This chapter examines the statutory grounds for governmental access to private-sector data in Korea. It focuses on issues such as the circumstances under which access is allowed without a warrant and how unjustified government access can take place in practice. Systematic government access to private-sector data can take place through warrants issued by a court. Notably, due to the unique truce situation, under which the Republic of Korea is technically still at war with North Korea, Korean authorities are sometimes allowed to obtain private-sector data without warrants, for national security purposes. This chapter examines the statutory grounds for governmental access to private-sector data in Korea, focusing specifically on issues such as the circumstances under which access is allowed without a warrant and how unjustified government access can take place in practice.

Проблема борьбы с преступностью в современной России является одним из приоритетных направлений государственной политики страны, условием обеспечения ее национальной безопасности. Пенитенциарная преступность выступает составной частью общей преступности и по многим показателям зависит от нее. Общеизвестно, что в местах лишения свободы совершаются преступления. Данные факты свидетельствуют о серьезных недостатках в деятельности уголовно-исполнительной системы, особенно это показательно, если преступления совершаются в колониях-поселениях, контингент которых представлен осужденными за преступления по неосторожности или положительно характеризующимися осужденными, переведенными из исправительных учреждений других видов. В профилактике преступлений важное место занимает организация применения основных средств исправления осужденных, одним из которых является воспитательная работа. В ходе анализа нормативной базы, регламентирующей проведение воспитательной работы, мы пришли к выводу, что многие особенности деятельности колоний-поселений не нашли отражения на законодательном уровне. Считаем, что правовая природа колоний-поселений наделяет администрацию учреждения широким спектром возможностей при организации воспитательного воздействия. С учетом наблюдений практических работников, полученных в процессе интервьюирования, мы предложили ряд изменений в нормативные акты, которые регулируют воспитательную работу. Их внесение в законодательство, по нашему мнению, будет способствовать совершенствованию организации воспитательной работы с осужденными, что в свою очередь позволит снизить уровень преступности в колониях-поселениях. The problem of combating crime in modern Russia is one of the priority areas of the country's state policy, a condition for ensuring its national security. Penitentiary crime is an integral part of overall crime and depends on it for many indicators. It is common knowledge that in places of deprivation of liberty crimes are committed. These facts reveal serious shortcomings in the functioning of the penal system, especially when crimes are committed in penal settlements, where the population is represented by those convicted of crimes by negligence or those transferred there from correctional institutions with different regime due to their conscious conduct. In crime prevention the organization of the use of basic means of prisoners’ correction, one of which is educational work, takes an important place. In the process of the analysis of the regulatory framework governing educational work, we came to the conclusion that many features of the activities of penal settlements were not reflected at the legislative level. We believe that the legal nature of penal settlement gives the administration of the institution a wide range of opportunities in organizing educational impact. Taking into account the observations of practitioners obtained during the interview process, we proposed a number of changes to the normative base that regulate educational work. Their introduction into legislation, in our opinion, will contribute the improvement of the organization of educational work with prisonerss, which in turn will reduce the level of crime in penal settlements.

Problem setting. On October 7, 2021, the Constitutional Tribunal of the Republic of Poland ruled in favor of Polish law over European Union law, which in the long run may violate the principles according to which the Union operates and the rights enjoyed by citizens of the state. Such a precedent can further serve as a basis for identical decisions of the bodies of constitutional jurisdiction of those states that have problems in fulfilling their obligations in the European community. Analysis of recent researches and publications. The problems of the functioning of the bodies of the European Union, the implementation of their decisions and the general status in EU law are widely studied in national science. In particular, many scholars have studied the legal nature of the EU, including: TM Anakina, VI Muravyov, NM Ushakov, A. Ya. Kapustina, NA Korolyova, Yu. Yumashev, BN Topornin, OYa Tragniuk, SS Seliverstov, IV Yakovyuk and others. Target of research is to establish the foundations of EU law in the functioning of Union bodies, especially the Court, as well as to determine the hierarchy of national law and EU law. Article’s main body. Over the years, the Court has, within its jurisdiction, issued a large number of judgments which have become the source of the Union’s Constituent Treaties and of EU law in general. Over the last two decades, the powers of the Court of Justice have changed significantly. In particular, this is due to the adoption of the Lisbon Treaty, which amended the EU’s founding treaties on the powers of the Court, then the reform of the European Court took place in 2015-2016, which concerned a change in the organizational structure of the Court. Despite the generally well-established case law of the Court of Justice of the European Union on the unification of the observance by the Member States of the basic principles of the European Union, the Constitutional Tribunal of the Republic of Poland adopted a decision on 7 October. Conclusions and prospects for the development. Following the decision of the Constitutional Court, the Polish authorities found themselves in a situation that significantly complicated its internal and external situation. The way out of which requires answers to fundamental questions about the legal nature of the EU. Undoubtedly, this is an issue not only between Poland and the EU, but also between other member states.

В статье рассматривается и обосновывается необходимость возобновления в уголовном праве института конфискации имущества в качестве уголовного наказания. Необходимость его возобновления обусловлена наличием ряда преступных деяний, представляющих угрозу обществу, государству, национальной безопасности Российской Федерации. В настоящее время законодательная регламентация конфискации имущества в качестве иной меры уголовноправового характера, вызванная неопределенностью его сущности, целевых установок и механизма назначения, не выполняет предупредительную задачу, установленную уголовным законодательством. The article discusses and substantiates the need to renew the institution of confiscation of property in criminal law as a criminal punishment. The need to resume it is due to the presence of a number of criminal acts that pose a threat to society, the state, and the national security of the Russian Federation. Currently, the legislative regulation of the confiscation of property as another measure of a criminal-legal nature, caused by the uncertainty of its essence, targets and the mechanism of appointment, does not fulfill the preventive task established by the criminal legislation.

The interrelated concepts of memory policy, historical policy and security policy are considered. It is shown that in Russia and in the Republic of Belarus there is a steady trend of securitization of historical policy and memory policy. The tendencies of indoctrination of the securitist model of historical policy into official documents of both states are considered. It is shown that both in Belarus and in Russia, the internal political confrontation is considered in the historicist construct of the Cold War. It is argued that in the context of the need to deepen integration within the framework of the Union State, it is necessary to search for a relatively unified holistic concept of history for all the forces of Russian and Belarusian societies.

The paper deals with the problem of water pollution in the Republic of Sakha (Yakutia). Considerable water resources are concentrated on the territory of this subject of the Russian Federation. However, providing the population with high-quality drinking water is one of the main regional problems. Water sources are negatively affected by industrial enter-prises. Natural and climatic features of Yakutia also play a significant role. As a result, there is a negative impact of water consumption on human health, pri-marily children’s health. The author of the paper analyzes how this problem manifests itself in urban and rural settlements. It is concluded that ensuring water security is an important component of the security of Yakutia and the national security of Rus-sia. Solving this problem requires an integrated ap-proach and comprehensive research.

Measures of state support of business in the conditions of digitalization of the economy in the Republic of Bashkortostan are considered. A set of measures and tools for the development and support of small business in the conditions of global challenges is proposed.

Currently, the definition of security that was put forward in 1952 by Arnold Wolfers in his article “National Security as an Ambiguous Symbol” is widely cited within the field of security studies while the definition of this concept that have been advanced by Walter Lippmann in his book from 1943, “US foreign policy: Shield of the Republic” is largely absent, a situation which hinders the turning into a research topic of the connections between these definitions. However, there are authors who cite both the definition of security advanced by Wolfers and the definition of it put forward by Lippmann, but they either do not mention the existence of connections between these definitions or take notice of them but do not investigate them, with the consequence that a thoughtful consideration of this problem is lacking. In order to fill this gap in the study of the early stages of the development of security studies, this article provides an in-depth investigation of the links between the two definitions of security which reveals that Wolfers’ reflection on security was meant to explain implicit aspects of Lippmann’s definition of this concept but that eventually and somehow unintentional Wolfers advanced a different perspective on security.
