La importancia de las contrataciones con el Estado ha dado lugar, en los últimos veinte años, al desarrollo de un marco regulatorio cada vez más amplio y especializado, en el cual la figura del arbitraje ha cobrado un protagonismo singular, dado que el propio ordenamiento peruano abstrajo de este mecanismo de solución de controversias sus características originarias, dotándole una identidad propia en este ámbito de aplicación. Con los diversos cambios normativos que ha sufrido el régimen, el arbitraje en contrataciones con el Estado ha sido objeto de numerosos ajustes, tanto en lo sustantivo como en lo adjetivo, encontrándonos hoy en día ante una disciplina especializada que aún está en proceso de consolidación debido a que, si bien se han dado importantes pasos para la compatibilización del arbitraje con nociones e instituciones propias del Derecho Público, todavía incide significativamenteen su desarrollo la frágil estabilidad del marco legal que lo contempla y la presencia de deficiencias regulatorias que no han podido coadyuvar a superar problemas suscitados en la práctica arbitral relacionados a su propia aplicabilidad e, incluso, al rol de los árbitros. En ese sentido, el presente trabajo tiene por objetivo graficar —desde una perspectiva analítica— el actual panorama del arbitraje en contrataciones con el Estado, a partir de las principales reglasincorporadas en las recientes modificaciones a la Ley N.º 30225, Ley de Contrataciones del Estado, y a su Reglamento, cuya pertinencia y eficacia será objeto de reflexión en relación al contexto antes descrito, a partir de la ratio legis que se desprende de las mismas. The importance of contracting with the State has given rise to the development of an increasingly broad and specialized regulatory framework, in the last twenty years, in which the arbitration figure has taken on a unique role, as the Peruvian legal order abstract of this mechanism of dispute resolution its origin features, giving itself own identity in this field of application. With the various regulatory changes that the regime has gone through, arbitrationin contracting with the State has been object to numerous adjustments, as in the substantive as in the adjective, facing today a specialized discipline that is still in the process of consolidation due to, although important steps have been taken for the compatibility of arbitration with notions and institutions of Public Law, the fragile stability of the legal framework that contemplates it and the presence of regulatory deficiencies that have not been able to contributeto overcome problems raised in arbitration practice related to their own applicability, they still have a significant impact, and even to the role of arbitrators. In this sense, the present work aims to graph —from an analytical perspective— the current overview of arbitration in contracting with the State, based on the main rules incorporated in the recent amendments to Law N.° 30225, Law on State Contracting, and its Regulation, whose relevance and effectivenesswill be object to reflection in relation to the context described above, based on the ratio legis that emerges from them.

The presented study examines the experience of forming a regulatory framework for the integration of the Eurasian Economic Union (EAEU) member states through the example of standardization as one of the key tools of quality economics.Aim. The study analyzes the major solutions of the EAEU authorities and member countries aimed at increasing the role of standardization in the economic integration of the Union over five years of its existence.Tasks. The authors identify efficient methods for developing standardization for the integration of the EAEU states as well as the most problematic aspects in this field that need to be taken into account in the qualitative strengthening of the Union’s economy.Methods. This study uses general scientific methods of cognition to examine the activities of the EAEU authorities and member states aimed at creating a system for the economic integration of the Union during a period of its transition from separate national markets towards a single (common) market.Results. Over five years of operation in the field of stadardization, the Eurasian Economic Union has created the necessary organizational and legal framework to ensure the successful development of integration processes. The national legislation on standardization has been modernized with allowance for the harmonization of these laws. In the next five-six years, the development of international standards for 40 technical regulations is expected to be completed, which would create a regulatory framework for unhindered interaction between all participants of the single (common) EAEU market. Conclusions. The analysis of activities in the field of standardization reveals a sufficiently thought-out and coordinated policy of the EAEU states in creating the necessary conditions for overcoming legal and administrative barriers in the movement of goods and services within the common economic space of the EAEU.

Foundations, as permanent funds established by a certain legal act, can serve manifold purposes, but often pursue charitable goals. As such, they play an important role for the public good. Therefore, states always had an interest in fostering foundations by providing a pertinent legal framework. In Austria, this topic has not yet been the focus of scholarship. Through this study some light is shed on the implementation of the law on foundations in the Habsburg Monarchy. It focuses on the role of the state and its legal system regarding the regulation and supervision of foundations from 1750 to 1918. This period is characterized by the sovereigns’ endeavor to regulate the position of foundations via extensive legislation. In particular, a system of oversight for foundations was created in order to guarantee the attainment of their charitable goals. In fact, this system prevailed until the end of the 20thcentury.

This study is designed to highlight the important role of the growing role played by the equitable economy and solidarity in building a balanced and integrated into the society, characterized by the values of solidarity in the framework of the spirit of the voluntary contribution and the spirit of the personal initiative, as well as the principles of equity and social justice that seeks this economy established and consolidated, the study found that the pilot experiences for both the state of Canada, Ecuador, Brazil, Finland, France, Spain, the reputation and excellence by relying primarily on the legal framework for this sector and organized the second degree of integration of all segments of society in the form of labor organizations for each category but every geographical region, the study recommended in the end to adopt the principle of integration and horizontal and vertical cooperation between these organizations in order to achieve effectiveness More competitive.

Estatuaren koordinazio-lana handitu ahal izateko sartutako elementuen zentzua, erabilgarritasuna, eraginkortasuna eta konstituzionaltasuna aztertzen dugu lan honetan. Gure ustez gure ordenamenduarekin koherenteak ez diren alderdiak ere adierazten ditugu, eta legegileak horren aurrean jarraitu beharko lukeen bidea erakusten dugu. RESUMEN: Partiendo del reparto competencial asentado en la materia de los espacios naturales protegidos, en general, y de los Parques Nacionales, en particular, y del concepto y ejercicio de la potestad de coordinación existente en nuestro ordenamiento jurídico, analizamos la batería de elementos que llevan a incrementar el papel coordinador del Estado, que consideramos constituye el cambio más trascendental de la inmediata reforma de la ley de Parques Nacionales. En este estudio analizamos el sentido, la utilidad, operatividad y constitucionalidad de los elementos introducidos para aumentar el papel coordinador del Estado. Al mismo tiempo, señalamos aquellos aspectos que consideramos que no son coherentes con nuestro ordenamiento y apuntamos el camino que tendría que seguir el legislador al respecto. ABSTRACT: On the basis of the allocation of powers regarding the protected natural spaces in general and National Parks in particular, and the concept and exercise of the power of coordination which exists in our legal order we analyze a set of elements which lead to promote the role of coordination by the State, which we consider to be the most significant change in the immediate reform of the Act on National Parks. We analyze in this study the meaning, the utility, operativity and constitutionality of the elements introduced in order to promote the role of coordination by the State. At the same time, we note those features that we consider that are not coherent with our order and in that regard we show the path to be followed by the legislator.

The situation in the construction complex of the state and crisis phenomena in it are shown. It is proposed to return to the basic components of system management of the industry, lost due to spontaneous pseudo-market processes. Problems that need to be overcome are systematized, they are the following: attracting investments, increasing effective demand in the domestic market, strengthening the competitiveness of production, the predominance of innovative technologies, increasing the quality of products and facilities, bringing the legal framework to European standards, training of employees and managers. The state of the housing market, the importance of its openness, transparency, systematization and regulation are described. The special importance of the regulatory function of the state in the current situation is pointed out. The importance and role of comprehensive activities for housing construction economic growth is emphasized. The need to create conditions for increasing the volume of products sold under international agreements through investment and interstate projects is noted. The relationship between the results of the construction industry and the effective use of human capital is given, for which each company needs measures to improve work with staff, improve their skills, financial incentives and social security. The expediency of introducing the mechanism of energy service in construction, which is part of the management system with subsystems of planning, organization, regulation, motivation and control, is proved. The role of methods for evaluating the effectiveness of innovative activities of enterprises to ensure quality and effective management of production processes is analyzed. The information on development schemes of the organization at registration of the allowing documentation, financing, designing, market research, selection of participants, accounting, construction, property management is provided. The function of settlements' territories as separate objects at construction of inhabited premises is defined. Award on the need for construction and reconstruction of "sleeping" areas in cities, which requires significant investment, development of building structures, as well as established close relationships with industrial, commercial, cultural, entertainment and other facilities.

AbstractThis paper explores subsidiarity as a constitutional principle in international law. Some authors have appealed to a principle of subsidiarity in order to defend the legitimacy of several striking features of international law, such as the centrality of state consent, the leeway in assessing state compliance and weak sanctions in its absence. The article presents such defences of state-centric aspects of international law by appeals to subsidiarity, and finds them wanting. Different interpretations of subsidiarity have strikingly different institutional implications regarding the objectives of the polity, the domain and role of subunits, and the allocation of authority to apply the principle of subsidiarity itself. Five different interpretations are explored, drawn from Althusius, the US federalists, Pope Leo XIII, and others. One upshot is that the principle of subsidiarity cannot provide normative legitimacy to the state-centric aspects of current international law on its own. It stands in need of substantial interpretation. The versions of subsidiarity that match current practices of public international law are questionable. Many crucial aspects of our legal order must be reconsidered – in particular the standing and scope of state sovereignty.

In the last four decades, Malaysian jurists and Sharî’ah scholars have immensely contributed to the field of Islamic finance sufficient to attract international recognition and acceptance. This has turned Malaysia to a vibrant global hub for Islamic financial services. In furtherance of this enviable position, a new legal framework was recently introduced which is expected to reemphasize the pragmatic and resilient nature of the Islamic finance industry. This paper therefore provides a judicial perspective on the recent reforms in the legal framework of Islamic finance industry, examines the dynamics of Islamic finance litigation, and highlights the important role of the judiciary and other dispute resolution institutions in shaping the future of the industry. In Malaysia, the nature of the trading concepts, upon which the Islamic finance facilities are based, are the major sources of disputes since the Islamic finance industry operates within a conventional framework and related disputes are litigated in the civil courts. It is therefore argued that the biggest challenge for the courts in the exercise of its judicial function is the application of relevant laws to Islamic finance transactions. The paper concludes that strengthening the legal architecture of the industrywill necessarily lead to the development of competitive products that are not only Sharî’ah-compliant but alsoconventionally viable. This can be achieved through the channelling of Islamic finance disputes to an alternative forum for appropriate dispute resolution. ABSTRAKDalam empat dekad yang lalu, cendekiawan Malaysia dan pakar Syariah telah memberi sumbangan yang besar kepada bidang kewangan Islam yang cukup bagi menarik pengiktirafan dan penerimaan antarabangsa. Ini telah menjadikan Malaysia suatu hab global bertenaga untuk perkhidmatan kewangan Islam. Bagi meneruskan kedudukan yang dicemburui ini, satu rangka kerja undang-undang baru telah diperkenalkan baru-baru ini yang diharap lebih menekankan kepada lumrah pragmatik dan berdaya tahan industri kewangan Islam. Oleh itu, kertas kerja ini memberikan perspektif kehakiman terhadap pembaharuan mutakhir dalam rangka kerja undang undang industri kewangan Islam, mengkaji dinamik litigasi kewangan Islam, dan menjelaskan peranan penting badan kehakiman dan institusi-institusi penyelesaian pertikaian yang lain dalam membentuk masa depan industri ini. Di Malaysia, lumrah konsep perdagangan, yang mana menjadi dasar kemudahan kewangan Islam, adalah punca utama pertikaian sejak industri kewangan Islam beroperasi di dalam rangka kerja konvensional dan pertikaian berkaitan telah dilitigasikan di mahkamah sivil. Maka ia telah dibahaskan bahawa cabaran terbesar bagi mahkamah pada menjalankan fungsi kehakimannya adalah aplikasi undang-undang yang berkaitan dengan urus niaga kewangan Islam. Kertas kerja ini menyimpulkan bahawa pengukuhan rangka kerja undang-undang industri akan membawa kepada pembangunan produk yang berdaya saing yang bukan sahaja patuh Syariah tetapi juga berdaya maju dari sudut konvensionalnya. Ini boleh dicapai melalui penyaluran pertikaian kewangan Islam kepada forum alternatif untuk penyelesaian pertikaian yang sesuai.

    There is no doubt that the guardianship of the funds of orphans, minors and the like is of the utmost importance, which the Kingdom of Saudi Arabia has given keen attention in all respects and has established for this purpose the State General Authority on the funds of minors and the like. And the extent to which it can carry out the objectives for which it was established. Where the purely objectives were, to identify ways to manage these funds. Evaluate the management of these funds and their ability to achieve the purpose of the street, which governs the details and mechanisms of the Authority's work. As well as to identify the role of the supervisory bodies in the maintenance of funds that fall within the competence of the General Authority of the State. The researcher used the analytical research methodology, which was limited to studying the theoretical framework for dealing with the funds of orphans, minors and the like in light of the executive regulations of the Authority. Also, the supervisory principles governing the guarantee and safe keeping and development of such funds. The study concluded that the answer to the research questions was that there is a good management of funds that fall under the mandate of the Commission to ensure their preservation? In addition, what is the role of the financial control bodies stipulated in the Authority's system in preserving these funds and ensuring their safety? In response to the first question, the study finds that the Authority, despite the efforts it is doing, is skeptical in its work, but may be tainted by some shortcomings, represented by some observations on the executive bylaw. Most importantly, the list did not address the termination of the mandate, which emerged as one of the main stages in the legal framework and control. In response to the second question, the Commission did not clarify the mechanisms of control over those funds. The study came up with a number of recommendations, most notably the addition of an article in the executive regulations stating the mechanism of refunding the beneficiaries in case of termination.

At the state level within the United States, did political ideology predict the outbreak of the novel coronavirus (COVID-19)? Throughout March 2020, the United States became the epicenter of the COVID-19 pandemic, recording the most cases of any country worldwide. The current research found that, at the state level within the United States, more conservative political ideology predicted delayed implementation of stay-at-home orders and more rapid spread of COVID-19. Effects were significant across two distinct operationalizations of political ideology and held over and above relevant covariates, suggesting a potentially unique role of political ideology in the United States’ COVID-19 outbreak. Considering political ideological factors may offer valuable insights into epidemiological processes surrounding COVID-19.

Sustainable public procurement, although a relatively old legal concept, began to take shape signifi cantly in the last 20 years. Large purchasing power of the state and the importance of public procurement procedures for each market necessarily led to the awareness and use of public procurement to achieve the secondary, social and environmental objectives. As such, sustainable public procurement certainly has more advantages than disadvantages. Indirect use of public procurement as a tool in achieving better environmental protection and greater inclusion of socially disadvantaged groups in society must be supported. However, the achievement of those goals must always be secondary, because the main objective of public procurement must be the procurement of the best goods, services or works with the least possible cost to the state budget. Sustainable public procurement has a growing importance in the EU legal order, and thus consequently increasing importance in the legal order of the Republic of Croatia. Beginning with the 2004 EU regulatory framework elements of sustainable procurement are included in the legal systems of all member states, while these elements are signifi cantly more present in the 2014 EU regulatory framework. Certain sustainable elements are signifi cantly expanded, while adding some new. The biggest changes are present in the technical specifi cations, criteria for selection of offers, conditions for performance of the contract, in the new institute of life cycle costing as well as environmental labels. The biggest problem is the fact that the implementation of sustainable elements in public procurement procedures is still voluntary and there is no way to force the implementation of these elements. However, I still think that the signifi cantly expanded elements of sustainable procurement in the 2014 EU regulatory framework willl certainly have a signifi cant impact on the achievement of the objective of 50% green public procurement by 2020. The new provisions in conjunction with the planned promotional activities and education of employees can have a signifi cant impact on raising awareness of the importance of sustainable public procurement. However, the fact that part of sustainable procurement relating to the achievement of social goals is not similarly recognized as important in Croatia is dissapointing.
