Failure to conduct violence-free elections in Nigeria has frequently reflected in the writings of local and foreign election observers and monitoring groups. Previous studies have devoted much attention to the consequences of electoral violence on sustenance and consolidation of democracy but less attention has been paid to the role political party elite play in this violence. This study examined the role of political party elite in election-related violence in Nigeria, 2011-2019. It equally assessed its nexus and implications for democracy and governance. The study utilized documentary research method using qualitative documentary analysis to analyze the data obtained from secondary sources following four-step approach. Findings revealed that political party elite exerted greater influence on politically-sponsored thugs, who were utilized to perpetrate election-related violence due to zerosum game, winners-takes-all syndrome, and non-punishment of electoral offenders with far-reaching implications for popular participation, free, fair and credible election, party politics, leadership legitimacy and stable polity. The study submitted that curbing party elite-sponsored electoral violence requires that the Independent National Electoral Commission (INEC) and the National Assembly wake up to their responsibility of ensuring strict enforcement of laws for electoral offences as this would deter both sponsors and perpetrators from engaging in violence during election.

Bawaslu resolves by deliberation by bringing together the disputing parties to then take a final and binding decision. The final and binding nature of this Bawaslu decision does not apply to certain disputes, namely the dispute over the verification of political parties participating in the General Election and the determination of the final list of candidates for the election of members of the DPR, DPD, and DPRD. The existence of these two characteristics of Bawaslu's decision then led to different interpretations between Bawaslu and the KPU. The formulation of the problem, namely 1). The authority of Bawaslu in resolving election disputes regarding the task of supervising the implementation of elections, 2). The nature of Bawaslu's decisions in resolving election disputes. The research method used in this paper is normative juridical, namely an approach to legal norms or applicable laws and regulations, theories, and history. From the discussion of the problem, it is concluded that a decision that is final and binding is given to Bawaslu by law in order to end election disputes so that it will show the role of Bawaslu as a unified function of organizing elections. Meanwhile, exceptions to the nature of final and binding decisions on political party verification disputes and the permanent list of candidates for members of the DPR, DPD, and DPRD indicate that Bawaslu is not a judicial institution, so it cannot decide disputes related to constitutional rights as election participants.

Abstract In 2015, Montenegro’s oppositional alliance Democratic Front (DF) launched ‘Freedom Calling’, a contentious campaign demanding regime change. Although presented as non-partisan, it did feature a party-stemming background. Thus, politics turned civil—meaning that the civil character was a disguise for a planned, creative party endeavour. Methodologically, the authors interpret the DF’s campaign, elaborating on process tracing and applying Tilly and Tarrow’s ‘contentious politics’ approach. They enquire into how the political-party background of the organizers influenced the unfolding of the contentious campaign, thereby addressing the role of parties as initiators of movements. This is especially pertinent in hybrid regimes with formally democratic institutions and persisting authoritarian practices. The Montenegrin case study of contentious (party) politics reveals that, while resources are available, the strong (ethno)political identity label of the party imposes constraints on the construction of a programmatic campaign.

Retakaful is an Islamic alternative to the reinsurance industry in ensuring the stability of takaful companies. In Malaysia, the takaful operators need to depend on retakaful operators to ensure the takaful industry's long-term continuity by sharing the risk with the retakaful operators due to the small numbers of takaful operators. As a result, they reinsure their Takaful with the conventional reinsurance companies to meet the market demand. This practice continues to be acceptable based on an argument of unavoidable circumstances such as a necessity (darurah) and a dire need (hajah) due to insufficient retakaful companies. The Shari'ah issues arose on the needs for retakaful operators with conventional reinsurers or operators. Therefore, the paper aims to analyze the role of retakaful and its potential within the industry by identifying. Then it explores the Shari'ah principle and the arguments, existing rules, and regulations on the said issues. This study utilized the doctrinal research method with the content analysis. The data is collected from the library consisting of primary and secondary sources. The study's findings revealed that the Shariah scholars resolution plays essential roles in enhancing the roles of the retakaful industry based on darurah and hajah.
