The contemporary principles of contract interpretation require courts to have regard to a number of factors to determine the meaning of a contract, including the plain meaning of the express contractual language, the contract's context, and commercial common sense. These principles superseded the narrower plain meaning rule, which directed courts to interpret contracts in a manner largely consistent with the plain and ordinary meaning of their express words. Since their manifestation some 20 years ago, these principles have undergone change, development and elaboration to the extent that some commentators now claim the approach to contract interpretation more closely resembles the former plain meaning rule, with courts giving "primacy" to the words of the contract in order to deliver "commercial certainty". This article argues that while courts must give primacy to the express contractual language, that does not mean courts should maintain an unwavering loyalty to the plain meaning of those words, even if their meaning is clear. Courts that adopt this approach, referred to by some as the "conservative approach", risk obscuring the true meaning of a contract that can only be obtained through the careful balancing of a contract's internal and external factors, including commercial common sense. This article demonstrates the problem with the "conservative approach" through the analysis of two Court of Appeal decisions, and argues that courts should not overstate the circumstances in which departure from the plain meaning of a contract should occur.

Organizational structure is a system of internal relations and links in the organization. Since adequately designed organizational structure is the key to the success of enterprises, efficient operations and achievement of the objectives of each organization, the basic issue of this paper is the process of organizational design, with particular focus on the differentfactors that affect this process.For this reason, the purpose of this paper is to describe the impact of certain internal and external factors on the organizational structure, as well as to point out their importance in the design process.Based on the conducted analysis and research, author has come to many conclusions on the basis of which has been proven that there are many internal and external factors that directly affect the organizational structure. In order to successfully operate in today's turbulent conditions, it is necessary for companies to constantly adjust to a number of factors. A successful response to new changes often requires a process of restructuring through which organizational structure adapts to new needs.

Previous research concerning barriers to internationalisation growth have modelled sets of internal and external factors impinging upon the behaviour of the firm. It is believed that this approach can only ever achieve a general perception of the difficulties encountered and that industry specific studies are needed in order to elicit particular differences encountered by these firms. By examining the internationalisation behaviour of the smaller craft firm, this research uncovers a number of factors not generally modelled in other works which impinge both upon the craft firm in particular and on smaller firms in general. This is done by adopting a pluralistic approach to research, resulting in in‐depth analysis of craft firm microenterprises and their owner/managers.

Attitudes and behaviors are the unity of a person's character which is formed by habit everyday. Entrepreneurial behavior is influenced by internal and external factors. These factors are ownership rights (property right, PR), abilities / competencies (competency / ability,), and incentives while external factors include the environment thus Attitudes and behavior can be changed by oneself and / or there are environmental pressures / influences. there is an influence from within themselves and from outside the environment to associate then grow indi attitudes and specific behaviors. It is necessary to anticipate small businesses’ difficulties by conducting an empirical study  on  the  entrepreneurial  spirit,  entrepreneurial  values,  and  assessment  of entrepreneurial behavior that may affect the realization of independence efforts. This study  aims to  analyze the  influence of  entrepreneurial spirit  and entrepreneurial values on entrepreneurial behavior to create business independence. The findings show that the entrepreneurial spirit has a direct positive influence on entrepreneurial behavior and positive indirect effect on the business independence.

This essay analyzes the political motivations behind the Jewish Nation-State Bill introduced in the Knesset in November 2014, shedding light on the ascendancy of the Israeli political establishment's radical right wing. It argues that there were both internal and external factors at work and that it is only by examining these thoroughly that the magnitude of the racist agenda currently being promoted can be grasped. The essay also discusses the proposed legislation's long history and the implications of this effort to constitutionalize what amounts to majoritarian despotism in present-day Israel.

This research aim to know the steps of learning and thepositive factors that influence the learning. This research use qualitative researchmethods. The results of this study are as follows: 1. Learning Steps to the Book"Al-Muhadasah Wa Muthala'ah Al-Arabiyah Juz Awwal" the teacher greets,remembering the students last lesson, giving new teaching material, the teacherreading the Muhadasah text and the students practiced the Muhadasah text thestudents were allowed to ask about the difficult mufrodat, the students translatedthe muhadasah text according to their abilities, then the teacher interpreted thewhole of the Muhadasah text. then the teacher gives training about sometimesthe teacher gives Arabic language games, the teacher tells students to memorize the muhadasah text and tells them to have two or two in front of the class, at the end of the lesson the teacher gives advice and motivation. 2. There are twopositive factors in the Learning of the Book "Al-Muhadasah Wa Muthala'ahAl-Arabiyah Juz Awwal" namely internal and external factors, internal factorsnamely: provisional teachers, the use of learning methodologies and appropriateteaching materials, students are eager to learn. External factors are: the scope ofthe Arabic language contained in the cottage.

Subject. This article discusses the role of social infrastructure in the national economy and analyzes the relationship between the notions of Infrastructure, Service Industry and Non-Productive Sphere. Objectives. The article aims to outline a methodology for development of the social infrastructure of Russia's regions. Methods. For the study, we used the methods of statistical and comparative analyses. The Republic of Crimea and Rostov Oblast's social infrastructure development was considered as a case study. Results. The article finds that the level of social infrastructure is determined by a number of internal and external factors. By analyzing and assessing such factors, it is possible to develop promising areas for the social sphere advancement. Conclusions. Assessment and analysis of internal factors largely determined by the region's characteristics, as well as a comprehensive consideration of the impact of external factors will help ensure the competitiveness of the region's economy.

Farmers participation is crucial for succeeding in the implementation of agricultural insurance in Indonesia. The purposes of this research are analyzing farmers' form and level of participation and also identifying some factors affecting farmer’s participation in agricultural insurance. The research was conducted in Curug Bitung Village, District of Nanggung, Bogor Regency involving 40 respondents. Primary data includes farmers characteristics, farmers participation form and farmers participation level as program beneficiaries. The data were processed using multivariable linear regression test. The results showed that the intensity of communication, age, education level, income level and length of stay did not significantly affect the participation level of farmers whose majority were at the level of no participation. Non-compliance occurs during program implementation. The form of participation shown by farmers in the program is varied.Keywords:  agricultural insurance, internal and external factors, farmers' participation ABSTRAK Partisipasi petani menjadi hal yang penting dalam rangka menyukseskan penerapan asuransi pertanian di Indonesia. Tujuan penelitian ini adalah menganalisis bentuk dan tingkat partisipasi petani dalam asuransi pertanian serta mengidentifikasi faktor-faktor yang memengaruhi partisipasi petani dalam program asuransi pertanian. Penelitian dilakukan di Desa Curug Bitung, Kecamatan Nanggung, Kabupaten Bogor dengan melibatkan 40 responden. Data primer meliputi karakteristik petani, bentuk partisipasi petani dan tingkat partisipasi petani penerima program. Data diolah menggunakan uji regresi linier multivariable. Hasil penelitian menunjukkan intensitas komunikasi, usia, tingkat pendidikan, tingkat pendapatan dan lama tinggal tidak berpengaruh secara signifikan terhadap tingkat partisipasi petani yang  mayoritas berada pada tingkatan tidak ada partisipasi. Ketidaksesuaian banyak terjadi selama penyelenggaraan program. Adapun bentuk partisipasi yang ditunjukkan petani dalam program bervariasi.Kata kunci: asuransi pertanian, faktor internal-eksternal, partisipasi petani

The title of this study is the Strategy of Increasing Consumer Food Loyalty in CurupCity, Rejang Lebong Regency (Case Study in "Henvian" Typical Food Industry). Thisresearch is based on the importance of strategies in increasing business and consumerloyalty to products sold.Strategies to increase business and consumer loyalty can bedone with a SWOT analysis. Place of this research is the "Henvian" shop that sellstypical Rejang lebong food. The method used in this study is descriptive qualitative.Informants in this study were people who were considered to know for certain about theHENVIAN Specialty Food Store in Curup City, Rejang Lebong Regency. The dataanalysis technique used in this study is a SWOT analysis to determine the strengths,weaknesses, opportunities and threats in a typical Rejang Lebong food business.By using SWOT analysis techniques that consist of strengths (weakness), weaknesses(weakness), opportunities (opportnity) and threats (threath). The results of this studycan be concluded that the internal factors that are the strength of the marketing strategyare the quality of the product that is good at a price affordable to the public andtourists, service that is friendly and responsive to consumer needs, as well astechnological advancements that facilitate the promotion of business. Internal factorsthat are a weakness are often lack of stock, there are some products that do not meet thestandard packaging, the product shelf life is short, employees do not use uniforms.External factors that become opportunities are a fairly high economic community,abundant raw materials while external factors that are a threat are the manycompetitors, an unstable economy, the price of basic needs increases. Based on theresults of the SWOT analysis of internal and external factors, the strategy used is toimprove product quality by improving the appearance of packaging and quality ofcontent and quality of service by providing uniforms to employees and providingstandards of service to consumers. .Keywords: Strategy, Consumer Loyalty, SWOT
