This study aims to find out all procedures for the transfer of rights to ex-customary land that have not been certified along with the requirements that must be completed to register the transfer of rights to ex-customary land that has not been certified as well as to find out the problems faced by the people of Ambit Village related to the registration of the transfer of rights to land. former customs and solutions for their solutions. The research method used is field research with an empirical juridical approach that is based on field research and interviews and is adapted to legal conditions. The results of the study can be concluded that the registration of the transfer of rights to former customary land that has not been certified in Ambit Village has been carried out in accordance with the provisions of the government regulation of land registration No. 24 of 1997. There are several problems that arise in the process of registering the transfer of rights to former customary land that has not been certified, such as land parcels that are still in dispute and there is no proof of SPPT PBB payment from the previous owner. It can be concluded that the community must follow the procedure and register their land with complete required documents and pay taxes on time. Abstrak Penelitian ini bertujuan untuk mengetahui seluruh prosedur peralihan hak atas tanah bekas adat yang belum bersertifikat beserta persyaratan-persyaratan yang harus dilengkapi untuk mendaftarkan peralihan hak atas tanah bekas adat yang belum bersertifikat serta mengetahui permasalahan yang dihadapi oleh masyarakat Desa Ambit terkait dengan pendaftaran peralihan hak atas tanah bekas adat beserta solusi penyelesaiannya. Metode penelitian yang digunakan adalah penelitian lapangan dengan pendekatan yuridis empiris yang didasarkan pada penelitian lapangan dan wawancara serta disesuaikan dengan keadaan hukum. Hasil penelitian dapat disimpulkan bahwa Pelaksanaan pendaftaran peralihan hak atas tanah bekas adat yang belum bersertifikat di Desa Ambit telah dilaksanakan sesuai dengan ketentuan peraturan pemerintah pendaftaran tanah No. 24 Tahun 1997. Terdapat beberapa permasalahan yang timbul dalam proses pendaftaran peralihan hak atas tanah bekas adat yang belum bersertifikat seperti bidang tanah masih dalam keadaan sengketa serta tidak ada bukti pembayaran SPPT PBB dari pemilik sebelumnya. Dapat disimpulkan bahwa masyarakat harus mengikuti prosedur dan mandaftarkan tanahnya dengan dokumen persyaratan lengkap serta membayar pajak tepat waktu.

Waqf is one of the Islamic philanthropy that carries the common interest. In the order of life, the Muslim community in the district of Berampu, Dairi district, is a Muslim minority. But even so, the spirit and practice of carrying out their religion is very strong. In this regard, including the concern is the spirit of the community to develop and increase the benefits of ulayat land, ulayat land is also waqf.This research aims to Knowing the position of ulayat land as an object of waqf by the people of Berampu sub-district, Dairi district in terms of Law No. 41 of 2004. To answer these problems, a field research was conducted with a qualitative research analysis model which was analyzed through a positive legal theory approach and Islamic law. Based on the results of the study it is known that the implementation of customary land waqf carried out by the people of the Berampu sub-district, as the researchers described earlier is not in accordance with Law No. 41 of 2004 concerning waqf. This is because 1)Customary land is not an object of waqf. This can be seen in PP No. 24 of 1997 in lieu of PP No. 10 of 1961 which states that customary land is not the object of land registration, while in PP no. 24 of 1997, waqf land is the object of land registration. So from this it can be seen that ulayat land is not actually an object of waqf. Because the object of waqf is land that has been registered in accordance with applicable regulations. 2) The practice of waqf carried out by the community of Berampu sub-district, Dairi Regency, is still mostly done verbally and not before PPAIW and is only based on mutual trust without any irar waqf deed as authentic evidence that the land has been waqfed for use in the public interest. As for the factors that cause the practice of waqf of ulayat land in Berampu sub-district, Dairi district are 1) Lack of public knowledge about waqf regulations in Indonesia. 2) The community still holds strongly to customs and habits that have been passed down from generation to generation. 3) The desire of the community to do charity through waqf institutions but not accompanied by knowledge.

Blora Regency is one of regencies in east end of Central Java province of the run National Agricultural Operations Program or commonly referred to PRONA. In fiscal year 2017 this amount PRONA in Blora Regency is one of the largest in Central Java province that is the number 25000 certification of land. Implementation of the National Agricultural Operations Program also involves various parties including the Government of Blora, Blora Regency Land Office and Regency Head / Head of Village related to the implementation of the National Agricultural Program's operation. Research methods which I use in this research is empirical juridical. Moreover, I also use this type of field research where the author falls directly to secure the data is valid in the field. From the results of this study concluded that the juridical implementation of the National Agricultural Program Operation in Blora with fiscal year 2017 is superbly accomplished in accordance with applicable regulations is Government Regulation No. 24 of 1997 on Land Registration and Technical Guidelines Prona.Keywords: National Operations Program; Registration of Land Mass.

The series of land registration activities requires expenditures in the form of tariffs charged at each stage. The principle that we can associate with the provisions of Article 9 paragraph (4) of the UUPA is an affordable principle, in the government regulation, the costs related to land registration are regulated, provided that the people who are not able to be released are paid for the fees. we can also find it in Government Regulation Number 128 of 2015 concerning Types and Rates of Types of Non-Tax State Revenues that Apply to the Ministry of Agrarian and Spatial Planning / National Land Agency. How is the affordable principle of land registration with the land registration service in the form of the first land registration service for certain parties? This study uses a normative juridical approach. Affordable principles in land registration can be seen in Government Regulation No. 128 of 2015, Article 22 and Article 24, which will certainly ease the burden on certain designated parties, so that they can reach those who need, especially the poor. Keywords: Affordable Principle, Land Registration, First Time, Parties Abstrak Rangkaian kegiatan pendaftaran tanah memerlukan pengeluaran berupa tarif yang dikenakan pada masing-masing tahapannya. Asas yang dapat kita kaitkan dengan ketentuan Pasal 9 ayat (4) UUPA adalah asas terjangkau,dalam peraturan pemerintah diatur biaya-biaya yang bersangkutan dengan pendaftaran tanah, dengan ketentuan bahwa rakyat yang tidak mampu dibebaskan dari pembayaran biaya-biaya tersebut.Peraturan pemerintah yang dimaksud pun dapat kita jumpai pada Peraturan Pemerintah Nomor 128 Tahun 2015 tentang Jenis dan Tarif Atas Jenis Penerimaan Negara Bukan Pajak Yang Berlaku Pada Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional. Bagaimana keterkaitan asas terjangkau dari pendaftaran tanah dengan pelayanan pendaftaran tanah berupa pelayanan pendaftaran tanah untuk pertama kali terhadap pihak tertentu. Penelitian ini menggunakan pendekatan yuridis normatif. Asas terjangkau dalam pendaftaran tanah dapat dilihat penerapannya dalam Peraturan Pemerintah Nomor  128  Tahun  2015, Pasal 22 dan Pasal 24, tentu akan meringankan beban bagi pihak tertentu yang ditunjuk tersebut, sehingga dapat menjangkau pihak-pihak yang memerlukan, khususnya masyarakat tidak mampu. Kata Kunci: Asas Terjangkau, Pendaftaran Tanah, Pertama kali, Pihak Tertentu

Implementation Land registration in society is now the task of the State. Land registration is carried out by the government for the benefit of the people, as an effort to provide legal certainty in the field of land. The Land Registration is carried out by the Land Office, and in carrying out the tasks the Land Office is assisted by The Land Deed Official, to carry out the activities set forth in PP 24/1997.The formulation of the problem in this research are: 1) How is the regulation of the registration of the Deed of Sale and Purchase exceeding the period of registration of land for the realization of legal certainty ?; 2) What are the obstacles faced by the Land Deed Officer in relation to the deed of sale and purchase that exceeds the period of land registration, which is shown for the realization of legal certainty and how is the solution to the settlement?This research method using research approach that is juridical normative. The specifications of this study were descriptively analyzed. Methods of data collection in this study, can be obtained by library research.The result of the research says that 1. The legal arrangement of registration of Deed of Sale and Purchase exceeding the time period specified for the realization of legal certainty is where if the registration of sale and purchase certificate exceeds 7 days then it is requested more clearly to the local Land Office. 2. The obstacles faced by the Land Deed Authority in relation to the deed of sale and purchase that exceeds the period of land registration such as the lack of public awareness, the bad image of the National Land Agency and the rights base is different from the field data. To overcome these obstacles then the National Land Agency made a program such as doing counseling to the public and through the PRONA program.The conclusion of the research results suggests that the legal arrangement of registration of Sale and Purchase Deed beyond the time period specified for the realization of legal certainty is where if the registration of the deed of sale and purchase exceeds 7 days then applied more clearly to the local Land Office. Although the submission of the deed of sale and purchase of land to the Land Office as practiced by most of the Land Deed Officials is not in accordance with the applicable laws but does not result in the cancellation of the land and there is no legal provision stating that With the delay of submission of the deed of sale and purchase of the land makes the relevant deed null and void. Keywords: Deed of Sale and Purchase, Land Registration

<p><em>Ulayat land is a land that is acquired from generation to generation whose control and utilization are regulated by the Mamak Waris Head. This is all obtained without correspondence or in Writing, only by knowing the boundaries naturally with someone else's land. In Padang City, especially in Bungus Teluk Kabung Subdistrict, most of the existing property is customary land. Ulayat land is used for the benefit of its people. The government is obliged to hold land registration in the entire territory of the Republic of Indonesia. One of the methods adopted by the Ministry of Agrarian and Spatial Planning / National Land Agency is through the Complete Systematic Land Registration Implementation Acceleration program as stipulated in the Regulation of the Minister of Agrarian and Spatial Planning / Head of the Republic of Indonesia National Land Agency Number 12 of 2017 concerning Acceleration of Complete Systematic Land Registration , which was carried out in Bungus Teluk Kabung Subdistrict which had a target of 1,100 fields. The formulation of the problem in this Writing is 1. How is the implementation of community ulayat land registration through the Complete Systematic Land Registration program in Bungus Subdistrict Teluk Kabung. 2. What obstacles were encountered in the implementation of the record of communal ulayat land through the Complete Systematic Land Registration program in Bungus Subdistrict Teluk Kabung. And in this Writing, the author uses a sociological juridical approach. Based on the research conducted by the author, the implementation of the registration of ulayat land of the people through the Complete Systematic Land Registration Program in Bungus District Teluk Kabung. It is challenging to implement and does not achieve this target because there are some obstacles in the implementation of the ulayat land registration of the people so that the ulayat land of the community cannot be registered with the Land Office. Constraints arise include subject, namely whose name certificate recorded in the name of the Mamak Chief Heir, on behalf of one member of the community or in the name of Mamak the Head of Waris along with members of the city because in most fields many register on behalf of one member the people without being noticed by Mamak To Waris and other members of the people. Another obstacle is the absence of the Mamak Waris Head and Kerapatan Adat Nagari in the land registration process.</em><em></em></p>

Abstract: The implementation of the announcement agency in land registration to apply the principle of publicity, but in its implementation according to PP 24 of 1997 and the PTSL regulation there is a difference in both the number of days of implementation and the status of registered parcels. This research used legal research methods is a normative law research methods and empirical juridical law that aims to determine the existence of the announcement agency in the implementation of PTSL and find out the legal consequences of the announcement agency on the legality of the Land Rights Certificate. The result of this research is the existence of the announcement agency in PP No. 24 of 1997 is different from the implementation of PTSL. Explicitly in PP No. 24 of 1997 the announcement was only carried out for customary land for 30 days and the announcement of state land was not implemented while the existence of the announcement agency in PTSL did not differentiate the status of the land, either state land or customary land, the announcement was still held for 14 calendar days. In accordance with the hierarchy of state the Government Regulation has a higher position than the Ministerial Regulation, this causes the making of the regulations below must refer to the regulations above so as not to collide/counter-productive. This rule collision will cause a legal gap if there is a lawsuit in the Administrative Court, so the product can be legally flawed and canceled. Kata Kunci : existence, announcement agency and PTSL Intisari: Pelaksanaan lembaga pengumuman sesuai PP No. 24 Tahun 1997 dan Pendaftaran Tanah Sistematik Lengkap (PTSL) terdapat perbedaan baik dalam jumlah hari pelaksanaan maupun status bidang tanah yang didaftarkan. Penelitian ini menggunakan metode penelitian hukum normatif dan hukum yuridis empiris yang bertujuan untuk mengetahui eksistensi lembaga pengumuman dalam pelaksanaan PTSL dan mengetahui konsekuensinya terhadap legalitas sertipikat hak atas tanah. Hasil dari penelitian ini adalah eksistensi lembaga pengumuman dalam PP No. 24 Tahun 1997 berbeda dengan pelaksanaan dalam PTSL. Secara tegas dalam PP No. 24 Tahun 1997 pengumuman hanya dilaksanakan untuk tanah adat selama 30 hari dan untuk tanah tanah negara tidak dilaksanakan pengumuman, sedangkan eksistensi lembaga pengumuman dalam PTSL tidak membedakan status tanah, baik itu tanah negara maupun tanah adat tetap dilakukan pengumuman selama 14 hari kalender. Sesuai dengan hierarki peraturan perundang-undangan, peraturan pemerintah memiliki kedudukan lebih tinggi dari peraturan menteri, hal ini menyebabkan pembuatan peraturan yang di bawah harus merujuk kepada peraturan yang ada di atasnya supaya tidak bertabrakan/kontra produktif. Tabrakan aturan ini akan menimbulkan celah hukum apabila terjadinya suatu gugatan di PTUN, sehingga produk yang dihasilkan bisa jadi cacat hukum dan dibatalkan. Development of village fund management is very much needed by the community so that it can be enjoyed by all levels of society in the villages. The seriousness of the government in developing villages is evidenced by the start of allocation of the Village Fund budget for 2015. The allocation of the Village Fund is mandated by Law (Law) Number 6 of 2014 concerning Villages and Government Regulation (PP) Number 6 of 2014 concerning Village Funds Sourced from STATE BUDGET. The regulation explained that the administration of the village government adheres to the principle of decentralization and the task of assistance. The principle of decentralization raises village internal funding (Desa APBD), while the principle of co-administration provides an opportunity for Villages to obtain funding sources from the government above it (APBN, Provincial APBD, Regency / City APBD). This study aims to observe what the development of village funds looks like, how they are implemented and the impact of the use of village funds in supporting development activities and community empowerment. The research method used is a qualitative research method that relies on observing places, actors and activities in Konawe Selatan Regency, Southeast Sulawesi Province, which was chosen as a case study. Initial observations show that the Village Fund does not have significant results in improving the welfare of the community. These indications are evident in the welfare of the community which has not improved with the existence of the village fund. Therefore it is necessary to develop a good management of village funds to improve the welfare of rural communities, especially in Konawe Selatan District. The output to be achieved is the scientific publication with ISSN Online and the level of technological Readiness that will be achieved 1-3.

The sale and purchase transaction in Badung Regency which was made by both parties was in the form of an agreement of hands, but one of the parties who broke a promise or could be called a default. The purpose of this research is to see the legal dangers of underhand trading on land ownership in Badung Regency. This research method uses empirical legal research. In practice, the implementation of binding purchases and purchases under land ownership rights is often carried out by several parties, one of which occurred in Badung Regency. The practice of buying and selling land carried out under the hand is not in accordance with government regulation Number 24 of 1997 concerning Land Registration, which requires that the sale and purchase be made with an authentic deed, and not under hand. However, the buying and selling process in Lukluk District, Mengwi District, Badung Regency is still ready for those who, the deed, because the fulfillment of the legal requirements for buying and selling under the UUPA is material, formal and cash, clear and sincere. In principle, in fine sales agreements and notaries will be a legal approach as law for them made. And also according to article 1320 of the Civil Code the validity of an agreement if, among others: There is an agreement, skills, certain matters, and valid reasons. And although according to lawful compliance with the requirements according to article 1320 of the Civil Code, the sale and purchase of land must be carried out before the prohibited authority (PPAT).

Abstrak: Tujuan penelitian adalah untuk mengetahui bagaimana perspektif maqāṣid al-syarīʻah terhadap pengawasan internal yang terkandung dalam Peraturan Pemerintah No. 60 Tahun 2008 tentang Sistem Pengendalian Intern Pemerintah. Penelitian dilakukan dengan metode penelitian kepustakaan dengan pendekatan yuridis-normatif yang dipadukan dengan pendekatan maqāṣidī. Hasil penelitian menunjukkan bahwa pengawasan internal secara maqāṣid al-syarīʻah, dianggap sebagai bagian dari al-maṣlaḥah al-ḥājjiyyah, dan berfungsi sebagai wasā‟il (sarana). Pengawasan internal merupakan sarana untuk memudahkan penyelenggaraan pelayanan publik supaya dapat berjalan sesuai dengan aturan yang telah Allah tetapkan. Pengawasan internal merupakan bagian dari pemeliharaan agama dan harta dalam wujud pelaksanaan amar makruf nahi mungkar dan pertanggung  jawaban  terhadap  amanah  serta  pemeliharaan  atas  harta  umum  (public  fund). Sehingga dapat disimpulkan bahwa secara umum konsep pengawasan internal yang diamanahkan dalam Peraturan Pemerintah tersebut telah sesuai dengan apa yang diinginkan oleh syarak, hanya saja masih harus dilakukan penyempurnaan pada sistem pengawasannya agar apa yang diinginkan oleh syarak dapat terimplementasi dengan baik.Abstract: The aim of the research is to find out how the perspective of maqāṣid al-syarīʻah towards internal supervision contained in Government Regulation No. 60 of 2008 About the Government Internal Control System. The study was conducted with a literature research method with a juridical-normative approach combined with the maqāṣidī approach. The results showed that internal supervision by maqāṣid al-syarīʻah, was considered as part of al-maṣlaḥah al-jiājjiyyah, and functioned as wasā'il (means). Internal supervision is a means to facilitate the implementation of public services so that they can run according to the rules that God has set. Internal supervision is part of the maintenance of religion and assets in the form of the implementation of amar makruf nahi mungkar and accountability for the mandate and maintenance of public assets (public funds). So it can be concluded that in general the concept of internal supervision mandated in the Government Regulation is in accordance with what is desired by the sharak, only that improvements must be made to its monitoring system so that what is desired by the sharak can be implemented properly.
