This study aims to reveal the paradigm of General Principles of Good Governance as a method of examination for Indonesian presidential impeachment based on the perspective of ethical control. This study employed the method of legal research. It was carried out to reveal principles and basis of (dogmatic or doctrinal) philosophy of positive law. In addition, the study is legal discovery in-concreto that is feasible to be applied to resolve a certain legal case. This study exposes that one of the legal reasons for the termination of the President of Indonesia is despicable deeds. It is determined as an act of President that degrade human characters. Hermeneutically, the meaning of “despicable deeds” may cover criminal acts and ethical actions. Therefore, the meaning of “despicable deeds” in this study is limited into acts of ethics infringement related to the General Principles of The Good Governance. The President can be terminated from the office when there is a violation to the General Principles of the Good Governance since the principles are the ethical principles of government. The principles contain honesty, accuracy, purity, balance, and legal certainty. These principles are the items that bring solution and reference for the House of Representatives (DPR) and the People’s Consultative Assembly (MPR) and the Constitutional Court. Theoretically, there is no norm, either of the 1945 Constitution or of other regulations, which limit the interpretation of “despicable acts” as a reflection of the acts of the President to be classified into ethical conducts. Therefore, the application of the General Principles of Good Governance as method of examination for the presidential impeachment is a new paradigm from the perspective of ethical control in Indonesia.

This research studies the legal status of a material guarantee for the bankruptcy process of Indonesia. The purpose of this research is to find out the legal status of whether the material guarantee that has been declared bankrupt by the appraisal because of not fulfill of repayment of the debtor to the creditor can be transferred on non-bankruptcy status? Moreover, what is the creditor's execution rights to the debtor's material guarantee? This research uses a normative legal research method, namely: legal research that is done with the purpose of discovering the principles and philosophical base (dogma or doctrine) of positive law, and the research of legal discovery efforts in concreto that is suitable to be implemented to solve a particular legal case. The result of this research is that material guarantees that have been determined as Bankruptcy cannot be transferred to their status when they are sold with a non-bankrupt status before a written decision by the judge justified the status. This shows obedience to the principles of legality and legal certainty, that selling the bankrupt assets with the status of (non-bankrupt assets) cannot be justified according to the law. If the curator still continues to sell the bankrupt assets, that process is illegal, including the execution of the selling according to the law. When it was being declared of bankrupt the total value of the material guarantee is assessed by the appraisal to be sufficient for paying all debts to the creditor, then it became the guarantee of repayment of the debtor, but if the value of the material guarantee valued by the appraisal is smaller than the debt, then there must be a reassessment in order to make justice for debtors and creditors. Mortgage-holding creditors, fiduciary guarantees, mortgage rights, mortgages, or other collateral rights, can execute their rights as if Bankruptcy did not occur, but there are several receivables that must be matched before executing their separatist rights.

Perkembangan pertumbuhan sistem ekonomi syariah, menuntut terhadap adanya penyesuaian-penyesuaian aturan hukum yang diberlakukan, khususnya terkait dengan penyelesaian sengketa yang terjadi. Baik secara litigasi maupun secara non litigasi. Termasuk bagian upaya penyelesaian ekonomi syariah, adalah melalui badan arbitrase syariah. Namun dalam perspektif yuridis, aturan mengenai kewenangan memberikan putusan eksekusi dan pembatalan terhadap putusan arbitrase syariah masih terjadi dualisme antara Peradilan Umum dan Peradilan Agama. Hal ini mencerminkan adanya ketidakpastian hukum dalam masalah tersebut. Melalui penelitian hukum normatif atau penelitian hukum doktrinal ini, penelitian ini bertujuan untuk menemukan jawaban-jawaban yang benar dengan melakukan pembuktian kebenaran yang dicari dari preskripsi-preskipsi hukum yang tertulis dalam kitab Undang-Undang serta sumber hukum lainnya. Penelitian ini menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan historis (historical approach). Penelitian ini difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma norma dalam hukum positif tentang kepastian hukum pelaksanaan eksekusi dan pembatalan putusan arbitrase syariah, khususnya pasca Putusan Mahkamah Konstitusi Nomor 93/PUU-X/2012. Pertentangan norma hukum tentang kewenangan pelaksanaan eksekusi dan pembatalan putusan arbitrase tersebut, meskipun secara yuridis terdapat pertentangan, namun  Mahkamah Agung telah melakukan langkah politik hukum untuk menyelesaikan dualisme kewenangan tersebut yang dapat menyelesaikan dalam jangka waktu pendek. Namun untuk penyelesaian jangka panjang, perlu adanya pembenahan terhadap peraturan perundang-undangan yang ada, guna menjamin kepastian hukum bagi para pencari keadilan.The development of the growth Islamic economic system requires the adjustments to the rule of law applied, particularly related to the settlements of disputes that occur, both litigation and non-litigation. One of the parts of  efforts to solve sharia economics is through Islamic arbitration bodies. But in a juridical perspective, the rules regarding the authority to give execution decisions and cancellation of sharia arbitration decisions still occur between the General Justice and the Religious Courts. This reflects the legal uncertainty for the case. Through normative legal research or doctrinal legal research, this study aims to find the correct answers by carrying out the verification of the truth sought from the legal prescriptions written in the law and other legal sources. By using statute approach and historical approach, this research is focused on examining the application of norms in positive law regarding legal certainty in the execution and cancellation of sharia arbitration decisions, especially after the Decision of the Constitutional Court Number 93/PUU-X/2012. Contradicting legal norms regarding the authority to carry out the execution and cancellation of the arbitration decision, even though there is a juridical conflict, the Supreme Court has taken legal political steps to resolve the dualism of authority which can be resolved in the short term. Yet for long-term solutions, it is necessary to reform existing laws and regulations to ensure legal certainty for justice seekers.

Legal research is a process to determine the rule of law, principles of law and legal doctrines in order to address the legal issues at hand. This study using a type of normative juridical (legal research). Rechtvinding understanding in Indonesian as legal discovery (translated literally) could mislead rechtvinding function is to find concrete norm to associate the relevant legal facts. Adhering to the understanding of the rechtvinding the judge in carrying out its functions prosecute a legal case can not be separated from efforts to find concrete norms to be linked to the fact the law. Furthermore, when the facts of law has no grounding norms that govern mutatis mutandis thus not regulated in the rules of positive law and customary law. Scholasticism and dialectic method is used as a support hermeneutic interpretation of legal facts to me recht construction of a new legal norm normative ideas should not be separated from Idee recht itself. Rechvinding model contained in the provisions of the Basic Law of Judicial Authority Article 1 in Conjunction with Article 5, Article 10 in conjunction with Article 50 1 for the model Rechtvinding is the approach taken by norma series is a concept of morals and justice and practices considered society as law and the criminal law model rechtvinding is also banned norma concrete (new), to assess the actions (act) so that an exit permit from the actions that have not been regulated in the act so that such actions are not punished.

Abstract: The Plato's conception of the rule of law states that good governance is based on good law. The organization also spreads to the world of Supreme Court justices, the election caused a decadence to the institutional status of the House of Representatives as a people's representative in the government whose implementation was not in line with the decision of the Constitutional Court. Based on the decision of the Constitutional Court No.27/PUU-XI/2013 explains that the House of Representatives no longer has the authority to conduct due diligence and suitability (elect) to prospective Supreme Judges proposed by the Judicial Commission. The House of Representatives can only approve or disapprove candidates for Supreme Court Justices that have been submitted by the Judicial Commission. In addition, the proportion of proposed Supreme Court Justices from the judicial commission to the House of Representatives (DPR) has changed, whereas previously the Judicial Commission had to propose 3 (three) of each vacancy for the Justices, now it is only one of each vacant for Supreme Court Judges. by the Supreme Court. The House of Representatives no longer has the authority to conduct due diligence and suitability (elect) to prospective Supreme Judges proposed by the Judicial Commission. The House of Representatives can only "approve" or "disagree" the Supreme Judge candidates nominated by the Judicial Commission.

The practice of polygamy in Indonesia until now has drawn criticism from some feminists who did not agree. But on the one hand, both Islamic law and positive law permit various conditions. In this case, the Religious Court (PA) becomes the last fence which becomes the determining point for a man to be able to polygamy. For this reason, researchers conducted a study of PA decisions on polygamy, namely Jombang PA Decision No. No. 0899 / Pdt.G / 2018 / PA.Jbg . The focus of the problem is (1) the value of gender justice in the decision and (2) reasoning rechtvinding(legal discovery) judge. The method used in this study is a normative-qualitative legal research method with content analysis techniques from Charles Purse. The results showed that the practice of polygamy licensing in the Religious Courts had actually gone through processes that reflected gender justice. This is reflected in the obligation of the Religious Court to summon the longest wife of the applicant for polygamy to be asked for willingness and information. The results of subsequent studies show that PA Jombang judges used hermeneutic techniques in making legal discovery efforts. Because, they not only focus on aspects of legality, but also consider the contextualization.

The Constitutional Court based on Article 24C of the 1945 Constitution of the Republic of Indonesia has 4 authorities and 1 obligation. These provisions are further contained in Article 10 of Law Number 24 Year 2003 concerning the Constitutional Court. The constitutional authority of the Constitutional Court in examining, adjudicating and deciding cases of judicial review of the constitution is about the constitutionality of norms. The method used is normative (doctrinal) legal research, using secondary data in the form of primary, tertiary and secondary legal materials. One of the legal materials used as the basis for analysis is the judge's decision and its implications for the judicial review. The results of the study that, the authority to test the Act against the 1945 Constitution theoretically or practically, makes the Constitutional Court as a controlling and balancing body in the administration of state power. The KPK is not the object of the Parlement questionnaire rights. The ruling emphasized that the KPK was an institution that could be the object of the questionnaire right by the Parlement. The implications of the decision of the Constitutional Court Number 36 / PUU-XV / 2017, can be grouped in two ways, namely: first, the implications are positively charged, namely the affirmation of the ownership of the House of Representatives questionnaire rights in Indonesian governance. Second, the negative implication is the possibility of using the DPR's excessive questionnaire rights without regard to existing limitations.Keywords : constitutional court; KPK; parlement.Mahkamah Konstitusi berdasarkan Pasal 24C UUD NRI Tahun 1945 memiliki 4 kewenangan dan 1 kewajiban. Ketentuan tersebut dituangkan lebih lanjut dalam Pasal 10 UU Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi. Kewenangan konstitusional Mahkamah Konstitusi dalam memeriksa, mengadili dan memutus perkara pengujian undang-undang terhadap Undang-Undang Dasar adalah mengenai konstitusionalitas norma. Metode yang digunakan adalah penelitian hukum normatif (doktrinal), dengan menggunakan data sekunder berupa bahan hukum primer, tersier dan sekunder. Salah satu bahan hukum yang dijadikan dasar analisis adalah putusan hakim dan implikasinya terhadap yudicial review. Hasil penelitian bahwa, kewenangan menguji Undang-Undang terhadap Undang-Undang Dasar 1945 secara teoritis atau praktis, menjadikan Mahkamah Konstitusi sebagai lembaga pengontrol dan penyeimbang dalam penyelenggaraan kekuasaan negara, Dalam Putusan Nomor 36/PUU-XV/2017, Mahkamah Konstitusi memutuskan menolak permohonan pemohon yang pada intinya menyebut KPK bukan merupakan objek hak angket DPR. Putusan tersebut menegaskan KPK merupakan lembaga yang dapat menjadi objek hak angket oleh DPR. Implikasi dari putusan Mahkamah Konstitusi Nomor 36/PUU-XV/2017 tersebut, dapat dikelompokkan dalam dua hal, yaitu: pertama, implikasi yang bermuatan positif, yaitu penegasan dimilikinya hak angket Dewan Perwakilan Rakyat dalam ketatanegaran Indonesia. Kedua, Implikasi yang bermuatan negatif yaitu adanya kemungkinan penggunaan hak angket DPR yang eksesif tanpa memperhatikan batasan-batasan yang ada.Kata Kunci: DPR; KPK; Mahkamah Konstitusi.

This research is normative legal research, an explanatory descriptive nature that aims to describe, disclose and explain the relationship between the non-criminal investigation of consumer protection with consumer guarantee agreements. The analysis is carried out using a juridical approach method which is then synchronized vertically or horizontally to related laws to see the existence of harmonization and certainty in the existing legal system. To further sharpen the results of the study also carried out an analysis of the effectiveness of the case. The results of the study provide an illustration that the Fiduciary Security Act has a problem in Article 15 regarding the provisions of the procedure for execution that is contrary to the HIR / RBg. Likewise, between Article 54 paragraph (3) and Article 56 paragraph (2) of the Consumer Protection Act, an inconsistency occurs in its application and implementation. With respect to agreements containing standard clauses, business actors and / or their management can be criminalized, in accordance with Article 18 in conjunction with Article 62 of the Consumer Protection Act. It is recommended that the Government and the House of Representatives of the Republic of Indonesia be able to revise these articles in order to realize legal certainty for all parties.

The Constitutional Court is one of the branches of judicial power that has authority to adjudicate at the first and last level whose decision is final to test the law against the Constitution as regulated in Article 24C paragraph (1) of the 1945 Constitution. The final nature of  decision of the constitutional court is binding on the entire community since it was said in the Open Plenary Session. Therefore, decision of constitutional court that invalidates the validity of a law must be followed up by legislators in the cumulative list open to the national legislation program. But in practice there are 2 (two) decisions that have not been followed up, namely Constitutional Court Decision Number 31 / PUU-XI / 2013 and Constitutional Court Decision Number 30 / PUU-XVI / 2018. Based on this description, it will be examined regarding the legal implications of not implementing the Constitutional Court Decision in case of judicial review? The author examines the problem using the method of normative legal research with the statutory approach. From the results of this study, it was found that the non-follow-up of the two decisions had violated the principle of rule of law in concept of the rule of law, and caused the loss of the decision-making power, and was a form of neglect of principle of legal awareness. So it is necessary to make changes in stages of the Constitutional Court Law and the House of Representatives' Regulations on Rules of Procedure.

Abstract: This paper describes the material tort against the decision of Pengadilan Negeri (PN) of Kepanjen No. 91/Pid.B/2008 / PN.KPJ on a post-verdict corruption of Constitutional Court of RI. No.003/PUU-IV/2006 and then analyzes from the standpoint of positive law and criminal (jinayah) Jurisprudence. The study concludes that although a tort is legally no longer valid in law of Indonesia after the Constitutional Court’s decision but in the case of corruption, Pengadilan Negeri of Kepanjen still applies the rule of the material tort. The existence of obscurity formula of tort is caused by the interpretation of the law and jurisprudence on tort material conducted by PN Kepanjen. The action of Pengadilan Negeri of Kepanjen in performing legal discovery and referring to jurisprudence, according to the criminal jurisprudence perspective, is true because Islam encourages its followers to do ijtihad when the rules are silent on the case submitted to the judge. If the judge cannot do ijtihad, he should refer to the previous jurisprudence.Keywords: Law, material, corruption, jurisprudence

ABSTRAKPutusan Pengadilan Negeri Bekasi Nomor 95/PDT.G/2008/PN.BKS menolak dan menghukum gugatan penggugat untuk membayar biaya perkara, dan memutuskan bahwa harta pewaris seluruhnya menjadi hak anak luar kawin tidak diakui karena hibah dari pewaris. Dari sisi penegakan hukum positif, hakim mendasarkan putusan hanya pada pembuktian tanpa menelusuri realitas dari akta hibah tersebut yang cacat hukum. Kajian penelitian putusan ini menggunakan teori hukum progresif dalam upaya mencari keadilan, dengan mengkaji permasalahan, serta bagaimana penyelesaian konflik pewarisan akibat hibah berdasarkan hukum progresif. Penelitian ini adalah penelitian socio-legal dengan pendekatan induktif yang berparadigma post-positivisme. Penelitian ini dilakukan secara kualitatif dengan mengutamakan kedalaman data dengan narasumber yang berkompeten di bidangnya. Dari penelitian ini, realita bahwa anak luar kawin tidak diakui dapat menguasai seluruh harta pewaris dengan hanya berdasarkan pada akta keterangan hibah, mestinya tidak terjadi. Hal ini menunjukkan betapa lemahnya peradilan yang hanya menggunakan hukum formalisme semata, sebagai puncak kepastian hukumnya, sehingga tujuan manfaat dan keadilan belum terpenuhi. Pola hukum progresif berfondasi pada progresivitas manusia, bahwa manusia sebenarnya baik, penuh kasih sayang, saling tolong menolong, dan empati kepada sesama manusia. Berhukum yang benar adalah berhukum yang bertujuan demi tercapainya keadilan masyarakat.Kata kunci: hibah, harta warisan, anak luar kawin tidak diakui, hukum progresif. ABSTRACTBekasi District Court Decision Number 95/PDT.G/2008/ PN.BKS objected the claim and give sanction to the plaintiff to pay court costs, and decided that all the assets of the testator became solely the possession or title of the child out of wedlock of no recognition owing to the grant of the testator. In terms of positive law enforcement, the judges based the ruling solely on proving without probing the legitimacy of the legally flawed grant deed. This analysis employed the theory of progressive laws in an effort to seek justice by studying the problems as well as the conflict settlement of the case of grant-based heir derived from progressive law. This is a socio-legal research study using inductive approach through the perspective of post-positivism. Qualitative research was conducted primarily by collecting references from the experts in the relevant field. From this research, it can be inferred that the granting of ownership to the entire inheritance to the child out of wedlock of no recognition based solely upon a Grant Deed should not have occurred. This indicates just how weak the judiciary is, barely imposing a mere formal law as the culmination of its legal certainty resulting in the unfulfilled objectives of law, those of the benefit and equity. The pattern of progressive law is based on the progression of humans that human beings are actually good, compassionate, mutually helpful to each other, and empathetic for their fellow human beings. Indeed the true law is aimed at achieving social justice.Keywords: grant, inheritance, child out of wedlock of no recognition, progressive law.
