of the essential status of individuals when he, as an individual, performed the rituals at the funeral of his mother, having individually studied the ancient history pertinent to the rites. An occasion of ontological impracticality is the fact that the exclusive attention to communal concord and harmony at the expense of personal individuality cannot have contributed to the medical advances and the breakthroughs made possible in modern medicine. Also discussed in this chapter is the contribution of Confucius in the academic sphere of the Chinese society.

AbstractThis paper discusses the thesis defended by Edith Stein that certain acts can be attributed to the State. According to Stein, the State is a social structure characterized by sovereignty. As such, it is responsible for the production, interpretation, and application of law. These tasks require the performance of acts, most of which are what Stein calls “social acts” like enactments and orders. For Stein, the acts in question are made by the organs of the State, but in the name of the State, and are thus attributed to the State via a relation of representation. In the first section, the paper presents Stein’s thesis that the sovereignty of the State entails a series of legal prerogatives, which in turn result in various social acts being ascribed to the State through its representatives. In the second section, the paper critically discusses Stein’s views, notably her theory of representation, and her account of the nature of the State, while emphasizing its most interesting aspects, namely, its fine-grained analyses of the various acts that are attributed to the State.

This article aims to trace and describe the bioethical threads in medical practice and the understanding of medicine among Tibetan refugees living in India. Taking up such a task results mainly from the fact that only traces of bioethical reflection are visible in Tibetan society, but without the awareness that it requires systematic reflection on its essence and changes that accompany modern medicine. I define the state of the discussion on Tibetan bioethics as preparadigmatic, i.e., one that precedes the recognition of the importance of bioethics and the elaboration of its basic concepts. In this paper, I will show how the Tibetan refugees today, in an unconscious way, approach bioethics, using the example of life-related topics, namely beginning and death. To this end, I chose topics such as abortion, fetal sex reassignment, euthanasia, and suicide. On this basis, I will indicate the main reasons that hinder the emergence of bioethics and those that may contribute to systematic discussions in the future. An introduction to Tibetan medicine will precede these considerations. I will show how medical traditions, especially the Rgyud bzhi text, are related to Tibetan Buddhism and opinions of the 14th Dalai Lama.

In 2014, the State Council of the People’s Republic of China released a document that called for the construction of a nationwide Social Credit System (SCS) with the goal to encourage sincerity and punish insincerity. The system uses blacklists that citizens land on for various cases of misbehavior, ranging from failing to pay a fine to being caught Jaywalking. This research explains the design process behind the SCS and in particular why many Chinese citizens are embracing this form of surveillance. It focuses on three topics to answer this question: the historical roots underlying the system, the perceived lack of trust in Chinese society and the comparison with concepts from surveillance theories developed in the West. From the analysis, following conclusions could be drawn: Historically, the state has often acted as a promoter and enforcer of moral virtue. The SCS fits perfectly into this tradition. The most prominent reason for the positive Chinese reaction is the lack of institutions in China that promote trust between citizens and businesses. There is a severe trust deficit which the government had to find a solution for. Regarding surveillance theory, Foucault’s concept of ‘panopticism’ shows similarities with the SCS and underlines its effectiveness in changing and steering people’s behavior while Lyon’s notion of ‘social sorting’ is used to demonstrate the potential dangers of the Chinese system.

For a qualitative analysis of the state of modern society and financial relations prevailing in the financial system of our country, it is especially important to study issues related to attracting public finances to the state economy. The long process of developing commodity-money relations has radically changed the content of finance. If earlier in these relations the main and fundamental role was played by the monarchs, the state, as the owners of all property, then in the XX century. The main owners of valuables, including enterprises and firms, are citizens, and the state represented by public authorities acts as an intermediary and a consumer of redistributed wealth. Confirming this thesis, P. Drucker expressed that the main impetus of progress now comes not from the social structure, but from an individual, and the present time requires every person to take effective actions to transform not only society, but above all himself [1 ].

The philosophy postulating the protection of human rights is based on values that are fundamental to western civilization. These values found expression in Jerusalem and in Athens. The divine command to love one’s neighbour as one loves oneself and to obey God’s laws is the basis of the sovereign’s duty to respect these “unwritten and immutable divine laws” of which Sophocles speaks. It took many centuries before these rights, “droits naturels et imprescriptible de l’homme,” were recognized by the state to the extent that their breach was supposed to entitle the citizens to revolt.

The article argues that, unlike Collins’ adamantly negative view towards vivisection in the latter half of the nineteenth century and approaching the end of his writing career and life, Wells and Galsworthy’s changing opinions responded to medical advances, reflected the dynamics of public opinion, and their own knowledge and experience at their time of writing. With its primary focus on Galsworthy, the study also explores the reactions of contemporary critics, readers, scientists and medical practitioners to these depictions of vivisection. Above all, the article argues that popular writers, particularly before modern multimedia, greatly influenced public attitudes towards changes in society, including medical research by vivisection. The ultimate change of heart towards vivisection by Nobel Prize winner Galsworthy, an indirect and eminent beneficiary of vivisection, the article concludes, would have boosted public acceptance and the cause of modern medicine.
