This study discussed about provision of grants is based on governor regulation of Bali number 2 of 2017 on Guidelines for Grant and Social Assistance, focusing on the implementation arrangement based on related Governor regulation and its relations with Article Number 298 (5) on Law Number 23         of 2014, which has caused different interpretation about the grant provision arrangement implemented by Bali Provincial Government. The study is done by using normative legal research, along with several approaches, such as legislation approach, legal concept approach, as well as case-based approach utilizing primary an d secondary legal sources with combination of snowball technique and card system to obtain all laws and regulations related to the issue studied. The objective of this studyis to formulate solutiontothe conflicting norms in the existing legislation in order to provide legal certainty for the community. The study shows that grant provision arrangement implemented by Bali Provincial Government is based on Bali Governor Regulation, Provision which was formulated based on Regulation of the Minister of Home Affairs Number 14 Year 2016 on the Second Amendment to the Regulation of the Minister of Home Affairs Number 32 Year 2011. It is found that the source of the conflicting norm sinimplementing grant provision at Bali Province comes fom the inconsistency between those regulations because the afore mentioned Governor Regulation has arranged for a logical flow of grant provision to community organizations not listed in the ministerial decree in order to support cultural sustain ability and development in Bali.

<p>Abstract<br />The authority to issue Mining Business Licenses based on Law Number 4 of 2009 concerning  Mineral and Coal Mining is owned by the Central Government, Provincial Government and Regency/City Government. Meanwhile, based on Law Number 9 of 2015 concerning the Second Amendment to Law Number 23 of 2014 concerning Regional Government the authority to issue  Mining Business Permits is owned by the Central Government and the Provincial Government. This article objective to discuss the implications of the regulation of mining business licenses that are not synchronized and efforts to synchronize the regulation of Mining Business Permits. This article is a descriptive analytical legal research. This research was carried out by the law approach. The data used are secondary data, namely the statutory provisions, the Regulation of the Minister of Energy and Mineral Resources, and the mining law literature with the technique of collecting study documents or library materials. So that the implications of these asynchronous arrangements can be resolved and the creation of an ideal Mining Business Permit arrangement.<br />Keywords: Synchronization; Implications; Mining Business Licenses; Investment.</p><p>Abstrak<br />Kewenangan penerbitan Izin Usaha Pertambangan berdasarkan Undang-Undang Nomor 4 Tahun  2009 tentang Pertambangan Mineral dan Batubara dimiliki oleh Pemerintah Pusat, Pemerintah  Provinsi, dan Pemerintah Kabupaten/Kota. Sedangkan berdasarkan Undang-Undang Nomor  9 Tahun 2015 tentang Perubahan Kedua Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah kewenangan penerbitan Izin Usaha Pertambangan dimiliki oleh Pemerintah Pusat dan Pemerintah Provinsi. Artikel ini bertujuan untuk membahas mengenai implikasi pengaturan Izin Usaha Pertambangan yang tidak sinkron dan upaya sinkronisasi pengaturan Izin Usaha Pertambangan. Artikel ini merupakan penelitian hukum doktrinal yang bersifat deskriptif analitis. Penelitian ini dilakukan dengan pendekatan undang-undang. Data yang digunakan merupakan data sekunder yaitu ketentuan perundang-undangan, Peraturan Menteri Energi dan  Sumber Daya Mineral, dan literatur hukum pertambangan dengan teknik pengumpulan data studi dokumen atau bahan pustaka. Sehingga implikasi dari pengaturan yang tidak sinkron tersebut dapat diselesaikan dan terciptanya pengaturan Izin Usaha Pertambangan yang ideal.<br />Kata Kunci: Sinkronisasi; Implikasi; Izin Usaha Pertambangan; Investasi.</p>

<p><strong>Abstract</strong><br />The purpose of this research is to explain the concept of law of consumer finance in the future, that consumer finance is characterized by Indonesia. The method used is normative legal research (legal research), with the approach of the statute and philosophy. Legal materials used in the study include legal primary, secondary and tertiary and supported with interviews. Legal material is then analyzed in such a way and poured in the form of a diskriptif analysis. The results of this research provide consumer finance law concept bids forward, namely consumer finance are characterized by Indonesia, which are based on religious, humanitarian, nationality, democracy and social justice. Consumer finance law characterized by  an  Indonesia  that  regulates  the  equivalence of  the  position  of  consumer  finance  companies  and consumers, legal protection for consumer finance companies as well as consumers, as well as paying attention to process contracts, and dispute resolution with the approach of the conscience, in the form of regulation-level legislation, with the hope of better guarantee legal certainty.<br /><em><strong>Key words: Legal concept, consumer Finance, Future.</strong></em></p><p><br /><strong>Abstrak</strong><br />Tujuan penelitian ini ialah untuk memamaparkan tentang konsep hukum pembiayaan konsumen di masa yang akan datang, yaitu pembiayaan konsumen yang bercirikan Indonesia. Metode yang digunakan ialah metode penelitian hukum normatif (legal research), dengan pendekatan undang-undang (statute approach) dan pendekatan filsafat (philosophy approach). Bahan hukum yang dipergunakan dalam penelitian ini meliputi bahan hukum primer, sekunder dan tersier dan ditunjang dengan wawancara. Bahan hukum kemudian dianalisis sedemikian rupa dan dituangkan dalam bentuk tulisan secara diskriptif analisis. Hasil penelitian ini memberikan tawaran konsep hukum pembiayaan konsumen ke depan, yaitu pembiayaan konsumen yang bercirikan Indonesia, yaitu berdasarkan religius, kemanusiaan, kebangsaan, demokrasi dan keadilan sosial. Hukum pembiayaan konsumen yang bercirikan Indonesia yang mengatur kesetaraan kedudukan perusahaan pembiayaan konsumen dan konsumen, perlindungan hukum bagi perusahaan pembiayaan konsumen maupun konsumen,  serta memperhatikan proses kontrak, dan penyelesaian sengketa dengan pendekatan nurani, dalam bentuk peraturan setingkat undang-undang, dengan harapan lebih memberikan jaminan kepastian hukum.<br /><em><strong>Kata kunci: Konsep Hukum, Pembiayaan Konsumen, Masa depan.</strong></em></p>

The development of military law as part of the national law for the security of order, justice and legal certainty within the military. The divestment development is implemented through the renewal of the law of military discipline stamped in Law Number 25 the Year 2014 on Military Discipline Law. Act No. 25 of 2014, it can be understood that the laws of military discipline other than applied to the military, are also applied to every person who is based on the law equated with the military, while also applied to prisoners of war. The enforcement of military discipline laws against prisoners of war may be too late, given the abolition of military discipline for the perpetrators of legal offenses must be committed by an Excusing Superior (Ankum), but acts, Act No. 25 of 2014 does not provide complete and clear arrangements on the authority of Ankum in upholding disciplinary law against prisoners of war. Based on normative legal research with the approach of legal concept and legislation, it can be obtained a conclusion about the norms and regulation of war tactics in Law Number 25 the Year 2014 is important, because the form of legal vagueness can result to the situation of legal uncertainty, especially the enforcement law against prisoners of war. In the next note, a more complete and clear arrangement is needed to enforce the legal provisions of military discipline against prisoners of war. Pengembangan hukum militer sebagai bagian dari hukum nasional ditujukan untuk menjamin terciptanya ketertiban, keadilan dan kepastian hukum di lingkungan militer. Pengembangan tersebut diantaranya diimplementasikan melalui pembaharuan hukum disiplin militer sebagaimana tertuang dalam UU Nomor 25 Tahun 2014 tentang Hukum Disiplin Militer. Mencermati ketentuan Pasal 6 ayat (1) UU Nomor 25 Tahun 2014, maka dapat diperoleh pemahaman bahwasannya hukum disiplin militer selain diberlakukan kepada militer, juga diberlakukan kepada setiap orang yang berdasarkan undang-undang dipersamakan dengan militer, adapun diantaranya adalah diberlakukan bagi tawanan perang. Pemberlakuan hukum disiplin militer kepada tawanan perang dapat dianggap terlampau dini, mengingat bahwa penjatuhan hukuman disiplin militer bagi pelaku pelanggaran hukum disiplin militer harus dilakukan oleh seorang Atasan Yang Berhak Menghukum (Ankum), namun kenyataannya, UU Nomor 25 Tahun 2014 tidak memberikan pengaturan secara lengkap dan jelas tentang kewenangan Ankum dalam menegakkan hukum disiplin terhadap tawanan perang. Berdasarkan penelitian hukum normatif dengan pendekatan konsep hukum dan perundangan-undangan, dapat diperoleh suatu kesimpulan bahwa kajian tentang kekaburan norma dan pengaturan tawanan perang dalam UU Nomor 25 Tahun 2014  merupakan hal yang penting, oleh karena bentuk kekaburan hukum tersebut dapat berakibat kepada situasi ketidakpastian hukum, khususnya penegakan hukum terhadap tawanan perang. Dalam tinjauan selanjutnya, hendaknya diperlukan pengaturan-pengaturan tertentu yang lebih lengkap dan jelas untuk menerapkan ketentuan hukum disiplin militer terhadap tawanan perang.

One of the institutions for providing capital and supporting the welfare of the people's economy is the Bank. Banks can channel funds to parties in need through the credit system. To provide legal certainty guarantees to the lending bank must be registered. Guarantee that takes precedence in this case, guarantee of materiality. One form of guarantee referred to is SKMHT. In the regulation or application of the Ministerial Decree on the Determination of Time Limits on the Use of SKMHT to guarantee the Repayment of Certain Loans, in reality, TAPA BPR is interesting for further study. The method used is an empirical legal research method. with a statutory, analytical, conceptual and sociological approach. The primary data collection technique in this study is the interview method. The results of this study indicate that there are three factors inhibiting the implementation of the time limit for using SKMHT in banking practices at PT. BPR TAPA, namely the credit guarantee does not have a certificate and the management period is long so that the SKMHT has ended, there is a disturbance in the BPN data input system, and the debtor is not willing to make payments, which causes SKMHT cannot be followed up by charging APHT

The study to analyze the formulation of the norm on handling the violations of local election which can affirm sanctions for violators of Article 73 of Law Number 10 of 2016 concerning the Second Amendment to the Act Number 1 of 2015 regarding the Government Regulation in Lieu of Act Number 1 of 2014 about the Election of Governors, Regents and Mayors into Law. The Type of the Research Method used in this study is normative legal research. The results of this study are the sanction formulation policies specifically regarding the formulation of administrative sanctions for violators of Article 73 of Act Number 10 of 2016 regarding The Election of Governors, Regents and Mayors, which have a number of fundamental weaknesses, thus affecting the effectiveness of handling violation, because the weaknesses in the formulation stage (in abstracto) are strategic weaknesses for the next stage, namely the application and execution stage (in concret). The conclusion of this study is that there is a legal certainty about the violation handling for the local election that is structured, systematic and massive. It is recommended that these elements are not to be used as a series of reasons that will be difficult in proving all three together since it will cause legal uncertainty and a short amount of time to handle an election crime, the bureaucracy to handle election crimes should be designed more simply.

Progressive law puts forward the sociology of law rather than legal certainty which is the focus of legal positivism. In Indonesia, this law was coined by Satjipto Rahardjo. This study aims to determine the formulation of progressive law in future criminal law, and to determine the actualization of the concept of progressive law in regulating corruption in Indonesia. The research method used is a normative legal research method with statute and conceptual approaches. The technique of collecting legal materials in this study is a descriptive method that aims to obtain the meaning of reality related to the problems to be discussed and solved in this study. The results show that in the current Criminal Code Bill, progressive law has been regulated, to be precise in Article 2 paragraph (1) and (2). Progressive law is also regulated in Law no. 48 of 2009 concerning Judicial Power. Then, the actualization of progressive law in regulating corruption in Indonesia is a judge with the powers that take into account the sociological context of society in making decisions. Judges, prosecutors and lawyers can certainly discuss together in eradicating corruption. Efforts are also being made to reconstruct and redefine the power of law enforcement. This arrangement can also encourage the KPK to be more progressive in eradicating corruption, as well as building law enforcers who have morality so that they can become role models and increase public participation, for example by forming NGOs in preventing or fighting corruption in various agencies.

Audiobook access for people with disabilities is very important. Access is the convenience that people get from a service. This study aims to analyze the legal certainty and legal protection of audiobook copyright access for blind people with disabilities. This study uses a normative legal research method with a statutory approach and comparative approach. This research found that access to audiobooks' works has been regulated in the Marrakech Treaty, Copyright Act Number 28 of 2014 and Government Regulation Number 27 of 2019. Akses karya cipta audiobook bagi disabilitas sangat penting. Aksesibilitas merupakan kemudahan yang didapat oleh orang terhadap suatu layanan. Penelitian ini bertujuan untuk menganalisis kepastian hukum serta perlindungan hukum akses karya cipta audiobook bagi disabilitas tuna netra. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan komparatif. Dalam penelitian ini menemukan bahwa akses karya cipta audiobook telah diatur dalam Traktat Marrakesh, UUHC 2014 serta Peraturan Pemerintah Nomor 27 Tahun 2019.

The writing of this article is based on the issuance of new regulations regarding the establishment and registration of limited partnership / CV in the business administration system (SABU) in accordance with the provisions of Article 5 paragraph (1) Regulation of the Minister of Law and Human Rights Number 17 of 2018 concerning Registration of Limited Partnerships, Firms, and the Civil Union which previously was only regulated in the Trade Law Book. Type of research used in this article is normative legal research. The purpose of this article is to determine the mechanism and legal certainty in the registration of the Limited Partnership after the enactment of business administration system. The results of the research and writing of this article are that there is an overlap in the registration mechanism for the Limited Partnership based on these two rules, it can be concluded that due to the provisions in KUHD and Minister Regulation No. 17 of 2018 both are still valid, the principle of legal preference can be used, namely lex specialis derogat legi lex generalis, means that a more specific law can override a more general law. The advice that can be given is to conduct a study of the enactment of the Minister Regulation whether to follow or not the provisions in the Trade Law Books due to avoid conflicting norms in the registration of a limited partnership.

The inheritance and the division of inheritance that is felt to be unfair is often a source of dispute. The disputes that occur can sometimes be resolved by making a peace agreement between the disputing parties. The peace desired by the parties is, of course, expected to end disputes/conflict and to provide legal certainty among those in dispute. However, sometimes peace agreements that have been made between those in dispute are disputed again in court. This study aims to examine the settlement of Balinese traditional inheritance disputes through a binding peace agreement between the parties make it. The method used in this study is a normative legal research, using a statute approach and a case approach. The result of this study showed that the settlement of Balinese indigenous inheritance disputes through a binding peace agreement of the parties that make it if the peace agreement is made based on the validity of the agreement as stipulated in article 1320 of the Civil Code, based on good faith as the principles in the law of the agreement, and must be made in the form of a notary deed is in accordance with the provisions for conciliation in book III of the Civil Code.

An auction is an activity of selling of goods in public by means of a verbal-bid to get the higher price or to get lower prices and the price quote can be done in a closed and written. This is done by the way of collecting the prospective buyers of the auction led by officials of the auction. In this case, the intended auction was the sale of goods that are held publicly. The auction, according to the regulations of security right, is when the debtor made a breach, the holder of the security rights have the right to sell the security rights’ objects over its own power through a public auction as well as taking payment of account receivable from the sale proceeds. An auction is an alternative to the sale of an undertaken asset by way of inviting prospective buyers at a particular time and place in which the last highest bidder in writing or orally is determined as the winner. The author used socio-legal research as his research method. To meet the forth standards set by the law, the auction should be widely announced to the public, either through printed file, electronic or visual. A legal certainty as a basis which concerned with propriety and justice is very closely related to the principle of auction sales in another. As the formulation of the problem of the form of identification of the problem, namely how the legal protection of the auction buyers encountered the obstacles as well as the solution.Keywords: Auction; Legal Protection; Mortgage Right
