AbstractThe regulation of the mineral mining sector underwent significant changes as a result of the enactment of the government’s policy to increase export duties on mineral exports. This paper examines wether the new regulation is in conformity with the principle of legal certainty and the principle of economy, as well as trying to find the ideal scheme in determining the Mineral Export Levy. This research concludes that there is conformity between new regulation and legal certainty, but there is unconformity with the principle of economy. The ideal scheme is to include consideration of the realitation of justice.IntisariRegulasi sektor usaha pertambangan mineral mengalami perubahan signifikan sebagai akibat ditetapkannya kebijakan pemerintah memungut bea keluar terhadap ekspor mineral. Tulisan ini berusaha mengkaji regulasi tersebut dalam kesesuaiannya dengan asas kepastian hukum dan asas ekonomi, serta mencoba mencari skema ideal dalam menentukan Bea Keluar Ekspor Mineral. Hasil penelitian ini menyimpulkan bahwa Penetapan BK Mineral telah sesuai dengan asas kepastian hukum namun belum sesuai dengan asas ekonomis. Skema yang ideal di dalam penatapan BK Ekspor Mineral adalah dengan memasukkan pertimbangan realisasi keadilan

Customary law is an unwritten rule that lives in the customary community of an area and will continue to live as long as the community still fulfils the customary law that was passed on to them from their ancestors before them. Settlement in criminal cases through customary law that produces results is a form of legal certainty. This study aims to determine the ideal concept in resolving criminal cases through customary courts in Merauke Papua. The method used in this study is a combination of normative legal research and empirical legal research with the reason that the author wants to examine the norms related to the problem of resolving customary criminal cases and seek direct information on the implementation of customary justice in Merauke Regency which is presented descriptively. recognition of customary courts must be stated in writing in the law on judicial power so that this institution has a clear legal basis and its decisions can be recognized so that it does not need to be tried again through national courts, criminal threats under five years must be resolved through customary courts and are final decisions   Received: 23 August 2021 / Accepted: 25 October 2021 / Published: 3 January 2022

Bagaimana kepastian hukum penerapan konsep lex spesialis sistematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan dari sudut pandang keadilan ? Kesimpulan Penerapan konsep lex spesialis sistematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan Dikaitkan Dengan Ajaran Perbarengan Dalam Hukum Pidana terdapat dalam beberapa dakwaan yang terhadap terdakwa yang diperiksa pada persidangan. Hal ini dapat dilihat pada contoh kasus putusan Nomor: 16/Pid.Sus-PK/2018/PT.DKI dengan kronologinya: Terdakwa Nur Alam selaku Gubernur Sulawesi Tenggara didakwa sebagai yang melakukan, menyuruh melakukan perbuatan yang secara melawan hukum melakukan perbuatan memperkaya diri sendiri atau orangt lain atau suatu korporasi yang merugikan keuangan Negara atau perekonomian Negara. Kepastian hukum penerapan konsep lex spesialis systematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan dari sudut pandang keadilan yaitu bahwa Kebijakan hukum pidana melalui implementasi asas kekhususan sistematis (systematische specialiteit) merupakan upaya penting dalam harmonisasi dan sinkronisasi antar undang-undang yang terkandung sanksi pidana didalamnya, baik itu yang bersifat pure criminal act ataupun hukum pidana administrasi (administrative penal law). Asas kekhususan sistematis terdapat pada pasal 14 UU Tipikor. Interpretasi terhadap pasal ini tidak seragam sehingga seringkali mengakibatkan terjadinya kriminalisasi kebijakan pejabat. Sehingga masih belum mencapai keadilan. Implikasi hukum penerapan konsep lex spesialis sistematis pada penegakan hukum tindak pidana korupsi di bidang Pertambangan dalam pembaharuan hukum pidana bahwa penegak hukum, JPU dan hakim,baik di tingkat pertama, banding, maupun kasasi, dalam menyikapi perkara pidana yang mempertemukan dua ketentuan hukum pidana khusus secara sistematis.ABSTRACTThe development and renewal of criminal law has increased with the application of the incorporation of law in the resolution of criminal cases. This can be seen in the example of case ruling Number: 16 / Pid.Sus-PK / 2018 / PT.DKI with its chronology: Defendant Nur Alam as the Governor of Southeast Sulawesi was charged as the one who committed, ordered to do an act that unlawfully commits an act of enriching oneself or any other person or corporation that is detrimental to the State's finances or the State's economy. Legal certainty The application of the concept of systematic specialist lex to law enforcement of corruption in the mining sector from the perspective of justice is that the criminal law policy through the implementation of the principle of systematic specificity (systematische specialiteit) is an important effort in the harmonization and synchronization between the laws contained in criminal sanctions therein , both those that are pure criminal act or administrative criminal law. The principle of systematic specificity is found in article 14 of the Corruption Law. The interpretation of this article is not uniform so it often results in the criminalization of official policies. So it still hasn't reached justice. Legal implications of the application of the concept of a systematic lex specialist on law enforcement for criminal acts of corruption in the Mining sector in the renewal of criminal law that law enforcement, prosecutors and judges, both at the first level, appeals, and cassation, in addressing criminal cases that bring together two specific criminal law provisions systematic.

Legal certainty is one of the "three basic values of the law" which means it can be equated with the principle of law. A verdict or court decision must be in accordance with the law because the judge must judge based on the law. Decisions must also be fair, objective and impartial. Therefore the ideal decision is a decision that contains justice, usefulness and legal certainty proportionally. Seeing from the application of the Criminal Procedure Code, the main purpose of tracking assets resulting from criminal acts to be confiscated in court proceedings and ultimately resulting in a court decision is to be returned to the rightful party. In practice, there is a conflict between the victim and the judge's decision regarding the confiscation of evidence by the State that was confiscated from a First Travel travel agent, because the evidence seized from First Travel is the result of fraud from a prospective Umrah pilgrimage that should be returned to the victim as compensation.

The purpose of this study is to analyze the process of scientific investigation, the empowerment of scientific investigation by investigators, obstacles faced and finding scientific investigation based ideal of justice. This study uses empirical juridical approach that is related to the professional investigators and forensic laboratory examiner in conducting scientific investigations, also used a qualitative approach of the source of primary data and secondary data, then analyzed diskriftif with sestematika sentence further discussion is concluded. The problem is analyzed with proof theory and the theory of legal certainty so that it can be concluded find scientific investigation based on the ideal of justice.

Law enforcement criminal court must dare to be assertive in the process of law enforcement should not be legalitik the chained stream normatik dogmatik, it's time to find the ideal concept in accordance with the sense of Justice in favour of society ( public) and realized that the dynamic laws of development. The small settlement of cases does not always have to be boiled down to the Court, using the means and utilizing the penal imprisonment or confinement sentence need to be considered again for the sake of the values of Justice. This article aimed to describe the less clarity of the scope of the regulatory legislation meant in article 26 paragraph (2) item o of Law no. 6 of 2014 about village that is interpreted to the village head’ role as the adjudication committee of land registration who is authorized to collect and organize physical and juridical data of land parcels in his area as it is listed on the government Regulation no. 24 of 1997 about Land Registration, regulation of Minister of Agrarian and Spatial Planning/ Head of National Land Agency of Republic of Indonesia no. 6 of 2018 about Complete systematic land registration. In addition, this article aimed to describe the ideal construction of village government in organizing land registration. The current study was classified as an empirical study with a descriptive qualitative approach. This study takes Pablegan Village Head Office of Matesih District of Karanganyar Regency and The Agrarian and Spatial Planning Office/ National Land Agency (ATR/BPN) of Karanganyar Regency as the location of the study. This study found that in the substance of article 26 paragraph (2) item o of Law no. 6 of 2014 about village, there is a phrase that makes the scope of its regulatory legislation less clear so that an ideal construction of village government in organizing land registration is needed to make the scope of article 26 paragraph (2) item o of Law no. 6 of 2014 about village clear and reflect legal certainty.

Increased depths of conventional gold and platinum mines, longer travelling times as working places move further from the shaft, and ancillary activities taking place in the mining cycle reduce the useable time spent at the workface. Current shift lengths of 8 hours 20 minutes may no longer be adequate to complete required mining activities.The impact of mineworker commuting times on shift work is also not well understood. The aim of this research was to draft a framework to optimize shift cycles in order to maximize productivity, health, safety, and wellness in the South African mining sector. The framework was informed by a review of the literature, case studies at a local gold mine and platinum mine, and a workshop with industry experts. The findings indicate potential advantages of extended shift lengths and continuous operations, such as improved productivity, asset utilization, and employee morale. However, concerns included fatigue and the associated safety hazards, particularly when working longer shifts, night shifts, and numerous consecutive shifts. Job demands, personal factors, and commuting times are further considerations when scheduling shifts. The ideal shift system for the mining sector should holistically consider and balance operational requirements, health and safety, and employees' and their families' requirements, and suit the unique needs of each operation. Changes in shift cycles will require a structured change management process, which involves all stakeholders, and could help to enhance the viability of the South African mining sector.
