AbstractThe Sharia Insurance Policy as a form of contract between the insurance company and the participant or insurance participant should duly follow sharia principles in order to avoid being forbidden, therefore in Indonesia the policy making must require Minister of Finance Regulation No. 18 of 2010 concerning the Implementation of the Basic Principles for the Implementation of Insurance Businesses and Efforts to Reassure Sharia Principles as the basis for the rules that describe the standardization of sharia policy contracts. This study uses qualitative methods, the data used consists of primary, secondary, and non-legal data. The technique used consisted of content analysis with normative juridical research themes that analyzed legal principles and systematics, and increased the level of ABC insurance products at PT. XYZ Minister of Finance Regulation No. 18 of 2010. The results of this study concluded that general research of ABC Takaful PT. XYZ is in accordance with Minister of Finance Regulation No. 18 of 2010, but most of these based on this policy still need to be questioned about their values. Such as the absence of an introduction to tabarru funds' incorporation for insurance participants, the company if all bear the responsibility to bear the loss of the company's corporate company company company company and and and and and contents, and incompleteness contained in article 12 of the MRSSP policy of PT.Keyword : insurance, contracts, policies, sharia, conformity AbstrakPolis Asuransi Syariah sebagai bentuk kontrak tertulis antara perusahaan asuransi dengan nasabah atau peserta asuransi sepatutnya mengikuti prinsip-prinsip syariah agar terhindar dari unsur yang mengharamkannya, untuk itu di Indonesia dalam pembuatan polis haruslah mengikuti Peraturan Menteri Keuangan No. 18 Tahun 2010 Tentang Penerapan Prinsip Dasar Penyelenggaraan Usaha Asuransi dan Usaha Reasurnasi Dengan Prinsip Syariah sebagai landasan aturan perundang-undangan yang memaparkan standarisasi kontrak polis syariah. Penelitian ini menggunakan metode kualitatif, data yang digunakan berupa data primer, sekunder, maupun bahan non hukum. Teknik yang digunakan berupa content analysis dengan tema penelitian yuridis normatif yang menganalisis asas-asas dan sistematika hukum, dan seberapa besar taraf sinkronisasi produk asuransi syariah ABC PT. XYZ Peraturan Menteri Keuangan No. 18 Tahun 2010. Hasil penelitian ini menyimpulkan bahwa secara umum polis asuransi syariah ABC PT. XYZ  telah sesuai dengan Peraturan Menteri Keuangan No. 18 Tahun 2010, namun  terdapat sebagian keganjilan pada polis ini sehingga masih perlu dipertanyakan nilai kesyariahannya. seperti tidak dicantumkannya penginformasuan penggabungan dana tabarru’ kepada peserta asuransi, kewajiban perusahaan untuk menanggung seluruh kerugian bila perusahaan melakukan wanprestasi, dan ketidaklengkapan isi dari pasal 12 polis MRSSP PT.Axa Mandiri tentang Penyelesaian Perselisihan bila terjadi konflik antara peserta dan perusahaan asuransi.Kata Kunci: asuransi, kontrak, polis, syariah, kesesuaian

The increasing of sharia insurance companies have sprung up in Indonesia. However, in their policy contracts there are still some parts that are not in accordance with sharia principles. This mismatch can cause information distortion that can harm customers or sharia insurance participants. The Sharia Insurance Policy as a form of written contract between the insurance company and the customer or the insurance participant should duly follow sharia principles in order to avoid the elements that forbid it, therefore in Indonesia the policy making must follow the legislation, namely Financial Services Authority Regulation No.69 / POJK.05 / 2016 (hereinafter abbreviated as POJK No.69 / POJK.05 / 2016) and the Financial Services Authority Regulation No.72 / POJK.05 / 2016 (hereinafter abbreviated as POJK No.72 / POJK.05 / 2016) as the basis of the rule legislation describing the standardization of sharia policy contracts. This study uses qualitative methods, the data used in the form of primary, secondary, and non-legal materials. The technique used is in the form of content analysis with the theme of normative juridical research that analyzes legal principles and systematics, and how much the level of synchronization of ABC Islamic sharia insurance products at PT. XYZ against POJK No.69 / POJK.05 / 2016 and POJK No.72 / POJK.05 / 2016. The results of this study concluded that generally the ABC Islamic Sharia insurance policy PT. XYZ is in accordance with POJK No.69 / POJK.05 / 2016 and POJK No.72 / POJK.05 / 2016, but there are some peculiarities in this policy so that it still needs to be questioned about the welfare side.

Disharmonization of Wakalah Agreement in Law Number 34 of 2014 and The DSN-MUI Fatwa Number 122/DSN-MUI/II/2018. BPKH as a Hajj financial management institution in Indonesia has an essential role in evolving the Hajj Fund. With the biggest potential of Muslims in the world, Indonesia can administrate hajj finances in a larger scope by investing hajj finances on business lines which has accordance towards sharia principles. In contrast, the wakalah agreement as the basis used between the prospective pilgrims to the BPKH institution is interpreted differently between Law Number 34 of 2014 and the DSN-MUI Fatwa Number 122/DSN-MUI/II/2018 so it causes disharmony in the two laws. Differences in the role interpretation of representatives in both of these invasions have legal consequences in the form of differences in the recipient of responsibilities involving the government and BPKH as the hajj financial manager if they experience investment failure. This study uses qualitative methods with secondary data in the form of legislation, related books, and non-legal materials. The used technique is content analysis with normative juridical research themes that analyze principles and legal systematics.

This study aims to analyze the application of financial accounting standards namely PSAK 62 (2015) regarding insurance contracts and PSAK 28 (2012) regarding loss insurance accounting at PT Asuransi AXA Indonesia, considering that PT Asuransi AXA Indonesia only provides services in the field of loss insurance excluding life insurance. This study uses qualitative methods with content analysis. The data used in this study is sourced from the official website of the relevant company, the data used as a sample are the financial statements of PT Asuransi AXA Indonesia from 2011 up to 2017. The analysis of this research was conducted on the presentation and disclosure of the company's financial statements adjusted to the provisions of accounting standards and applicable regulations. The results of this study indicate that PT Asuransi AXA Indonesia has implemented the recognition, measurement and presentation of premium income, claims and acquisition costs applied by those in accordance with PSAK 28 (2012) as well as PSAK 62 (2015).

The European refugee crisis has been communicated visually through images such as those of Alan Kurdi lying dead on the beach, by body bags on the harbor front of Lampedusa, by people walking through Europe and by border guards and fences. This article examines the broader visual environment within which EU policy-making took place from October 2013 to October 2015. It identifies ‘tragedy’ as the key term used by the EU to explain its actions and decisions and points out that discourses of humanitarianism and border control were both in place. The article provides a theoretical account of how humanitarianism and border control might be visualized by news photography. Adopting a multi-method design and analyzing a dataset of more than 1000 photos, the article presents a visual discourse analysis of five generic iconic motifs and a quantitative visual content analysis of shifts and continuity across four moments in time. The article connects these visual analyses to the policies and discourses of the EU holding that the ambiguity of the EU’s discourse was mirrored by the wider visual environment.

This article aims to review the implementation of Fatwa No. 21 / DSN-MUI / X / 2001 concerning General Guidelines for Sharia Insurance in Insurance Institutions. Sharia life insurance is a type of life insurance whose application is based on the provisions of Islam. PT. Prudential Life Assurance is a sharia life insurance company. In carrying out its activities to develop customer funds, PT. Prudential Life Assurance invests. In practice, the investment and insurance percentage determination is carried out unilaterally by the agent. Determining the percentage of this investment will affect customers' cash value claims that do not match the illustration. More specifically, in this connection, the author will analyze two aspects. First, the analysis of Fatwa No.21 / DSN-MUI / X / 2001 regarding the General Guidelines for Islamic Insurance on the implementation of the investment system at PT. Prudential Life Assurance Ponorogo Branch? Second, the analysis of Fatwa No.21 / DSN-MUI / X / 2001 regarding the General Guidelines for Islamic Insurance on the payment of cash value claims for customers at PT. Prudential Life Assurance Ponorogo Branch? The author's type of research is field research using qualitative methods, while the data collection techniques used are interviews and documentation. The analysis used uses the deductive method, namely a discussion that begins with presenting arguments, theories or provisions that are general and then put forward a specific fact. From this research, it can be concluded that the implementation of the investment system at PT. Prudential Life Assurance at the Ponorogo branch is only limited to administration. Where the agent determines the percentage of insurance and investment unilaterally to get a hefty fee, this is not following the DSN fatwa No.21 / DSN-MUI / X / 2001, which reads "investment must be made under sharia." Meanwhile, regarding the payment of cash value claims from customers that do not match the illustration, it follows the DSN fatwa No.21 / DSN-MUI / X / 2001, which reads "different claims in the amount according to the premium paid."Artikel ini bertujuan untuk mengkaji implementasi Fatwa No. 21/DSN-MUI/X/2001 tentang Pedoman Umum Asuransi Syariah Pada Lembaga Perasuransian. Asuransi jiwa syariah adalah jenis asuransi jiwa yang penerapannya berdasarkan ketentuan Islam. PT. Prudential Life Assurance adalah perusahaan asuransi jiwa syariah. Dalam menjalankan kegiatannya untuk mengembangkan dana nasabah, PT. Prudential Life Assurance berinvestasi. Dalam praktiknya, penentuan persentase investasi dan asuransi dilakukan secara sepihak oleh agen. Penetapan persentase investasi ini akan mempengaruhi klaim nilai tunai nasabah yang tidak sesuai dengan ilustrasi. Lebih khusus lagi, dalam hubungan ini, penulis akan menganalisis dua aspek. Pertama, analisis Fatwa No.21/DSN-MUI/X/2001 tentang Pedoman Umum Asuransi Syariah Tentang Penerapan Sistem Investasi Pada PT. Prudential Life Assurance Cabang Ponorogo? Kedua, Analisis Fatwa No.21/DSN-MUI/X/2001 tentang Pedoman Umum Asuransi Syariah Tentang Pembayaran Klaim Nilai Tunai Bagi Nasabah Pada PT. Prudential Life Assurance Cabang Ponorogo? Jenis penelitian penulis adalah penelitian lapangan dengan menggunakan metode kualitatif, sedangkan teknik pengumpulan data yang digunakan adalah wawancara dan dokumentasi. Analisis yang digunakan menggunakan metode deduktif, yaitu pembahasan yang diawali dengan mengemukakan argumentasi, teori atau ketentuan yang bersifat umum kemudian dikemukakan suatu fakta yang spesifik. Dari penelitian ini dapat disimpulkan bahwa penerapan sistem investasi pada PT. Prudential Life Assurance di cabang Ponorogo hanya sebatas administrasi. Dimana agen menentukan persentase asuransi dan investasi secara sepihak untuk mendapatkan fee yang besar, hal ini tidak sesuai dengan fatwa DSN No.21/DSN-MUI/X/2001 yang berbunyi “investasi harus dilakukan secara syariah”. Sedangkan mengenai pembayaran klaim nilai tunai dari nasabah yang tidak sesuai dengan ilustrasi, mengikuti fatwa DSN No.21/DSN-MUI/X/2001 yang berbunyi “beda klaim besarnya sesuai dengan premi yang dibayarkan”.

AbstractObjectiveWe conducted a content analysis of public comments to understand the key framing approaches used by private industryv. public health sector, with the goal of informing future public health messaging, framing and advocacy in the context of policy making.DesignComments to the proposed menu-labelling policy were extracted from Regulations.gov and analysed. A framing matrix was used to organize and code key devices and themes. Documents were analysed using content analysis with Dedoose software.SettingRecent national nutrition-labelling regulations in the USA provide a timely opportunity to understand message framing in relation to obesity prevention and policy.SubjectsWe examined a total of ninety-seven documents submitted on behalf of organizations (private industry,n64; public health,n33).ResultsPublic health focused on positive health consequences of the policy, used a social justice frame and supported its arguments with academic data. Industry was more critical of the policy; it used a market justice frame that emphasized minimal regulation, depicted its members as small, family-run businesses, and illustrated points with humanizing examples.ConclusionsPublic health framing should counter and consider engaging directly with non-health-related arguments made by industry. Public health should include more powerful framing devices to convey their messages, including metaphors and humanizing examples.

The competitiveness of an insurance company depends on the competitiveness of the products and services it introduces in the market. The competitive advantages of the insurance company are expressed in the attractiveness and competitiveness of insurance policies. An economic and mathematical model of increasing the competitiveness of the insurance company is proposed, which allows to calculate the integrated indicator of competitiveness of the insurance policy based on a comprehensive system of indicators characterizing the reliability of the insurance company, quality of its services, competitiveness, social activity. To analyze the impact of these indicators on the competitiveness of the insurance policy and identify areas for improving the efficiency and competitiveness of the insurance company. The competitiveness of an insurance company depends on the competitiveness of the products and services it introduces in the market. The assessment of the quality of insurance company services is compliance with the needs, requirements, and insurance interests of customers. This assessment is performed each time an individual client chooses to cooperate with an insurance company that meets his insurance interests and wishes. Therefore, the overall competitiveness of the enterprise depends on the competitiveness of products and services offered on the market. The competitive advantages of the insurance company are expressed in the attractiveness and competitiveness of insurance policies. The insurance market in recent years has shown consistently high growth, which makes it attractive for doing business. In these conditions, the task of modeling the activities of the insurance company in a highly competitive market environment becomes relevant. A mathematical model of increasing the competitiveness of the insurance company is proposed, which allows to calculate the integrated indicator of competitiveness of the insurance policy based on a comprehensive system of indicators characterizing the reliability of the insurance company, quality of its services, competitiveness, social activity. With the proposed model, insurance companies can objectively assess their weaknesses and strengths to ensure continuous growth and decent competition in a competitive market environment. The model allows you to select performance indicators and perform modeling and determine the consequences of changes in this indicator, analyze the impact of these indicators on the competitiveness of insurance policies and identify areas for improving the efficiency and competitiveness of the insurance company. By conducting such experiments, insurance companies can make more informed choices and decisions, analyze areas of competitiveness, and more efficiently allocate resources.

The tolerant spirit of Islam has inspired Ottoman rulers to adopt policies relating to non-Muslim citizens. The leadership crisis in the Ottoman Empire and the Western interests through capitulation have changed judicial system in the empire, including the system for non-Muslims that allows them to conduct their own judiciary and provide absolute freedom of religious matters. Tanzimāt, which is expected to bring improvements to the legislation system in Ottoman Empire, has marginalized Islamic law which is only enforced in aḥwāl al-shakhṣiyyah. Sultan Abdul Hamid II tried to maintain Islamic law by codifying Western European style. Some legal codifications contain qawāid fiqhiyyah (principles of Islamic law) which are sourced from the books of the Hanafi School of jurisprudence, and some others adopt Western laws by taking a few opinions of Islamic jurisprudence. This study analyzed various literatures related to policies towards non-Muslim citizens in the Ottoman era. The study uses descriptive and qualitative methods with a content analysis approach. Broadly speaking, this study found that the Ottoman Empire had given good treatment to non-Muslim citizens. The non-Muslim citizens get various facilities from the State, including the establishment of special institutions that handle their own affairs, although at the same time they have been used by Western countries to support their interests in Ottoman Empire.

Purpose The purpose of this paper is twofold: to perform a synthesis of academic research published between 2009 and 2016 regarding the changes in tourism consumer behavior brought about by the use of social media (SM); and to suggest a set of strategies for tourism businesses to seize opportunities and deal with resulting challenges. Design/methodology/approach A volume of 146 peer-reviewed journal articles were retrieved from two major databases. Content analysis of this academic research has been performed, exploring the effects of online reviews on tourism consumers and providers. Findings The content analysis identified three main research themes that were investigated by scholars and classified into two major categories, namely, consumer perspective and provider perspective: the antecedents (factors motivating and influencing tourists); the influence of online reviews on consumer behaviour; and the impact of these reviews on tourism businesses (providers’ perspective). Research limitations/implications This study is based on a literature review and outcomes reported by previous studies; hence, the suggestions are indicative rather than conclusive. Some publication sources were not included. Practical implications This paper suggests a range of adequate strategies, along with operational actions, formulated for industry practitioners in the fields of management and marketing. Originality/value It provides an update of the state of published academic research into SM and an integrated set of management and marketing strategies for tourism providers in seizing the opportunities and dealing with the challenges raised in a digital context.

A systematic review of articles using qualitative methods to generate questionnaire items identified in MEDLINE and PsycINFO from 2000 to 2014 was carried out. Articles were analyzed for (a) year of publication and journal domain, (b) qualitative data collection methods, (c) method of data content analysis, (d) professional experts’ input in item generation, and (e) debriefing of the newly developed items. In total, 371 articles were included and results showed (a) an acceleration of published articles, (b) individual interviews and focus groups were common ways of generating items and no emergent approach was identified, (c) the content analysis was usually not described (43% of articles), (d) experts were involved in eliciting concepts in less than a third of articles, (e) 61% of articles involved a step of further submission of newly developed items to the population of interest. This review showed an insufficient reporting of qualitative methods used to generate new questionnaires despite previous recommendations.
