This article aims to analyze the legal implications of regulating the authority of the Regional Representative Council of the Republic of Indonesia (DPD RI) in supervising the draft regional regulations and regional regulations in Indonesia. This is based on the existence of a conflict of norms in Article 249 paragraph (1) letter j of Law Number 2 of 2018 with the Constitution, especially regarding the authority of the DPD RI itself. This study uses a normative juridical research method with a statutory and conceptual approach. The result of this study is the existence of legal uncertainty in the supervision of draft regional regulations and regional regulations. Because Article 22D paragraph (1) to paragraph (3) of the Constitution does not provide and does not mention the authority to monitor and evaluate draft regional regulations and regional regulations as stipulated in Article 249 paragraph (1) letter j of Law N 2 of 2018.

The purpose of this research is to determine the constitutional complaint mechanism based on comparisons in other countries, practices, and adaptation of constitutional complaints under the authority of the Constitutional Court of the Republic of Indonesia. Many cases with constitutional complaint substance have been submitted to the Constitutional Court of the Republic of Indonesia even though they don’t have this authority. This research uses a normative legal research method using a statutory approach, a conceptual approach, a comparative approach, and a case approach. This research indicates that the constitutional complaint mechanism in Germany, South Korea, and South Africa has been well implemented. In practice, cases with constitutional complaint substance are filed to the Constitutional Court of the Republic of Indonesia by changing the form by using the legal means of a judicial review, such as case number 16/PUU-VI/ 2008, case number 140/PUU-XIII/2015 and case number 102/PUU-VII/2009. Due to the consideration of the structure, substance, and culture of law, adaptation of constitutional complaint within the authority of the Constitutional Court of the Republic of Indonesia needs to be carried out by amending Law Number 24 of 2003 jo. Law Number 7 of 2020 concerning the Constitutional Court.

Perkembangan pandemi Covid-19 saat ini sangat mengkhawatirkan dimana terjadinya suatupeningkatan kasus corona khusus di Indonesia. Penelitian ini bertujuan untuk mengetahuidan menganalisis kebijakan yang diambil pemerintah dalam penanganan pandemi Covid-19serta langkah-langkah yang diambil pemerintah untuk menganggulangi dampak-dampak, terutama dampak dari segi ekonomi dan sosial akibat pandemi Covid-19. Metode penelitianhukum yang digunakan yakni metode penelitian hukum normatif. Adapun pendekatan yangdigunakan dalam penelitian ini adalah pendekatan perundang-undangan dan pendekatankonseptual. Penelitian ini berlandaskan pengaturan perundang-undangan yang mengaturmengenai penanganan dan penganggulangan pandemi Covid-19 serta analisis atas konseppenetapan peraturan perundang-undangan tersebut. Hasil dari penelitian ini adalah dalamrangka penanganan Covid-19, berawal dari pemerintah tmengeluarkan kebijakan tentangPembatasan Sosial Berskala Besar yang merujuk pada Undang-Undang Nomor 6 Tahun2018 tentang Kekarantinaan Kesehatan. Peraturan pelaksanaannya yaitu PeraturanPemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar, sertaKeputusan Presiden tentang Kedaruratan Kesehatan sampai dengan saat ini pemerintah telahmengeluarkan kebijakan PPKM yang dimana dilakukan secara berkala. Untukmenganggulangi dampak Covid-19 dari segi ekonomi dan sosial pemerintah mengambilbeberapa kebijakan-kebijakan, yang diantaranya adalah: Peraturan Menteri KeuanganRepublik Indonesia Nomor 23/Pmk.03/2020 tentang Insentif Pajak Untuk WajibPajakTerdampak Wabah Virus Corona; Peraturan Otoritas Jasa Keuangan Republik Indonesia Kata Kunci : Kebijakan, Penanganan, Covid-19 The current development of the Covid-19 pandemic is very worrying where there is anincrease in special corona cases in Indonesia. This study aims to identify and analyze thepolicies taken by the government in handling the Covid-19 pandemic and the steps taken bythe government to mitigate the impacts, especially the economic and social impacts of theCovid-19 pandemic. The legal research method used is the normative legal research method. The approach used in this research is a statutory approach and a conceptual approach. Thisresearch is based on the legislation governing the handling and handling of the Covid-19pandemic as well as an analysis of the concept of establishing these laws and regulations. The results of this study are in the context of handling Covid-19, starting with thegovernment issuing a policy on Large-Scale Social Restrictions which refers to Law Number6 of 2018 concerning Health Quarantine. The implementing regulations are GovernmentRegulation Number 21 of 2020 concerning Large-Scale Social Restrictions, as well as thePresidential Decree on Health Emergencies. Until now, the government has issued a PPKMpolicy which is carried out regularly. This research aims to determine the legal implications of the agreement on which the sharia banking dispute resolution clause was submitted through the state court's post-decision of the Constitutional Court No. 93/PUU-X/2012. The research method used normative research with a statute approach and a conceptual approach and analyzed descriptive qualitative. The results of the study show that the contract that contains the clause for the settlement of Islamic banking disputes through the District Court after the Constitutional Court decision has the implication of being null and void because it contradicts the contract or causa that is lawful, so that the parties make an addendum so that no future disputes occur.

The political party's position as a determinant of government head nomination in Indonesia made the political party a central and strong role in the determination of the Cabinet in the presidential government of Indonesia and allowed the political party to determine the Cabinet domination established by the President elected. This research aims to determine the model of the presidential institution strengthening in the multi-party era in Indonesia and to know the political and juridical construction of the presidential institution in determining the cabinet in Indonesia. The method used is a normative legal research method with a conceptual approach. The results of this research are, firstly that the strengthening of the presidential institution in the multi-party era can occur when done with the restriction of political parties through the mechanism of the parliamentary threshold. Secondly, that the political construction of the cabinet determination by the President is based on the coalition of political party supporters of the government, and the juridical construction of the President may elect the Minister of the party proposal because it is based on article 6A paragraph (2) The Constitution of the Republic of Indonesia 1945. Kedudukan partai politik sebagai penentu pencalonan kepala pemerintahan di Indonesia menjadikan Partai Politik memiliki peran sentral dan kuat dalam penentuan kabinet di Pemerintahan Presidentiil Indonesia dan memungkinkan partai politik untuk menentukan dominasi kabinet yang dibentuk oleh Presiden terpilih. Penelitian ini bertujuan untuk mengetahui model penguatan lembaga kepresidenan pada era multi partai di Indonesia, dan untuk mengetahui konstruksi politis dan yuridis lembaga kepresidenan dalam menentukan kabinet di Indonesia. Metode yang digunakan adalah metode penelitian hukum normatif dengan pendekatan konseptual. Hasil penelitian memperlihatkan bahwa pertama, penguatan lembaga kepresidenan di era multi partai dapat terjadi apabila dilakukan dengan pembatasan partai politik melalui mekanisme parlementary threshold. Kedua, bahwa konstruksi politis penentuan kabinet oleh presiden didasarkan atas koalisi partai politik pendukung pemerintahan, dan konstruksi yuridis presiden dapat memilih menteri dari usulan partai karena didasarkan pada Pasal 6A ayat (2) UUD 1945.

The existence of rules limiting the cassation becomes an obstacle for the public to obtain justice and is not in accordance with the principles of the state of Indonesia as a state of law which is stated in the provisions of the 1945 Constitution of the Republic of Indonesia in Article 28D. Problem: Is the limitation of cassation in Article 45A of the Supreme Court Law in accordance with the provisions of the 1945 Constitution and the Criminal Procedure Code. This research is a normative research method with a statutory approach and a conceptual approach as well as prescriptive analysis techniques. The cassation legal effort should return to its basic purpose, namely maintaining legal uniformity and unity and providing justice for the community.

AbstractPornography has become a material for sale and purchase transactions. Pornographic transactions on the internet have many processes , so that there are many laws and regulations that can be applied. This creates legal uncertainty. The formulation of the problem in this research is the qualification of criminal acts related to pornography selling and buying transactions on the internet media and the accountability of criminals in selling and buying pornography on the internet media. The research method used is legal research through a conceptual approach and a statutory approach to assess existing legal problems. The results of this study show that the sale and purchase of pornography via the internet can be applied to the ITE and pornography laws. Then the responsibility depends on the evidence in the process of proving in court what the form of pornography is.Keywords: Criminal Liability; Transactions; Buying and Selling; Pornography; Internet.AbstrakPornografi sudah menjadi bahan yang di transaksi jualbelikan. Hal ini membuat ketidak pastian hukum. Rumusan masalah dalam penelitian ini adalah Kualifikasi tindak pidana terkait transaksi jualbeli pornografi di media internet dan pertanggungjawaban pelaku tindak pidana dalam transaksi jualbeli pornografi di media internet. Metode penelitian yang digunakan adalah legal research dengan melalui pendekatan konseptual dan pendekatan peraturan perundang-undangan untuk mengkaji permasalahan hukum yang ada. Hasil dari penelitian tersebut diketahui bahwa transaksi jualbeli pornografi melalui internet dapat diterapkan Undang-Undang ITE dan Pornografi. kemudian pertanggungjawabannya tergantung dari pembuktian dalam proses pembuktian di dalam persidangan apakah bentuk dari pornografi tersebut.Kata Kunci: Pertanggungjawaban Pidana; Transaksi; Jual Beli, Pornografi; Internet.

Undang-Undang Dasar Negara Republik Indonesia 1945 (UUD 1945) Pasal 24C ayat (6) menentukan bahwa hukum acara serta ketentuan lainnya tentang Mahkamah Konstitusi diatur dengan undang-undang. Berdasarkan ketentuan tersebut jelas bahwa hukum cara Mahkamah Konstitusi diatur dengan undang-undang. Makna frasa "diatur dengan" menurut Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan materi muatan itu harus diatur hanya di dalam Peraturan Perundang-undangan yang didelegasikan dan tidak boleh didelegasikan lebih lanjut ke Peraturan Perundang-undangan yang lebih rendah (subdelegasi). Pokok permasalahan yang penting diteliti adalah apa implikasi hukum pengaturan hukum acara Mahkamah Konstitusi dalam bentuk Peraturan Mahkamah Konstitusi. Sesuai dengan permasalahan yang diangkat, penelitian ini adalah penelitian doktrinal atau juga disebut sebagai penelitian normatif. Pendekatan yang digunakan adalah pendekatan teoretis (theoretical approach), dan pendekatan konseptual (conceptual approach). Implikasi hukum pengaturan hukum acara Mahkamah Konstitusi dalam bentuk Peraturan Mahkamah Konstitusi berdasarkan hasil penelitian ini teridentifikasi ada 3 (tiga), yaitu: ketidakpastian hukum, pelanggaran hierarki peraturan perundang-undangan, dan ketiadaan tertib hukum. Akibat ketiga implikasi hukum tersebut maka penyelenggaraan wewenang dan kewajiban Mahkamah Konstitusi menjadi tidak sah. Namun demikian mengingat asas kemanfaatan dan asas praduga rechtsmatig maka selama memberi mandat dan sampai dengan belum ada pembatalan Peraturan Mahkamah Konstitusi maka tindakan MK selalu harus dianggap benar.1945 Constitution (UUD 1945) Article 24C Paragraph (6) provides that the procedural law and other provisions concerning the Constitutional Court shall be regulated by act. Based on these provisions it is clear that the law of the way the Constitutional Court is regulated by act. The meaning of the phrase "governed by" pursuant to Act No. 12 of 2011 concerning the Establishment of the Acts and Regulations on the contents of the content shall be regulated only in the delegated Legislation and shall not be further delegated to the lower Legislation Regulations (subdelegations ). The main issue that is important to examine is what is the legal implication of regulation of procedural law of the Constitutional Court in the form of Constitutional Court Regulation not in an Act. In accordance with the issues raised, this study is a doctrinal research or also referred to as normative research. The approaches are theoretical approach, and the conceptual approach. The legal implications of the procedural law setting of the Constitutional Court in the form of Constitutional Court Regulation based on the results of this study are identified there are 3 (three), namely: legal uncertainty, violation of legal hierarchy of regulations, and absence of orderly law. As a result of these three legal implications, the legal consequences for the implementation of the authority and duties of the Constitutional Court become invalid. However, considering the principle of expediency and presupposition principle of rechtsmatig then as long as giving benefit and until there is no cancellation of the Constitutional Court Regulation, the action of the Constitutional Court must always be considered true.

Transportation is one of the derivative needs in society due to economic, social activities, and so on. In general, there are two transportations, namely based on conventional and online, but the problem is that discrimination often occurs against providers of online-based transportation services, especially in transporting passengers. Thus, the purpose of this study is to find out the legal protection for online transportation service providers in transporting passengers and to find out the legal consequence of discriminating against online transportation service providers in carrying passengers. The method used in this study is normative legal research method. Meanwhile, the legislative and conceptual approach is the approach used in this study. The results of this study showed that the legal protection of online transportation service providers in Indonesia is regulated in legislation including the 1945 Constitution of the Republic of Indonesia which in principle every legal subject must be treated equally before the law, and Law Number 39 Year 1999 which protects that every person is entitled to a job, and legal protection is also contained in Law No. 8 of 1999 which in principle regulates the rights and obligations of business actors. The legal consequence of discrimination is that it can result in criminal and civil law in the form of compensation for imprisonment or fines.

The corona virus or what is known as Covid-19 is an infectious disease caused by a new type of coronavirus that was discovered at the end of 2019 in the city of Wuhan, China, which has spread throughout the world, has killed hundreds of people and infected tens of thousands of others. Previously, Indonesia was one of the countries that had not been infected, and finally in February the corona virus entered Indonesia. The spread of the corona virus causes panic among Indonesian people. The purpose of this study is to uncover legal sanctions against state officials who violate health protocols during the COVID-19 pandemic. The research method used is a normative legal research method where the reference is based on a conceptual approach to legislation. Sources of materials and laws used are primary and secondary. The data collection technique used is to collect references related to research. Furthermore, the data will be processed and analyzed using legal data processing methods systematically. The results of this study indicate that cases of spread and death rates caused by the corona virus are now increasing quite rapidly, a number of countries have even taken action by prohibiting every citizen from traveling abroad or receiving visits from foreign nationals (lockdown). In order to deal with the unrest experienced by the Indonesian people and efforts to prevent the transmission of the corona virus which is increasingly increasing the number of positive patients, the government issued several regulations or policies, namely Government Regulation of the Republic of Indonesia Number 21 of 2020, concerning Large-Scale Social Restrictions. (PSBB) in the context of accelerating the handling of the 2019 coronavirus disease (covid-19).

 Dinamisasi kabinet kerja yang merupakan hak prereogratif presiden tidak hanya memperhatikan resistensi antara presiden dengan kepentingan partai politik, namun juga pertimbangan antara eksistensi Pemerintah Daerah sebagai konsekuensi dari sistem Presidensil dalam bentuk Negara Kesatuan Republik Indonesia. Tulisan ini berusaha menelaah topik pembahasan Dinamisasi Kabinet dan Upaya Konsistensi Sistem Presidensial di Indonesia. Metode penelitiаn ini аdаlаh yuridis normаtif dengan pendekatan historis, pendekatan konseptual, dan pendekatan peraturan perundang-undangan. Hasil dalam pembahasan ini menyimpulkan bahwa postur kabinet harus dibarengi dengan sinkornisasi hukum hingga pada titik minimum postur pemerintahan (Pemerintah Daerah) dengan Pemerintah Pusat yang direpresentasikan oleh kementerian melalui UU Nomor 23 Tahun 2014 tentang Pemerintah Daerah dengan UU Nomor 39 tahun 2008 tentang Kementerian. Bentuk sinkornisasi tersebut dapat dilakukan melalui: Penambahan unsur profesionalisme dalam UU, Penambahan peraturan terkait komposisi, dan/atau syarat, dalam penambahan/ pengubahan/ penghapusan kementerian, dan penambahan pengaturan terkait harmonisasi kewenangan dan ruang kerja antara pusat dan daerah.Kata kunci: Dinamisasi, Kabinet, Pemerintah. The dynamism of the working cabinet, which is the president's prerequisite, not only takes into account the resistance between the president and the interests of political parties, but also the consideration between the existence of the Regional Government as a consequence of the Presidency system in the form of the Unitary State of the Republic of Indonesia. This paper attempts to examine Cabinet Dynamics and Efforts to Consistency in the Presidential System in Indonesia. This research method is juridical normative with a historical approach, a conceptual approach, and a statutory approach. The results of this discussion conclude that the cabinet posture must be accompanied by legal syncornization to the minimum point of government posture (Regional Government) with the Central Government represented by the ministry through Law Number 23 of 2014 concerning Regional Government with Law Number 39 of 2008 concerning Ministries. This form of syncornization can be carried out through: Adding elements of professionalism in laws, adding regulations related to composition, and/or requirements, adding/ changing/ deleting ministries, and adding regulations related to harmonization of authority and work space between the central and regional governments.Keywords: Cabinet, Dynamism, State Government
