The government has issued regulations to ensure the health of Umrah pilgrims however there is no standard of health care for the Umrah pilgrims, either before departing, while traveling and in Saudi Arabia or returning to Indonesia. This study analyzes the Umrah health regulations and their implementation in the perspective of the rights to health. This research is a legal research design with sociological jurisprudence because the object under study is the application of law. The results of this study have explained that the right to health of Umrah pilgrims has been guaranteed in Law no. 8 of 2019 concerning the Implementation of Hajj and Umrah. However, there are still obstacles in the implementation which are the responsibility of the Umrah Travel Organizer, so it is necessary to make a policy by the ministry that organizes affairs in the health sector after carrying out affairs in the field of religion.

All this time, both in academic discourse and the reality of legal practice in the field tend to show a lack of attention to the rule of judges as an instrument of legal reform. Generally, the law is regarded as the main instrument of legal reform. Therefore, instilling an understanding of the law enforcement officers, especially the judges through their decision, is a very urgent thing to do. The main issue to be discussed in this paper is: How is the contribution of the Judge's decision to legal reform in Indonesia? This study used the perspective of the School of Sociological Jurisprudence, mainly the philosophical mind of Roscoe Pound. The results of this study show that the effort to make a judge's decision as a means of legal reform is a necessity. This can be realized through a progressive legal paradigm. The presence of a progressive legal paradigm is very important in order to give birth to a progressive type of judge who has a legal decision that qualifies maturity of law. The product of a progressive judge's decision is expected to become a jurisprudence that can be used as a reference in solving the next case so that judges will be able to make the law, not merely as a tool of social control as well as a tool of social engineering. These conceptions of legal function are essentially about to reveal that the nature of the law is dynamic rather than static. The legal philosophy of the sociological jurisprudence school offers a holistic understanding and a holistic view of the law, that is, the law applied must pay attention to the values, the living law, and the local wisdom of society. This holistic understanding of the law will ultimately be able to unify the law and society as its sociological basis.

As an affected COVID-19 pandemic country, Indonesia took policy options through Social Restrictions on Large-Scale (PSBB), supported by six legal documents from Government Regulation in Lieu-of-The Law, Government Regulations, to Presidential Decrees. This socio-legal research aims to analyze the COVID-19 countermeasure policy through Roscoe Pound's sociological jurisprudence. Base on empirical data from March to December 2020, the results showed that the policy to overcome COVID-19 is supported by six legal documents when examined through analysis of the hierarchy of norms, clarity of the purpose and usefulness very contradictory to the purpose of the deployment restrictions of COVID-19 itself. Referring to sociological jurisprudence, the COVID-19 policies should be based on four essential elements adjusted to public requirements so that the implementation of the policies can perform effectively.

The government has implemented a Policy for the Imposition of Restrictions on Emergency Community Activities that have an impact on the trade sector, one of which is micro, small and medium enterprises. These business actors, in addition to experiencing a decrease in turnover, also received criminal sanctions in the midst of the imposition of this emergency Community Activity Restriction by the local government. The formulation of the problem in this study is how freedom of trade in the midst of the Imposition of Restrictions on Emergency Community Activities is viewed from the point of view of sociological jurisprudence and justice. The approach method used in this study is a normative juridical approach, with secondary data collection. Data collection in this research is by literature study. The results obtained were analyzed qualitatively. From the results of the study, it shows that in sociological jurisprudence, trading in the midst of the Imposition of Restrictions on Emergency Community Activities is a community right that becomes a public reality that should still be monitored and controlled without imposing fines even though the Salus Populi Suprema Lex Esto principle is the basis for implementing these sanctions. However, at least the legal ideals must still be considered in order to change social values in the community. In the concept of justice, trading in the midst of the Imposition of Restrictions on Emergency Community Activities is the right of everyone to defend their life and life which has been formulated by law in the form of rights and obligations. This emphasizes that the Government must still pay attention to justice by considering economic and social factors, which of course must be relevant to public order where a scale of justice is recognized.

<p>Abstract<br />Law always moves dynamically and experiences development and even changes, for example  Islamic law. Islamic law is the basis for the formation of new laws, especially in the Aceh region. Aceh has the features of local laws / regulations called Qonun. This qonun was formed because of the influence of the environment and customs related to legal values   / norms. The life of the legal community will continue to grow and develop and then serve as a code of conduct. In the perspective of sociological jurisprudence, the law that was born in Acehnese society is known as the living law in the form of habits (costumes), customs, beliefs, and so on. The living law has a role that is not inferior to positive law in managing human relations. According to Eugen Ehrlich, the development of law is centered on the community itself, not on the formation of law by the state, judges’ decisions, or on the development of legal science because society is the main source of law.<br /><br /></p><p>Abstrak<br />Hukum selalu bergerak dinamis dan mengalami perkembangan bahkan perubahan, contohnya  hukum islam. Syariat islam menjadi dasar terbentuknya hukum baru khususna di wilayah Aceh. Aceh memliki keisitimewaan hukum / peraturan daerah yang biasa disebut Qonun. Qonun ini terbentuk karena adanya pengaruh lingkungan dan adat istiadat yang berkaitan dengan nilai/ norma hukum. Kehidupan masyarakat hukum akan terus tumbuh dan berkembang lalu akan  dijadikan sebagai pedoman berperilaku. Dalam perspektif Sosiological Yurisprudence hukum yang lahir di masyarakat Aceh ini  dikenal dengan istilah the living law dalam bentuk kebiasaan (costume), adat istiadat, kepercayaan, dan sebagainya. The living law mempunyai peranan yang tidak kalah dengan hukum positif dalam menata pergaulan manusia. Menurut Eugen Ehrlich perkembangan hukum berpusat pada masyarakat itu sendiri, bukan pada pembentukan hukum oleh negara, putusan hakim, ataupun pada pengembangan ilmu hukum karena masyarakat merupakan sumber utama hukum. <br /><br /></p>

<p><strong><em>Abstract</em></strong></p><p><em>The issue of regulation has indeed become a lively discourse in recent years. Laws and </em> <em>regulations, which in essence is a set of regulatory systems to provide an orderly legal order and society, often creates conflicts, both internal conflicts between regulations and external conflicts involving government agencies and the community. The study of legal science in the perspective of sociological jurisprudence is a scientific instrument that makes sense to analyze the phenomenon of legal problems that occur in indonesia, this is because the beginning and the end of a regulation is society. The results show that regulatory conflicts occur because in practice the formation of laws and regulations often ignores procedural due process of law and substantive due process of law, one of the main points is that the widest possible public participation is required in the regulatory formation process. As a result, several regulations that have been produced often cause conflicts due to a mismatch between the substance of the regulations and the conditions and needs of the community.</em></p><p><strong> </strong></p><p><strong>Abstrak</strong></p><p>Isu permasalahan regulasi menjadi diskursus yang sering mencuat beberapa tahun terakhir.  Peraturan perundang-undangan yang esensinya merupakan sekumpulan sistem aturan untuk menghadirkan tatanan hukum dan masyarakat yang tertib, justru realitanya sering kali memunculkan konflik, baik konflik internal antar peraturan maupun konflik eksternal yang melibatkan lembaga pemerintahan dan masyarakat. Kajian ilmu hukum dalam perspektif sosiologi hukum menjadi instrumen keilmuan yang masuk akal untuk membedah fenomena permasalahan peraturan perundang-undangan yang terjadi, hal ini dikarenakan hulu dan hilir suatu regulasi adalah masyarakat. Hasil penelitian menunjukkan bahwa konflik regulasi terjadi dikarenakan di dalam praktik pembentukan peraturan perundang-undangan masih sering kali mengabaikan <em>procedural due process of law </em>dan <em>substantive due process of law </em>yang salah satu poin utamanya adalah dibutuhkan partisipasi publik yang seluas-luasnya di dalam proses pembentukan peraturan. Alhasil beberapa regulasi yang dihasilkan kerap menimbulkan konflik dikarenkan ketidaksesuaian antara substansi peraturan dengan keadaan dan kebutuhan di masyarakat.</p>

Most American legal scholars have described their nineteenth-century predecessors as deductive formalists. In my recent book, Law’s History : American Legal Thought and the Transatlantic Turn to History, I demonstrate instead that the first generation of professional legal scholars in the United States, who wrote during the last three decades of the nineteenth century, viewed law as a historically based inductive science. They constituted a distinctive historical school of American jurisprudence that was superseded by the development of sociological jurisprudence in the early twentieth century. This article focuses on the transatlantic context, involving connections between European and American scholars, in which the historical school of American jurisprudence emerged, flourished, and eventually declined.

Dilatarbelakangi dengan suatu keprihatinan tentang teori-teori, pendapat-pendapat, dan konsepsi pemikiran hukum di Indonesia yang lahir dari para pakar dan ahli hukum. Kendatipun Indonesia telah Merdeka 76 Tahun, masih saja terbelenggu dan mengagungkan teori dan konsep pemikiran yang bersumber dari para ilmuawan Barat. Padahal ilmu hukum berbeda dengan ilmu sosial lainnya, apalagi dengan ilmu eksakta. Hukum itu bukanlah ilmu yang bersifat universal, tapi dia punya batas yuridiksi dan teritorial, dan hukum itu harus digali dan diambil dari nilai-nilai yang hidup dari masyarakatnya sendiri. Di Indonesia adalah  hukum adat yang lahir dan tumbuh dan ditaati oleh masyarakat itu sendiri. Dengan melakukan penelitian kepustakaan dan mengamati fenomena yang ada di dunia akademis maupun dikalangan praktisi hukum kiranya saatnya kita mencari teori hukum yang bercirikan Keindonesiaan berdasarkan aliran Sociological Jurisprudence, halmana hukum sebagai pencerminan dan kongkretisasi nilai-nilai yang hidup dalam massyarakat (living law), selanjutnya hukum positif hanya akan efketif apabila selaras dengan hukum ynag hidup dalam masyarakat yang merupan cerminan nilai-nilai yang hidup di dalamnya. Dalam penulisan ini penlis mengambil contoh yang diambil dari falsafah Adat Jawa, Bali dan Minangkabau.

U.S. Supreme Court introduce common law’s techniques for achieving new goal, protection new constitutional rights and public interest. ABSTRACT Indonesia has been deprived of its own true roots as a maritime country. This is the success of the colonial Dutch colonialists who do "devide at empera" in which eventually the nation in the archipelago of this archipelago sees the sea as a separator and inhibitor space.The purpose of this novice lecturer's research is to Know the concept of archipelagic state and maritime state in Indonesia and to prove its implementation in policy and development direction in Indonesia. Is the Government Homeland use in marine activities as a prime mover and a pledge to increase the economy, (2) is supported by a fleet of strong civilian and military, and (3) contribute as much as possible for the prosperity of the people.The research method used in writing this beginner lecturers are socio-juridical legal research methods is often called legal sociological research based school of sociological jurisprudence. Judging from the effectiveness of law or facts that exist in the field which is then compared with the rules of positive law.
