Pemulihan Akidah Bagi Kes-Kes Permohonan Keluar Agama Islam di Mahkamah Syariah

The Syariah Court in Malaysia possesses executive jurisdiction in deciding upon matters related to creed and religious status. The jurisdiction aims to restrain the signs of heresy and renunciation of religion of Islam among Muslims. Nevertheless, the creed restoration practice (istitabah) for the state level renunciation of religion of Islam application cases is still unclear. This study aims to analyse the procedure after the application to renounce religion of Islam is received at Syariah Court and the process of creed restoration that is instructed upon an applicant prior to the Syariah Court decision. This study used document analysis approach by conducting specialized observation on the law provisions and renunciation of religion of Islam cases as well as the restoration modules in the centre of creed restoration. The outcomes of the study found that the creed restoration practice was conducted in the form of creed counselling or detention at the centre of creed restoration depending on the instruction from the Syariah Court Judge after the acceptance of religious status application cases. There were no clear and standardized law provisions regarding repentance order (istitabah) at state level. The study also provides the implications and several recommendations for improvement of the creed restoration practice. ABSTRAK Mahkamah Syariah di Malaysia mempunyai bidang kuasa eksklusif dalam memutuskan perkara-perkara berkaitan persoalan akidah dan status agama. Bidang kuasa ini bertujuan mengekang gejala ajaran sesat dan murtad dalam kalangan orang Islam. Walau bagaimanapun, amalan istitabah bagi kes-kes permohonan keluar agama Islam masih kurang jelas di peringkat negeri. Kajian ini bertujuan menganalisis prosedur selepas penerimaan permohonan keluar agama Islam di Mahkamah Syariah dan proses istitabah yang diperintahkan kepada pemohon sebelum Mahkamah Syariah membuat keputusan. Kajian ini menggunakan pendekatan analisis dokumen dengan membuat tinjauan khusus terhadap peruntukan undang-undang dan kes-kes permohonan keluar agama Islam serta modul pemulihan di pusat pemulihan akidah. Hasil kajian mendapati amalan istitabah dibuat dalam bentuk kaunseling akidah atau tahanan di pusat pemulihan akidah bergantung kepada perintah hakim Mahkamah Syariah selepas penerimaan kes-kes permohonan status agama. Tiada peruntukan undang-undang yang jelas dan seragam mengenai perintah taubat (istitabah) di peringkat negeri. Implikasi dan beberapa cadangan untuk penambahbaikan amalan istitabah ini juga diberikan.

This study aimed to examine two objectives: first, legal considerations of court decision Number 05/G/2011/PTUN.Yk regarding state administrative decision on intermittent termination and replacement (PAW) a member of the Bantul Regional Representative Council (DPRD), and second, panel of judges rationale concluded that the decision on PAW was not absolute competence of PTUN. This research is classified as normative legal research using  both  primary  data by conducting interviews with PTUN judges and the expert, and secondary data in the form of legal material. The results showed: first, there are three main legal considerations used by judges: 1. the decision on PAW is a decision in the field of politics and constitutionality; 2. the decision on PAW does not fullfil the unilateral will element; 3. the existence of jurisprudence. Second, the judge's judgments rested on the conclusion that the decision did not fulfill the 'state administration' element and was emphasized in the 'initial process' of the PAW stage series, not to the 'final process' in the form of issuing decisions. The judgments put forward the interpretation based on doctrine, while if compared with the provisions of the Law on Administrative Court, the decision on PAW had actually been fulfilled as the KTUN which was the absolute competence of PTUN.

Legal certainty is one of the "three basic values of the law" which means it can be equated with the principle of law. A verdict or court decision must be in accordance with the law because the judge must judge based on the law. Decisions must also be fair, objective and impartial. Therefore the ideal decision is a decision that contains justice, usefulness and legal certainty proportionally. Seeing from the application of the Criminal Procedure Code, the main purpose of tracking assets resulting from criminal acts to be confiscated in court proceedings and ultimately resulting in a court decision is to be returned to the rightful party. In practice, there is a conflict between the victim and the judge's decision regarding the confiscation of evidence by the State that was confiscated from a First Travel travel agent, because the evidence seized from First Travel is the result of fraud from a prospective Umrah pilgrimage that should be returned to the victim as compensation.

This note concerns a controversial issue that has, surprisingly, received limited academic interrogation: whether the Public Protector has the power to instruct the President of South Africa to appoint a commission of inquiry. In this respect, I critique a high court decision which answered the question in the affirmative. I contend that the judgment contradicts prior case law, including Constitutional Court precedent. Thus, I argue that the court misconstrued the law on the President’s powers, particularly when it concluded that those powers are not purely discretionary but entail ‘responsibilities’ which are ‘coupled with a duty’. This reasoning led the court to conclude that the President thus has a constitutional ‘obligation’ to appoint a commission. In summary, I take issue with the court’s conclusion that the Public Protector has the power to instruct the President to appoint a commission of inquiry. I conclude that the decision caused uncertainty on the limitations of the Public Protector’s powers. I further say it is questionable whether the commission, better known as the ‘State Capture’ commission, was established lawfully.

В статье рассматриваются вопросы нормативного регулирования избрания меры пресечения в виде заключения под стражу в отношении лиц, выполняющих определенные виды публично-правовой деятельности и в силу этого наделенных законодательством иммунитетом от уголовного преследования; порядок рассмотрения компетентными государственными органами ходатайств органов предварительного расследования и прокуратуры о лишении лица иммунитета от уголовного преследования; анализируются положения уголовно-процессуального закона и иных нормативных актов, регламентирующих правовой статус лиц, обладающих данным иммунитетом. Особое внимание уделяется порядку избрания меры пресечения в виде заключения под стражу в отношении членов Совета Федерации, депутатов Государственной Думы и судей. Предлагаются корректировки уголовно-процессуального закона и закрепление положений об обязательности получения согласия компетентного государственного органа на избрание, а не на исполнение меры пресечения в виде заключения под стражу. The article deals with the problems of regulatory regulation of detention of persons performing certain types of public legal activities, for which immunity from criminal prosecution is established. The special features of the detention of these persons are provided for by the Criminal Procedure Act, as well as other normative acts. At present, the law establishes that a court decision on detention against members of the Federation Council, deputies of the State Duma and judges is executed with the consent of the Chamber of the Federal Assembly of the Russian Federation or the qualification board of judges. Taking into account the principle of the independence of the court and the obligation of court decisions, it is proposed to amend the law and to provide for the consent of these bodies to choose this preventive measure, rather than to implement the court decision.

This study aims to determine whether the decision of West Jakarta District Court which decided Loan Agreement between Nine AM Ltd. with PT. Bangun Karya Pratama Lestari is null and void according to the law of treaties or not and to know the legal implications of the West Jakarta District Court decision in Case Number 451 / Pdt.G / 2012 / PN.Jkt.Bar about the cancellation of loan agreements. This research using normative legal research by the statute approach and a case approach. The results of this study were 1) the West Jakarta District Court decision was in accordance with the law of treaties that the agreement is null and void. This decision caused by the Loan Agreement was infringing Article 1320 of the Burgerlijk Wetboek, that is not the fulfillment of the elements of a cause of the lawful and contrary to Article 31 of Act number 24 of 2009 concerning Flag, Language, and The State Emblem and Anthem Language and Article 1339 of the Burgerlijk Wetboek which provides that an agreement is not only bound to what is explicitly approved in the agreement, but also bound by propriety, customs, and laws. 2) Juridical implications of that decision is any agreement that is not made in accordance with the provisions of Article 31 Act number 24 of 2009 concerning Flag, Language, and The State Emblem and Anthem will be declared null and void / agreement is deemed never existed and the parties returned in original condition. Likewise with any follow-up agreement (assumed as accessories) will be declared null and void anyway, even the agreement made with the competent authority knowing it.

This Article addresses developments in Virginia oil and gas law for the period from July 31, 2014 to July 31, 2019. This period is longer than normally addressed by this journal to capture important developments in the law between this update and the last Virginia update published in 2015. At the state level, in Swords Creek Land Partnership v. Belcher, the Supreme Court of Virginia concluded coalbed methane (“CBM”) is a separate and distinct mineral estate from coal. It held that the meaning of “coal” within an 1887 severance deed was unambiguous and did not intend to convey ownership rights to the CBM.1 This decision reaffirmed and expanded the Court’s previous holding in Harrison-Wyatt. In Dye v. CNX Gas Co., the Court held that a deed conveying “all coal and minerals” was also unambiguous and with the addition of the “and minerals” language constituted a transfer of CBM.

This paper will provide the school-based speech-language pathologist (SLP) with an overview of the federal requirements for Medicaid, including provider qualifications, “under the direction of” rule, medical necessity, and covered services. Billing, documentation, and reimbursement issues at the state level will be examined. A summary of the findings of the Office of Inspector General audits of state Medicaid plans is included as well as what SLPs need to do in order to ensure that services are delivered appropriately. Emerging trends and advocacy tools will complete the primer on Medicaid services in school settings.
