Halal certificate is a written fatwa MUI that states halal food products in accordance with Islamic law, aims to provide legal assurance to consumers. However, the existing regulations are still per-ceived sectoral, partial, inconsistent and not systemic. Moreover, the most fundamental thing is the halal certification is not an obligation (mandatory) for businesses but it is voluntary. Consequently, halal certification and halal label do not have strong legal legitimacy which results in legal uncer-tainty of halal food products. In regard to this, the draft of Law on Halal Product Guarantee that is still stalled in the House should be soon stipulated and MUI should be given the authority to issue halal certification and perform it through the Fatwa Commission LPPOM. In addition, the govern-ment serves as a regulator as well as supervisor in the implementation of the provisions of the law which cause justice uncertainty.Key words: halal certificate, the Indonesian Ulama Council, food products

Common philosophy of Sasak, Samawa, and Mbojo, that is “adat bersendi syara’, syara’ bersendi kitabullah” (tradition is based upon sharia, sharia is based upon the Book of Allah) supports the Islamic identity that has provided a foundation for the issuance of halal regulation and the accommodation of character and civilized based local identities through local friendly entities.

Results of research show that 1) the level of understanding of the community in the District Mempura Siak about sharia pawning is very well with indications that most of the community involved in the activity of sharia pawn can understand as an alternative financing based on Islamic law; 2) lien contract practice that has been done by the community in the District Mempura Siak is not the Sharia lien contract based Islamic law. Practice is more accurately described as muzara'ah, which is a form of cooperation between landowners and land managers with profits shared according to the agreement. 3) The practice of buying gold then pawned again at the time of high gold prices does not constitute as a lien contract practice based on Islamic law, but more as buying and selling gold. This practice has been in the category of speculation on the price of gold, as gold prices are subject to change-change according to market gold in the international market.

The purpose of this paper to look at consumer ethics in the view of maqasid sharia, because of the high level of consumption of a Muslim who is not in accordance with Islamic principles. In consuming a Muslim must also look at the maslahah of the products consumed. Maqasid sharia is the basis for a Muslim to consume halal food. Maqosid sharia is very necessary to be described so as to provide an understanding of the rationale based on sharia for humanity to live according to Islamic law. In consuming consumer behavior, it must be based on what has been regulated by Islamic law, namely: consuming Halal and Service Goods which are permitted which are clearly halal and haram, consumption for life in the world and the hereafter, paying attention to expenditure patterns so that income and expenditure are balanced, unlimited human desires but consumption must be balanced, a standard of living that is simple and not extravagant, does not accumulate wealth, and considers halal and haram what is consumed. So that to meet primary, secondary and tertiary needs must be in accordance with Islamic principles.
