The article deals with the analysis of major changes introduced to the Polish Public Procurement Law for the reason of the outbreak of the COVID-19 pandemic. First of all, the regulation in this area concerns the exclusion of the Public Procurement Law application in respect of necessary procurements. In addition, the legislator has introduced a mutual obligation to communicate about the impact of circumstances relating to the occurrence of COVID-19 on the proper performance of the contract and, as a consequence, the possibility of amending the public procurement contract. The last regulation has introduced solutions to reduce the costs of participation in tender proceedings and to encourage contractors to participate in public tenders.

AbstractPublic Procurement has an important role in achieving the goals of the Indonesian people as stated in the Constitution. Especially in the development of infrastructure because the existence of adequate infrastructure will move the wheels of the economy even better and economic equality throughout Indonesia. Integrated construction work is a combination of construction work and consultancy services. Every construction carried out by the service provider must get technical supervision in the field. Field supervision must be carried out by placing supervisory experts according to the needs and complexity of the work. In this case the supervisory consultant is generally tasked with overseeing construction work with the aim of controlling the completion of the work process and minimizing irregularities that occur in the procurement contract. The method of approach used in this research is the statute approach, case approach, and conceptual approach to assessing legal issues that occur, namely the accountability of supervisory consultants in integrated work. Keywords: Integrated Construction; Supervisory Consultant; Public Procurement.AbstrakPengadaan Barang/Jasa Pemerintah memiliki peran yang penting dalam mencapai tujuan bangsa Indonesia sebagaimana tercantum dalam Konstitusi. Terutama dalam pembangunan infrastruktur karena dengan adanya infrastruktur yang memadahi akan menggerakkan roda ekonomi lebih baik lagi dan pemerataan ekonomi di seluruh wilayah Indonesia. Pekerjaan konstruksi terintegrasi merupakan gabungan antara pekerjaan konstruksi dan jasa konsultansi. Setiap pelaksanaan konstruksi yang dilakukan oleh penyedia jasa harus mendapatkan pengawasan secara teknis dilapangan. Pengawasan lapangan harus dilakukan dengan menempatkan tenaga-tenaga ahli pengawas sesuai dengan kebutuhan dan kompleksitas pekerjaan. Dalam hal ini konsultan pengawas bertugas secara umum mengawasi pekerjaan konstruksi dengan tujuan agar terkendalinya proses penyelesaian pekerjaan dan meminimalisir penyimpangan yang terjadi dalam kontrak pengadaan. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan, pendekatan kasus, serta pendekatan konseptual untuk mengkaji permasalahan hukum yang terjadi, yaitu tanggung gugat konsultan pengawas dalam pekerjaan terintegrasi. Kata Kunci: Pekerjaan Konstruksi Terintegrasi; Konsultan Pengawas; Kontrak Pengadaan Barang/Jasa.

The article is devoted to the legal analysis of the peculiarities of concluding agreements in the sphere of economic and trade activity. The article emphasizes that among the civil law contracts, which are the basis for the obligation, a special place is occupied by the trade and economic contract. It is noted that the trade and economic agreement does not mean a separate type, but a set of agreements with a number of such inherent qualities that necessitate to establish within the general rules of contract law rules common to business agreements only - deliveries, contracts for capital construction, transportation of goods, operation of non-public railway access roads, etc. The commonality of these agreements is expressed in a number of features, which are also covered in this article. It is emphasized that trade and economic agreements pursue certain economic goals and serve economic activities. It is noted that the specifics of trade and economic agreements is that they are or are planned. It is recorded that the forms of economic and trade activities include: logistics and sales (supply and purchase and sale); energy supply; procurement (contract of contracting of agricultural products); Wholesale; retail trade and public catering; sale and lease of means of production; commercial mediation in the implementation of trade activities and other ancillary activities to ensure the sale of goods (services) in the field of circulation (agency agreements, commissions, instructions, transport and forwarding activities, etc.). Emphasis is placed on the fact that this commonality of all economic agreements and necessitates the establishment of a number of general rules for them, and therefore it is necessary to study the theoretical basis of the trade and economic agreement.

The article explores the mechanism of public procurement in the sphere of providing the remote sensing services to public entities. Authors emphasize on the benefits of the centralized procurement of remotely sensed data that will lead to cost savings of state funds through the avoidance of duplicate purchases. Authors give special consideration to the difference in products obtained within the Earth observation (EO) process, the purchase of which can be carried out according to different procedures, as well as the duality of the status of the National Center for the Management and Testing of Space Facilities (NCMTSF) as a supplier and intermediary in public procurement legal relations. It is determined that NCMTSF as a centralized procurement organization will collect requests from contracting authorities (public consumers) for remote sensing services, analyze them for the possibility of satisfying it with products from the existing own fund or the need to purchase remote sensing data. It is argued that in case of impossibility to provide relevant services from the available resources of the remote sensing fund, but economic feasibility of purchasing raw remote sensing data, considering the consolidated application of public consumers, NCMTSF will act as a centralized procurement organization. It is emphasized that, unlike other centralized procurement organizations, the procurement contract with the winner of the procurement will be concluded by NCMTSF. NCMTSF will provide free of charge public authorities, enterprises, institutions, and organizations with raw data information products which were purchased at the expense of state budget according to their requests. It is suggested that in case of impossibility and economic inefficiency of providing data processing services, NCMTSF as a centralized procurement organization organizes procurement in the interests of public consumers. The procurement contract is concluded between the public consumer and the winner of the procurement. That is, in this case, the NCMTSF performs an intermediary function of procurement organization, which can professionally qualify the participants and determine the most economically advantageous tender. In addition, several procedures have been discovered that will unify suppliers’ offers according to contracting authorities’ technical requirements and optimize budget spending, that was based on an analysis of domestic legislation on public procurement and models for the procurement of remote sensing products in space states such as the USA, Australia and India. The article provides an in-depth analysis of the implementation of multi-use supplier list as prequalification system for potential economic operators of remote sensing services.

In this case study of a research and development facility construction project at a large biopharmaceutical organization, we explored how digital investments must be accompanied by a partnership approach and a transformation of the cultural values of an organization tied to operational principles. The project faced considerable challenges, including a highly constrained market environment, time and cost constraints, and a multiyear organization transformation with a diverse mix of stakeholder objectives. Despite these challenges, the project was brought in under budget and on schedule, achieving other objectives that often seem at odds with each other (best-in-class sustainability ratings, quality scores from customers, and with a remarkably low number of change requests). We found that significant stakeholder engagement early in the architect and contractor selection process leads to the right contract management process and ultimately successful outcomes. A key insight from this case involves the need for differentiated supplier relationship management for procurement-project team integration.

Abstract The experience gained in the field of public procurement leads me to the statement that the activity of amending the public procurement contract / framework agreement is a challenging activity for the contracting authority. Maybe not from the perspective of elaborating the documents necessary to operate the change or changes that may be required during the development of the public procurement contract / framework agreement, but rather from the perspective of the solutions offered by the law, solutions that cover only certain areas. Starting from the normative acts in force, this paper aims to identify the situations and the way in which the contracting authority can modify the public procurement contract / framework agreement, the documents to be elaborated and the effects that the modifications might entail. In order to increase transparency, predictability and coherence in relation to the operation of contractual changes, contracting authorities should carry out analyses after each public procurement process as well as of the various practical situations encountered during the execution of contracts.

Контрактная система в сфере закупок, как совокупность участников контрактной системы в сфере закупок и осуществляемых ими операций, направленных на обеспечение государственных и муниципальных нужд, внесла кардинальные изменения в содержание управления государственными закупками, результатом которых стала необходимость пересмотра отдельных аспектов устоявшихся управленческих механизмов, внедрения новых методов и инструментов анализа системы управления (технологических, управленческих, экономических и организационных), предназначенных для обеспечения интересов общества и государства. Посредством контрактной системы был реализован системный подход к сфере планирования и осуществления государственных закупок, обеспечена гласность и прозрачность данной сферы, внедрены механизмы предотвращения коррупции и других злоупотреблений в сфере закупок. В основу контрактной системы в сфере закупок заложены принципы открытости и прозрачности, конкуренции, профессионализма, стимулирования инноваций, единства контрактной системы в сфере закупок, ответственности за результативность и эффективности осуществления закупок. Для сферы образования, включающей элементы государственного централизованного и децентрализованного управления, потребовались отдельные подходы к организации управления закупками для эффективного расходования бюджетных средств. Данная статья посвящена систематизации основных аспектов закупочной деятельности в государственной организации, осуществляющей образовательную деятельность, выявлению особенностей контрактной деятельности государственных образовательных организаций, а также вопросам эффективного управления закупочной деятельностью образовательной организации. The procurement contract system, as a set of participants in the procurement contract system and their operations aimed at meeting state and municipal needs, made fundamental changes in the content of public procurement management, which resulted in the need to revise certain aspects of established management mechanisms, the need to introduce new methods and tools for analyzing the management system (technological, managerial, economic and organizational), designed to protect the interests of society and the state. Through the contract system, a systematic approach to the planning and implementation of public procurement was implemented, transparency and transparency of this area were ensured, mechanisms were introduced to prevent corruption and other abuses in procurement. The contract system in procurement is based on the principles of openness and transparency, competition, professionalism, stimulation of innovation, unity of the contract system in procurement, responsibility for efficiency and efficiency of procurement. Education, which includes elements of centralized and decentralized public administration, required separate approaches to the organization of procurement management in order to effectively spend budget funds. This article is devoted to the systematization of the main aspects of procurement activities in a state organization conducting educational activities, the identification of the features of contract activities of state educational organizations, as well as issues of effective management of procurement activities of an educational organization.

Contracts for the procurement of government goods/services are the realm of private law that implements pure private contracts. A legal relationship in a private contract, especially in a contract settlement, is a relationship between the settlement of the rights and obligations of the parties. This study describes the settlement of government goods/service procurement contracts that require a legal basis both in principle and theory. By using the conceptual analysis method, the findings indicate an inconsistency in solving a legal problem in a government procurement contract, where private legal issues are resolved through administrative law. Theoretically, this study contributes to the resolution of this problem, there are intersections between two legal aspects, namely private law and administrative law. In practical terms, this study encourages the development of government goods/service procurement contract problem-solving practices to adopt the contract problem-solving method starting to use administrative law.
