Dalam penyelenggaraan pemerintahan diperlukan dukungan pegawai ASN yang profesional. ProfesionalismeASN tentunya dapat memberikan kontribusi secara positif bagi birokrasi pemerintahan. Untuk menciptakansumber daya aparatur yang profesional perlu dilakukan reformasi birokrasi dibindang manajemen ASN. UUNomor 5 Tahun 2014 Tentang ASN mengamanatkan adanya pengangkatan Jabatan Pimpinan Tinggi ASNberbasis merit yang diawasi lembaga independen (Komisi Aparatur Sipil Negara) KASN. Permasalahanpenelitian, bagaimanakah model pengangkatan Jabatan Pimpinan Tinggi Aparatur Sipil Negara? Tujuannyapenelitian ini adalah menganalisis model pengangkatan Jabatan Pimpinan Tinggi Aparatur Sipil Negara.Penelitian ini menggunakan pendekatan deskriptif kualitatif. Data penelitian digali dengan teknik studipustaka (literature). Lokasi penelitian di DPR RI (Komisi II), Kementerian RAN RB, dan BKN. Analisisdata melalui tahapan reduksi data, penyajiandata, dan penarikan kesimpulan. Hasil penelitian menunjukansistem pengangkatan JPT ASN dilakukan dengan sistem merit melalui seleksi terbuka mulai dari seleksiadministrasi, seleksi kompetensi, tes wawancara, penelusuran rekam jejak, serta tes kesehatan dan psikologiyang menghasilkan 3 (tiga) kualifikasi untuk ditetapkan 1 (satu) JPT oleh Pejabat Pembina Kepegawaian.AbstractGovernment administration is required a professional Apparatus Civil Servants (ASN) support. Theirprofessionalism certainly give contribution to government bureaucracy, positively. To create a professionalapparatus human resources demand bureaucratic reform of ASN management. The Law of The Republic ofIndonesia Number 5 Year 2014 Concerning Apparatus Civil Servants(ASN) mandates a position high leadershipappointment of ASN based on merit that supervised by the Commission of Apparatus Civil Servants (independentinstitution). The purpose of this research is to analysis a model ofposition high leadership appointment of StateCivil Apparatus. It is a qualitative descriptive approach. Collecting data by literature research. The researchsite is at House of Representative of R.I. (Commission II), the Ministry of State Apparatus Empowerment andBureaucratic Reform, the National Civil Service Agency. Data analysis comes to data reduction, data display,and conclusion. The result of this research shows that the system of position high leadership appointment ofState Civil Apparatus carried out by merit system through open bidding starting from administration selection,competency selection, interview, track record research, and health and psychology test that producing three (3)qualifications confirmed one (1) position high leadership by Trustees Personnel Officer.

The side of the government bureaucracy to the political power or the dominant group makes the bureaucracy not sterile. Many viruses continue to irritate it like; impartial service, far from objectivity, too bureaucratic, etc., as a result they feel stronger themselves, immune from supervision. The descriptions above may be concluded that the neutrality of the bureaucracy will always be associated with political elements and political power; in this case the political element is defined as the power to make decisions, while the political power is all political aggression in the form of political parties. With the issuance of Law Number 5 of 2014 concerning ASN, in which the law has been regulated and determined in the form of restrictions and sanctions that will be received by a member of the ASN Public Servants and Government Employees with this Work Agreement (PPPK). By looking at the phenomena or opinions above, the writer tries to give a little review of the various impacts that will occur on the roles and functions of civil servants ASN and PPPK if they are not neutral in bureaucratic services as follows: 1. Community interests are distorted, 2 Services are not optimal, 3. Position placement tends to see the involvement in the election, 4. The position of the bureaucracy is filled by incompetent civil servants. That in order to maintain the neutrality of ASN in the election, it is very necessary: There is a strengthening of the ASN Code of Ethics with clear and firm limitations, There is a guarantee of protection in maintaining the neutrality of ASN; Collaboration with BKN is established to provide administrative sanctions in the form of not being promoted to ASN, Construction of KASN cooperation, Regional Civil Service Agency (BKN) with Regional Civil Service Agency (BKD) as a source of information in the regions, and Bawaslu to oversee the election and election throughout the Republic of Indonesia. This study aims to investigate the implementation of performance appraisal of public services in the Village Cemorokandang as a form of affirmation of bureaucratic reform. This research method using qualitative descriptive through surveys, interviews and distributing questionnaires. The result showed that the implementation of performance appraisal of public services in the Village Cemorokandang was successful. The performance assessment it done using the Sasaran Kerja Pegawai (SKP). SKP has significant impacts on the assessment using such as motivation in the competitive performance, namely as a form of motivation in the competition's performance, an objective in its research and targeted who is rated, control the behavior of employees and enhancements to the character of the civil state apparatus.

Tax revenues paid by taxpayers are the main source of state revenue at this time. Individual and corporate taxpayers owed tax in Indonesia are spread throughout the territory of Indonesia. However based on the data, the tax ratio of each province is vary. Therefore, in this paper we will discuss whether the existing tax regulations are in accordance with the existing conditions.This study uses a qualitative descriptive method. Based on the research, due to the principle "can be implemented" in the Law of the Republic of Indonesia Number 12 of 2011, several current tax regulations have been formulated without considering existing conditions namely   the geographical conditions of various tax offices’s work areas, the uneven availability of the internet in each region along with the unsupported behavior of internet users for electronic services,  and  unavailability of the postal services in some villages.  Those make taxation regulations difficult to be implemented in all regions of Indonesia  and do not support the optimum collection of taxes in all regions of Indonesia. The aim of the research is to provide recommendations to the DGT to improve the tax regulations to a better level.

Undang-undang No.5 Tahun 2014 tentang Aparatur Sipil Negara (ASN) merupakan wujud dari kelanjutan pelaksanaan Reformasi Birokrasi, menuju profesionalisme pegawai. Merit sistem merupakan cerminan manajemen kepegawaian yang profesional dimana penempatan pegawai dan pejabat menggunakan kompetensi kinerja dan track record sebagai alat ukur pengangkatan Tujuan penelitian ini untuk mengevaluasi implementasi sistem merit dalam Manajemen ASN pada Kantor Wilayah Kementerian Agama Prov. Sulawesi Selatan dan melihat faktor-faktor yang mempengaruhi implementasi sitem tersebut. Penelitian ini merupakan penelitian normatif empiris dengan menggunakan pendekatan kualitatif dengan tujuan mengetahui bagaimana implementasi sistem merit dalam manajemen ASN serta faktor-faktor yang mempengaruhi implementasi tersebut. Sehingga diharapkan dapat memberikan sumbangan pemikiran terhadap pemerintah dalam pengkajian dan pelaksanaan sistem merit kearah yang lebih baik. The implementation of the Act Number 5, Year 2014 on The Civil State Apparatus is entity of a sustainable successful implementation of bureaucracy reform head to officers professionalism. The Merit System is a reflection of professional staffing management. The merit system is performance assessment based on work performance. The purpose of this research is to evaluate the implementation of merit system to officers development according to the needs of South Celebes Regional Office the Ministry of Religions and the factors affecting of its implementations. It is a normatif-empiric method with qualitative approach. It is hoped to describe the implementation of merit system in civil state management and and the factors affecting of its implementations. So that it is expected to contribute ideas to the government in the study and implementation of a better Merit System.

Pajak merupakan kontribusi wajib kepada Negara yang termasuk utang oleh orang pribadi atau organisasi yang bersifat memaksa berdasarkan Undang-Undang, dengan tidak menghasilkan imbalan yang nyata dan dipakai sebagai keperluan Negara sebesar-besarnya untuk menyejahterakan kemakmuran rakyat dengan Undang-Undang Ketentuan Umum dan Tata Cara Perpajakan Nomor 28 Tahun 2007 (UU KUP No. 28 TAHUN 2007). Usaha mikro adalah usaha yang berjalan dan dimiliki oleh badan usaha maupun perorangan pribadi dengan memenuhi syarat dalam Undang-Undang Republik Indonesia Nomor 20 Tahun 2008. Penelitian ini bertujuan untuk mengetahui persepsi wajib pajak Usaha Mikro Kecil Menengah (UMKM) terhadap Peraturan Pemerintah (PP) Nomor 23 Tahun 2018 Kabupaten Kepulauan Sangihe. Metode penelitian ini adalah jenis penelitian deskriptif kualitatif yaitu penelitian yang dilakukan untuk mendapatkan informasi terhadap objek yang diteliti berdasarkan pada situasi. Sumber Informasi dalam penelitian ini adalah beberapa Wajib Pajak yang memiliki Usaha Mikro Kecil Menengah (UMKM) Khususnya warung-warung yang ada di Pasar Kampung Kulur II sebanyak 5 narasumber atau informan. Berdasarkan hasil ini diperoleh kesimpulan bahwa pelaku usaha yang menjadi informan penelitian kurang memiliki sedikit pengetahuan tentang pajak.   Kata Kunci : Persepsi, UMKM, Peraturan Pemerintah   ABSTRACT Taxes are mandatory contributions to the State which are included in debts by private persons or organizations that are compelling based on the law, without producing tangible rewards and are used as a large amount of the State's need for the welfare of the people with the Law on General Provisions and Tax Procedures Number 28 of the year. 2007 (UU KUP No. 28 of 2007). A micro business is a business that runs and is owned by business entities and private individuals by fulfilling the requirements in the Law of the Republic of Indonesia Number 20 of 2008. This study aims to determine the perception of taxpayers of Micro, Small and Medium Enterprises (MSMEs) against Government Regulation (PP) Number 23. In 2018 Sangihe Islands Regency. This research method is a type of qualitative descriptive research, namely research conducted to obtain information on the object under study based on the situation. Sources of information in this study are several taxpayers who have Micro, Small and Medium Enterprises (MSMEs), especially 5 food stalls in Kampung Kulur II Market. Based on these results, it can be concluded that business actors who are research informants do not have a little knowledge about taxes.   Key Words : Persepetion, UMKM, Development Rules

Indonesia is a country of law that upholds justice and guaranteeing all citizens equal before the law in its position without any exceptions. In the opening text of the Constitution of the Republic of Indonesia in 1945 and the first paragraph of the fifth principle of Pancasila prove that Indonesia is a country that upholds the sense of social justice for all Indonesian people, independent country, united, sovereign, just and prosperous. Indonesia received the law as the state ideology to create order, security, justice and prosperity for its citizens. One of the state apparatus that perform the function of the law is the police, one of the actions of the national police is investigating. The process of investigation is the examination process in criminal cases in order to obtain enough information to find and collect evidence on the matter and to find the suspects. Nowadays many cases of wrongful arrests in the investigation process at the police level causing adverse effects on the morale and psychological. How the legal protection for victims of wrongful arrests made by the police of the Republic of Indonesia. The method used in this study is adalahYuridis Normative that is based on the Principles of Law, the rules of law and Regulation Legislation relating to criminal law. In the legal protection as stipulated in the Regulation Legislation that the suspect, defendant or convict is entitled to sue for damages because of being arrested, detained, charged and prosecuted or subjected to other measures, without reason under the Act or in error about the person or the applicable law , Paragraph (2) compensation claim by the suspect or his heirs for the arrest or detention and other measures without reason under the Act or in error about the person or the applicable law as referred to in paragraph (1) that its case was not submitted to the district court, disconnected at a pretrial hearing.Negara Indonesia adalah negara hukum yang menjunjung tinggi rasa keadilan dan menjamin semua warga negara, sama dalam kedudukannya dimata hukum tanpa ada perkecualian. Dalam teks pembukaan Undang Undang Dasar Negara Republik Indonesia 1945 alinea pertama dan Pancasila sila kelima membuktikan bahwa Indonesia adalah negara yang menjunjung tinggi rasa keadilan sosial bagi seluruh rakyat Indonesia, negara yang merdeka, bersatu, berdaulat, adil dan makmur. Indonesia menerima hukum sebagai ideologi negara untuk menciptakan ketertiban, keamanan, keadilan serta kesejahteraan bagi warga negaranya. Salah satu aparatur negara yang menjalankan fungsi hukum adalah Polri, Salah satu tindakan polri adalah penyidikan. Proses penyidikan adalah proses pemeriksaan dalam perkara pidana guna mendapatkan informasi yang cukup, menemukan dan mengumpulkan bukti-bukti mengenai perkara tersebut dan guna menemukan tersangkanya. Sekarang ini banyak kasus salah tangkap dalam proses penyidikan pada tingkat kepolisian menyebabkan kerugian yang berdampak pada moril dan psikis. Bagaimana perlindungan hukum terhadap korban salah tangkap yang dilakukan oleh kepolisian Negara Republik Indonesia. Metode yang digunakan dalam penelitian ini ini adalahYuridis Normatif yaitu berdasarkan Asas-Asas Hukum, kaidah-kaidah hukum dan Peraturan Perundang-Undangan yang berkaitan dengan hukum pidana. Dalam perlindungan hukum sebagaimana diatur di dalam Peraturan Perundang-Undangan bahwa tersangka, terdakwa atau terpidana berhak menuntut ganti kerugian karena ditangkap, ditahan, dituntut dan diadili atau dikenakan tindakan lain, tanpa alasan yang berdasarkan Undang-Undang atau karena kekeliruan mengenai orangnya atau hukum yang diterapkan. Ayat (2) tuntutan ganti kerugian oleh tersangka atau ahli warisnya atas penangkapan atau penahanan serta tindakan lain tanpa alasan yang berdasarkan Undang-Undang atau karena kekeliruan mengenai orang atau hukum yang diterapkan sebagaimana dimaksud dalam ayat (1) yang perkaranya tidak diajukan ke pengadilan negeri,diputus di sidang praperadilan.

Corruption is an organized crime, so that its existence is required to complete the law not only for the perpetrators but also for the results of acts of corruption which are often not found with a track record of all assets of corruption. This study aims to examine legal products in Indonesia regarding the seizure of assets resulting from criminal acts of corruption. Philosophically, the existence of criminal acts of corruption is a form of state responsibility to eradicate because there is not yet a strong legal basis to regulate the mechanism of confiscation effectively in the enforcement of corruption. This research method uses normative juridical with conceptual legal approach with qualitative descriptive research type. The results of this study can be concluded that the urgency of the establishment of the Draft Law on the confiscation of assets resulting from acts of corruption is to change the legal paradigm in law enforcement of criminal acts of corruption which is not only focused on perpetrators of corruption but assets resulting from criminal acts of corruption can be returned based on the amount of losses suffered by the perpetrators of corruption. country. The effectiveness of the law with the formation of these legal products closes the gaps that have so far arisen so that it triggers the existence of criminal acts of corruption.

In the modern world, public councils (councils) exist in almost every legal state. They are created in various forms and spheres of public life to achieve the political goals of the state. In general, councils widely exercise their powers in monitoring the activities of state bodies, public control, developing regulatory documents, and expressing the opinion of the population. In implementing the concept of a “hearing state”, councils effectively respond to constructive requests from citizens and are the most important link between the state and society, since problems in the state apparatus are caused by the lack of feedback from the population between local government and citizens. The article highlights the realities from the moment of adoption of the Law of the Republic of Kazakhstan “On public councils” to the present day, indicating the presence of a number of problems that bureaucratize and devalue the ideological basis. At the same time, practice shows real results that have a positive impact on building a dialogue and mandatory regulatory procedures that have no impact on society. The problems that have accumulated today, such as duplication of functions, lack of motivation, imperfect legislation, and others, require certain measures to be taken. This was preceded by the lack of practical experience of Kazakhstan at the time of adoption of the law, insufficient analysis of foreign practice and gaps in legislation. Solving these and other problems, as well as building the work of councils on a new principle, promotes openness and responsibility of the state to the population.

The article studies some aspects of improving the legal regulation of civil service in Ukraine. Domestic norms that provide for the application of restrictions on civil servants in accordance with the Law of Ukraine “On Purification of Government” were analyzed. Moreover, it was found that such restrictions violate a person’s right to respect for private life. The procedure for assessing the performance of civil servants was studied. It was substantiated that the application of dismissal of civil servants as a result of receiving a negative assessment after the performance appraisal does not meet the principles of individuality, objectivity and proportionality when deciding on dismissal and general norms concerning disciplinary liability of civil servants provided by the Law of Ukraine “About civil service”. The experience of legal regulation of civil service in Poland, Moldova and Germany was analyzed. It was determined that the improvement of domestic legal regulation of civil service in some part may occur through the borrowing of those peculiarities of civil service, which are found in the legislation of the abovementioned countries. For example, the experience of the Republic of Poland is useful for borrowing in terms of improving the performance appraisal of civil servants. Moldova’s experience shows the successful use of polygraph testing of civil servants. The German experience is useful for Ukraine in terms of training and retraining of civil servants. Proposals were presented to improve the legislation on the civil service, namely the application of reprimands, rather than dismissal due to a negative assessment of the results of the civil servant’s performance appraisal. It is suggested to amend the lustration legislation, which would provide for an individual approach to a person who will be lustrated if his guilt in making decisions, committing acts that contributed to the undemocratic regime of Viktor Yanukovych is proved.

Abstract: The Bengkulu Provincial Government is strongly committed to improving the quality of the Apparatus Resources of bureaucratic reform, especially the reform of apparatus resources within the Regional Government of Bengkulu Province. The ASN task has been regulated in Article 11 of the ASN Law stated that ASN employees are in charge of: a. Carry out public policies made by Personnel Development Officers in accordance with statutory provisions; b. provide professional and quality public services; and c. Strengthen the unity and unity of the Unitary State of the Republic of Indonesia. In order to carry out its duties, violations often occur that might interfere with public services which should be prioritized in carrying out their duties.
