RESUMOO trabalho mostra a inter-relação do uso da expressão “parcerias” no contexto de concessões administrativas e patrocinadas, significando a colaboração estabelecida entre o setor público e o privado. O instituto jurídico das concessões renova-se com a criação do sistema de Parceria Público-Privada. Tem como objetivo a execução de obras, a elaboração de projetos, financiamentos, gestão, operações e manutenção de serviços públicos. Busca-se com ele melhorar a prestação dos serviços em termos de eficiência e de resultados. Essa espécie de parceira é analisada neste artigo com base nas modalidades de concessões patrocinadas e administrativas, sua aplicabilidade em consonância com as diretrizes institucionais, bem como a importância do procedimento licitatório. O modelo teórico proposto sugere que a adoção das parcerias público-privadas poderá ser uma das vias institucionais para a melhoria da capacidade na prestação de serviços públicos.ABSTRACTThis paper shows the term "partnerships" use on administrative and sponsored concessions meaning the collaboration established between public and private sectors. The legal concessions are renewed with Public-Private Partnership rules. The objective of this paper is to analyze execution of works, elaboration of projects, financing, management, operations and maintenance of public services. It is intended find ways to improve the service success in terms of efficiency and better results. Partnership is analyzed based on modalities of sponsored and administrative concessions, their applicability according to institutional guidelines and the importance of bidding procedure. The theoretical model proposed suggests that the adoption of Public-Private Partnerships could be one institutional way to improve the capacity to provide public services.

The increasing use of public–private partnerships (PPP) as a means of delivering public services or constructing public infrastructures draws growing interest in the legal community. The ambiguity and lack of consensus surrounding the content of PPP as a concept, leads the researcher to refer to various disciplinary sources. Widely encouraged in law, transdisciplinarity often suffers methodological insufficiencies when comes the time to define transdisciplinary concepts. The authors revisit the interpretation methods developed by the courts, and propose a complementary conceptual analysis framework. The developed framework is then applied to the emerging concept of public–private partnership, as it is used and defined in various disciplines. The paper demonstrates the feasibility and desirability to provide a transdisciplinary perspective to legal concepts.

This paper discusses recent changes in the way public services are delivered A marked increase in the cooperation between the public and private sector in the realization of complex projects, mostly concerning development of infrastructure, is the main characteristic of present-day developing economies. The creation of new, innovative agreements is driven by the limitation of public funds and an ever-growing demand for an increase in the quality of public services. Looking upon the western economies experience alternatives to the traditional public sector procurement are identified in the public/private partnership. The public/private partnership can be seen as one component in the rearrangement of the public sector with a management culture that focuses on the citizen or customer. Also included in this are accountability for results, investigation of a wide variety of alternative service delivery mechanisms, and competition between public and private bodies for contracts to deliver services consistent with cost recovery and the achievement of value for money. The partnership can be realized through an array of models and in this paper priority is given to the DBFO (design-build-finance-operate) model, due to its importance in implementation. The DBFO model is considered to be a synonym for the public/private partnership, as it is the most suitable for complex projects and gains the most benefits.

In this article the author analyzes perspectives on the Eurasian Single Economic Space’ concerning infrastructural investment projects. These perspectives are considered with a consideration of Public-Private Partnership (PPP) principles and the traditional framework of EAEU (Eurasian Economic Union) integration. The article examines national legal differences, such as the existence of regulations for PPPs, possible models for project realization and spheres where PPP could be used.  The author also analyzes the characteristics of the most famous PPP projects in the EAEU. The purpose of the article is to identify practical recommendations for the development of public-private partnerships to further cooperation between the EAEU countries. This research stems from the study of international experiences of public-private partnerships, the adaptation thereof, and clarification of the necessary steps for the most efficient development of PPP in EAEU countries. As such, the following priority steps for EAEU countries are suggested: 1) EAEU countries should take steps to unite their respective legislative bases in terms of mutual compatibility so that public and private partners could act as inhabitants of the Union everywhere, removing not only customs barrier obstacles for them, but also additional tax restrictions; 2) EAEU countries should create an international council for problems and disputes pertaining to PPP which will include representatives of the countries of EAEU, representatives of the business and scientific communities and non-profit associations. Such a council was recommended to be set up at the United Nations during the third session of the United Nations Economic Commission for Europe on the problems of international public-private partnership, held in Geneva (Switzerland) on 18-19 April 2011; 3) EAEU countries should make use of practical experience in the implementation of interstate PPP projects. An example of a successful interstate PPP - the project for expansion and modernization of the international airport in Warsaw, through which more than 85% of all passengers of international flights have passed.

Purpose. The aim of the article is to present selected conditions for the development of public-private partnerships (PPP) in Poland and factors which constitute a contribution and a hindrance to the development of this concept. Moreover, the present author attempts to describe issues related to public-private partnerships as a factor influencing the development of tourism in specific tourist destinations. Method. The research methodology is based on the application of the Desk Research method, including the verification of data obtained from generally available secondary sources (specialist literature, the Internet - Web Research). The desktop research data were of qualitative and quantitative nature and were created as primary or secondary sources. Modern methods of data collection were utilised: CATI (phone interviews), CAPI (computer-assisted interviews) and questionnaire forms. Findings. In general, the results of the research concern the possibility of applying the formula of public-private partnership in the development of local tourism economy. The study focuses on the examination of selected conditions which are favourable to this concept and those which act in an obstructive way. Research and conclusion limitations. The research was of diagnostic nature. The applied methods and research techniques allow to present selected conditions for the implementation of public-private partnerships in Poland, i.e. in the tourist industry, which is a frequently underappreciated branch of economy, much like the case of public-private partnerships but for other reasons. Practical implications. Starting cooperation and establishing relationships between entities from the public and private sectors should contribute to the propagation of the concept of public-private partnership and economic development of tourist regions by creating and expanding tourist infrastructure, and infrastructure in general. Furthermore, the tourist industry is one of the branches of economy which requires fast development. The growing demand and qualitative requirements of contemporary tourists create a necessity for modern solutions, the creation of tourist infrastructure and cooperation with organisations and entities from various sectors, the answer to which can be the concept of public-private partnerships. Originality. One important and original issue seems to be the need to determine the relation between the representatives of the private and public sectors, especially to answer the question: what type of atmosphere prevails in their relations, that of competition or cooperation, and what is their attitude towards joint cooperation? The article views the creation of public-private partnership as an important direction in the activation of the innovative type of the development of the economy of Russia. The need to combine the efforts of the public and private business in solving this problem is connected, firstly, with the economic sanctions of the West and not only financial sanctions but also with the refusal to supply high-tech equipment to Russia and, secondly, even more threatening prospects of the dynamics of the innovative development of the manufacturing sector. That is why the main attention is paid to the impact of public-private partnership on the development of integrated business in the context of the implementation of the strategic task of the innovative way of the Russian economy development. It is shown that public-private partnerships are one of the most common instruments for attracting private investments in infrastructure projects both in Russia and abroad. But the format of public-private partnerships for the implementation of Russia's industrial policy in the field of innovation should be used not only for the infrastructure development but also for the development of Russian industrial enterprises and the implementation of national projects.

City government 's desire based on the opinion the Government is obliged to fulfill its social responsibility to the community economy , and to ensure that public services can be done to the entire community.The aim in this paper to analyze the cooperation scheme of Public Private Partnerships ( PPP ) what is right for the city government The method used in this paper is a descriptive study with technical literature , ie finding relevant theory reference to the case or the problems found , namely the problem of public private partnership cooperation city government with the private sector in the provision of public services . This type of data is secondary data obtained from the documentation media and internet and also sourced from books and other literature sources that support the discussion in this study.In order for the cooperation of public private partnership city government with the private sector managed a few things that must be considered: this cooperation must be strategically important for both parties , this cooperation are complementary rather than mutually competence , openness to information in both parties , and should this cooperation raises link although the true integration of different cultures . Mutual trust is the main thing. Forms of cooperation of public private partnership with the city government to the private sector in the form of contract maintenance , Leasing ( Lease ) or Contract of Build- Operate- Transfer / BOT or Build Operate and Transfer OwnedIt was concluded that the Public -Private Partnership cooperation is not always a bad connotation and in order to succeed , a lot of terms and conditions must be met . It is intended that the government gets the best results , people also get results commensurate , ie welfare . Thus , the spirit of Public -Private Partnership is to strengthen the government or the public service which is considered inefficient

The aim of the work is to study the motivation for the development of the private medical sector in the system of public-private partnership on the basis of sustainability. Results. Emphasis is placed on the challenges of sustainability in the health care system, including the fragmentation of the health care system, labor constraints, and investment in improving technologies that put pressure on the financial capacity of health systems to meet needs. In modern science and practice, public-private partnership is the interaction of the public and private sectors: in a broader sense, any cooperation in various spheres of public life, supporting society with entrepreneurship and strengthening its social role. The intensification of the process of public-private partnership development is due to the steady growth of demand for public services and increased attention of a wide range of people to optimise their provision. Today, public-private partnership has become an important tool for attracting investment to create a modern public service infrastructure. The purpose of this study is to examine possible strategies for the development of public-private partnerships in the context of decentralisation. The methodological basis of the presented research is a combination of theoretical methods: information synthesis and analysis, classification, systematisation. In addition, an analysis of the scientific literature on the research subject was conducted during the study. In particular, articles on public-private partnerships were analysed. As a result of the study, the general trend towards decentralisation of power and reform of local self-government was established, which means transferring more powers to local state structures, where the state, represented by a territorial community, becomes one of the main subjects. It is proved that partnerships between local communities and business structures, including foreign ones, considerably expand the competence of local authorities, in particular, attract investment in the development of urban infrastructure. Based on the analysis of European experience and considering the specific features of Ukrainian legislation, the most acceptable forms of cooperation between the state and companies were identified: private partnership investment agreements, asset management agreements, leases, concessions, and joint venture agreements. The practical value of the study is that the highlighted results will be useful for public and private sector managers
