Abstract: This paper aims to analyze the process of forming the Draft Law on the Elimination of Sexual Violence (RUU Elimination of KS) from the perspective of Islamic law and analyze the political configuration in the formation of the law. The method used is descriptive analysis with the type of normative-empirical research. This method is considered able to answer all the main problems in this study. The results show that, in Islamic law a leader is obliged to maintain the soul, mind, dignity and worth of his people. Islam does not justify violence against women, Islam commands that every human being can give love and affection to women without violence as stated in QS. Ar-Rum (30): 21. To prevent sexual violence against women and uphold moral values, the leader must form a regulation as a form of responsibility from a leader to his people. These regulations must be obeyed and implemented by all his people, this is explained in (QS. An -Nisa, (04); 59. In the formation of the Draft Law on the Elimination of KS, there was a tug of war. Since 2016 until now, the Bill on the Elimination of KS has been in and out of the National Legislative Council (Prolegnas) however, until now it has not been ratified for various reasons given until it was clashed with religious beliefs The ratcheting up of the ratification of the KS Abolition Bill shows the reluctance of the legislature to provide legal protection to the public.Abstrak: Tulisan ini bertujuan untuk menganalisis proses pembentukan Rancangan Undang-Undang tentang Penghapusan Kekerasan Seksual (RUU Penghapusan KS) ditinjau dari perspektif hukum Islam dan menganalisis konfigurasi politik dalam pembentukan Undang-Undang tersebut. Metode yang digunakan adalah analisis deskriptif dengan jenis penelitian normatif-empiris yang dianggap mampu menjawab semua pokok permasalahan dalam penelitian ini. Hasil penelitian menunjukkan bahwa dalam hukum Islam seorang pemimpin wajib menjaga jiwa, akal, harkat dan martabat dari rakyatnya. Islam tidak membenarkan adanya kekerasan terhadap perempuan, Islam memerintahkan agar setiap manusia dapat memberikan kasih dan sayang kepada perempuan tanpa adanya kekerasan sebagaimana tertuang dalam QS.Ar-Rum (30):21. Untuk menjaga agar tidak adanya kekerasa seksual terhadap perempuan dan menjunjung tinggi nilai moralitas, maka pemimpin harus membentuk suatu peraturan sebagai bentuk tanggung jawab dari seorang pemimpin kepada rakyatnya. Peraturan tersebut wajib dipatuhi dan dilaksanakan oleh semua rakyat­nya, hal ini dijelaskan dalam (QS. An-Nisa, (04);59. Dalam pembentukan RUU  Penghapusan KS terjadi tarik ulur. Sejak tahun 2016 hingga saat ini, RUU  Penghapusan KS telah berapa kali keluar masuk Prolegnas, namun sampai saat ini belum kunjung disahkan dengan berbagai alasan yang diberikan sampai dibentrokan dengan keyakinan agama. Tarik ulur pembahasan RUU Penghapusan KS menunjukan, keengganan dari badan legislatif dalam memberikan payung hukum kepada masyarakat.

Lagu-lagu tradisional Aceh merupakan bagian rezim hak cipta dan termasuk dalam ekspresi budaya tradisional masyarakat Aceh, kekayaan dan identitas bangsa. Untuk memajukan lagu-lagu tradisonal sebagai bagian kebudayaan Aceh, diperlukan langkah strategis melalui perlin-dungan, pengembangan, pemanfaatan, pembinaan untuk mewu-judkan masyarakat Aceh yang berdaulat secara politik, berdikari secara ekonomi, dan berkepribadian dalam Kebudayaan. Hal lainnya, lagu-lagu tradisional Aceh merupakan hak milik yang dapat beralih melalui warisan. Dalam praktiknya ahli waris pencipta lagu-lagu Aceh tidak memahami dan belum mendapatkan hak ekonominya  sebagai-mana diatur dalam Pasal 16 ayat (2) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Budaya masyarakat komunal berbeda pandang dengan filosofi konsep hak kekayaan Intelektual, bersifat eksklusif monopoli, dan lemahnya implementasi penegakan hukum hak cipta merupakan persoalan yang harus mendapat perhatian pemerintah di Aceh dalam melestarikan budaya tradisonalnya. Tujuan penulisan menjelaskan perlindungan hukum terhadap lagu tradisional Aceh yang merupakan ekspresi budaya tradisional, menjelaskan perlindungan kepada ahli waris pencipta lagu Aceh melalui warisan menurut Undang-Undang Hak Cipta, Kitab Undang-undang Hukum Perdata, dan Hukum Islam menjelaskan kendala pengalihan pencipta hak ekonomi lagu-lagu tradisional Aceh melalui warisan. Jenis penelitian ini menggunakan data sekunder sebagai data utama, atau yang disebut penelitian yuridis normatif yang menguji norma hukum sebagai objek penelitian. Pendekatan yang digunakan adalah pendekatan konseptual dan pendekatan hukum komparatif. Tulisannya disajikan dalam bentuk analisis deskriptif. Aceh Traditional Cultural Expression and Its Inheritance Model Traditional Acehnese songs which are part of the copyright regimes are one part of the expression of traditional Acehnese culture, wealth and national identity. The promotion of Acehnese culture through traditional songs requires a strategic step through protection, development, utilization, and coaching to realize an Acehnese society that is politically sovereign, economically independent, and has a personality in culture. Other things Traditional Aceh songs are property rights that can be transferred through inheritance. In practice the heirs of Acehnese songs creators do not understand and obtain economic rights from the commercial use of Acehnese songs as stipulated in Article 16 paragraph (2) of Law Number 28 of 2014 concerning Copyright. The communal society's culture is different from the philosophy of the concept of intellectual property rights that is exclusively monopoly and the weak implementation of copyright law enforcement is an issue that must be gotten the attention of the government, especially in Aceh to preserve the traditional Acehnese culture which is the expression of its people. The purpose of writing is to explain the legal protection of traditional Acehnese songs which are expressions of Acehnese cultural identity, explain the protection to the heirs of the creators of Aceh songs through inheritance according to the 2014 UUHC, the Civil Code and Islamic Law and explain what constitutes obstacles to the transfer of rights economic creator of traditional Acehnese songs through inheritance. This type of research uses secondary data as the main data, or so-called normative juridical research that tests legal norms as the object of research. The approach used is the conceptual approach and comparative legal approach. This writing is presented in the form of descriptive analysis.

Housemaids are one of the most vulnerable groups to violence and unfair wage. The problem is that, in Indonesia, female comprised 90% of the housemaids, thus making them even more vulnerable. Several cases of physical, psychological, and sexual violence that happened against housemaids are due to discriminative environment. This problem is what urges for the access of justice for female housemaids in Indonesia, thus the focus of this article. The research of this article used the normative legal approach based on literature studies and descriptive analysis towards the problem. The urgency of legal protection for female housemaids in Indonesia is caused by the prevalence of domestic violence and unfair compensation. Therefore, a comprehensive and exhaustive legal framework is needed to provide a sufficient access of justice mechanism for female housemaids, such as a legislative act specified for them. Rehabilitation is also a vital mechanism, especially to housemaids who suffered from violence by providing them temporary shelters, counseling, and protection from retalitation.

<p class="p1">This article is using a critical interpretation based on radical feminist theory to analyze the issue of sexual violence against women in Indonesia. Based on data from Komnas Perempuan in 2020, the number of victims of sexual violence is increasing. The root of sexual violence comes from the biological differences between women and men that has been constructed in society. Men are considered to have sexual dominance on women. The existence of sexual politics maintains by the state have taken away women’s authority both in private and public spheres. Using the critical and praxis feminist approach, this article assesses the data research from Komnas Perempuan, especially related to cases of sexual violence. The analysis and criticism of sexual politics in this article also highlights the Draft Law on the Elimination of Sexual Violence. The analysis proves the importance of state involvement in ensuring the lives of Indonesian female citizens, especially concerning protection from sexual violence.</p>

This article discusses the institutionalization of Islamic law into national law in Indonesia. The aim is to analyze the possibility of incorporating Islamic Law into the national legal system. This desire is logical, considering that Muslims in Indonesia occupies the majority position (85%) and the community requires appropriate regulations sourced from the teachings of their religion. Based on the results of the 1979/80 BPHN legal review seminar, there are at least 3 (three) main things that could be done, namely; (1) making Islamic law one of the ingredients in the preparation of national law, (2) reviewing and updating national legal products originating from colonial law that is not following the elements of Islamic law. (3) coordinating new regulations which contain Islamic legal norms. This study finds the fact that not all provisions of Islamic law can be incorporated into national law. Only provisions of a civil nature and which are truly correlated with public order (public interest) can be adopted. Apart from that, the law is not only a legal product but also a political product. In other words, the configuration of legal politics in Indonesia shows a very close relationship with the political realm. Therefore, it is necessary to have a strong synergy between Muslim intellectuals and political actors.Keywords: Islamic law, legal politics in Indonesia, political configuration.

AbstractVictims of sexual violence against persons with disabilities need legal protection through justice or social care, legislation is one of the references in the process of handling sexual violence because so far women have had difficulty in obtaining justice. With the aim of providing Islamic law in order to realize a better and fairer human life, as well as for the recovery of victims of sexual violence so that it can be accepted in the community and discrimination is not done which can make victims more traumatized. From the research that has been done that many people with disabilities who do not know the legal protection for them to avoid violence, harassment or taking away their rights are often ignored because of physical deficiencies, the positive law lies in the fact that the law is made and can be erased from everything acts that have been done by humans and are independent of the norms themselves.Keywords: legal protection; victims of violenceAbstrakKorban kekerasan seksual pada kaum difabel memerlukan perlindungan hukum baik melalui peradilan ataupun kepedulian sosial, perundang-undangan adalah salah satu rujukan dalam proses penanganan tindak kekerasan seksual karena selama ini perempuan sulit mendapatkan keadilan. Abstract: The Political Configuration of the Shariah Banking in Indonesia. Islamic law applies to Muslims wherever they are, whatever their nationality. But the National law is the law applicable to a particular nation, in a particular national state. In Indonesia's case, the National law also means the law developed by the Indonesian people, after Indonesia became an independent country and in force for the Indonesian people as successor to the old colonial law. Thus, Islamic law should be used now instead of the colonial law, which is no longer relevant to Islamic values. Shariah banking law is a product of National law which is adopted from Quranic and Sunnah values. The problems of this study are: view of the living norms of public life related to the legalization of abortion under PP No. 61 of 2014 on Reproductive Health in the jurisdiction of Ex Residency of Cirebon, Legal protection of children conceived for Pregnancy Preferred (KTD), form the legal protection of children conceived for Pregnancy Preferred (KTD), particularly rape victims in the future.The method used by researchers is sociological approach juridical law and specification in this study was included descriptive analysis. As for sources and types of data in this study are primary data obtained from interviews with field studies Cirebon MUI, and secondary data obtained from the study of literature. Data were analyzed qualitatively. The problems studied by the theory of effectiveness and progressive law.Based on the results of research that potentially incompatible with Islamic law if it does not pay attention to the provisions of law or the Fatwa of Indonesian Ulama Council, besides that government regulation is taking the authority of the judiciary by the executive branch, because the authority to determine a person can have an abortion only submitted to the doctor and known by the Health Department / districts forwarded to the Provincial Health Office, without having to get a judgment and / or determined by the court, including the MUI Fatwa can ignore. Abortion performed by a rape victim is allowed and does not constitute a crime, but as a special lex and Health Act Government Regulation No. 61 Of 2014 on Reproductive Health has taken over the authority of the judiciary, because abortion is performed by a rape victim does not need to get a determination from the court. Reflected Bill-September 2019-the Penal Code refers to the Law of Health and Government Regulation No. 61 of 2014 on Reproductive Health, so that the provision is contrary to the Constitution of the Republic of Indonesia 1945.Keywords: Provocate Abortion; Child; Rape; Legal Protection.

<p class="IABSSS">The article 4 clause 2 in the Act Number 1 Year 1974, mentioned that discrimination against women (wife) potentially in increasing the divorce rates. It can be minimized by creating a gender-based mindset, that will be the object of this research. This research will use qualitative methods with normative juridical approach. This research found that: firstly, that the Act Number 1 Year 1974 and its derivative laws such as Compilation of Islamic Law (KHI), has not reach yet the Pancasila values and also justice and humanity as the main mission of law. Secondly, the political configuration in the drafting of laws and “black and white” in understanding of religious texts are contribute to creating injustice. Thirdly, the justice is one of the goals of the law, so discrimination must be eliminated. This research provides a recommendation that polygamy in article 4 clause 2 in the Act Number 1 Year 1974 must be removed, and become the principle of monogamy absolutely.</p><p class="IABSSS">[]</p><p class="IABSSS">Diskriminasi terhadap perempuan (Isteri), sebagaimana tertuang pada Pasal 4 ayat 2 UU No. 1 Tahun 1974, berpotensi menciptakan tingginya angka perceraian. Meminimalisasi hal tersebut dengan membangun pemikiran berbasis keadilan gender merupakan tujuan dalam penelitian ini. Adapun metode yang dipilih adalah kualitatif dengan pendekatan yuridis-normatif. Hasil penelitian yang ditemukan; Pertama, bahwa UU No. 1 Tahun 1974 beserta perundang-undangan turunannya seperti KHI, masih jauh dari nilai-nilai Pancasila dan misi utama hukum; yaitu nilai keadilan dan kemanusiaan. Kedua, konfigurasi politik dalam produksi UU Perkawinan dan pemahaman teks agama yang “hitam-putih” adalah kontributor terciptanya ketidakadilan. Ketiga, salah satu tujuan hukum adalah keadilan, maka bentuk-bentuk diskriminasi harus dihapuskan. Artikel ini merekomendasikan penghapusan poligami dalam pasal 4 ayat 2 UU No.1 Tahun 1974, dan menjadikan monogami bersifat mutlak.</p>

Abstract: This article discusses the influence of legal political configuration of the New Order against the Compilation of Islamic Law in Indonesia. Legal political configuration of the New Order was based on Pancasila and the Constitution of 1945 as the basis of its policy to enhance and improve national law. The background formation of KHI is the need for technical justicial Religious Courts. KHI can be regarded as Indonesian fiqh sound Pancasila due to the influence of political codification and unification of the law of the New Order. This study efforts to prove that the relationship between the political configuration and character of legal product that produces any legal products is a reflection of the political configuration that gave it birth. The character of the law product is determined by the political vision that developed in the midst of society. Sometimes the character of legal product is responsive/populistic and there is also a legal product was characterized by conservative/orthodox/elitist. Likewise with KHI must have certain characters were born as a result of legal political configuration of the New Order regime.Keywords: Effect, political configuration, the new order, and KHI

Based on data obtained from the Annual Records of the National Commission on Women, the percentage of violence against women has increased by 792% in the past 12 years. In addition, cases of Online Gender Based Violence (OGBV) have increased 300% and the most cases are revenge porn cases. This proves that women are one of the most vulnerable subjects to become victims of violence, and violence against women is not only carried out in the real world but also in cyberspace. One of the most common OGBV cases is revenge porn, where a perpetrator threatens to spread pornographic content belonging to the victim online without the victim’s consent with the potential to damage the victim’s reputation. The absence of regulations governing revenge porn makes it difficult for victims to get legal protection. The existence of the Draft Law on the Elimination of Sexual Violence (RUU PKS) which specifically regulates the types of sexual violence has given rise to hope for victims in seeking justice. The purpose of this study is to examine the urgency of the ratification of the RUU PKS regardless of the pros and cons circulating in society in providing legal protection for the victims. This study uses a normative legal research method that emphasized data obtained indirectly, such as legal materials. The results of this study indicate that the existence of laws and regulations such as the Electronic Transaction and Information Act, the Pornography Law, as well as provisions in the Criminal Code are considered insufficient to provide legal protection for the victims. Therefore, it is necessary to ratify the RUU PKS as a legal umbrella to provide protection for the victims.
