AbstrakBerangkat dari Nawa Cita ketiga yaitu “membangun Indonesia dari pinggiran dengan memperkuat daerah-daerah dan desa dalam kerangka Negara Kesatuan Republik Indonesia” dan kesadaran untuk melaksanakan amanat Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Tujuan penelitian ini untuk mengetahui pengakuan hak atas asal usul masyarakat desa serta melihat peta keragaman kesiapan kelembagaan desa dan fisibilitas mengenai pengelolaan dana desa, dengan menggunakan metode kualitatif. Dari data lapangan dapat disimpulkan bahwa Undang-Undang No.6 Tahun 2014 tentang Desa berupaya mengkoreksi kesalahan-kesalahan Negara dalam mengatur desa dan masyarakat hukum adat. Undang-Undang desa ingin mengembalikan hak asal usul yang melekat pada desa adat untuk mengurus kehidupan masyarakat hukum adat dan pengurusan wilayah masyarakat hukum adatnya (hak ulayat). Negara perlu memberikan sarana dan prasarana kepada setiap lembaga adat agar lembaga adat dalam mengelola masyarakat adat serta adat istiadatnya dapat berjalan dengan baik. Untuk itu, perlu ada payung hukum untuk menampung keistimewaan desa adat dibeberapa daerah. Selain itu juga, perlu diatur secara khusus didalam peraturan perundang-undangan mengenai penetapan anggaran khusus terhadap lembaga-lembaga adat, sehingga lambat laun keberadaan lembaga adat ini tidak akan hilang.Kata kunci: Revitalisasi, Pemerintahan Desa, Sumatera Barat.AbstractBased on the third Nawa Cita it is “to build Indonesia by strengthening areas and villages within the framework of The Unitary State of the Republic of Indonesia” and awareness to implement the Act No. 6 2014 about Village. The purpose of this research is to know the recognition of the origin of rural community rights and to look at the map of the diversity of Village institutional readiness and feasibility on the village funds management, by using the qualitative method. From the data the field we can conclude that the act of no.6 year 2014 village about trying to emend state mistakes in regulating village and community adat law.The act of village want to restore the right of the origin of attached to customary village to take care of the lives of the customary law and management of the region of law community custom (unalienated rights). The state needs to give of facilities and infrastructure to every customary institutions that create a conducive customary in managing indigenous people as well as customary to take place. For that, there should be a legal framework for accommodate village customary privileges of several regions .It is also, needs to be regulated specifically in the legislation regarding the stipulation of a special budget against customary institutions, so which gradually customary the existence of this institution will be lost.Keywords: Revitalization, Village Administration, West Sumatra

Abstract The authors present the issues and challenges related to the changes in status of a company and its impact on competitiveness. Status changes of companies, mostly mergers and acquisitions of companies, are one of the ways in which capital owners and management direct economic activities with the aim of maximizing profits. In order to make the right and justified decision, in terms of achieving the economic interests of the company, it is essential to know the laws and regulations in this area. This paper should provide answers on various questions which will be presented to decision makers in every company, considering status changes. Bearing in mind that the question of status changes often associated with an international element, the authors will pay special attention on the EU legislation and current legal framework in the Republic of Serbia.

This study aims to analyze the legal aspects of the Position of Inheritance Rights of Girls in the Context of Islamic Inheritance in Indigenous Mandailing in Sipirok District, South Tapanuli Regency. This research is empirical normative namely research by looking at existing conditions in the field by linking the source of Islamic Law and the legal source of Regulations in force in the Republic of Indonesia. The benefits to be received from the results of this study are to determine the Position of Inheritance of Girls in the Context of Islamic Law and Regulations in Indonesia and the Position of Inheritance of Girls in the Context of Islamic Inheritance in Mandailing Customs in Sipirok District, South Tapanuli Regency, the results of the study stated that In Islamic Inheritance Law strongly recognizes the position of the daughter in receiving inheritance with a strong legal basis in accordance with the al-Qur’an. In Islamic Inheritance Laws, a daughter has a position as Nasabiyah's heir so that she has the right to receive inheritance. In the Mandailing customary inheritance law in Sipirok Mandailing Natal, the position of a daughter is considered as an heir when a male heir is found, but if the girl is a mere woman, the woman is not entitled to inheritance from her parents. The distribution of inheritance in the Mandailing Inheritance law in Sipirok Mandailing Natal uses local customary law, as a basis for the distribution of inheritance which is still being realized in the Community.

Leadership has a major influence on the political and state life of a nation. A leader will also determine the progress and retreat of a country. This paper provides an understanding of the criteria for candidate state leaders whose mechanisms have been determined in the laws and regulations of the Republic of Indonesia and the criteria for candidate state leaders in the view of fiqh siyasah. This study uses a qualitative method with a literature approach. The data in this study were obtained from binding legal materials consisting of legislation, court decisions, legal theory, books, scientific writings and legal journals. The results of this study state that the criteria for candidates for state leaders in the Republic of Indonesia as stated in the laws and regulations have several similarities with the criteria for candidate leaders according to Fiqih Siyasah, the presidential election of the Republic of Indonesia in the period before 2009 was carried out with the concept of Bay'at Ahl al-Hall wa al-'Aqd, the presidential election is carried out in the deliberations of the people's representatives who are in the People's Consultative Assembly (MPR), appointed by the assembly, and when the term of office ends, an accountability report will be asked to the assembly that appointed it. The presidential election of the Republic of Indonesia, in the period after 2009 was carried out by way of direct elections through elections, all levels of society who have the right to vote can make their choice directly, no longer through representatives by people's representatives. But the weakness is that the elected president is not asked to report an accountability report at the end of his term of office.Keywords: Criteria for prospective leaders, mechanisms, fiqh siyasah. AbstrakKepemimpinan berpangaruh besar terhadap kehidupan berpolitik dan bernegara suatu bangsa. Seorang pemimpin juga akan menentukan maju mundurnya sebuah negara. Tulisan ini memberikan pemahaman bagaimana kriteria calon pemimpin negara yang sudah ditetapkan mekanismenya dalam peraturan perundang-undangan Republik Indonesia dan kriteria calon pemimpin negara dalam pandangan fikih siyasah. Penelitian ini menggunakan metode kualitatif dengan pendekatan literatur. Data dalam penelitian ini diperoleh dari bahan-bahan hukum yang mengikat yang terdiri dari perundang-undangan, keputusan pengadilan, teori hukum, buku-buku, tulisan-tulisan ilmiah dan jurnal hukum. Hasil penelitian ini menyatakan bahwa kriteria calon pemimpin negara di Republik Indonesia yang tertuang dalam peraturan perundang-undangan memiliki beberapa persamaan dengan kriteria calon pemimpin menurut Fiqih Siyasah, Pemilihan presiden Republik Indonesia dalam kurun waktu sebelum tahun 2009 dilaksanakan dengan konsep Bay’at Ahl al-Hall wa al-‘Aqd, pemilihan presiden dilakukan di dalam musyawarah para wakil rakyat yang berada di dalam Majelis Permusyawaratan Rakyat (MPR), diangkat oleh majelis, dan ketika berakhir masa jabatan akan dimintai laporan pertanggung jawaban kepada majelis yang mengangkatnya. Pemilihan presiden Republik Indonesia, dalam kurun waktu sesudah tahun 2009 dilakukan dengan cara pemilihan langsung melalui pemilu, semua lapisan masyarakat yang mempunyai hak pilih bisa menentukan pilihannya secara langsung, tidak lagi melalui perwakilan oleh wakil rakyat. Tetapi kelemahannya  presiden terpilih tidak dimintai laporan pertanggung jawaban di akhir masa jabatan. Kata kunci : Kriteria calon pemimpin, mekanisme, fiqih siyasah.

The author presents a comparative legal analysis of the segments of construction law in Croatian and Slovenian law, with the aim of pointing out the differences that exist between them. Considering that this is a relatively new legal institute, which was somewhat earlier standardized in Slovenian law in relation to Croatian law, in the introductory exposition, a brief review was made of the occurrence of the construction law and the reasons for earlier non-regulation. The second part of the paper is dedicated to the stipulations of Act on ownership and Property Code of the Republic of Slovenia. This part refers to the conceptual definition of the construction law, in order to classify it in a certain broader unit, to which it belongs - genus proximum - searching for the closest relative, emphasizing the important characteristics that make it specific in relation to other property rights. In the third part of the paper, the author analyses the stipulations related to the subject of building rights, with reference to the dilemmas that exist in that sense, both in Croatian and Slovenian jurisprudence, as well as in the legal science of some other countries. The fourth part of the paper is dedicated to the stipulations that regulate the acquisition and duration of construction rights. Considering that derivative acquisition, among other things, characterizes the existence of bases and ways of acquisition, first possible bases of acquisition are presented, and then entry in appropriate public books as a way of acquiring this right and its duration. The concluding part of the paper summarizes the results of the analysis and evaluates the considered legal solutions, with the presentation of reasoned objections to the existing regulations, all with the aim of eventual amendment of the right to build in the legal systems in question.

Gospel and constitutional imperatives: the right to life In the Republic of South Africa, Christians are called to live out gospel imperatives within the legal framework of the Constitution. Ethical issues about the right to life are considered from the perspectives of selected gospel and constitutional imperatives. Gospel imperatives impose themselves as a consequence of Christian discipleship. These are many and diverse, both explicit and implicit. Christian vocation, discipleship, witness and perseverance, are foundational and integral to the praxis of Christian daily living. These facets of Christian life are illustrated by the selected gospel imperatives, “Follow me” (Matt. 4:19 and synoptic parallels), “Love God, and your neighbour as yourself” (Matt. 22:34-40 and synoptic parallels), and “Take up your cross” (Matt. 10:38 and synoptic parallels). The central theoretical argument of this article is driven from a reformed ethical perspective. Gospel imperatives have priority over constitutional imperatives since gospel imperatives are of divine origin and constitutional imperatives of human origin. Acknowledgement of these priorities informs the Christian ethical perspective on the right to life and on abortion.

In spite of the legal framework intended for the promotion and protection of rights of the disabled, such persons are still facing significant difficulties in the labour market. Intellectually disabled persons are in a particularly difficult position, primarily due to the negative perceptions held by citizenry which stem from the lack of knowledge and information about their labour potentials. We conducted research in order to determine the most prevalent obstacles in the employment of intellectually disabled persons, as perceived by employed non-disabled persons. The research comprised a sample of 269 subjects of both sexes, of differing educational levels and employed in the private and public sector in the Republic of Serbia. The analysis of the attained results points to the need for certain kinds of educational interventions, whose programmes would improve the knowledge and awareness of employed persons regarding the right to work of intellectually disabled persons, promote diversity and create an inclusive working environment. The different modes of training, reinterpretation and transformation of previous experience, informing and establishing positive contacts with intellectually disabled persons, conducted by a multidisciplinary team of experts would establish a stable base for the removal of obstacles in the employment process.

The purpose of this study was to determine the supervision of village funds by the village consultative body (BPD) in Kampung Poo, Jagebob District, Merauke Regency. The research method used is a qualitative method, descriptive qualitative research type. The research was conducted through observation and in-depth interviews. After that the data obtained is collected to be described and analyzed to draw a conclusion. The results showed that the supervision of the Village Funds by the Village Consultative Body (BPD) in Kampung Poo has not been going well, especially at the pre-distribution stage and the distribution and use of Village funds, only the third stage has been carried out well, but the Pre-Distribution Stage of Village Funds is still not carried out well, especially in the Aspect of Appropriateness of the Village Fund Planning Arrangement Procedure because the village head did not make a decision letter regarding the Village Fund Implementing Technical Officer (PTPD) but only made direct appointments to the village secretary and head of financial affairs, and the distribution and use stage, namely in the financial aspect and use, where the People's Consultative Body (BPD), which is the representative of the community at large to oversee the Village Fund Budget, does not get the opportunity to consult to determine priority programs funded by village funds so that supervision of village funds is still not very effective.

Foreigner is a person who does not have any citizenship with the Republic of Turkey. According to the third paragraph of Article 35 of the Deed Law, the Council of Ministers/President of the Republic, in the interests of the country, is entitled to define, limit and prohibit, the limited real rights of the foreign real persons and foreign trade companies, in terms of country, person, geographical region, time, number, rate, type, quality, square measurement and amount. To entitle the Council of Ministers/President of the Republic to limit and prohibit the use of limited rights of the foreigners, may be contrary to Article 16 of the Constitution. The limited real rights are the usufruct rights (TCC 794), the right of residence (TCC 823), the right of construction (TCC 837) and the right of pledge and immovable load (TCC 839). It may be established the right of usufruct, right of construction and immovable load in favor of foreigners in Turkey who can acquire real estates. It may be established pledge rights without being subject to restrictions in favor of foreign real and legal persons.

This study explains empowering Indonesian Migrant Workers (IMW) through Productive Migrant Village Programs (PMVP) in the Banyumas Regency. PMVP is a program of the Ministry of Manpower of the Republic of Indonesia held since 2016. The program aims are to empower, improve services and protection for IMWs starting from the village. The paradigm of the study is a constructivist paradigm by using a critical model. The research method used is a qualitative method with a phenomenological approach, which explores data to get the meaning of the basic and essential things of the empirical phenomena experienced by the research subject. The results of the research are 1). In providing information about the process of migrant workers faced with challenges from recruitment agencies/recruitment companies (Private Indonesian Migrant Worker Placement Agency). 2). In the stage of the production process, there are obstacles that the equipment provided by the Ministry cannot use. 3). The care of children of migrant workers is still individual only to their families. The community even still stigmatizes them as children who deserve problems since their parents abandoned them. 4). Late initiation of the migrant workers’ cooperatives. Procedures for establishing migrant workers cooperatives, mentoring, and guidance specifically related to migrant workers are needed.
