Os Direitos Humanos são princípios que orientam ou devem orientar as ações dos Estados, sociedades e indivíduos, porém, estes não possuem necessariamente o poder de configurar obrigações jurídicas. Bucci (2001) argumenta que para transformá-los de princípios em instrumentos com poder de regra, é necessário estabelecer políticas públicas para direitos humanos. Assim, este trabalho busca verificar a hipótese da autora através de um estudo de caso  sobre o sistema de refúgio no Canadá a fim de observar os efeitos causados pela construção de uma política pública apropriada para abordar o problema em questão. O país, que aderiu tardiamente aos acordos internacionais sobre o refúgio, não somente adequou-se às normas propostas pela comunidade internacional, comotornou-se referência na recepção, proteção e reassentamento de refugiados.Palavras-chave: Políticas Públicas, Direitos Humanos, Canadá.ABSTRACTHuman Rights are principles that guide, or should guide, the actions of States and societies and individuals, but they don’t necessarily have the power to create judicial obligations. Bucci (2001) states that the path to transform them from principles to tools with legal power, it is necessary to develop public policies for human rights. Therefore, this work aspires to verify the author’s hypothesis through a case study on Canada’s refuge system to observe the effects of the development of an appropriate public policy to this end. El presente trabajo estudia al Enfoque de Derechos Humanos a partir de sus mecanismos de garantía, dentro de los cuales hallamos a las políticas públicas. Es un estudio cualitativo que aplica el método documental, a través del cual se concluye que el Enfoque antes citado representa un elemento transformador y un avance de carácter sustancial para la construcción de los programas de política pública, en tanto que pone como centro del diseño, implementación y evaluación de los mismos a los derechos humanos y a las personas como sus titulares, poniendo énfasis en las obligaciones que los Estados han adquirido con la firma y ratificación de tratados internacionales, de tal manera que las políticas públicas se desarrollan como medios o mecanismos de satisfacción de derechos, y no solo como mecanismos para la solución de problemas.   Human rights approach, guarantee and public policies. Concepts and theory The objective of this work is to analyze the Human Rights Approach from the concepts of guarantee and public policies. The above to identify its most important elements, actors, as well as the process of linking with public policy. It is a qualitative study that applies the documentary method. It is concluded that the Human Rights Approach is a transforming element of development practices and a form of vindication of second and third generation rights. It represents an advance in the construction of public policy programs, as it puts human rights and people as their holders at the center of their design, implementation and evaluation, in addition to representing a substantive contribution to the contents of public policies that emphasize state obligations, in such a way that public policies are developed as means or mechanisms to guarantee the satisfaction of rights, and not only as mechanisms for solving problems. Hay tres procesos políticos que interactúan en algunos países de América Latina: el giro a la izquierda, la generación de movimientos constituyentes impulsados por dichos gobiernos, y un cada vez más relevante papel de los derechos humanos (DH) en la formulación de política pública (PP). Daremos cuenta de la convergencia de estos procesos situándonos en el último: la PP con perspectiva de DH (PPDH). La constitucionalización de los derechos humanos es un tema extensamente trabajado; sin embargo, la vinculación de este con la política pública es un ámbito de análisis relativamente nuevo, aunque fundamental para entender las brechas entre el cumplimiento y el ejercicio de los derechos humanos. Nos preguntamos: ¿cuál es la relación entre las constituciones emitidas por los gobiernos del giro a la izquierda y la formulación de PPDH? Se esperaría que el papel que tomaron los DH en las nuevas constituciones tuviera un impacto sostenido en la formulación de la PP;  no obstante, esto no es necesariamente así. Si bien hay interacción entre las constituciones y las PP, hay dos aspectos interesantes por subrayar: el proceso de resignificación, en el caso ecuatoriano, y la segunda vuelta institucional, en el caso venezolano. Public policies with a human rights perspective in the shift to the left. From rupture to the second round in Venezuela and Ecuador  Abstract  There are three processes that interact in certain countries in Latin America: the shift to the left, movements to develop new constitutions driven by left wing governments , and the increasingly relevant role played by human rights in the development of public policy. We will make evident these interactions by analyzing this last point: public policy with a human rights perspective (PPHR). The inclusion of human rights in constitutions is something that has been thoroughly analyzed; yet the link of this inclusion with pubic policy is an area that is relatively new despite it being key in understanding the gaps between the fulfillment and enjoyment of human rights. We ask: what is the relationship between constitutions issued by left wing governments and the development of PPHR? One would expect that the role played by human rights in new constitutions would have a sustained impact in the development of PP. This is not necessarily the case: although there is interaction between constitutions and PP, there are two interesting aspects to highlight: the rebranding in the case of Ecuador and the second round in the case of Venezuela.

This article follows a previous article published in Obiter Vol 2 of 2016. In that article the concept of jus cogens and its role in the international community, together with the nature of the right to religion, were discussed. In Part Two, the seriousness of such human rights violations needs to be appreciated by the international community at large. To this end, the Democratic People’s Republic of Korea will serve as a case study, examining the extent of the DPRK’s compliance of its obligations vis-à-vis the right to religion. This should ultimately lead to an understanding as to why the right to religion emerging as a jus cogens norm will not solve the problem of enforcement, and even if it could, due to the uncertainty surrounding the formation of jus cogens it is unlikely that other human rights will be added to the list in the near future.

ABSTRACTThe purpose of this research is to analyze the participation of different stakeholders, resulting from the implementation of the Public Policy Magical Towns, aimed at sustainable development of Villa Tapijulapa. This investigation is currently underway, however it has been observed that it has been funded development projects, through various government institutions that contribute to Magic Towns Program, which has not been successful, in addition there is a misuse system resources. These issues are presented by the complexity of cooperation, multiplicity of participants and perspectives; and the various attitudes and degrees of involvement of the various stakeholders. As the analysis of the social capital of the community and the characteristics of the agency charged with implementing achieve identify areas of opportunity to propose strategies for improvement.RESUMENEl propósito de ésta investigación es analizar la participación de los diferentes actores sociales, derivada de la implementación de la Política Pública de Pueblos Mágicos, dirigida al desarrollo sustentable de Villa Tapijulapa. Esta investigación actualmente se encuentra en proceso, sin embargo se ha podido observar que han sido financiados proyectos de desarrollo, a través de diferentes instituciones gubernamentales que coadyuvan al Programa de Pueblos Mágicos, los cuales no han sido exitosos, además de existir, un mal uso del sistema de recursos naturales. Estas problemáticas se presentan por la complejidad de la cooperación, multiplicidad de participantes y perspectivas; así como las diversas actitudes y grados de compromiso de los diferentes actores sociales. Por lo que el análisis del capital social de la comunidad y de las características de la agencia encargada de la implementación lograrán detectar las áreas de oportunidad para proponer estrategias de mejora.

Resumo O objetivo deste artigo é discutir a ação “Espaços Mais Cultura” no contexto do Programa Mais Cultura como política pública, que visa qualificar o espaço urbano, particularmente as áreas de vulnerabilidade social, através da implantação de equipamentos culturais. Ao mesmo tempo, os Espaços Mais Cultura poderão se constituir em ferramentas de política pública que se inserem em um quadro de valorização do conhecimento e de construção de novas dinâmicas sociais e culturais a partir da produção da cultura imaterial e da economia criativa. Neste sentido, pretende-se compreender o perfil destes projetos a partir do trabalho de visita técnica e análise dos projetos realizado pela Fundação Nacional de Artes em 2008. RESUMOOs debates em educação necessitam cada vez mais de concepções pedagógicas que emanem do movimento de libertação das oprimidas e dos oprimidos, assim como apregoava o professor Paulo Freire. Isso significa que é preciso realizar o ato educacional na aproximação dos sentidos elaborados pelos sujeitos participantes das dinâmicas pedagógicas, respeitando e potencializando suas identidades no movimento de busca do ser mais no/com o mundo. É preciso sentir o cheiro daqueles/as que conosco participam da construção das aprendizagens, que devem ser instrumentos políticos que re/elaborem nossa presença no mundo. É nesse sentido que este artigo reflete teoricamente acerca da necessidade da construção de currículos que respeitem as identidades gays elaboradas fora e dentro da escola; construídas pelos corpos que, com seus gestos, inscrevem sua presença no mundo e com isso também suscitam políticas públicas para esses sujeitos.Palavras-chave: Currículo. Políticas Públicas. Gays.ABSTRACTDebates on education increasingly require pedagogical conceptions emanating from the liberation movement of the oppressed and oppressed, as Paulo Freire proclaimed. This means that it is necessary to carry out the educational act in the approximation of the senses elaborated by the subjects participating in the pedagogical dynamics, respecting and potentializing their identities in the search movement of being more in / with the world. It is necessary to feel the smell of those who participate with us in the construction of learning, which must be political instruments that re-elaborate our presence in the world. This chapter examines the link between human rights and forced migration. It first considers the human rights problems confronting forced migrants both during their flight and during their time in exile before discussing the differing definitions accorded refugees today as well as the difficulty in coming up with a widely accepted definition. It then explores the roles and functions of the Office of the UN High Commissioner for Refugees and the international refugee regime. It also uses the case study of Myanmar to illustrate many of the human rights features of a protracted refugee and internal displacement crisis. Finally, it describes how the international community might respond to new and emerging challenges in forced migration and world politics, and better adapt to the ongoing tension between the power and interests of states and upholding refugee rights.

Este estudo busca compreender de maneira retrospectiva como ocorreu o ciclo do programa Ciência sem Fronteiras (CsF) ao considerá-lo uma política pública intersetorial. Para tal, tem como objetivo: descrever a intersetorialidade do CsF enquanto uma política de estímulo à ciência, tecnologia e inovação, uma política educacional e uma política de redução de desigualdades; investigar a formulação, a organização e a gestão do CsF; e verificar como foi a implementação do programa. A partir do estudo de caso do CsF, realiza uma revisão da literatura de políticas públicas, além da apuração de trabalhos empíricos, de informações governamentais e da repercussão midiática sobre o programa. Conclui que embora o programa tenha tido falhas, o seu fim representou um retrocesso no desenvolvimento brasileiro pelo regresso ao incentivo à inovação e por retirar as oportunidades de inclusão social. To do so, it set as goals: to describe the intersectoriality of the program as a stimulus to science, technology and innovation policy, as an educational policy, and as a reduction of social inequalities; to investigate the formulation, organization and management of the program; and to observe the process of implementation.From a case study of the CsF, a review of the public policies literature was made, as well as a canvass of empiric surveys, governmental information and media repercussion about the program. The conclusion was, besides the program’s flaws, its abrupt end represented a kickback to the Brazilian development, due to the withdrawal of the incentivesto innovation and opportunities of social inclusion.Keywords: Science Without Borders program. This paper willpresent the ratification process of the Marrakesh Treaty in Brazil, its place within the legal system and the likely effects on copyright limitations. We structure the paper in two parts. First we show how the Brazilian Constitution governs the reception of human rights international treaties and conventions and expose their effects throughout the system. We follow by the presentation of the Marrakesh Treaty’s ratification process in Brazil, concentrating on the justifications and results of the legislative procedures. Finally, we consider the likely and possible effects on public policy, legal change and the judicial interpretation of the limitations. We choose to use primary official sources to present the questions for analyses. Our method of choice is inductive, since we extensively use legislative records to elaborate on the political processes and legal rationales behind it.
