Abstract This article explores how jurists articulated the distinction between free and enslaved Muslim women through sartorial norms in the formative and early post-formative periods of Islamic law. Drawing on works of fiqh (positive law), tafsīr (Qurʾān commentary) and ḥadīth (Prophetic and non-Prophetic reports), I posit that this distinction attests to the tensions between “proprietary” and “theocentric” sexual ethics, as noted by Hina Azam. Specifically, I track the variant transmissions of a widely-cited report featuring the Caliph ʿUmar (r. 13–23/634–44), and trace how jurists responded to the free-slave binary in their discussion of “modesty zones” (ʿawrāt) and veiling practices. Based on a detailed examination of fiqh sources to the early fifth Islamic century (with some attention to subsequent material), I argue that Islamic modesty norms are best understood in light of the proprietary/theocentric binary, and that the divergence between juristic expectations of free and enslaved women increased in the post-formative period.

Yayasan Taman Mandiri Syari’ah merupakan lembaga yang bergerak di bidang sosial, kemanusiaan dan keagamaan. Yayasan ini dibangun dengan tujuan mengangkat harkat sosial kemanusiaan kaum yatim dan dhuafa dengan dana zakat, infak, shodaqoh serta wakaf dan dana-dana yang dihalalkan oleh syariat dan legal, baik dari perorangan, perusahaan, kelompok masyarakat, atau sumber lembaga lainnya. Penelitian ini menggunakan metode penelitian Kualitatif, dengan pendekatan literatur dan empiris. Hasil penelitian ini menyatakan bahwa Pengelolaan wakaf di Yayasan Taman Mandiri Syari’ah, berdasarkan tinjauan Hukum Islam dan Hukum Positif, proses perwakafan di Yayasan Taman Mandiri Syari’ah, ketentuan wakafnya sudah memenuhi rukun dan syarat. Namun dalam kelengkapan surat wakaf, YTS sebagai Nadzir atas wakaf tanah di Depok, belum melengkapi surat wakaf yang seharusnya didaftarkan ke Badan Pertanahan Nasional (BPN). Pengelolaan wakaf yang sudah berjalan di Yayasan Taman Mandiri Syari’ah berupa wakaf tanah dan wakaf tunai.Kata Kunci: Pengelolaan, Wakaf, Hukum AbstractTaman Mandiri Syari'ah Foundation is an organization in the social, humanitarian and religious. The foundation aims to raise the social dignity of orphans and poor people with zakat, infaq, shodaqoh, and waqf that are permitted by the Shari'a and legal funds from individuals, companies, community groups, or other institutions. The study uses Qualitative method with literary and empirical approach. The findings of this study are state waqf management of Taman Mandiri Syari'ah Foundation, based on the perspective of Islamic Law and Positive Law, the waqf process of Taman Mandiri Syari'ah Foundation, the provisions of the waqf have required the pillars and conditions. Yet the waqf letter, YTS as Nadzir for land waqf in Depok, has not completed the waqf document by register to National Land Agency. The waqf management has doing are land waqf and cash waqf.Keywords: Waqf, Management, Law.

AbstractThe study of the relationship between ijtihād and Taqlīd has been dominated by an approach that privileges ijtihād over Taqlīd on the assumption that the former is an intellectually superior mode of legal reasoning. By analyzing the role of Taqlīd in regulating the actions of muftīs and judges as discussed by post-6th/12th century jurists of the Mālikī school, I conclude that Taqlīd resulted from the desire to have uniform rules rather than as a result of intellectual stagnation. While ijtihād was individualistic and solipsistic, Taqlīd was the result of group interpretation that provided an objective basis upon which legal decisions and legal rulings could be described as being either substantively correct or incorrect. Viewed in this light, Taqlīd was originally a desire to limit the discretionary power of legal officials, especially those at the bottom of the legal hierarchy. The desire to possess uniform rules found its logical outcome in the legal genre of the mukhtaṣar as it emerged in the 7th/13th century. The mukhtaṣar functioned as the authoritative collection of a legal school's doctrine, and, for that reason, I argue that Islamic law in the age of mukhtaṣars is best understood as a codified Common Law.

The 2019 passage of the ‘The Muslim Women Protection of Rights on Marriage Act’ criminalizing the practice of triple-ṭalāq has been actively debated in both political and academic spheres. For some, the act signals a much-awaited victory for the Muslim women of India who have suffered the consequences of instantaneous and irrevocable divorces; while for others, it signals the continued marginalization of the Muslim community and the willingness of the Indian government to encroach upon their rights as a distinct religious community. To understand the passage of this Act in context, this article explores the larger context surrounding debates over Islamic Law in India, prior watershed Supreme Court decisions, and the recent political agenda of the BJP.  These explorations reveal that ‘The Muslim Women Protection of Rights on Marriage Act’ is a red herring that, if fully enacted, can exacerbate the social and legal challenges women face when seeking divorce while also encroaching upon the rights of the increasingly politically marginalized Muslim community.

The phenomenon of inter-religious marriage is problematic, controversial, and resulted debate among Muslim and non-Muslim relationship in Indonesia. It also not only becomes the social conflict among Muslim and non-Muslim couples, but also pro and contra among the others such as family and society. In the classical Islamic marriage law discourse (fiqh al-munakahat), there are two kinds of inter-religious marriage, namely marriage between Muslim men with non-Muslim women and marriage between non-Muslim men with Muslim women. Some Muslim scholars said that Muslim men allowed marrying non-Muslim women and non-Muslim men prohibited marrying Muslim women, which the reason is based on the concept of polytheists and the group of experts (Kitabiyyah). In contrast, some Muslim scholars in Indonesia rejected inter-religious marriage based on the reason that it has been changed and regulated under Marriage Law Number 1 of 1974 and President Regulation Number 1 of 1991 on Islamic Law Compilation. One the one hand, the phenomenon of inter-religious marriage is an interesting phenomenon in the society and on the other hand it will become the legal implication to the inheritance and children care rights in Islamic and Indonesian law perspective. Therefore, the aim of this paper is to examine comprehensively about the legal status of inter-religious marriage in Islamic and Indonesian law perspective, including its legal implication to the inheritance and children care rights.

The Common properties (community property) is an asset that the husband and wife acquired during the household lifes, which both of them is agree that after united through marriage bonds, that the property produced by one or both of them will be common property. It shows, that if there's an agreement between husband and wife before marriage (did not to unify their property), then the property produced both will not become a joint treasure. Thus, if a husband or wife dies, or divorces, then the property owned by both of them can be distributed in accordance with their respective shares, another case when the two couples are not making an agreement, then the property gained during marriage bonds can be divided into types of communal property. In Islamic law, this kind of treasure is not contained in the Qur'an or Sunnah. Nor in Islamic jurisprudence. However, Islamic law legalizes the existence of common property as long as it is applicable in a society and the benefit in the distribution of such property. In contrast to the positive law, this property types have been regulated and described in the Marriage Law, as well as the Islamic Law Compilations, which became the legal restriction in the affairs of marriage in force in Indonesia. In this study, the author tries to compile the existence of common property according to the Islamic law reviews and positive law.

Government Regulation No. 9 of 1975 related to the implementation of marriage was made to support and maximize the implementation of Law No. 1 of 1974 which had not yet proceeded properly. This paper examines Government Regulations related to the implementation of marriage from the perspective of sociology and anthropology of Islamic law. Although the rules already exist, some people still carry out marriages without being registered. This is anthropologically the same as releasing the protection provided by the government to its people for the sake of a rule. In the sociology of Islamic law, protection is a benchmark for the assessment of society in the social environment. Therefore the purpose of this paper is to find out how the implementation of marriage according to PP. No. 9 of 1975 concerning the Marriage Law in the socio-anthropological perspective of Islamic Law.

Marriage is a sacred bond which is ideally only held once in a lifetime. Both Islamic law and positive law require an eternal happy marriage. To support this the Koran proclaims marriage as mitsaqan galiza. The marriage is then registered in the state administration. In line with this, the laws and regulations are formulated in such a way as to make divorce more difficult. However, when there are acceptable reasons and due to coercive conditions, divorce can be done through a judicial process. The divorce must then be registered by taking certain procedures. The court delivered the notice and sent a copy of the decision to the marriage registrar to file the divorce properly. The implementation of this divorce record was not effective. The separation of the Religious Courts Institution from the Ministry of Religion has become a factor that causes the registration task not to be carried out. The loss of the obligation to submit a copy of the decision on the judge's ruling caused the recording to be constrained. The unavailability of shipping costs also contributed to the failure to register divorce. Even though there is a threat to the Registrar who neglects to deliver a copy of the verdict, unclear sanctions make this ineffective. As a result of the lack of recording of divorce, the status of husband and wife becomes unclear and opens opportunities for abuse of that status.

Resumo: Em O Capital, Marx nos alertou que a mercadoria tem um caráter misterioso que carrega “sutilezas metafísicas e argúcias teológicas”. Este artigo tenta decifrar um pouco desse mistério buscando decodifica-lo naquilo que denominamos como a estranha objetividade do valor. Para isso, analisamos a relação entre a ideologia e o valor a partir da crítica marxiana à mercadoria, consignada à lógica de Hegel. Vemos que o valor se constitui como razão ontológica da mercadoria enquanto produto do processo de trabalho que carrega uma racionalidade imanente, isto é, um espírito socialmente produzido que se objetiva à medida que é vivenciado pelos indivíduos como uma lógica social que rege as relações nesta sociedade. Isso se dá por meio de “sutilezas metafísicas” na formação da realidade social marcada por contradições estabelecidas entre, de um lado, o conteúdo objetivo das relações sociais, e de outro, a forma como essas relações são vivenciadas pela consciência na sociedade capitalista. Nesta relação entre conteúdo e forma, encontramos determinações de profundidade ontológica entre o valor e a ideologia, enquanto forma social que opera harmonizando as contradições constituintes da realidade social, a exemplo do que acontece no trabalho assalariado. A mediação ideológica se põe como uma progressão imanente à materialização da vivência concreta da relação entre capital e trabalho no salário, de maneira a naturalizar a exploração que se esconde na estranha objetividade do valor que se realiza na troca de mercadorias. Concluímos que a conexão ontológica entre o ser social e a mercadoria é socialmente ubíqua, precisamente por conta do seu caráter ideológico na formação da sociabilidade a partir do processo de trabalho subjugado ao capital.  Palavras-chave: Valor. Ideologia. Trabalho, Capital. Salário.  Abstract: In Capital, Marx warned us that the commodity has a mysterious character bearing "metaphysical subtleties and theological insights." This article attempts to decipher a little of this mystery by decoding it into what we call the strange objectivity of value. For this, we analyze the relation between ideology and value from the Marxian critique of the commodity, consigned to the Hegelian logic. We see that value is constituted as the ontological reason of the commodity as the product of the labor process that carries an immanent rationality, that is, a socially produced spirit that is objectified as it is experienced by the individuals as a social logic that governs the relations in this society. This is done through "metaphysical subtleties" in the formation of social reality marked by contradictions established between, on the one hand, the objective content of social relations, and on the other, the way in which these relations are experienced by consciousness in capitalist society. In this relationship between content and form, we find determinations of ontological depth between value and ideology, as a social form that operates by harmonizing the constituent contradictions of social reality, as in wage labor. Ideological mediation is seen as an immanent progression to the materialization of the concrete experience of the relation between capital and labor in wage, in order to naturalize the exploitation that is hidden in the strange objectivity of the value that is realized in the exchange of commodities. We conclude that the ontological connection between the social being and the commodity is socially ubiquitous precisely because of its ideological character in the formation of sociability from the labor process subjugated to capital.  Keywords: Value. تناولت هذه الورقة فلسفة العقوبة في الشريعة الإسلامية، وفلسفتها في القانون الوضعي، وتمت الموازنة بين الفلسفتين، وخلص العرض والموازنة إلى نتائج ملخصها أن مسألة عصمة الشريعة وسموها تعد علامة فارقة بين الشريعة الإسلامية والقانون الوضعي، هذه العلامة نتج عنها فروق كثيرة أولها أن العقوبة في التشريع الوضعي تكون تابعةً للهدف، فالهدف يوضع أولاً ثم تصاغ على ضوئه العقوبة، ولذلك كلما ظهرت مدرسةٌ جديدةٌ تؤسس لفكرٍ جديدٍ ظهر اختلافٌ في التشريع العقابي. بينما النظام العقابي الإسلامي ثابتٌ ومعصوم، وقد وُجدت الحاجة إلى معرفة أهدافه وفلسفته ليتسنى السير على مقتضاها فيما يستجد من وقائع، وأن سمو فلسفة العقوبة في الشريعة الإسلامية ينبع من سمو مصدرها، فواضع هذه العقوبات هو خالق البشر. بينما العقوبة في القانون الوضعي تعتمد في فلسفتها على خبرة واضعيها، وهي خبرة محدودة وأحكامها نسبية، لذا كان تطبيق العقوبات الشرعية أجدر حتى وإن لم يُدرَك كنه هذه العقوبات وفلسفتها. الكلمات الرئيسية: فلسفة العقوبة، القانون الإسلامي، القانون الوضعي، التشريع العقابي.******************************In this paper light is shed on the philosophy of punishment in Islamic and positive laws and a comparison between them is accomplished. In brief, the conclusion of the exposition and comparison is that issue of infallibility of SharÊ‘ah and its nobleness are the distinguishing marks between Islamic and positive laws. This led to further differences. The first difference is that the punishment in positive laws is in accordance with the stipulated goal, that is, the goal is set first and then the punishment is formulated in that light. That is why whenever any new school of thought appears based on some ideology, differences emerge in punitive legislation. Islamic penal system is, however, immutable and infallible. There is a need to know its objectives and wisdom so as to in order to tackle new emerging issues. The nobility of the philosophy of punishment in Islamic law stems from the nobility of its source and that is no one but the Creator of human beings. The punishment in the positive law, on the other hand, relies on the philosophy that is based on the experiences of the authors of these laws. And these experiences are limited and their rulings are relativistic. Applying Islamic legal punishments are, therefore, more legitimate, even though their essence and philosophy are not fully grasped.Key words: Philosophy of Punishment, Islamic Law, Positive Law, Punitive Legislation.

Shari'ah (Islamic law) has been the dominant moral and legal code ofMuslim societies for the gnxter part of their history. During the early centuriesof Islam, Shari'ah hcilitated the social growth and develojment of the Muslims,growth that culminaa in the establishment of a vast emph and an outstandmgcivilization. By the close of the fifth century of Islam, however, Shari'ahbegan to lose its role as the guiding force that inspired Muslim creativityand ingenuity and that nurtured the growing spirit of the Muslim community(Ummah). Consequently, the Ummah entered a period of stagnation thatgradually gave way to intellectual decline and social decadence. Regrettably,this painful trend continues to be more or less 'part of the individualconsciousness and collective experience of Muslims.This paper attempts to trace the development of the principles of Islamicjurisprudence, and to assess the impact of Shari'ah on society. It argues thatthe law ceased to grow by the sixth century of Islam as a result of thedevelopment of classical legal theory; more specifically, law was put on hold,as it were, after the doctrine of the infallibility of ijma' (juristic consensus)was articulated. The rigid principles of classical theory, it is contended, havebeen primarily induced by the hulty epistemology employed.by sixth-centuryjurists.Shari'ah, or Islamic law, is a comprehensive system encompassing thewhole field of human experience. It is not simply a legal system, but rathera composite system of law and morality. That is, Islamic law aspires to regulateall aspects of human activities, not only those that may entail legalconsequences.
